(अं) किसी राष्ट्रीय राजमार्ग अथवा किसी राज्य राजमार्ग से दृश्यमान किसी भी मदिरा दुकान का प्रवेश द्वार राजमार्ग की .
ओर नहीं होगा, बल्कि मदिरा दुकान इस प्रकार स्थापित होगी कि मदिरा दुकान की पीठ राजमार्ग की ओर रहे। (ब) किसी राष्ट्रीय राजमार्ग अथवा किसी राज्य राजमार्ग से किसी - भी मदिरा दुकान पर लगा हुआ साईन बोर्ड, दृश्यमान नहीं होगा । . [स) किसी राष्ट्रीय राजमार्ग अथवा किसी राज्य राजमार्ग पर किसी भी मदिरा दुकान को इंगितसूचित किये जाने वाला साईन बोर्ड भी दृश्यमान नहीं होगा :
परन्तु उपनियम--(1) के उपबंध किसी नगरीय निकाय (नगर निगम, नगर पालिका तथा नगर पंचायत) की .
परिसीमा में स्थित किसी राष्ट्रीय राजमार्ग अथवा किसी राज्य राजमार्ग के. खण्ड/भाग में स्थापित /अवस्थित मदिरा दुकान पर लागू नही हंोंगे।
(2) किसी फुटकर मदिरा दुकान को परिसर में मदिरा का उपभोग करने के लिए अनुज्ञप्ति देते समय निम्नलिखिंत स्थितियों पर विचार किया जायेगा.
यदि दुकान - | | (क) किसी मिल, कारखाने या अन्य स्थान के, जहां श्रमिकों का विशाल समूह नियोजित हो, आसपास में है, तो मिल के स्वामी या श्रमिकों के ऐसे नियोजक को, ऐसी दुकान खोलने के प्रस्ताव पर- उनकी आपत्तियों को, कथित करने का अवसर दिया गया है। (ख) किसी धार्मिक या किसी शैक्षणिक संस्था, किसी अस्पताल, जातियोंके सदस्यों की किसी कालोनी, किसी श्रमिक कालोनी या किसी बस स्टैण्ड, रेलवे स्टेशन के निकट है या जहां राज्य सरकार की मंजूरी अभिप्राप्त की गई है सिवाय इसके कि जहां ऐसी दुकान, ऐसे स्थान के 50 मीटर या उससे अधिक की दूरी पर स्थित है।

fag Ta UNIV: Tea S| मध्यप्रदेश राजपत्र, दिनांक 6 फरवरी 2015 110 (1) अस्पताल या बस स्टैण्ड आदि, उस दुकान से पचास मीटर या उससे कम की दूरी के भीतर अस्तित्व में आते हैं तो परिसर में उपभोग के लिए अनुज्ञप्त कोई मदिरा दुकान, उप नियम (2) के खण्ड (ख,)में निर्दिष्ट प्रतिषिद्ध दूरी के भीतर स्थित नहीं समझी जाएगी परन्तु उपनियम (2) के खण्ड (क) एवं (ख) के उपबंध. निम्नलिखित को लागू नही हंोंगे (क) ऐसी परिसर में उपभोग हेतु अनुज्ञप्त मदिरा दुकान, जो तारीख 31. मार्च, 2010 को पिछले तीन वर्षों से वर्तमान स्थल पर विद्यमान रही हो। (ख) प्रारूप एफ.एल.-1 बी में अनुज्ञप्ति धारण करने वाली दुकान हा यदि वे उप नियम (3) के उपबंधों का अनुपालन करती | स्पष्टीकरण इस नियम के प्रयोजनों के लिए - (क) “शैक्षणिक संस्था” से अभिप्रेत है किसी स्थानीय प्राधिकारी ह या राज्य सरकार अथवा केन्द्रीय सरकार द्वारा प्रबंधित या . मान्यता प्राप्त कोई पूर्व प्राथमिक, प्राथमिक या सेकण्डरी स्कूल और विधि द्वारा स्थापित किसी विश्वविद्यालय से संबद्ध कोई - महाविद्यालय, किन्तु इसमें कोचिंग संस्था सम्मिलित नहीं है। (ख) “धार्मिक संस्था” से अभिप्रेत है ऐसी संस्था जो किसी धर्म । की प्रोन्नति के लिए हो और उसमें सम्मिलित है ऐसा मंदिर मठ, मस्जिद, गिरजाघर या सार्वजनिक धार्मिक पूजा का अन्य स्थान, जिनका मध्य प्रदेश पब्लिक ट्रस्ट एक्ट, 1951 या तत्समय प्रवृत्त किसी अन्य अधिनियमिति के अधीन रजिस्ट्रीकृत किसी लोक न्यास द्वाश प्रबंध क्रिया जाता हो, या उसके स्वामित्व में हो और उसमें अन्य ऐसी धार्मिक संस्थायें सम्मिलित होंगी, जैसा कि राज्य सरकार आदेश द्वारा, इस ... निमित्त्त विनिर्दिष्ट करें। (ग) उप नियम (2) के खण्ड (ख) में निर्दिष्ट दूरी. का माप, दुकान के प्रवेश के मध्य बिन्दु से ऐसे निकटतम मार्ग से किया.

