. 2462 24622462 2462(अ) (अ)(अ) (अ).—अ�तरराि�यक नदी जल िववाद अिधिनयम, 1956 (1956 का 33) (िजसे इसम� इसके प�ात उ� अिधिनयम कहा गया ह)ै क� धारा 4 के अधीन अिधसूचना स"ंयाकं का0 आ0 451 (अ),तारीख 2 अ*ैल, 2004 +ारा कृ-णा जल िववाद अिधकरण (िजसे इसम� इसके प�ात् उ� अिधकरण कहा गया ह)ै का गठन अ�तरराि�यक कृ-णा नदी और उसक� नदी घाटी स ेसंबंिधत जल िववाद3 के �यायिनण4यन के िलए 6कया गया था;
और, उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (2) के अधीन अपनी 7रपोट4 और िविन�य तारीख 30 6दस:बर 2010 को *<तुत कर 6दया था ;
और, के�?ीय सरकार और प@कार रा�य आ�A *दशे, कना4टक और महाराC +ारा उनसे संबंिधत संदभE को उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण को तारीख 29 माच4, 2011 को भेज 6दए गए हH;
और, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन उ� अिधकरण +ारा अित7र� 7रपोट4 तारीख 29 माच4 2011 स ेएक वष4 या उस तारीख से पहले के�?ीय सरकार को भेजना अपेि@त था;
और उ� अिधकरण के अनुरोध पर उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन अित7र� 7रपोट4 *<तुत करने क� अविध समय-समय पर अिधसूचना सं"यांक का0 आ0 653 (अ),तारीख 29 माच4, 2012, का0 आ0 2339 (अ), तारीख 28 िसतंबर, 2012, का0 आ0 916 (अ), तारीख 2 अ*ैल, 2013, का0 आ0 2939 (अ), तारीख 27 िसतंबर, 2013, का0 आ0 3515 (अ) तारीख 27 नवंबर, 2013 +ारा 31 जनवरी, 2014 तक बढ़ाई गई थी िजसे जल संसाधन मंKालय के 5 फरवरी, 2014 के आदशे +ारा 31 जुलाई, 2014 तक बढ़ा 6दया गया था; का0 आ0 1290 (अ), तारीख 15 मई, 2014 ;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II —SEC. 3(ii)] और उ� अिधकरण ने उ� अिधिनयम क� धारा 5 क� उपधारा (3) के अधीन अित7र� 7रपोट4 29 नव:बर, 2013 को क� ?ीय सरकार को अOेिषत कर दी ह;ै और उ� अिधिनयम क� धारा 12 के अधीन अिधकरण +ारा 7रपोट4 अOेिषत 6कये जाने के बाद और क� ?ीय सरकार का यह समाधान होने पर क� इस मामले म� अिधकरण को कोई अित7र� स�दभ4 भेजा जाना आवQयक नहR होगा, क� ?ीय सरकार अिधकरण का यथाशीS िवघटन कर दगेी;
और आंA *दशे पुनग4ठन अिधिनयम, 2014 (2014 का 6) क� धारा 89 म� यह *ावधान 6कया गया ह ै6क कृ-णा जल िववाद अिधकरण क� अविध उ� धारा के खंड (क) और खंड (ख) म� िविनXदY संदZभत िनबंधन3 के अनुसार बढ़ाया जायेगा ;
और, क� ?ीय सरकार उ� अिधिनयम क� धारा 5 क� उपधारा (3) के +ारा *द[ शि�य3 का *योग करते \ए, उ� अिधकरण +ारा अित7र� 7रपोट4 *<तुत करने क� अविध को सं"यांक का0 आ0 1290 (अ),तारीख 15 मई, 2014 +ारा भारत के राजपK म� *कािशत भारत सरकार के जल संसाधन मंKालय तारीख 15 मई, 2014 +ारा तारीख 1 अग<त, 2014 से दो वष4 क� अित7र� अविध के िलए बढ़ाई गयी थी ता6क उ� धारा के खंड (क) और खंड (ख) म� िविनXदY िनद]श के िनबंधन संबोधन 6कया जा सके;
और, उ� अिधकरण ने 7रपोट4 और िनण4य *<तुत करने के िलए अविध 1 अग<त, 2016 से एक वष4 क� और बढ़ाने का अनुरोध 6कया है;
अतः अब, के�?ीय सरकार, उ� अिधिनयम क� धारा 5 क� उपधारा (3) के परंतुक +ारा *द[ शि�य3 का *योग करते \ए, उ� अिधकरण +ारा अित7र� 7रपोट4 *<तुत करने क� अविध को तारीख 1 अग<त, 2016 स े एक वष4 क� अित7र� अविध के िलए बढ़ाती ह।ै [फा. सं. 17/4/2016-बी.एम.]
