Section 40: Repeal and savings

(1) The Jammu and Kashmir Evacuee (Administration of Property) Act, 2005 (X of 2005) is hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken in the exercise of any power conferred by the Jammu and Kashmir Evacuees' (Administration of Property) Act, 2005 shall be deemed to have been done or taken in the exercise of the powers conferred by this Act, and any penalty incurred or proceedings commenced under that Act shall be deemed to be a penalty incurred, or proceeding commenced under this Act as if this Act were in force on the day when such thing was done, action taken, penalty incurred or proceeding commenced.

[41. Power of Government to apply Act to other persons. - (1) Notwithstanding anything contained in this Act, the Government may, by notification in the Government Gazette, apply provisions of this Act to a person or class of persons who after the 15th day of august, 1947, on account of civil disturbances or the fear of such disturbances, left any place in the State for any place outside the State except the territories now forming part of Pakistan or such part of the state as is under the operational control of the Pakistan Armed Forces and who for reason beyond their control are unable to occupy, supervise or manage in person their property in the State.

(2) Property of such persons shall vest in the Custodian from the date of the order passed under sub-section (1) and for the purposes of this Act shall be treated as evacuee property.]
