Section 2: Definitions

The Leader of Opposition in Maharashtra Legislature Allowances Rules 1987State Rules of Maharashtra · 1978

In these rules, unless the context requires otherwise,—

(a) “Act” means the Leaders of Opposition in Maharashtra Legislature Salaries and Allowances Act, 1978 ;

(b) “Actual travelling expenses” means the actual cost of transport of a Leader of the Opposition and the members of his family and for transport of his and his family’s personal luggage, including charges for ferry and other tolls, if paid, but does not include charges,—

(i) for accommodation in a hotel or in a travellers’ bungalow, or

(ii) for refreshments, or

(iii) for the carriage of any stores or conveyance, or

(iv) on account of presents to a driver and the like, or

(v) for any allowance for such incidental losses or expenses as breakage of crockery, wear and tear of furniture, or

(vi) for the employment of any additional domestic servants ;

(c) “family” means a Leader of the Opposition’s Spouse residing with the Leader of the Opposition and children [including adopted children (if any), if under the personal law of the Leader of the Opposition, adoption is legally recognized], and step children residing with and wholly dependent upon the leader of the Opposition, and except in rule 4, includes his parents, sisters and minor brothers if residing with and wholly dependent upon the Leader of the Opposition, but does not include more than one wife ;

(d) “holiday”, means a public holiday prescribed or notified by or under section 25 of the Negotiable Instruments Act, 1881;

(e) “Leader of the Opposition” means the Leader of the Opposition in the Assembly or the Leader of the Opposition in the Council, as the case may require ;

(f) “Section” means a section of the Act.
