PART II—Section 3—Sub-section (ii) izkf/dkj ls izdkf'kr PUBLISHED BY AUTHORITY la- 1538] ubZ fnYyh] eaxyokj] ebZ 14] 2019@oS'kk[k 24] 1941 No. 1538] NEW DELHI, TUESDAY, MAY 14, 2019/VAISAKHA 24, 1941 गृह मं�ालयगृह मं�ालयगृह मं�ालयगृह मं�ालय अिधसूचनाअिधसूचनाअिधसूचनाअिधसूचना नई �द�ली, 14 मई, 2019 काकाकाका.आ..आ..आ..आ. 1730173017301730((((अ)अ)अ)अ)....————िलबरेशन टाइगस� ऑफ तिमल ईलम (िजसे इसम� इसके प� चात् एलटीटीई कहा गया ह)ै �ीलंका म� आधा#रत एक संगम ह ै�क&तु उसके समथ�क, सहानुभूित रखने वाले और अिभकता� भारत रा1 य2े3 म� भी ह4; और जब�क एलटीटीई का उ5े�य सभी तिमल6 के िलए पृथक् गृहभूिम (तिमल ईलम) भारत क9 :भुता और रा1य 2े3ीय अखंडता के िलए खतरा ह ैऔर संघ से भारत के रा1 य2े3 के �कसी भाग के अ= यप�ण और िवलग हो जाने के समान ह ैतथा इसिलए िविधिव@A �Bयाकलाप6 के अंतग�त आता ह;ै और जब�क एलटीटीई ने, �ीलंका म� मई, 2009 म� अपनी सै& य हार के प� चात् भी ‘ईलम’ क9 संक�पना का प#रE याग नहF �कया ह ैऔर ‘ईलम’ के िलए िछपे तौर पर िनिधय6 को उगाहने और :चार �Bयाकलाप6 म� लगा Iआ ह ैऔर एलटीटीई के शेष नेताL या काडर6 ने िछM-िभM �Bयाकलाप6 को पुनः समूहबA करने तथा इकाई का Oथानीय और अंतरा�P Qीय तौर पर पुनजRिवत करने के :यास :ारंभ कर �दए ह4; और जब�क पृथकतावादी तिमल उS राP Qवादी समूह6 और एलटीटीई समथ�क समूह पृथकतावादी :वृिT को जनता के म=य :ोEसािहत करने म� लगे ह4 और भारत म� और िविशP टतया तिमलनाडु म�, एलटीटीई के समथ�न आधार को बढ़ा रह ेह4, यह अंततोगE वा भारत क9 :भुता और अखंडता पर :बल िवघटनकारी :भाव डालेगा, अत: ऐसे सभी पृथकतावादी �Bयाकलाप6 को सभी संभव िविधपूण� साधन6 Xारा िनयं3ण करने क9 :बल आव� यकता ह;ै और जब�क एलटीटीई, एलटीटीई समथ�क घटक6 और उS राP Qवादी समूह6 के िव@A िविधिव@A �Bयाकलाप (िनवारण) अिधिनयम, 1967 के अधीन मामले भारत सरकार के गृह मं3ालय क9 अंितम अिधसूचना सं. का.आ. 1272(अ), तारीख 14 मई, 2014 से अथा�त् मई, 2014 और मई, 2019 के म= य िवO फोटक पदाथ� अिधिनयम, 1908 और भारतीय दंड संिहता, आ�द के उपबंध6 के अधीन रिजOQीकृत मामल6 के अित#र_ त रिजOQीकृत �कया गया था;
2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] और :वासी, एलटीटीई क9 हार के िलए भारत सरकार को उTरदायी मानते Iए �ीलंका के तिमल6 के म= य भारत िवरोधी भावनाL को इंटरनेट पोट�ल पर लेख6 के मा= यम से फैलाना जारी रखे Iए ह4 और इस तरह इंटरनेट के मा= यम से ऐसे :चार से, भारत म� अित महEवपूण� `िaय6 क9 सुर2ा पर :ितकूल :भाव पड़ने क9 संभावना ह;ै और जब�क उपरो_ त कारण6 से क� cीय सरकार क9 यह राय है �क एलटीटीई एक िविधिव@A संगम ह ैऔर सभी संभव साधन6 Xारा ऐसे सभी पृथकतावादी �Bयाकलाप6 को िनयंि3त करने क9 आव� यकता ह;ै और जब�क क� cीय सरकार को यह जानकारी ह ै�क — (i) एलटीटीई के शेष काडर, सहानुभूित रखने वाल6 और समथ�क6 के �Bयाकलाप6 से (िजनका हाल ही म� तिमलनाडु रा1 य म� पता चला ह)ै यह संकेत िमलता ह ै �क उa काडर जो तिमलनाडु म� भेजे गये ह4 अंितम dप से एलटीटीई Xारा िविधिव@A �Bयाकलाप के िलए उपयोग �कये जाएंग�; (ii) भारत सरकार क9 जानकारी म� यह आया ह ै�क :ितबंध6 के :वत�न म� होने के बावजूद एलटीटीई समथ�क संगठन और f यि_ तय6 के �Bयाकलाप एलटीटीई को उनका समथ�न देने म� :यासरत ह4; (iii) एलटीटीई के नेताL और समथ�क6 ने उनके संगठन म� भारत क9 नीित और उनके �Bयाकलाप6 को िनयंि3त करने म� रा1 य तं3 Xारा क9 गई कार�वाई का िवXषेतापूव�क िवरोध �कया ह;ै और जब�क क� cीय सरकार क9 यह राय ह ै�क एलटीटीई के उपरो_ त �Bयाकलाप भारत क9 :भुता और रा1य 2े3ीय अखंडता के साथ ही साथ लोक शांित के िलए भी खतरा है और इसिलए इसे िविधिव@A संगम घोिषत �कया जाना चािहए; और जब�क क� cीय सरकार क9 यह और राय ह ै�क— (i) _ य6�क एलटीटीई के िहसांE मक और िवघटनकारी �Bयाकलाप जारी ह4, जो �क भारत क9 :भुता और रा1य 2े3ीय अखंडता पर :ितकूल :भाव डालते ह4; और (ii) एलटीटीई ने लगातार :बल भारत िवरोधी @ख अंगीकृत �कया है जो भारत क9 सुर2ा को गंभीर खतरा भी :O तुत करता ह,ै इसिलए, एलटीटीई को तुरंत :भाव से िविधिव@A संगम घोिषत करने क9 आव� यकता ह;ै अत: अब क� cीय सरकार, िविधिव@A �Bयाकलाप (िनवारण) अिधिनयम, 1967 (1967 का 37) क9 धारा 3 क9 उपधारा (1) और (3) के Xारा :दE त शि_ तय6 का :योग करते Iए िलबरेशन टाइगस� और तिमल ईलम (एलटीटीई) को एक िविधिव@A संगम घोिषत करती है और यह िनदशे दतेी है �क उ_ त अिधिनयम क9 धारा 4 के अधीन �कए गए �कसी आदशे के अधीन रहते Iए, यह अिधसूचना राजप3 म� :काशन क9 तारीख से ही :वृT होगी । [[[[फा....सं. 11034/4/2018-सीटी-II]]]] पीयूष गोयल, , , , संयु_ त सिचव MINISTRY OF HOME AFFAIRS NOTIFICATION New Delhi, the 14th May, 2019 S.O. 1730(E).—WHEREAS the Liberation Tigers of Tamil Eelam (hereinafter referred to as the LTTE), is an association based in Sri Lanka but having its supporters, sympathisers and agents in the territory of India;
