No. 128 F4-129-2014-XVIII-1.- In exercise of the powers conferred by sub-section (1) and sub-clause (a) and (b) of clause (iv) of sub-section (2) of section 355 read with sub-section (1) of section 86 of the . Madhya Pradesh Municipalities Act, 1961(No. 37 of 1961), the State Government, hereby makes the following rules namely.- RULES 1- Short title and commencement -
(1) These rules may be called the Madhya Pradesh State Urban Engineering Service (Recruitment and Conditions of Service) Rules, 2015.
(2) They shall come into force from the date of their publication in the Madhya Pradesh Gazette.
2- Definitions.« In these rules, unless the context otherwise requires,-
(a) "Act" means the Madhya Pradesh Municipalities Act, 1961 (No. 37 of 1961);
(b) "Appointing authority" in respect of service or post means the Government or competent authority;
(c) "Commission" means the Madhya Pradesh Public Service Commission;
(d) "Commissioner" means the Commissioner,' Urban Administration and Development, Madhya Pradesh;
(e) "Committee" means the Departmental Promotion committee/selection committee;
(f) "Disciplinary Authority" means an authority, as prescribed in column (7) of . Schedule I;
(g) "Examination" means a competitive examination for recruitment to the service held under rule 12;
(h) "Government" means the Government of Madhya Pradesh;
(i) "Other Backward Classes" means the Other Backward Classes of citizens as specified by the State Government vide notification No. F-8-5/2S/4/84 dated 26 December, 1984 as amended from time to time;
(j) "Selection Institute" means Institute, Agency, Public Sector Unit or any autonomous body prescribed by the State Government for selection from time to time.
(k) "Schedule" means Schedules appended to these rules;
(I) "Scheduled Castes" means any caste, race or tribe or part of or group within a caste, race or tribe specified as Scheduled Castes with respect to the State of Madhya Pradesh under article 341 of the Constitution of India;

(m) "Scheduled Tribes" means any tribe or tribal community or part of or group within a tribe or tribal community specified as scheduled tribes with respect to the State of Madhya Pradesh under article 342 of the Constitution of India;
(n) "Service" means the State Urban Engineering Service;
(0) "State" means the State of Madhya Pradesh.
3- Scope and application.- without prejudice to the generality of the provisions contained in the Madhya Pradesh Civil Service (General Conditions of Service) Rules, 1961, these rules shall apply to every member of the Service.
4- Constitution of the Service.- The Service shall consist of the following persons, namely:-
(i) persons, who at the time of commencement of these rules, are holding any post substantively or in the officiating capacity, as specified in Schedule I;
(ii) persons, recruited to the service before the commencement of these rules; and
(iii) persons, recruited to the service in accordance with the provisions of these rules.
5- Classification, scale of pay etc- The classification of the service, the number of posts included in the service and scale of pay attached therero shall be in accordance. with the provision contained in Schedule-I:
Provided that the Government may, from time to time, add to or reduce the number of posts included in the service on permanent or temporary basis.
6- Method of recruitment>
(1) Recruitment to the service or post after the commencement of these rules shall be made by the following methods, namely:-
(a) by direct recruitment through examination, interview or both;
(b) by promotion of the members of the service as specified in Schedule IV;
(c) by transfer of persons who are holding in substantive capacity, such posts in such services as may be specified in this behalf.
(2) The number of persons recruited under clause (b) or clause (c) of sub-rule (1) shall not, at any time, exceed the percentage as shown in Schedule II and the number of posts as specified in Schedule-I.
(3) Subject to the provisions of these rules, the method or methods of recruitment to be adopted for the purpose of filling any particular vacancy or vacancies in the service as may be required to be filled during any particular period of recruitment and the number of persons to be recruited by each method shall be determined on each occasion by the Appointing Authority.

