PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 5073] ubZ fnYyh] cq/okj] fnlEcj 26] 2018@ikS"k 5] 1940 No. 5073] NEW DELHI, WEDNESDAY, DECEMBER 26, 2018/PAUSHA 5, 1940 गृहगृहगृहगृह म�ंालयम�ंालयम�ंालयम�ंालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 26 �दस� बर, 2018 काकाकाका. . . . आआआआ.... 6313631363136313((((अअअअ).).).). —जब�क िविधिव�� ��याकलाप (िनवारण) अिधिनयम, 1967 (1967 का 37) (िजसे इसके बाद उ� अिधनयम के �प म� संद�भत �कया गया ह)ै का अिधिनयमन �ि�य� तथा संगठन� के कितपय िविधिव�� ��याकलाप� को अिधक #भावी तरीके से रोकने के िलए तथा आतंकवादी गितिविधय� तथा उससे संबंिधत मामल� से िनपटने के िलए �कया गया है; और जब�क, उ$ त अिधिनयम क% धारा 2 क% उपधारा (1) के ख' ड (एम) के अनुसार, ‘आतंकवादी संगठन’ का ता) पय* उ$ त अिधिनयम क% #थम सूची म� सूचीब� �कसी संगठन या इस #कार सूचीब� �कसी ऐसे संगठन से ह ैजो उसी नाम के अंतग*त संगठन चला रहा हो; और जब�क, उ$ त अिधिनयम क% #थम सूची म� इस #कार के आतंकवादी संगठन� क% सूची दी गई ह;ै और जब�क, ‘खािल0तान िलबरेशन फोस* (िजसे इसके आगे केएलएफ कहा गया ह)ै’ 3हसापूण* तरीक� से भारत गणरा6य से पंजाब रा6य को अलग करके 0वतं7 खािल0तान रा6य बनाने के उ8े:य से वष* 1986 म� अि0त)व म� आया था; और जब�क, खािल0 तान िलबरेशन फोस* भारत म� िनद<ष लोग�/पुिलस अिधका=रय� क% ह) या, िसिविलयन ल> य� पर अनेक बम िव0 फोट करने, जबरन उगाही, अपहरण, ब?क डकैती आ�द के माA यम से आतंकवादी कायB के िलए िनिधयां जुटाने और मह) वपूण* सरकारी पदािधका=रय� क% ह) या के #यास� म� संिलC त था; और जब�क, खािल0 तान िलबरेशन फोस* ने आतंकवादी कृ) य� को अंजाम �दया ह ैतथा वह आतंकवादी गितिविधय� को बढ़ावा द ेरहा ह ैऔर भारत म� आतंकवादी गितिविधय� के िलए युवाF को अितवादी बनाने और उनक% भतG करने म� लगा Hआ ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और जब�क, पंजाब रा6 य पुिलस Iारा खािल0 तान िलबरेशन फोस* के पांच सद0 यीय मॉKूल को िवफल �कया गया था िजसक% वजह से नाभा, पंजाब म� इ� #ोवाइ6 ड ए$ सC लोिसव िडवाइसेस (आईईडी) लगाए जाने से संबंिधत दो मामल� को सुलझाया जा सका; और जब�क, पंजाब रा6 य के गुरदासपुर िजले म� खािल0 तान िलबरेशन फोस* के एक अN य मॉKूल को िवफल �कया गया था और खािल0 तान िलबरेशन फोस* के चार ऐसे आतंकवा�दय� को अवैध हिथयार� एवं गोलाबा�द के साथ िगरOतार �कया गया जो �कसी िवशेष राजनैितक दल के पठानकोट म� रहने वाले नेताF को िनशाना बनाने क% योजना बना रह ेथे; और जब�क, पंजाब रा6 य म� अमृतसर िजला पुिलस Iारा खािल0 तान िलबरेशन फोस* के एक अN य मॉKूल को िवफल �कया गया था और के एल एफ के उन तीन आतंकवा�दय� को िगरOतार �कया गया जो �कसी िवशेष समुदाय के #मुख सद0 य� को िनशाना बनाने क% योजना बना रह ेथे ता�क पंजाब रा6 य म� सां#दाियक सPाव को भंग �कया जा सके; और जब�क, पंजाब राज् य म� जालंधर िजला पुिलस ने खािल0 तान िलबरेशन फोस* /खािल0 तान 3जदाबाद फोस* के चार सद0 यीय मॉKूल को िवफल कर �दया तथा खािल0 तान िलबरेशन फोस* के मुिखया को अवैध हिथयार� एवं गोलाबा�द के साथ �दनांक 07 नवंबर, 2014 को िगरOतार कर िलया; और जब�क, सुरQा एज�िसय� ने 2017 म� खािल0 तान िलबरेशन फोस* के एक ऐस ेमॉKूल को िवफल कर �दया िजसने पंजाब रा6 य म� कानून एवं R यव0 था क% ि0थित को अि0थर करने तथा पंजाब रा6 य म� आतंकवाद को पुनजGिवत करने के उ8े: य से भारत म� िविशT ट समुदाय एवं संगठन� के R यि�य� क% ह) या करने या ह) या के #यास संबंधी आठ घटनाF को अंजाम �दया था; और जब�क, भारत म� इस उWवादी समूह के सद0 य� को िवदशे ि0थत उनके संचालक� से िव) तीय एवं संभार तं7 संबंधी सहायता #ाC त हो रही ह;ै और जब�क, क� X सरकार का ऐसा मानना ह ै�क ‘खािल0 तान िलबरेशन फोस* (केएलएफ)’ आतंकवाद क% घटनाF म� संिलC त ह ै$ य��क इसने भारत म� िविभN न आतंकवादी घटनाF को अंजाम �दया ह ैतथा उनम� सहभागी रहा ह;ै अब, इसिलए, क� X सरकार िविधिव�� ��याकलाप (िनवारण) अिधिनयम, 1967 क% धारा 35 क% उप-धारा (1) के ख' ड (क) के तहत #द) त शि�य� का #योग करते Hए, उ$ त अिधिनयम क% #थम अनुसूची म� िन� निलिखत अित=र$ त संशोधन करती ह:ै- उ$ त अिधिनयम क% #थम अनुसूची म�, �म संY या 39 के प: चात् और उसस ेसंबंिधत #िविZय� म� िन� निलिखत �म संY या और #िविZयां शािमल क% जाएंगी, नामत: :— “40. खािल0 तान िलबरेशन फोस* और इसके सभी �प।” [फा. स.