AND WHEREAS the LTTE’s objective for a separate homeland (Tamil Eelam) for all Tamils threatens the sovereignty and territorial integrity of India, and amounts to cession and secession of a part of the territory of India from the Union and thus falls within the ambit of unlawful activities;
AND WHEREAS the LTTE, even after its military defeat in May, 2009 in Sri Lanka, has not abandoned the concept of ‘Eelam’ and has been clandestinely working towards the ‘Eelam’ cause by undertaking fund raising and propaganda activities and the remnant LTTE leaders or cadres have also initiated efforts to regroup the scattered activists and resurrect the outfit locally and internationally;
AND WHEREAS the separatist Tamil chauvinist groups and pro-LTTE groups continue to foster a separatist tendency amongst the masses and enhance the support base for LTTE in India and particularly in Tamil Nadu, ¹Hkkx IIµ[k.M 3(ii)] Hkkjr dk jkti=k % vlk/kj.k 3 it will ultimately have a strong disintegrating influence over the territorial integrity of India, hence, the strong need continues to exist to control all such separatist activities by all possible lawful means;
AND WHEREAS cases were registered under the Unlawful Activities (Prevention) Act 1967, against LTTE, pro-LTTE elements and chauvinist groups since the last notification of the Government of India in the Ministry of Home Affairs vide number S.O. 1272 (E), dated the 14 th May, 2014 that is between May, 2014 and May, 2019 besides cases under the provisions of Explosive Substances Act 1908, Indian Penal Code, etc.;
AND WHEREAS the Diaspora continue to spread through articles in the Internet portals, anti-India feeling amongst the Sri Lankan Tamils by holding the Government of India responsible for the defeat of the LTTE and such propaganda through Internet, which remains continued, is likely to impact Very Very Important Persons (VVIP) security adversely in India;
AND WHEREAS for the reasons aforesaid, the Central Government is of the opinion that the LTTE is an unlawful association and there is a continuing strong need to control all such separatist activities by all possible means;
AND WHEREAS the Central Government has the information that –
(i) the activities of the LTTE remnant cadres, dropouts, sympathisers, supporters who have been traced out recently in the State of Tamil Nadu suggest that the cadres sent to Tamil Nadu would ultimately be utilised by the LTTE for unlawful activities;
(ii) the activities of pro-LTTE organisations and individuals have come to notice of the Government of India that despite the ban in force, attempts have been made by these forces to extend their support to the LTTE;
(iii) the LTTE leaders, operatives and supporters have been inimically opposed to India’s policy on their organisation and action of the State machinery in curbing their activities;
AND WHEREAS the Central Government is of the opinion that the aforesaid activities of the LTTE continue to pose a threat to, and are detrimental to, the sovereignty and territorial integrity of India as also to the public order and, therefore, it should be declared as an unlawful association;
AND WHEREAS the Central Government is further of the opinion that—(i) because of the LTTE’s continued violent and disruptive activities which are prejudicial to the integrity and sovereignty of India; and (ii) the LTTE continues to adopt a strong anti-India posture as also continues to pose a grave threat to the security of Indian nationals, it is necessary to declare LTTE as an unlawful association with immediate effect;
NOW, THEREFORE, in exercise of the powers conferred by sub-sections (1) and (3) of section 3 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby declares the Liberation Tigers of Tamil Eelam (the LTTE) as an unlawful association and directs that this notification shall, subject to any order that may be made under section 4 of the said Act, have effect on and from the date of its publication in the Official Gazette.
