Section 22: Enhanced punishment for second or subsequent offence

Whoever, having been convicted by a Court, of an offence punishable under this Act, again commits the same offence, shall be punishable for every such subsequent offence with imprisonment for a term which may extend to one year, but which shall not be less than three months or with fine which may extend to four thousand rupees:
Provided that the Court may, for any adequate and special reason to be recorded in the judgement; impose a sentence of imprisonment for a term of less than three months.
