1. Short title and Commencement.-(1) These rules may be called the Madhya Pradesh Aviation Department (Gazetted-Technical) Service Recruitment and Service Condition Rules, 2003.
(2) They shall come into force form 19th September, 2003.

(1) RULES
PART-I GENERAL "Appointing Authority" means the State Government; "Appointment" means appointment on any post of, the service by the State Government; "Authorized Medical Authority" means a Medical Officer or Medical Board who is authorized to certify the compliance of established medical standards required in view of the discharge of duty of the members of the service; "Director" means the Director, Directorate of Aviation, Madhya Pradesh; 954 (9) "Directorate" means the Directorate of Aviation Madhya Pradesh; "Engineer"' means the Technical Officer working in the Directorate who maintains aero plane/helicopter and possesses its qualification; "Foreman'" means the Technical Officer working in the Directorate, who is involved in the supervision of the Technical staff and maintenance related work of the Aircraft; "Government" means the Government of Madhya Pradesh; "Governor" means the Governor of Madhya Pradesh; "Pilor" means the Technical Officer working in the Directorate who operates the flights of aeroplane/ helicopter and possesses its qualification; "Schedule" means a Schedule appended to these rules: "Service'" means Madhya Pradesh Aviation Department (Gazeteed-Technical) Service which includes the services of Pilots, Engineers and Foreman. af 954 (10)
3. Scope and Application.-Notwithstanding anything contained in the Madhya Pradesh Civil Service (General Conditions of Service) Rules, 1961 these rules shall apply to every member of the service.