(4) Notwithstanding anything contained in sub-rule (1), if in the opinion of the Appointing Authority, the exigencies of the service so require, the Appointing Authority may, after obtaining prior concurrence of the General Administration Department, adopt such method of recruitment to the service other than those specified in the said rule, as may, by order be issued in this behalf.
7- Appointmentto the Service.-
(1) All appointments to the service after the commencement of these rules shall be made by the Appointing Authority and no such appointment shall be made except after selection by one of the methods of recruitment specified in rule 6.
(2) Appointment to class-Il posts as specified in schedule I shall be made by the State Government through Madhya Pradesh Public Service Commission.
(3) Appointment to class-III service shall be made by the Commissioner through a selection institute prescribed by the State Government.
8- Conditions for eligibility of direct recruitment.- In order to be eligible for a selection, a candidate must satisfy the following conditions, narnely.-
(a) Age.-
(i) Minimum and maximum age limits shall be in accordance with the notifications issued by General Administration Department from time to time. Age shall be calculated on the first day of coming January following the date of advertisement.
(ii) The Upper age limit shall be relaxable as under.-
(a) Relaxation shall be admissible to employees of Government of Madhya Pradesh and State Corporations/Board, Autonomous Bodies, Contingency paid employees and Work charged employees as per circulars issued from time to time by General Administration Department;

(c) Relaxation shall be admissible to native Woman candidates of Madhya Pradesh as per Madhya Pradesh ci-n Service (Special provision for Appointment of Women) Rule, 1997;
(d) Relaxation shall be admissible to the ex-servicemen of natives candidate's of Madhya Pradesh as per rule 5 of Madhya Pradesh Exservicemen (Reservation of Vacancies in. the State Civil Services and Posts Class III and Class IV) Rules, 1985;
(e) Relaxation shall be admissible to the following classes as per circulars issued from time to time by the General Administration Department of Government of Madhya Pradesh;
(i) WidowlDestitute Woman/Divorcee Woman;
(ii) Physically handicapped person;
(iii) Green Cardholder under Family Planning programme;
(iv)· Vikram awarded sportsperson;
(v) Awarded Upper Caste Partner of a couple under the Inter Caste Marriage incentive programme;
(vi) Other Categories specified by the General Administration Department, Government of Madhya Pradesh Note: (1) In any case, maximum age limit including all relaxations for any class shall not exceed the maximum age limit of 45 years fixed by the General Administration Department, Government of Madhya Pradesh.
(2) The calculation of the upper age limit shall be as per the General Administration Department's Circular No. C-3- 11112/113Dated and 20-11-2012 and 03-11-2014 as amended from time to time.
(b) Educational qualification.- Candidates must possess the educational qualifications prescribed under column (5) of Schedule III.
(c) Fee.- Candidates shall pay the fees prescribed by the Commission or selection Institute.
9. Disqualification.
(1) Any attempt on the part of candidate to obtain support for his candidature by any means shall render him liable to be disqualified by the appointing authority for appearing in the examination/selection.
(2) No candidate shall be eligible for appointment to the service or a post, who has married before attaining the minimum age fixed for marriage.

(3) No male candidate who has more than one wife living and no female candidate who has married a person having a wife living, shall be eligible for appointment to any service or post.
(4) A candidate shall not be eligible for any service or post if he has more than two living children and one of whom is born on or after 26th January, 2001:
Provided that no candidate shall be disqualified for appointment to a service or post who already has one living child and next delivery takes place on or after 26th January, 2001 in.which two or more than two living children are born.
(5) No candidate shall be eligible for the appointment to any service or post who has been convicted for an offence against the women:
Provided that if such case is pending in a court against the candidate, his -. appointment shall be kept pending till the final decision of the criminal case.
10- Appointing authority's decision shall be flnal.- The decision of the Selection Institute or appointing authority about the eligibility or disqualification of candidate for appearing in examination! Interview or both shall be final.
11- Direct recruitment by competitive examination/selection.-
(l)The competitive examination! selection for recruitment to the service shall be held at such intervals, as the Appointing Authority may, in consultation with the State Government or Commission, as the case may be, determine from time to time.
