इस विभाग की अधिसूचना क्रमांक 14-पांच-पूआ. तारीख 7 जनवरी, 1960 द्वारा प्रकाशित रूलस आफ जनरल एप्लीकेशन में निम्नलिखित संशोधन करती हैं, जिसका धारा 62 की उपधारा (3) द्वार अपेक्षित किए गए. अनुसार “मध्यप्रदेश राजपत्न' में पूर्व में प्रक्राशन किया जा चुका है, अर्थात् :-- संशोधन उक्तनियमों में, नियम 1 के स्थान पर निम्नलिखित नियम स्थापित'किया जाए,अर्थात् -- “1, दुकानोंकी अवस्थिति-(1) किसी फुटकरःदुकान को परिसर में मदिरा का 'ठपभोग करने के लिए अनुज्ञप्ति देतेसमय मफ मिम्नलिखित स्थितियों परविचार किया जाएगा, यदि दुकान,-- (कै) किसी मिल, कारखाने या' अन्य स्थान के, जहाँ श्रमिकों का विशालसंपूहनियोजित हो, आसपास में है, तो मिल के स्वामी या श्रमिकों के पैसे नियोजक को ऐसी दुकान खोलने के प्रस्ताव पर उनकी आपत्तियोंको कथित करने का अवसर दिया गया है.

(2) दुकान की स्थिति ऐसी होगी कि उसमें प्रवेश करने वाला व्यक्ति देखे जाने से बच न सके, परन्तु वह ऐसी सुस्पष्ट भी नहीं होंगी कि गुजरने वाले व्यक्ति उस ओर ध्यान देने को बाध्य हो जाएं,
(3) यदि ऐसी अनुज्ञप्ति मंजूर किए जाने के पश्चात्, किसी भी समय, उप नियम (1) के झण्ड (ख)में निर्दिष्ट कोई संस्था (शैक्षणिक याधार्मिक), अस्पताल या बस स्टेण्ड आदि, उस दुकान से पत्नास मीटर या उससे कम कौ दूरी के भीतर अस्तित्व में आते हैं तो परिसर में उपभोग के लिए अनुज्ञप्त कोई मदिरा दुकान, उप निदाम (1) के खण्ड (ख)में निर्दिष्ट प्रतिषिद्ध दूरी के भीतर स्थित नहीं समझी जाएगी |श परन्तु इस नियम के उपबंध निम्नलिखित को लागू नहीं होंगे :- (क) ऐसी दुकान को, जो तारीख 31 मार्च, 1996 को पिछले तीन वर्षों से वर्तमान स्थल पर विद्यमान हीं हों, (खत) प्ररूप एफ. एल.-1 जौ में अनुज्ञप्ति धारण करने वाली दुकानों को, यदि वे उप नियम (2) के उपबंधों का अनुपालन करती हों स्पष्टीकरण.--इस नियम के प्रयोजनों के लिए-- । (क) “शैक्षणिक संस्था” से अभिप्रेत है किसी स्थानीय प्राधिकारी या राज्य सरकार अथवा केंद्रीय सरकार द्वारा प्रबंधित या मान्यता प्राप्त कोई पूर्व प्राथमिक, प्राथमिक या सेकण्डरी स्कूल औरविधिद्वारा स्थापित किसी विश्वविद्यालय सेसंबद्ध कोई महाविद्यालय किन्तु इसमें कोचिंग संस्था सम्मिलित नहीं है, (ख) “धार्मिक संस्था'' से अभिप्रैत हैं ऐसी संस्था जो किसी धर्म की प्रोन्नतिके लिए हो, और उसमें सम्मिलित है ऐसा मंदिर, मठ, मस्जिद, गिरजाघर या सार्वजनिक धार्मिक पूजा का अन्य स्थान, जिनका मध्यप्रदेश पब्लिक ट्स्ट एक्ट, 1951 या तत्समय प्रवृत्त किसी अन्य अधिनियमिति के अधीन रजिस्ट्रीकृत किसी लोक न्यास द्वाग प्रबंध किया जाता हो, या उसके स्वामित्व में हो और उसमें अन्य ऐसी धार्मिक संस्थाएं सम्मिलित होंगी, जैसा कि राज्य सरकार, आदेश द्वारा, इस निमित्त विनिर्दिष्ट करे.
(ग) उप नियम (1) के खण्ड (ख्) में निर्दिष्ट दूरी का माप, दुकान के प्रवेश के मध्य बिन्दु से ऐसे निकटतम मार्ग से किया जाएगा जिससे कोई पदांति (पिडेसट्रिंअत)-- (एक) यदि कोई अहाता दोबार है तो संस्था के निकटतम द्वार के मध्य बिन्दु तक और यदि कोई अहाता दीवार नहों है तो संस््थां के निकटतम प्रवेश के मध्य बिन्दु तक, या (दो) यदि कोई अहाता दीवार है तो मध्यप्रदेश राज्य सड़क परिवहन निगम के बच स्टेण्ड, स्टेशन या डिपो के निकटतम द्वार के मध्य बिन्द तक और यदि कोई अहातां दीवार नहीं है तो, ऐसे बेस स्टेण्ड, स्टेशन या डिपो की सीमा के निकटतम बिन तक साधारणत: पहुंचता है.