4. Constitution of the Service.The Service shall consist of the following persons, namely:

(b) Ihose persons who were working with the Madhva Pradesh Flying Club before the formation of the Directorate on lst June, 1982 and who have since been absorbed in the Directorate on date. Those persons, possessing qualification and experience as specified in Schedule-ll, who are/were in employment with the Government of India or other State Government (s) and may be provided employment by the Government on Deputation or on contract. Inose persons, poSsessing qualifications and experience as specified in Schedule-II, who are/were in employment with other organizations of th� country, and, who may be provided employment on contract basis, by the Government, on the basis of open competition.
5. Classification, the Scales of Pay etc.(a) The classification of service, the pay scales thereof and the number of posts included in the service, shall be as specified in Schedule-I. However, the Government may add to, or, reduce the number of posts included in the service, either on a permanent, or, tenmporary basis.
(b) No member of the service shall be entitled to compensation, in consequence of, any change in the structure of the service, or, in the event of unfilled by the Gvoernment, or, holding in abeyance, a vacant post in the cadre.
6. Initial Appointment in the Service.) All initial appointment under these rules shall be made by the State Government from time to time keeping in view the requirements of the Department, under those conditions, as specified by the government in the service Conditions of Technical Officers Class-I and Il, of the Directorate, in accordance with any one of the following methods : on the basis uf Deputation;
PART-III APPOINTMENT shall be obtained later. Contractual Employment on the basis of Open competition.
(2) For the appointment, under clause (b) of sub-rule (1) the State Government shall issue an advertisement in news papers for inviting application, eligible candidates shall be called for interview. The interview board shall be constituted as mentioned in sub ule (3) of rule 14. The interview board may recommend suitable names for appointment including waiting list.
(3) Notwithstanding anything contained in sub-rule (1), ifin the opinion of the Government immediate and exigency of the service so requires, the Government may adopt such other methods of recruitment to the service, in addition mthose specified in the said sub-rule, in respect of the appointment ofa suitable candidate., to be regulated by a specia order isued by the Government in anticipation of the approval of the cabinet. 8. Technical Qualifications and Experience.--The technical qualifications and experience for the appointment shall be such as specified in Schedule-II.
9. Character.--The character of the applicant must be such, which completely qualify for his employment with the Government, and his working experience should be undisputed, unsuspicious, unobjectionable and unblemished charàcter.
10. Physical and Mental Fitness.-() The Candidate must be healthy, smart and free form any kind of organic defect or bodily infirmity and shall fulfill the required health related standards established by the approved Medical Authority:
(2) the Pilot/Engineers shall be responsible to keep there licence valid (i.e. they shall appear before the approved Medical Authority at least before such time as to complete the specified formalities directed by the approved Medical Authority in adequate time, for the continuity of the validity of the Licence) However, the Government will provid� all necessary facilities to the concerned Pilot/Engineer towards the renewal, endorsement (if so necessary) of the licence (s) all necessary examination specified by the Medical Authority towards the renewal of the Medical Examination and timely completion of all formalities, as per rules, specified by the Director General of Civil Aviation, Government of India, in respect of the licence.
11. Disqualification.-Any attempt on the part of a candidate to obtain support for his candidature, by any means, may be held by the Appointing Authority, to disqualify him for the appointment.
12. Final Decision in respect of Appointment.-The decision of the Government, in respect of employment, shall be final and binding on the candidate.
13. Necessary Arrangement for work Proficiency.-In order to enhance the Technical Proficiency and Administrative Capability of the various members of the service, the arrangement for the necessary training (s), from time to time, shall be specified by' the Government.
14. Procedure for Appointment by Promotion.(I) The Technical Officers (Pilot/Engineer) of the Directorate shall remain in the pay scale of Junior post during the first 6 years of service, working experience of 4 years for Senior post and thereafter, further 4 years of working experience with excellent discharge of duties for Senior Selection Grade/Post>.
(2) After having attained the ability/qualification/experience as specified in Schedule-II, the Government shal' consider the case of suitable officers of the service for promotion who is entitle for promotion to the higher post as mentioned in annexure-iv, on the recommendation of the Director and the decision of the Government in respect of the promotion shall be final and binding.
(3) On the recommendation of the Director under sub-rule (2), the Government shall constitute a promotion committee comprising of Principal Secretary (home), Principal Secretary (Aviation), Director of Aviation and invite a subject expert of that service. The Promotion committee shall consider the promotion proposal and shall apprise the Principal Secretary Aviation Department with its recommendation. The Government shall takea final decision for giving promotion in accordance with the recommendation of the committee.
(4) Even After having attained the ability/qualification/experience specified for the next higher post, of no higher post exists for the promotion in the cadre, due to any reason the Government on the recommendation of the Direetor shall adopt such procedure as may be deemed appropriate, to take necessary decision for the sanction of that pay scale of the higher post, to that technical officer of the service, who has continuous excellent service record, and, is deprived of promotion due to the non availability of the higher post. 954 (12)
2. Katio of direct Recruitment/Promotion Posts.-There shall be no separate ratio for all the posts as mentioned In Schedule-1, for Direct Recruitment or by Promotion., ie. the Government shall use its disCTeuo O ne Posts by direct recruitment or by promotion keeping in view of the requirements of the Departmenl.
16. Applicability of Reservation AcURules/Orders.The Appointing Authority shall ensure the compliance of all Reservation Ac/Rules/Orders applicable and in force at the time of recruitment or Promouol. I1. Seniority.-The inter seniority of the members of the service shall be determinéd by the Government, as per the provisions of the Madhya Pradesh Civil Services (General Conditions of Service) Rules, 1961. T6. Gradation List.-The Government shall keep a gradation list, showing the names of the members of the service in their order of seniority. I9. Pay.The pay of the members of the service, for various posts of the service, shall be such as specified in Schedule-I, or as may be determined by the Government.
20. Allowance.-The allowances normally granted by the Gvoernment, from time to time, shall be payable to the members of the service. However, in addition to the said allowances the special allowances shall also be payable to the members of the service as specified in Schedule-lll, after approval of the Gvoemment, from time to time, keeping in view the laboriousness of the services of the technical officers.
21. Conduct Rules.-The members of the service shall be governed by the Madhya Pradesh Civil Services (Conduct) Rules, 1965. qye TGYA, fÍA 19 fLa 2003 2 S. No.

22. Relaxation.-Nothing in these rules shall be construed to limit, or abridge the power of the Government. to deal with the case of any person, to whom these rules apply, in such manner, as may appear to it. to, be just and equitable:
Provided that. where any tule is relaxed /n the case of any person, the case shall not be dealt with, in any manner less favorable to him, than that provided in these rules.
23. Interpretation.If any question arises relating to the interpretation of these rules, it shall be refermed to the General Administration Department to the Government, whose decision thereon, shall be final. 1. Short title and Commencement.-(1) These rules may be called the Madhya Pradesh Aviation Department (Gazetted-Technical) Service Recruitment and Service Condition Rules, 2003.
(2) They shall come into force form 19th September, 2003.

