S..R. O. No. 127/2018.—In exercise of the powers conferred under section 20 of the Kerala State Commission for Economically Backward Classes among Forward Communities Act, 2015 (2 of 2016), the Government of Kerala hereby make the following rules, namely: — RULES od. Short title and commencement —( 1) These rules may be called the Kerala State Commission. for Economically Backward Classes among Forward Communities Rules, 2018.
(2) They shall come into force at-once.
2. Definitions. (1) In these rules unless the context. otherwise requites,— fa) “Act” means the Kerala State Commission for Economically Backward Classes among Forward Communities Act, 2015 (Act 2 of 2016);
(b) “Chairperson” means the Chairperson of the Commission nominated by the Government under. clause (a) of sub- section (2) of section 3 of the Act;
(c) “Forward Community Certificate” n means the certificate issued under section 10 of the Act in the form and manner specified in these rules;
(d) “Form” means a form appended to these rules;

(e). “Member Secretary”. means the Member Secretary of the Commission nominated by the Government under clause (c) of sub-section
(2) of section 3 of the Act;
. () “Schedule” means the schedule appended to these rules. | -2. All other words and expressions used but not defined in’ these rules and defined in the Act shall have the. meanings respectively assigned to them in the Act.
3. Headquarters. —The Headquarters of the Commission shall be at Thirevananthapuram. .
4, Status of the: Chairperson of the Commission. The Chairperson of the Commission. shall have the same status of a inde of the Supreme Court or High Court, as the case may be.
5. Term of office of the Chairpersori and Members. ~The Chairperson and each’ Member may continue in office for.a term: of three years fron the date on which he assumes office, unless removed from office.
6. Pay and Allowances, Leave, Pension, Travelling, Allowance, Leave Travel Concession etc. of the Chairperson. Members and Member Secretary of the Commission. ~—). ‘When a person who i is of has been, a Judge of the Supreme. Court is appointed. as the Chairpergon of the Commission, he shall be entitled to the: salary, allowances, leave and other perquisites: as are’ available to a sitting Judge of the. Supreme Court as provided i in the Supreme Court Judges (Salaries and Conditions of Services) Act,. 1958. (Central. Act 41 of 195 8) and they shall apply mutatis mutandis along with the rules made thereunder, as amended from time to time.
15 _ (2) When a person. who is or-has been Judge of the High Court is appointed. as the Chairperson of the Commission, he ‘shall be entitled to the salary, allowances, leave and other perquisites as are available to a sitting Judge of the High Court as provided in the High Court-Judges (Salaries and. Conditions of Service) ‘Act, 1954 (Central Act 28 of 1954), and they shall apply mutatis mutandis along with the rules made thereunder, as amended from time to time:
‘Provided that when a person who is a” Judge of the Supreme Court -ora High Court or a person who has been: Judge of the Supreme Court ‘ora High Court holding any office equivalent to that of a Judge of the Supreme Court or ‘High Court and receiving ‘pay, allowances and perquisites, ‘as stated in sub-rule (1) or (2), as the case may be, is appointed as the Chairperson of the’ ‘Commission, he shall not be eligible to réceive pay, allowances and perquisites as aforementioned’ as long as he holds ihe former office except travelling allowance, daily allowance and sitting fee for atiending the meetings and affairs of the Commission.

(4) In the case the Chairperson or a Member or the Member- Secretary is in receipt of, or has ‘received or ‘has: become entitled to receive any retirement benefits, by way. of. pension, gratuity or employer’s contribution. ‘to the Contributory Provident Fund or other forms of retirement benefits - the pay of such Chairperson, Member or Member- Secretary, as the case may be, shall be reduced by the gross amount of pension. or employer’s contribution to. the Contributory Provident Fund or any other | form of retirement benefit, if any-(except pension ‘equivalent of retirement gratuity), drawn or to be drawn by him.

(5) Subject to sub-rules (1) and (2), the Chairperson shall be entitled to Leave Travel Concession applicable to a Judge of the Supreme Court or a Judge of a High Court, as the case may be. The Members and Member Secretary shall be entitled to leave travel concession as available to an Officer holding equivalent status and position in the Government.
(6) The terms and conditions for granting leave, leave salary, medical and travelling allowance and other allowances to the Chairperson and members of the Commission shall-be as applicable to the Government employees.
(7) On the expiry of the term of office in the Commission, the Chairperson, a Member or the Member Secretary shall be entitled to receive cash equivalent of leave salary in respect of earned leave standing to the credit of such Chairperson/Member/Member Secretary subject to the condition that the leave encashed under this rule together with earned leave, if any, encashed at the time of retirement from former service, shall not exceed the maximum stipulated by the Government, "7. Authority competent to-grant. leave.—The authority competent to grant leave to the Chairperson shall be the Government. The Chairperson shall be competent to grant leave to other members including the Member- Secretary.
_ &.. Travelling Allowances.—The Chairperson, Members and the Member Secretary shall be entitled to Travelling Allowances for journey on official tour (including the journey undertaken to join the Commission and on the expiry of his term in the Commission to proceed to his hometown) as per the existing rules applicable to a Judge/Officer holding equivalent status and position.

9. Right to subscribe to General Provident Fund.—The Chairperson, a Member and the Member Secretary shall be entitled to subscribe to the General Provident Fund (Kerala).
10. Officers and other employees of the Commission.—(1) The method of appointment of Officers and other employees of the Commission shall ‘be as specified in the Schedule to these rules,
(2) The salary and allowances, Leave, Leave Travel Concession/ allowances and pension to officers and other employees of the Commission shall be governed by the Kerala Service Rules and orders issued thereunder by the Government from time to time.
(3) The Government shall be the appointing authority. in respect of the officers and staff of the Commission.
(4) -The provisions of the Kerala Government Servant’s (Conduct).
Rules, 1960 and the Kerala Civil Services (Classification, Control and Appeal) Rules, 1960 shall be applicable to the officers and staff of the Commission.
11. ‘Forward Community Certificate.—The Form of Forward Community Certificate required to be issued by the Tahsildar/ Village Officer under section 10 of the Act shall be as specified in Form I appended to these rules, , A Annual statement of Accounts——The Commission shall prepare the annual statement of audited accounts under sub-section (1) of section 16 of the Act in Form IL appended to these rules.
13. Annual Report—The Commission shall, for each ‘financial year;
prepare the annual report giving complete information of its activities in the previous financial year, within six months after the completion of the financial year and a copy of the same shall be forwarded to Government, directly as provided under section 17 of the Act. The annual report of the Commission shall be prepared in Form III appended. to these rules.

22 Explanatory Note ‘ (This does not form part of the notification, but is intended to indicate its general purpose.)
Section 20 of the Kerala State Commission for Economically Backward Classes among Forward Communities Act, 2015 (Act 2 of 2016) empowers the Government to make rules to carry out the provisions of the Act with respect to the matters specified thereunder.
Hence, the Government have decided to issue the Kerala State Commission for Economically Backward Classes among Forward Communities Rules, 2018.
