(ak) "Student of the Umver~1ty" means a person enrolled m the Umvers1ty for takmg a course of study for a degree, dtploma or other academ1c d1stmct10n duly m~t1tuted,
(al)' "Teacher" means a per~on appomtcd by the Govemmg Counctl of the Umvers1ty for the purpose of 1mpartmg mstructwns or conductmg and gu1dmg rc~earch or extensiOn education projects, and mcludcs any other person who may be spec1fied by the Statutes to be a teacher,
(am) "Umvers1ty" means the Umverstty of F1shenes and Ocean Stud1es established and mcorporated under th1s Act,
(dn) "Umvers1ty Govemmg Counctl" means the Umvers1ty Goven11ng Counctl spec1fied m sect1on 12,
(ao) "Vtce Cham,ellor" means the V1ce Chancellor of the Umverslly CHAPTI R II lHE UNIVERSDY 3 F:stabhshment and /ncorporatton of the Untverstty -(I) There shall be estabh~hed dnd mcorporated a Umvers1ty by the name "The Kerala Umvers1ty of f1shenes and Ocean Stud1es"
(2)' The Umvers1ty shall cons1st~ of Chancellor, the Pro Chancellor, the Y1ce Chancellor, Pro- V1ce Chancellor, Dean, the Reg1strar, t~e Umvers1ty Govermng Council, the Academic Council, the Research Counctl, School Govemmg Council, Departmental Govemmg Counc1ls and other authontle'> and officers a~ set forth m th1~ Act or a~ prov1ded m the Statutes made thereunder
(3) The Un1vers1ty shall be a body corporate havmg perpetual ~ucce~s1on and a common seal w1th power, subject to the prov1s1ons of th1s Act to acqu1re and hold property • both movable and 1mmovable, to lease, sell or othcrw1se transfer any movable or Immovable property which may have become vested m or have been acqu1red by 1t for the purpose of the Un1ver<;1ty, to borrow moneys from the Central Govem~nt or any other State • Government or from any body corporate approved by the Government of Kerala, to contract and to do dll other thmgs nece!>sary for the purposes of th1s Act and shall by the <>aid name sue and be sued 'l I I • • 67 -.

(3) All schools and rcg10nal centres of research and other mst1tut10ns commg under colleges the JunsdlctJOn and authonty of the Umvcrs1ty shall form constituent umts of the Umvers1ty under the full management and control of the Officers and Authont1es of the Un1vers1ty and no school, research or expenmcntal station or other mst•tut10m ~hall be recogn•~:cd as an affiliated umt ( 4) ·1 he Umverslty may conduct d1stant educatiOn cour<>es all over the country or abroad or to adm1t non-rcs1dcnt student<> or to appomt teachers

(vui) to develop breed.; and hybrids of ornamental fishc<;, prawn!> and oy-.tcrs havtng features like production capacity, resic;tmg power and good qualtty suitable to the environment of Kerala, (Ix) to develop farmmg practices, fi<;h feeds, fish disease control, resistant and vigtlant !>tcp<; ~uitable to the sustamable farmmg of ornamental fi~hes, '
(x) to pre!>crve the fi<;h bio-dJversity of Kerala, to estabhsh the1r mtellectual property right to develop and uttiize the possibtiitles of new I technology ltke bio-technology,
(xi) to conduct study and to· record and preserve the !>tudy results relatmg to traditiOnal ftsh technology, traditional knowledge, ~ustamable fish protection and to fo<;ter devttlopment , (x11) to strengthen research on fishtng and related habitat and the relevant environmental factor!>, and (xu1) <;uch other purposes as the Uni\ersity may deem necessary from time to lime 6 Admz~.110n to the Umvenlty -(I) ·1 he Umverslty shall, !>Ubjeet to the prov1s1on~ of this Ac~ and the Statutes made thereunder be open to any persons Prov1dcd that nothmg m this section shall be deemed to requ1re the Umver<>Ity to admit to any course of study any person who does not meet the rcquned academIC standards· for adm 1ss1on or to ret am on the rolls of the Umver!>tty any person who!>c academic records arc below the mmmmm standards rcqutred for the award of a degree or dtploma or certificate~ or v.hose personal conduct ts such as to mmucal to the appropnate nghts and pnvtleges of other students and staff, or to admit to any course of s"tudy a large number of students that can be accommodated with the ava1lable facilitieS of the Umver<;tty and a<; determmed by the Academic Counctl
(2) Subject to the provmons of !>Ub-sectwn (I) the Government may dtrect that the University shall reserve such number of seats as may be not1fied by the Government from t1me to time for Scheduled Castes, Scheduled Tnbes, Ftshermen Commumty, Other Backward Classes and for !>tudents from other States and Umon Terntones m India '.