(1) RULES
PART-I GENERAL "Appointing Authority" means the State Government; "Appointment" means appointment on any post of, the service by the State Government; "Authorized Medical Authority" means a Medical Officer or Medical Board who is authorized to certify the compliance of established medical standards required in view of the discharge of duty of the members of the service; "Director" means the Director, Directorate of Aviation, Madhya Pradesh; 954 (9) "Directorate" means the Directorate of Aviation Madhya Pradesh; "Engineer"' means the Technical Officer working in the Directorate who maintains aero plane/helicopter and possesses its qualification; "Foreman'" means the Technical Officer working in the Directorate, who is involved in the supervision of the Technical staff and maintenance related work of the Aircraft; "Government" means the Government of Madhya Pradesh; "Governor" means the Governor of Madhya Pradesh; "Pilor" means the Technical Officer working in the Directorate who operates the flights of aeroplane/ helicopter and possesses its qualification; "Schedule" means a Schedule appended to these rules: "Service'" means Madhya Pradesh Aviation Department (Gazeteed-Technical) Service which includes the services of Pilots, Engineers and Foreman. af 954 (10)
3. Scope and Application.-Notwithstanding anything contained in the Madhya Pradesh Civil Service (General Conditions of Service) Rules, 1961 these rules shall apply to every member of the service.

4. Constitution of the Service.The Service shall consist of the following persons, namely:

(b) Ihose persons who were working with the Madhva Pradesh Flying Club before the formation of the Directorate on lst June, 1982 and who have since been absorbed in the Directorate on date. Those persons, possessing qualification and experience as specified in Schedule-ll, who are/were in employment with the Government of India or other State Government (s) and may be provided employment by the Government on Deputation or on contract. Inose persons, poSsessing qualifications and experience as specified in Schedule-II, who are/were in employment with other organizations of th� country, and, who may be provided employment on contract basis, by the Government, on the basis of open competition.
5. Classification, the Scales of Pay etc.(a) The classification of service, the pay scales thereof and the number of posts included in the service, shall be as specified in Schedule-I. However, the Government may add to, or, reduce the number of posts included in the service, either on a permanent, or, tenmporary basis.
(b) No member of the service shall be entitled to compensation, in consequence of, any change in the structure of the service, or, in the event of unfilled by the Gvoernment, or, holding in abeyance, a vacant post in the cadre.
6. Initial Appointment in the Service.) All initial appointment under these rules shall be made by the State Government from time to time keeping in view the requirements of the Department, under those conditions, as specified by the government in the service Conditions of Technical Officers Class-I and Il, of the Directorate, in accordance with any one of the following methods : on the basis uf Deputation;
PART-III APPOINTMENT shall be obtained later. Contractual Employment on the basis of Open competition.
(2) For the appointment, under clause (b) of sub-rule (1) the State Government shall issue an advertisement in news papers for inviting application, eligible candidates shall be called for interview. The interview board shall be constituted as mentioned in sub ule (3) of rule 14. The interview board may recommend suitable names for appointment including waiting list.
(3) Notwithstanding anything contained in sub-rule (1), ifin the opinion of the Government immediate and exigency of the service so requires, the Government may adopt such other methods of recruitment to the service, in addition mthose specified in the said sub-rule, in respect of the appointment ofa suitable candidate., to be regulated by a specia order isued by the Government in anticipation of the approval of the cabinet. 8. Technical Qualifications and Experience.--The technical qualifications and experience for the appointment shall be such as specified in Schedule-II.
9. Character.--The character of the applicant must be such, which completely qualify for his employment with the Government, and his working experience should be undisputed, unsuspicious, unobjectionable and unblemished charàcter.
10. Physical and Mental Fitness.-() The Candidate must be healthy, smart and free form any kind of organic defect or bodily infirmity and shall fulfill the required health related standards established by the approved Medical Authority:
(2) the Pilot/Engineers shall be responsible to keep there licence valid (i.e. they shall appear before the approved Medical Authority at least before such time as to complete the specified formalities directed by the approved Medical Authority in adequate time, for the continuity of the validity of the Licence) However, the Government will provid� all necessary facilities to the concerned Pilot/Engineer towards the renewal, endorsement (if so necessary) of the licence (s) all necessary examination specified by the Medical Authority towards the renewal of the Medical Examination and timely completion of all formalities, as per rules, specified by the Director General of Civil Aviation, Government of India, in respect of the licence.
11. Disqualification.-Any attempt on the part of a candidate to obtain support for his candidature, by any means, may be held by the Appointing Authority, to disqualify him for the appointment.
12. Final Decision in respect of Appointment.-The decision of the Government, in respect of employment, shall be final and binding on the candidate.
13. Necessary Arrangement for work Proficiency.-In order to enhance the Technical Proficiency and Administrative Capability of the various members of the service, the arrangement for the necessary training (s), from time to time, shall be specified by' the Government.
14. Procedure for Appointment by Promotion.(I) The Technical Officers (Pilot/Engineer) of the Directorate shall remain in the pay scale of Junior post during the first 6 years of service, working experience of 4 years for Senior post and thereafter, further 4 years of working experience with excellent discharge of duties for Senior Selection Grade/Post>.
(2) After having attained the ability/qualification/experience as specified in Schedule-II, the Government shal' consider the case of suitable officers of the service for promotion who is entitle for promotion to the higher post as mentioned in annexure-iv, on the recommendation of the Director and the decision of the Government in respect of the promotion shall be final and binding.
(3) On the recommendation of the Director under sub-rule (2), the Government shall constitute a promotion committee comprising of Principal Secretary (home), Principal Secretary (Aviation), Director of Aviation and invite a subject expert of that service. The Promotion committee shall consider the promotion proposal and shall apprise the Principal Secretary Aviation Department with its recommendation. The Government shall takea final decision for giving promotion in accordance with the recommendation of the committee.
(4) Even After having attained the ability/qualification/experience specified for the next higher post, of no higher post exists for the promotion in the cadre, due to any reason the Government on the recommendation of the Direetor shall adopt such procedure as may be deemed appropriate, to take necessary decision for the sanction of that pay scale of the higher post, to that technical officer of the service, who has continuous excellent service record, and, is deprived of promotion due to the non availability of the higher post. 954 (12)
2. Katio of direct Recruitment/Promotion Posts.-There shall be no separate ratio for all the posts as mentioned In Schedule-1, for Direct Recruitment or by Promotion., ie. the Government shall use its disCTeuo O ne Posts by direct recruitment or by promotion keeping in view of the requirements of the Departmenl.
16. Applicability of Reservation AcURules/Orders.The Appointing Authority shall ensure the compliance of all Reservation Ac/Rules/Orders applicable and in force at the time of recruitment or Promouol. I1. Seniority.-The inter seniority of the members of the service shall be determinéd by the Government, as per the provisions of the Madhya Pradesh Civil Services (General Conditions of Service) Rules, 1961. T6. Gradation List.-The Government shall keep a gradation list, showing the names of the members of the service in their order of seniority. I9. Pay.The pay of the members of the service, for various posts of the service, shall be such as specified in Schedule-I, or as may be determined by the Government.
20. Allowance.-The allowances normally granted by the Gvoernment, from time to time, shall be payable to the members of the service. However, in addition to the said allowances the special allowances shall also be payable to the members of the service as specified in Schedule-lll, after approval of the Gvoemment, from time to time, keeping in view the laboriousness of the services of the technical officers.

