PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1071] ubZ fnYyh] c`gLifrokj] ebZ 15] 2014@oS'kk[k 25] 1936 No. 1071] NEW DELHI, THURSDAY, MAY 15, 2014/VAISAKHA 25, 1936 जल संसाधन मं ालय जल संसाधन मं ालय जल संसाधन मं ालय जल संसाधन मं ालय अिधसूचना अिधसूचना अिधसूचना अिधसूचना नई �द� ली, 15 मई, 2014 काकाकाका....आआआआ. 1290. 1290. 1290. 1290 ((((अअअअ))))....————अ तराि�यक नदी जल िववाद अिधिनयम,1956 (1956 का 33) (िजसे इसम� इसके प� चात उ� त अिधिनयम कहा गया ह)ै क� धारा 4 के अधीन अिधसूचना सं" यांक का.आ. 451(अ.) तारीख 2 अ#ैल, 2004 %ारा कृ' णा जल िववाद अिधकरण (िजसे इसम� इसके प� चात् उ� त अिधकरण कहा गया ह)ै का गठन, अ तरराि�यक कृ' णा नदी और उसक� नदी घाटी से संबंिधत जल िववाद. के यायिनण/यन के िलए �कया गया था ; और, उ� त अिधकरण ने उ� त अिधिनयम क� धारा 5 क� उप-धारा (2) के अधीन अपनी 3रपोट/ और िविन� चय तारीख 30 �दस5 बर, 2010 को #6 तुत कर �दया था ; और, के 8ीय सरकार और प9कार रा� य आ ; #देश, कना/टक और महारा' > %ारा उनसे संबंिधत संदभ/ उ� त अिधिनयम क� धारा 5 क� उप-धारा (3) के अधीन उ� त अिधकरण को �दनांक 29 माच/, 2011 को भेज �दये गए ह@; और, उ� त अिधिनयम क� धारा 5 क� उप-धारा (3) के अधीन उ� त अिधकरण %ारा अित3र� त 3रपोट/ तारीख 29 माच/, 2011 से एक वष/ या उस तारीख से पहल ेके 8ीय सरकार को भेजना अपेि9त था ; और, उ� त अिधकरण के अनुरोध पर उ� त अिधिनयम क� धारा 5 क� उप-धारा (3) के अधीन अित3र� त 3रपोट/ #6 तुत करने क� अविध समय-समय पर अिधसूचना सं" यांक का.आ.653 (अ) तारीख 29 माच/, 2012, का.आ. 2339 (अ) तारीख 28 िसतंबर, 2012, का.आ. 916 (अ) तारीख 2 अ#ैल, 2013, का.आ. 2939 (अ) तारीख 27 िसतंबर, 2013, का.आ. 3515 (अ) तारीख 27 नव5 बर, 2013 %ारा 31 जनवरी, 2014 तक बढाई गई थी िजसे जल संसाधन मंDालय के 5 फरवरी, 2014 के आदेश %ारा 31 जुलाई, 2014 तक बढा़ �दया गया था ; और, उ� त अिधकरण ने उ� त अिधिनयम क� धारा 5 क� उप-धारा (3) के अधीन अित3र� त 3रपोट/ 29 नवंबर, 2013 को के 8 सरकार को अFेिषत कर दी ह ै; और, उ� त अिधिनयम क� धारा 12 के अधीन अिधकरण %ारा 3रपोट/ अFेिषत �कए जाने के बाद और के 8 सरकार का यह समाधान होने पर �क इस मामल ेम� अिधकरण को कोई अित3र� त संदभ/ भेजा जाना आव� यक नहG होगा, के 8 सरकार अिधकरण का िवघटन कर देगी ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और, आं; #देश पुनग/ठन अिधिनयम, 2014 (2014 का 6) क� धारा 89 म� यह #ावधान �कया गया ह ै�क कृ' णा जल िववाद अिधकरण क� अविध उ� त धारा के खंड (क) और (ख) म� िविनIद' ट संदJभत िनबंदन. के अनुसार बढ़ाया जाएगा ; और के 8ीय सरकार अित3र� त दो वष/ के िलए या अगल ेआदेश. तक, जो भी पहल ेहो, अिधकरण क� अविध बढाना आव� यक मानती ह ै; अत: अब, के 8ीय सरकार, उ� त अिधिनयम क� धारा 5 क� उप-धारा (3) %ारा #दK शिLय. का #योग करते Mए, उ� त अिधकरण %ारा अित3र� त 3रपोट/ #6 तुत करने क� अविध को तारीख 1 अग6 त, 2014 से दो वष/ क� अित3र� त अविध (अथवा अगल ेआदेश. तक, जो भी पहले हो) के िलए बढ़ाती ह ै िजससे आं; #देश पुनग/ठन अिधिनयम, 2014 (2014 का 6) क� धारा 89 के खंड (क) और खंड (ख) म� िविनIद' ट िनदNश के िनबंधन. को O यवहार म� लाया जा सके A [फा.सं. 17/1/2007-बी.एम.] उJवला खाती, संयु� त सिचव (पीपी) MINISTRY OF WATER RESOURCES NOTIFICATION New Delhi, the 15th May, 2014 S.O. 1290(E).— Whereas, the Krishna Water Disputes Tribunal (hereinafter referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) hereinafter referred to as the said Act, for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof;
And, whereas, the said Tribunal has submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010;
And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra have preferred their respective references, to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011;
And, whereas, the said Tribunal was required to forward to the Central Government a further report under subsection (3) of section 5 of the said Act on or before one year from 29th March, 2011;
And, whereas, on the request of the said Tribunal, the period of submission of further report under sub-section
(3) of section 5 of the said Act was extended from time to time vide notifications number S.O 653(E), dated the 29th March, 2012, S.O. 2339 (E), dated the 28th September, 2012, S.O. 916 (E), dated the 2nd April, 2013 and S.O. 2939 (E), dated the 27th September, 2013 and S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5th February, 2014;
And, whereas, the said Tribunal has forwarded to the Central Government its further report under sub-section
(3) of section 5 of the said Act on the 29th November, 2013;
And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary ;
And, whereas, section 89 of the Andhra Pradesh Re-organisation Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and (b) of the said section;
And, whereas, the Central Government considers it necessary to extend the tenure of the Tribunal for two years or until further orders whichever is earlier;
Now, therefore, in exercise of the powers conferred by the sub-section (3) of section 5 of the said Act, the Central Government hereby extends the period of submission of further report by the said Tribunal for a further period of two years ( or until further orders, whichever is earlier) with effect from the 1st August, 2014 so as to address the terms of reference specified in clauses (a) and (b) of the Section [F.