(2) For the posts to be filled through Selection Institute the examination shall be conducted by the Selection Institute in accordance with such orders as the State Government, may from time to time issue.
(3) There shall be reserved posts for the persons belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes at the stage of direct recruitment in accordance with the provisions of in the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Evam Anya Pichhade Vargon ke liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994) and orders issued by the State Government from time to time.
(4) At the time of filling the vacancies so reserved, candidates who are members of the Scheduled Castes, Scheduled Tribes and Other Backward Classes shall be considered for appointment in the order in which their names appear in the list referred to in rule 12, irrespective of their relative ranks as compared with other candidates.
(5) Candidate belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes considered by the Appointing Authority to be suitable for appointment to the service with due regard to the maintenance of the efficiency of administration, may be appointed to the vacancies reserved for the candidates of 11~ ~, ~ 12 ~ 2015 216 (23) the Scheduled Castes, Scheduled Tribes and Other Backward Classes, as the case may be.
(6)There shall be reserved posts for the women candidates, in accordance with the provisions of the Madhya Pradesh Civil Service (Special Provisions for Appointment of Women) Rules, 1997.
(7) There shall be reserved posts for handicapped candidates in accordance with the circular of the General Administration Department.
(8) There shall be reserved posts for ex-serviceman in accordance with the circular of the General Administration Department.
(9) In such cases, where experience of some period has been prescribed as an essential .
conditions for the posts to be filled in by direct recruitment and it is found in the opinion of the Appointing Authority that there is a possibility, the candidates belonging to the Scheduled Castes, Scheduled Tribes, and Other Backward Classes, may not be available in sufficient number, the Appointing Authority may relax the conditions of experience to the candidates of Scheduled Castes, Scheduled Tribes and Other Backward Classes in consultation with the General Administration Department.
(lO)If sufficient number of candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes are not available for fining all the vacancies reserved for them, the remaining vacancies shall not be filled by other candidates and vacancies shall be kept reserved for candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes for next selection.
12. List of candidates recommended for appointment to the posts of service.-
(1) The Appointing Authority shall prepare and forward a list arranged in order of merit of the candidate, who have qualified by such standard as determined by the Appointing Authority and a list of the candidates belonging to the Scheduled Castes, Scheduled Tribes and Other Backward Classes, who though not qualified by that standard but are declared by the Appointing Authority to be suitable to the service with due regard to the maintenance of efficiency in administration and the list shall also be published for general information.
(2) Subject to the provisions of these rules and the Madhya Pradesh Civil Service (General Condition of Service) Rules, 1961, candidates shall be considered for appointment to the available vacancies in order in which their names appear in the list.
(3) The inclusion of candidate's name in the list confers no right to appointment unless the Government is satisfied after such enquiry, as it may be consider 216 (24) 11~ ~, ~ 12 ~ 2015 necessary, that the candidate is suitable in all respects for appointment to the service.
(4) The select list shall be valid for a period of one year from the date of issue that may be extended for the period of six month with concurrence of the Government (in case of Sub-Engineer) and Commission (in case of Assistant Engineers)
13. Appointment by promotion.-
(1) Promotion up to the post of Executive Engineer shall be on the basis of seniority subject to fitness. Promotion for the higher posts shall be on the basis of meritcum- seniority i.e. in case of equal merit, seniority shall be considered.
(2) There shall be constituted a committee consisting of members as mentioned in Schedule IV, for making a selection for promotion of eligible candidates:
Provided that if the nominated members other than the member presiding the Departmental Promotion Committee in respects of the posts to be filled up by promotion do not represent the category of Scheduled Castes or Scheduled Tribes, then one member belonging to the Scheduled Castes or Scheduled Tribes category of the same status shall be included in the Departmental Promotion Committee shall be extended to that limit.