ं 11034/13/2018-सीटी-I] पीयूष गोयल, संयु$ त सिचव नोटनोटनोटनोट :::: िविधिव�� ��याकलाप (िनवारण) अिधिनयम, 1967 क% #थम अनुसूची को िपछली बार भारत सरकार क% �दनांक 19.06.2018 क% अिधसूचना संY या का.आ. 2947 (अ) के Iारा सशंोिधत �कया गया था। ¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 26th December, 2018 S.O. 6313(E).—Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith;
And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, ‘terrorist organisation’ means an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an organisation so listed;
And whereas, the First Schedule to the said Act contains the list of such terrorist organisations;
And whereas, the ‘Khalistan Liberation Force’ (hereinafter referred as KLF) came into existence in the year 1986 with the objective of establishing an independent State of Khalistan by secession of the State of Punjab from the Republic of India through violent means;
And whereas, the KLF was engaged in killing of innocent persons and police officers, several bombings on civilian targets in India, collection of funds for terror activities through extortion, kidnappings, bank robberies etc., and assassination attempts of important Government functionaries;
And whereas, the KLF has committed acts of terrorism and promoting acts of terrorism and has been engaged in radicalisation and recruitment of youth for terrorist activities in India;
And whereas, a five member KLF module was busted by the Police of the State of Punjab, which resulted in working out the two cases relating to planting of Improvised Explosive Devices (IEDs) in Nabha, Punjab;
And whereas, another KLF module was busted in Gurudaspur District of the State of Punjab and four terrorists of KLF were arrested with illegal arms and ammunitions, who were planning to target Pathankot based leaders of a particular Political Party;
And whereas, another KLF module was busted by Amritsar District Police in the State of Punjab and three KLF terrorists were arrested, who were planning to target prominent members of a particular community, so as to disrupt the communal harmony in the State of Punjab;
And whereas, the Jalandhar District Police in the State of Punjab busted a KLF/ Khalistan Zindabad Force module of four members and arrested the Chief of KLF along with illegal arms and ammunition on 7th November, 2014;
And whereas, the security agencies busted a KLF module in the year 2017, which carried out a series of eight incidents of killings or attempted killings of specific communities and organisations in India in order to destabilise the law and order situation and reviving terrorism in the State of Punjab;
And whereas, the members of this militant group in India are getting financial and logistic support from their handlers based abroad;
And whereas, the Central Government believes that the ‘Khalistan Liberation Force (KLF)’ is involved in terrorism as it has committed and participated in various acts of terrorism in India;
Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967, the Central Government hereby makes the following further amendments in the First Schedule to the said Act, namely:- In the First Schedule to the said Act, after serial number 39 and the entries relating thereto, the following serial number and entries shall be inserted, namely:- “40. The Khalistan Liberation Force and all its manifestations.”.