(a) to prov1de 1nstructton dnd trammg m f1shcncs, ocean stud1es and other alhcd branches of leammg as the Umvcrs1ty may, deem fit, tb) to make prov1s1ons for research m fishenes, ocean stud1es and all1cd branches of leammg,
(c) subject to the prov1s1ons of ~ectwn 4 7, to make prOVISions for dlsscmmatlon of the findmgs of research and tcchntcal mformatJOn through an extensiOn cducat1on programme,
(d) to mstllute and award degree~, d1ploma~, cert1f1cates and other acadcm1c d1stmcllons, . (c) to h?ld cxamtnatiOn~ and to confer degrees and other academ1c d1stmct!Ons for persons who shall have pursued approved course~ of study m the Umvers1ty, College or School unlcs<, exempted therefrom m the manner prescnbed and ~hall have passed the prescnbed exammatton of the Umvcrslly or shall have earned on research sat1sfactonly under cond1t1ons as may be prescnbed and wh1ch ha~ been duly evaluated,
(f) to confer such honorary degree!> and other d1~tmct10ns as may be prescnbed for d1stmgu1shed' persons .
(g) to prov1de lecture~ mstruct1ons and tratntng to f1eld workers, vtlldgers and other pcr!>ons not enrolled as regular students of the Umvers1ty and to grant them ~uch cert1ftcatc~ as may be pn:scnbed,

(2) 'I he Government shall, before causmg dn mspect10n or mqmry to be made under sub-sectwn (1 ), gtve due notice of such mspcct1on or enqmry, a!> the cd~e may be, the Umvcrs1ty, and the Umvcrs1ty shall be entitled to appomt 1ts representative who shall have the nght to be present and to 'be hea1 d at such mspect10n or mqu1ry
(3) fhe Government shall communicate to the Umvc[sity the v1cw~ of the Government w1th reference to the result-; of such mspect10n or mqu1ry for Its opm1on thereon and may, after obtammg the same, ddv1se the Umvcr!>lty d~ to the action to be taken m pursuance thereof and fix a t1me lumt for takmg <;uch action ( 4) :rhe Umvers1ty shall. w1thm the time limits so fixed, report to the Government the action wh1ch has been taken or IS proposed to be taken on· the adv1ce rendered by the Government /

(vlll) abolitiOn of Umvcrs1ty schools, departments or mstttutwns, con:.titucnt colleges and centres, (1:>..) quahficallons, recruitment, workload, code of conduct, terms of office, duties and condltwns of se1 vice, mclud1ng pcnod1c assessment of teacher<;, officers and other employees of the Umverstty, the provision of pension, gr.ttUJty and provident fund, the manner of termmanon of their services, wherever apphcablc, as approved by the State Government, ,
(x) applicatiOn of funds of the Umvcrs~ty for furtherance of the obJC'Ctives of the limvcrsity, (x1) conditiOns and procedure for the affiliation of colleges or for withdrawmg the affiliatiOn of colleges, (x11) the norms for grant of autonomy to Umvers1ty schools, departments, colleges and rccogmsed mstnuuons, subJect to the approval of the State Government, (x111) acceptance and management of trusts, bequests, donations, endowments and grants from mdividuals or orgamsatwns, (x1v) provision of reservatiOn of adequate number of posts of tea<.hers, officers and other employee~ of the Umvers1ty, colleges, and schools • for the members of the Scheduled Castes and Scheduled 1 nbes and Other • Backward Classes m accordance with the Constitutional proviSions and pohcy of the State Government,
(xv) fixmg of number of workmg days, number of actual days of IRstructwns, holidays other than Sundays, vacatiOn and terms 111 academic year, (x v1) disciplmary action agamst teachers, officers and other employees of the Umvcrs1ty, affiliated ~olleges and recogmsed mstltutions,
(xvu) the taking over or transfernng, tn pubhc mterest, of the management of a college or msututiOn by the Umvers1ty and the conditions for <;uch takmg over or transfcmng, subJect to the approval of the State Government, and (xv111) any matter a:. may be prcscnbed by Statutes or which IS necessary to g1vc effect to the proviSions of th1s Act 109 ..
67 Protedure for makmg Statute~ (1) Notw1thstand1ng anyth1ng conta1ncd tn th1s Act, the Government shall make the f1rst Statute of the Umvcrslly .
(2) I he Govcrnmg Coune1l may, from 11mc to t1mc, make new • or add1twnal Statutes or may amend or repeal the Statutes referred to m sub-sect10n ( 1) • >
(3) The Statute may be made, amended or repealed by the Govcmmg Council m the manner heremaftcr provtdcd,-
(1) 'lbc Govemmg C~unctl may take mto consideratiOn the draft of a Statute e1ther moved by any member of the Council or on a proposal by the VIce-Chancellor,
(11) '!be Govemmg Counc1l, 1f 1t thmks necessary may also obtam the op1mon of any officer, authonty or body of the Untvcrslly m regard to any draft Statute wh1ch IS before 1t for consideration Prov1dcd that, where any such draft Statute pcrnuns to acadcm1c matters, the Govemmg Council shall obta{n the optmon of the Academtc Counc1l before constdenng the same,
(111) '!be Govcmmg Council shall not propose the draft of a Statute or of an amendment to a Statute affcctmg the status, powers or constttutton of any authonty of the Umvcrstty until such authonty has been gtvcn an opportumty of exprcssmg an opm10n upon the proposal and any opm10n so expre<>Scd shall be m wntmg and shall be cons1dercd by the Govcmmg Council
(tv) [very Statute passed by the Governmg Counctl shall be subn11tted to the Chancellor who may gtve or wHhhold hts assent thereto, or send 1t back to the Govemmg Council for reconsideration,
(v) No Statute passed by the Govemtng Counctl c;hall be vahd or shall come mto force until asc;ented to, by the Chancellor 68 Ordmances -Subject to the condlt10ns preo;cnbcd by or under thts Act, the Govcmmg Counc1l may make Ordmances, to provtde for all or any of the followmg matters, namely-
(1) the conditions under whtch students shall be admttted to courses of study for degree, dtploma, certtficatc and other academ1c dtstmcttons, 110
(u) the fees to be charged for enrolment of students for attendmg such courses m the Umvcrs1ty and that for admiS~Jon to the exammat1ons leadmg to degrees, diplomas, certificate and other academiC d1stmctwns, and for registratiOn of graduates and any other type of fees to be charged, (u1) the cond1t10n~ of residence, conduct and dJSCiplme of the students of the Umvc~lty, and actiOn to be taken agamst them for breach of d1sc•phnc or misconduct, mcludmg the followmg --
(a) usc of unfdir means at an cxanunallon or abetment thereof,
(b) refusal to appear or g1vc evidence m any authonsed mqmry by an officer m charge of an exammatwn or by any officer or authonty of the Umvcrslly , or
(c) disorderly or otherwise obJeCtiOnable conduct, whether w1thm or outs1dc the Umvers1ty, (•v) the cond1t1ons govcnung the appomtmcnt and dulles of cxammers, .
(v) the conduct of cxammat10ns and other tc'its and the manner m v. h1ch the candidates may be a~~cssed or cxammcd by the cxammcrs, (v1) the classification of teachers, staff strength m vanous departments, v.orkload of teachers and other staff m the Umvcrs1ty departments, colleges and schools,
(vu) the mo;pcctJon of colleges, rccogmsed mstJtutJOns, and hostels;
(\ lll) the mode of executiOn of contracts or agreements for, by or on behalf of the Umvers•ty, (1x) the rule~ to be observed and enforced by colleges and recogmsed mstitutwns regardmg transfer of students wherever necessary,
(x) the duties and functiOns of students' assoc1atwns and other orgamsatwns m colleges, (x1) all other matters wh1ch, by or under th1s Act or Statutes, arc to be or may be, provided by Ordmanccs, and
(xu) generally, all matters for which proviSion IS, m the opm1on of the Govcrnmg Council, necc~~ary for the exercise of the power<> conferred or the performance of the dut1e~ unposed on any authonty of the Umvers1ty under th1s Act or Statutes • • • • 111