(3) The promotion of members of the service specified in column (2) of Schedule-Tv to the posts as specified in column (3) thereof, the eligibility of candidate, selection process, reservation in promotion an appointment by promotion shall be in accordance with prevailing rules and with the provision as specified in the Madhya Pradesh Public Service (Promotion) Rule, 2002 for the post to be filled through commission.
(4) Certificationby the Appointing Authority.- Appointing Authority shall endorse On the promotion order to be issued by him a certificate to the effect that he has complied with the provisions of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon AuI' Anya Pichhede Vargon ke liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994) and the Madhya Pradesh Public Service (Promotion) Rule, 2002 and the instruction issued in the light of the provisions of the said Act and the rules by the State Government and that he has taken full cognizance of the provision of sub-section (1) of section 6 of the said Act.
14. Condition of eligibility for promotion.- (1) The Committee referred to in sub-rule (1) of rule 15, shall consider the cases of all persons, who on the 1st day of January of that year, had completed such number of years of service (whether officiating or substantive) in the posts from which promotion is to be made or on any other post or posts declared equivalent thereto by the Government as specified in column (3) of the schedule-Tv and are within the zone of consideration in accordance with the provisions of sub-rule (3):

Provided that no junior person shall be considered for selection, selectiee grade/promotion in preference to the persons senior to him, only on the basis ~j,Yr completing the prescribed period of service.
l5.. Preparation of the list of suitable candidates for promotion.- . (1) The Departmental Promotion Committee shall prepare a list of such persons wt~/};
satisfy the conditions prescribed in rule 14 and are held by the committee to m:
suitable for promotion to the service according to the provisions of the Madhya Pradesh Public Service (Promotion) Rules, 2002. The list shall be sufficientte cover the anticipated vacancies on account of retirement/promotion during the course of one year from the date of preparation of the select list. A reserve fi!ft consisting of 25 percent number of persons, included in the said select list shalf also be prepared to meet the unforeseen vacancies occurring during the course 'Of the aforesaid period.
(2) The criteria of preparation for select list shall be as per the provisions of-Madhya Pradesh Public Service (Promotion) Rules, 2002.
(3) The names of persons included in the select list shall be arranged in order olf seniority in the service or posts as specified in column (2) of Schedule IV at ttK:
time of preparation of each select list. Whenever promotion is to he made on ·tbe basis of merit-cum-seniority the select list shall be prepared as per the provisions of the Madhya Pradesh Public Service (Promotion) Rules, 2002.
U5. Appointment to the service from the select list.-
(1) Appointment of the persons included in the select list to the posts born on true cadre of the service shall follow the order, in which the name of such persons appear in the select list.
(2) It shall not ordinarily be necessary to consult Commission before the appointmesa of a person whose name is included in the select list in the service unless during the period intervening between the inclusion of his name in the select list and tt.-.<e dates of his proposed appointment~there occurs any deterioration in his wm«C which in the opinion of the Government in such as to render him unsuitable t~~r appointment to the service.
n. Probation.- Every person directly recruited to the service shall be appointed on probaties for a'period of two years.
H). Interpretation:- If any question arises relating to the interpretation of these rules, it sha[~ be referred to the Government, whose decision shall be final.

19. Relaxation: Nothing in these rules shall be construed to limit or abridge the powers of the Governor to deal with the case of any person, to whom these rules apply, in such manner, as may appear it to be just and equitable:
Provided that no case shall be dealt with in any manner less favorable to a person than that is provided in these rules.
20. Saving. - Nothing in these rules shall affect reservation, and other conditions required to be provided for Scheduled Castes, Scheduled Tribes and Other Backward Classes in accordance with the. rules made or instructions/ order issued by the State Government from time to time, in this regard.
21. Repeal and Saving - All rules corresponding to these rules in force immediately before their commencement are hereby repealed in respect of matters covered by these rules:
Provided that any order made or action taken under the rules repealed shall be deemed to have been made or taken undercorresponding provision of these rules.