डा. बी. राजे�दर, संयु� सिचव (पीपी) MINISTRY OF WATER RESOURCES, RIVER DEVELOPMENT AND GANGA REJUVENATION NOTIFICATION New Delhi, the 18th July, 2016 S.O. 2462(E).—Whereas, the Krishna Water Disputes Tribunal (hereafter in this notification referred to as the said Tribunal) was constituted on the 2nd April, 2004 vide notification number S.O. 451(E), dated the 2nd April, 2004, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956) (hereafter in this notification referred to as the said Act), for the adjudication of the water disputes regarding Inter-State river Krishna and river valley thereof;
And, whereas, the said Tribunal has submitted its report and decision under sub-section (2) of section 5 of the said Act on 30th December, 2010;
And, whereas, the Central Government and the Party States of Andhra Pradesh, Karnataka and Maharashtra have preferred their respective references, to the said Tribunal under sub-section (3) of section 5 of the said Act on 29th March, 2011;
And, whereas, the said Tribunal was required to forward to the Central Government a further report under subsection (3) of section 5 of the said Act on or before one year from 29th March, 2011;
And, whereas, on the request of the said Tribunal, the period of submission of further report under sub-section
(3) of section 5 of the said Act was extended from time to time vide notifications number S.O 653(E), dated the 29th March, 2012, S.O. 2339 (E), dated the 28th September, 2012, S.O. 916 (E), dated the 2nd April, 2013 and S.O. 2939 (E), dated the 27th September, 2013 and S.O. 3515(E), dated the 27th November, 2013 up to the 31st January, 2014, which was further extended up to 31st July, 2014, vide Ministry of Water Resources order dated 5 th February, 2014, S.O.1290 (E), dated the 15 th May, 2014;
And, whereas, the said Tribunal has forwarded to the Central Government its further report under sub-section
(3) of section 5 of the said Act on the 29th November, 2013;
¹Hkkx IIµ[k.M 3(ii)º Hkkjr dk jkti=k % vlk/kj.k 3 And, whereas, under section 12 of the said Act, the Central Government shall dissolve the Tribunal after it has forwarded its report and as soon as the Central Government is satisfied that no further reference to the Tribunal in the matter would be necessary;
And, whereas, section 89 of the Andhra Pradesh Re-organization Act, 2014 (6 of 2014) provides that the term of the Krishna Water Disputes Tribunal shall be extended with the terms of reference specified in clauses (a) and (b) of the said section;
And whereas, in exercise of the powers conferred by the sub-section (3) of section 5 of the said Act, the Central Government extended the period of submission of further report by the said Tribunal for a further period of two years with effect from the 1st August, 2014 so as to address the terms of reference specified in clauses (a) and (b) of the said section vide the notification of the Government of India, Ministry of Water Resources, dated the 15 th May, 2014, published in the Gazette of India, vide number S.O. 1290 (E) dated the 15th May, 2014;
And whereas, the said Tribunal had requested to extend the period of submission of report and decision for a period of one year with effect from the 1st August, 2016;
Now, therefore, in exercise of the powers conferred by the proviso to sub-section (3) of section 5 of the Inter- State River Water Disputes Act, 1956 (33 of 1956), the Central Government hereby extends the period of submission of report and decision by the Krishna Water Disputes Tribunal for a period of one year with effect from the 1 st day of August, 2016.
