PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 3155] ubZ fnYyh] c`gLifrokj] vxLr 9] 2018@Jko.k 18] 1940 No. 3155] NEW DELHI, THURSDAY, AUGUST 9, 2018/SHRAVANA 18, 1940 जलससंाधनजलससंाधनजलससंाधनजलससंाधन, नदी िवकास और गंगा संर�ण , नदी िवकास और गंगा संर�ण , नदी िवकास और गंगा संर�ण , नदी िवकास और गंगा संर�ण म�ंालयम�ंालयम�ंालयम�ंालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 9 अग� त, 2018 का.आ.का.आ.का.आ.का.आ. 3939393950505050(अ)(अ)(अ)(अ)....—अ�तरराि�यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) (िजसे इसम� इसके प�ात उ� अिधिनयम कहा गया है) क� धारा 4 के अधीन अिधसचूना सं&याकं का.आ. 451 (अ), तारीख 2 अ(ैल, 2004 *ारा कृ,णा जल िववाद अिधकरण (िजस ेइसम� इसके प�ात् उ� अिधकरण कहा गया ह)ै का गठन अ�तरराि�यक कृ,णा नदी और उसक� नदी घाटी से संबंिधत जल िववाद4 के �यायिनण5यन के िलए �कया गया था; और, उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (2) के अधीन अपनी 8रपोट5 और िविन�य तारीख 30 �दस;बर 2010 को (�तुत कर �दया था ; और, के�@ीय सरकार और पAकार रा�य आ�C (दशे, कना5टक और महाराE *ारा उनस ेसंबंिधत िनदFश4 को उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण को तारीख 29 माच5, 2011 को भेज �दए गए हI; और, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण *ारा अित8र� 8रपोट5 तारीख 29 माच5 2011 स ेएक वष5 या उस तारीख से पहले के�@ीय सरकार को भेजना अपेिAत था; और उ� अिधकरण के अनुरोध पर उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन अित8र� 8रपोट5 (�तुत करने क� अविध समय-समय पर अिधसूचना स&ंयांक का.आ. 653 (अ),तारीख 29 माच5, 2012 का.आ. 2339 (अ), तारीख 28 िसतंबर, 2012, का.आ. 916 (अ), तारीख 2 अ(ैल, 2013, का.आ. 2939 (अ), तारीख 27 िसतंबर, 2013, का.आ. 3515 (अ), तारीख 27 नवंबर, 2013 *ारा 31 जनवरी, 2014 तक बढ़ाई गई थी िजसे जल संसाधन मंMालय के तारीख 5 फरवरी, 2014 के आदशे (अिधसूचना सं&या का.आ. 1290 (अ), तारीख 15 मई, 2014, का.आ. 2462 (अ), तारीख 18 जलुाई, 2016 और का.आ. 2459 (अ), तारीख 31 जुलाई, 2017 *ारा और बढ़ा �दया गया था; और, उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन क� @ीय सरकार को अपनी अित8र� 8रपोट5 29 नव;बर, 2013 को अPेिषत कर दी ह;ै 2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, उ� अिधिनयम क� धारा 12 के अधीन अिधकरण *ारा 8रपोट5 अPेिषत �कये जाने के बाद और क� @ीय सरकार का यह समाधान होने पर �क इस मामले म� अिधकरण को कोई अित8र� िनदFश भेजा जाना आवRयक नहS होगा, क� @ीय सरकार अिधकरण का यथाशीT िवघटन कर दगेी; और, आंC (दशे पुनग5ठन अिधिनयम, 2014 (2014 का 6) क� धारा 89 म� यह उपबंध �कया गया ह ै�क कृ,णा जल िववाद अिधकरण क� अविध उ� धारा के खंड (क) और खंड (ख) म� िविनYदZ िनबंधनानुसार बढ़ाया जायेगा; और, क� @ीय सरकार, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के *ारा (द[ शि�य4 का (योग करते \ए, उ� अिधकरण *ारा अित8र� 8रपोट5 (�तुत करने क� अविध को सं&याकं का.आ. 2459 (अ), तारीख 31 जुलाई, 2017 *ारा भारत के राजपM म� (कािशत भारत सरकार के जल संसाधन, नदी िवकास और गंगा संरAण मंMालय *ारा तारीख 1 अग�त, 2017 से एक वष5 क� और अविध के िलए बढ़ाई गयी थी ता�क उ� धारा के खंड (क) और खंड (ख) म� िविनYदZ िनबंधनानुसार संबोधन �कया जा सके; और, उ� अिधकरण ने 8रपोट5 और िविन�य (�तुत करने के िलए 1 अग�त, 2018 से और एक वष5 क� अविध बढ़ाने का अनुरोध �कया है; अतः, अब, के�@ीय सरकार, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के परंतुक *ारा (द[ शि�य4 का (योग करते \ए, उ� अिधकरण *ारा अित8र� 8रपोट5 (�तुत करने क� अविध को तारीख 1 अग�त, 2018 से और एक वष5 क� अविध बढ़ाती ह।ै [फा. सं. 17/4/2016-बी.एम.] टी. राजे�वरी, अपर सिचव MINISTRY OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION NOTIFICATION New Delhi, the 9th August, 2018 S.O. 3950(E).—Whereas, the Krishna Water Disputes Tribunal (hereafter in this notification referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereafter in this notification referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof;
And, whereas, the said Tribunal has submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010;
And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra have preferred their respective references, to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011;
And, whereas, the said Tribunal was required to forward to the Central Government a further report under sub-section (3) of section 5 of the said Act on or before one year from 29th March, 2011;
And, whereas, on the request of the said Tribunal, the period of submission of further report under sub-section (3) of section 5 of the said Act was extended from time to time vide notifications number S.O 653(E), dated the 29th March, 2012, S.O. 2339 (E), dated the 28th September, 2012, S.O. 916 (E), dated the 2nd April, 2013 and S.O. 2939 (E), dated the 27th September, 2013, S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5th February, 2014, S.O.1290 (E), dated the 15th May, 2014 and S.O. 2462 (E) dated 18th July, 2016 and S.O. 2459 (E) dated 31st July, 2017;
And, whereas, the said Tribunal has forwarded to the Central Government its further report under subsection (3) of section 5 of the said Act on the 29th November, 2013;
And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And, whereas, section 89 of the Andhra Pradesh Re-organization Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and (b) of the said section;
And, whereas, in exercise of the powers conferred by the sub-section (3) of section 5 of the said Act, the Central Government extended the period of submission of further report by the said Tribunal for a further period of one year with effect from the 1st August, 2017 so as to address the terms of reference specified in clauses (a) and (b) of the said section vide the notification of the Government of India, Ministry of Water Resources, River Development and Ganga Rejuvenation dated the 15th May, 2014, published in the Gazette of India, vide number S.O. 2459 (E), dated the 31st July, 2017;
And, whereas, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from the 1st day of August, 2018;
Now, therefore, in exercise of the powers conferred by the proviso to sub-section (3) of section 5 of the Inter-State River Water Disputes Act, 1956 (33 of 1956), the Central Government hereby extends the period of submission of report and decision by the Krishna Water Disputes Tribunal for a period of one year with effect from the 1st day of August, 2018..