Procedw e for makmg Ordmanws --- rhe Governmg Counc1l may make, amend 01 repeal Ordmance'> m the manner hercmafter provlded,- {t) No Ordmances concernmg the matter~ referred to m clauses (1) to (v1) of '-CCt!On 67 above, Of any Other matter COnnected With the mamtenance of the standards of teachmg and exammat10ns wtthm the Un1ver~1ty, ~hall be mc1de by the Governmg Counc1l unless a draft thereof has been considered by the Academ1c Council,
(11) rhe Governmg Counc1l 'hall not have the power to amend any draft proposed by the A"adenuc Councll under clau'>c (1) abo\'c, out may return 11 to the Academic Council for recons1derdllon, m pc1rt or Ill whole, together With any amendments wh1ch the Go\-ernmg Counc!l may suggest
(111) All Ordmances made by the GO\ ernmg Council shall have effect from -;uch date as 1t mc1y d1rect, but every Ordmance so made shall be submtlted to the Chancellor With Ill two weeks 1 he Chancellor shall have the power to dtreet the Governmg Council, w1th1n four weeks of the rece1pt of the Ordmances, to ~uspend 1ts operatiOn and he ~hall, a~ soon a~ pos'>lble, mform the Govermng Counc!l of h1s obJeCtiOn to 11 lie may alter rece1vmg the comments of the Govemmg Councd etther Wlthdrav. the order .suspendmg the Ordmanees or disallow the Ordmanccs and hts dec1~10il shall be final 70 Regufalwm -(1) Subject to prov1~1ons of tht-; Act, the Statutes and Ordmances and the approval of the Governmg Council, the Academic Counc1l may make regulatiOns m the manner prc<;cnbed by Statutes, prov1dmg for all or any of the followmg matters, namely -
(t) the cour<;es of 'itud1es and the conduct of exammattons,
(11) the adm1~~10n of students to the \-anous courscc; of -;tudy and to the exammat10ns, {111) the quahficat10n~ of teachers, {tv) the appomtmcnt and prescnpllon of duttes of the Board~ of Stud1es and exammer-;,
(v). rccogmt10n of cxammatJOn<>, degrees and dip