22. Relaxation.-Nothing in these rules shall be construed to limit, or abridge the power of the Government. to deal with the case of any person, to whom these rules apply, in such manner, as may appear to it. to, be just and equitable:
Provided that. where any tule is relaxed /n the case of any person, the case shall not be dealt with, in any manner less favorable to him, than that provided in these rules.
23. Interpretation.If any question arises relating to the interpretation of these rules, it shall be refermed to the General Administration Department to the Government, whose decision thereon, shall be final. After rule 9, the following rule shall be inserted, namely :— Disqualification.—Any attempt on the part of a candidate to obtain support for candidature by any means may be held by the Government to disqualify him for appearing in the examination/selection, No candidate shall be eligible for any service or post who has married before the minimum age fixed for marriage, No candidate shall be eligible for appointment to the service or post who has more than two living children one of whom is born on or after the 26th day of January 2001:
Provided that no candidate shall be disqualified for appointment to a service or post, who has already one living child and next delivery takes place on or after 26th day of January, 2001. in which two or more than two children are born. No candidate shall be eligible for appointment to service or post who has been convicted of an offence against women:
Provided that where such cases are pending in a court against a candidate, his case of appointment shall be kept in pending till the final decision of the criminal case".

(b) Holder of Aircraft Mantenance Engineer (AME) Licence.;
(c) Experience : At least 10 years as Aircraft Mantenance Engineer. should have at least one aircraft endorsed on Aircraft Mantenance Engineer license of the aircrafts maintained by the State Government.
(d) Preference would be given to candidates possessing maintenance experience on fixed and rotary aircrafts and experience in managerial capacity in a Director General of Civil Aviation approved Maintenance Organisation.