(ec), (fF) and (h) of sub-section (2) of Section 62 of the Madhya Pradesh Excise Act, 1915 (No, II of 1915), the State Government hereby makes the following amendment in the Rules of General Application published vide this Department Notification No. 14-V-SR dated 7th January 1960, the same have been previously published in the "Madhya Pradesh Gazelle" as required by sub-section (3) of Section 62, namely :— AMENDMENT In the said rules, for rule 1, the follawing rule shall be substituted, namely :— “|. Lecation of Shops.—{1) At the time: of granting licence to a retail shop for the consumpticn of liquor on the premises, the following conditions shall be considered if the shop is.—
(a) in the neighbourhood of a mill, factory or other place where a large body of labourers is employed, the: mill owner of such employer of labourers an opportunity of stating. their objections to the proposal for opening of such shop has been given.
(b) near a religious or any educational institulion a hospital, a colony of members of Scheduled Castes, a labour colony, or a bus stand, railway station, national highway, a state highway or where the sanction of the State Government is obtained except when such shop is situated ata distance of 50 meters or more from such place.
(2) The position of a shop shall be such that no person entering it shall escape observation, but it shall not be so prominent as to compel attention of persons passing by.
(3) Any liquor shop licensed for consumption on the premises shall not be deemed to be. situated within prohibited distance referred to in clause (b) of sub-rule (1), if at any time after such licence is granted, any institution (education or religious), hospital, or bus stand ete. referred to in clause (b) of sub-rule (1) comes into existence within a distance of fifty meteres or Icss from that shop :
Provided that the provisions of this rule shall not apply (a) to a shop which is existing at the present site for the last three years as on 31 March 1996, (b) to shops, holding licence in form F.L, 5 1B if they comply with the provisions of sub-rule (2),
Explanation.—for the purposes of this rule—
(a) “Educational institution" means any pre-primary, primary or secondary school managed or recognised by any local authority or the State Government or the Central Government and any college affiliated to any University extablished by law, but docs not include any coaching institution.

(b) “Religious institution” means an institution for the promotion of any religion and includes temple, math, mosque, church or other place of public religious worship which is managed or owned by a public trust registered under the Madhya Pradesh Public Trusts Act, 1951 or any other enactment for the time being. in force and shall include such other religious institutions as the State Government may by order specify. in this: behif.
(c) The distance referred to in clause (b) of sub-rule (1) shall be measured from the mid point of the entrance of the shop along the nearest path by which a pedestrian ordinarily reaches,—
(i) The mid point of the nearest gate of the institution if there is a compound wall and if there is no compound wall the mid point of the nearest entrance of the institution, or
(ii) The mid point of the nearest pate of the Bus stand, Station or depot ux Madhya Pradesh State Road Transport Corporation if there is a compound wall and °*f there is. no compund wall the nearest point of the boundary of such Bus: stand, static. or depot.
(d) “Bus Stand" means bus stand of MPSRTC or of Municipal Corporation or any other local body) us the case may be,
(e) "Hospital" means any hospital or nursing home run by State or Central Government or by any “Charitable institution", where at least facilities of 10 Beds are available for admission and lrealment of 10 patients.
