Up to 5% of sanctioned intake per course shall be available to non-resident Indian candidates only, if they are available, in those private unaided professional educatiohal institution who have got approval of AICTE for filling the same. Candidates admitted against such scats will 'not be allowed to .change institution / course in any circumstances.
5: Procedure of admission against non-resident Indian scats.— (1) The Competent Authority shall conduct the centralized counseling process inviting applications through online / offline method for admission in order of merit against non-resident Indian seats. Detailed counseling process for these seats will be declared by the Competent Authority.
(2) If-sufficient number of non-resident Indian candidates are not available, then remaining vacant seats shall -be merged into general pool and shall be filled as per the procedure laid down in Admission Rules, 2008. ' •
(3) The eligible candidates interested in seeking admission against non-resident Indian seats, shall be required to submit following 'document to the Competent Authority :- Mark sheet of qualifying examination. If the Board / University from which candidate has passed his qualifying examination award marks in grade system, then the formula for conversion of grade into percentage marks shall apply. This formula should be certified by Indian Embassy / Indian consulate of that country. Candidates who have passed the qualifying examination from a country other than India are required to submit a certificate from the Indian Embassy I Indian consulate or Association of Indian Universities, New Delhi to the effect that the examination passed is equivalent to respective qualifying examination of Indian system;
proof of nationality;
certificate from Indian Embassy or Indian consulate of the country where non-resident Indian is residing to the effect that father / mother is non-resident Indian, or original passport of nonresident Indian or true copy of pages of passport certified by Indian Embassy or Indian consulate of the country, where don-resident Indian mother Mather is residing;
.(d) notarized affidavit of mother / father sponsoring their .son / daughter under non-resident Indian category;
(e) two passport size self attested photographs of the candidate.
(4) The Competent Authority shall verify the documents for eligibility of candidates as per stated norms as mentioned in the regulation and shall have the authority to cancel admission of non-eligible candidates. Competent Authority shall release the list of admitted candidates against non-resident Indian seats before commencemerit of counseling of general pool seats.
Conversion of vacant non-resident Indian seats.— Vacant non-resident Indian seats i.e. unfilled nonresident Indian seats or seats against which admission have been made but the candidate has not taken admission in the institution within stipulated time, shall be merged into general pool by competent authority and these seats shall be filled by competent authority as per the procedure adopted for general pool seats.
Cancellation of adinission.— The competent authority shall check the eligibility of candidates seeking admission against non-tesident Indian seats and shall be authorized to cancel admission of non-eligible candidates.
If at ad)/ stage, it is found that a candidate has been admitted on the basis of false or incorrect information or by hiding relevant facts or if at any time after admission it is found that the admission was given to the candidate due to some mistake or oversight, the admission granted to such a candidate shall liable to be cancelled forthwith without any notice at any tffne during the course of his studies, by the Head of the Institution or by Competent Authority.
Tuition and other fee.— Tuition and other fees shall be as prescribed by the Admission and Fee Regulation Committee.

Refund of fee.— If non-resident Indian candidate gets his admission cancelled before 7 days of last date of admission as declared by the Competent Authority or before 7 days of last date of centralized counseling (whichever is earlier), the balance deposited fee shall be refunded back after deducting 10% of the annual tuition fee fixed for the non-residential Indian seats.
Interpretation.— If any question arisesselating to the interpretation of these regulations, it shall be referred to the State Government, whose decision thereon shall be final.
Jurisdiction.— In case of any dispute the jurisdiction shall be limited to the courts constituted and situated in the State of Madhya Pradesh only.
Repeal and savings.— (1) The Admission (Reservation to non-resident Indian) Regulations, 2009 is hereby repealed.
(2) Notwithstanding the repeal of the said regulations, anythink done or any action taken under the said regulations shall be deemed to have been done or taken under the corresponding provision of these regulations.
