8.0. 653(E).—Whereas, the Krishna Water Disputes Tribunal aiereinafier referred to as the said Tribunal) was constituted on 2ndApril, 2004 vide notification number 8.0. 45 103), dated the 2nd April, 2004, under Section 4 ofthe Inter- State River Water Disputes Act, 1956 (33 of 1956) (hereinafier referred to as the Said Act) for the adjudication ofthe water disputes regarding Inter-State river Krishna and river valley thereof;
And whereas, the said Tribunal was required to submit its report and deCISIOH under sub-section (2) of Section 5 of the said Act on or before the lst day ofApril, 2007;
And whereas, the said Tribunal had requested to extend, the period ofsubmission ofreport and decision for fimher periods from time to time;
And whereas, the Central Government vide notifications number 8.0. 400(E), dated the 20th March, 2007,8.0. 414 (E), dated the 3rd March, 2008, 8.0. 21 16 (E), dated the 27th August, 2008 had extended the period ofsubmission ofreport and decision upto lstApril, 2009;
And whereas, the Government of Karnataka approached the Hon'ble Supreme Court vide writ petition (Civil)No. 408/2008 to direct the Centnfl Government to reckon the date of constitution of the Tribunal as February or March, 2006;
And whereas, the Enable Supreme Court heard the matter on 17th December, 2008 and directed that effective date of the constitution ef the Krishna Water Disputes Tribunal under Section 3 of the said Act would be the lst February, 2006;
And whereas, the said Tribunal had again requested to extend the period ofsubmission of its report and decision for a further period ofone year with eflect from lst February. 2009, _ And whereas, alter taking mtoconsrderatwn the Connorder, fltenotification number 5.0. 2116(E), dated the 27th August, 2008 and the prowso to subsection (2) of Section 5 offite said Act, the Central Government vide notification number. 8.0. 543 (13). dated thei’Sth February. 2009. e ntenfleflthe puiod ofsuhmission of report and decision for a timber period ofone yearwith effect from lstfehruary, 2009 qptoBlst January, 2010; .

And whereas, the Central Govemmont vide notifications number S0. 21203) dated the 29th January, 2010, SO.
2347(E) dated the 28th September 2010 and S. O. 2847 (E) dated the 26111 November. 2010 had extended the nerind nf submission of report and decision upto Blst December, 2010;
And whereas, the said Tribunal submittedits report and decision under sub-section (2) of Section 5 of the said Act on 30th December, 2010;
And whereas, the Central Government and the Party States ofAndhra Fradesh, Kamataka and Maharashtra have preferred then respccnve References, lastly by the State ofMaharashtra and the Central Government to the said Tribunal under sub-section (3) ofSection 5 of the said Act on 29th March, 2011.
And whereas the said Tribunal was required to forward to the Central Government a further report under sub-section (3) of Section 5 of the said Act on or before one year from 29th March 2011.
And whereas, the said Tribunal has again requested to extend the period of submission of further report under the proviso to sub-section (3) of Section 5 of the said Act upto 30th September, 2012;
Now, therefore,'1n exercise of the powers conferred by proviso to sub-section (3) of Section 5 of the said 'Act, the Central Government hereby extends the period of submission of further report by the said Tribunal for a further period upto 30th September, 20 12.