Now, therefore, In exercise of the powers conferred by sub-section (1) and clauses (e), (f) and (h) of sub-section (2), read with proviso to sub-section (3) of Section 62 and section 63 of the Madhya Pradesh Excise Act, 1915 (No. II of 1915), and in supersession of this department’s Notification No (23) B-1-74-97- CTD-V dated 7" June, 2001 and Notification No. (14) B-1-36-2009-2-V dated 29" September, 2010, the State Government, hereby, makes the following amendment in the Rules of General Application published under Notification No.
14-V-SR, dated 7” January, 1960 namely :- / AMENDMENTS In the said rules, for rule 1, the following rule shall be substituted, namely :-
1. Location of shops-

(a) Any liquor shop visible from any national highway or any state highway would not face the. entrance to highway, but the shop would be so located as it’s back portion will be towards the highway.
(b) Signboard on any liquor shop shall not be visible from any national highway or any state highway.
(c) Any signboard indicating to or informing about liquor shop | shall also not be visible on any national highway or any state highway:
Provided that, the provisions of sub-rule (1) shall not be. applicable to a liquor shop situated/located in section/part of any national highway or any state highway within .the limits of any Urban. body (Municipal Corporation, Municipality and Nagar Panchayat).
(2) At the time of granting license to a retail shop for the consumption of liquor on the premises, the following conditions shall be considered, if the shop is:-
(a) In the neighborhood of a mill, factory or other place where a large body of labourers is employed, the mill owner of such employer of labourers an opportunity of stating their objections to the proposal for opening of such shop has been given.
(b) near a religious or any educational institution, a hospital, a colony of members of Scheduled Castes, a labour colony, or a bus stand, railway station or where the sanction of the State Government is obtained except when such shop is situated at a distance of 50 meters or more from such . place. :
(3) The position of a shop shall be such that no person entering it shall escape observation, but it shall not be so prominent as to compel attention of persons passing by.
(4) Any liquor shop licensed for consumption on the premises shall not be deemed to be situated within prohibited distance referred to in clause (b) of sub-rule (2), if at any time after such license is granted, any institution (education or religious), hospital, or bus stand etc. referred to in clause (b) of sub-rule (2) comes into existence within a distance of fifty meters or less from that shop :
Provided that the provisions of this rule shall not apply —
(a) to a shop which is existing at the present site for the last three years as on 31 March 2010,
(b) to shops holding license in form F.L.1-B if they comply with the provisions of sub-rule (3).

Explanation.- for the purposes of this rule —
(a) “Educational institution” means any pre-primary, primary or secondary school managed or recognized by any local authority or the State Government or the Central Government and any college affiliated to any University established by law, but does not include any coaching institution.
(b) “Religious institution” means an institution for the promotion of any religion and includes temple, math, mosque, church or other place of public religious worship which is managed or owned by a public trust registered under the Madhya Pradesh Public Trusts Act, 1951 or any other enactment for the time being in force and shall include such other religious institutions as the State Government may by order specify in this behalf.
‘(c) The distance referred to in clause (b) of sub-rule (2) shall be ‘measured from the mid point of the entrance of the shop along the nearest path by which a pedestrian ordinarily reaches,--
(i) The mid point of the nearest gate of the institution if there is a compound wall and if there is no compound wall the mid point of the nearest entrance of the institution, or
(ii) The mid point of the nearest gate of the Bus stand, Station or depot or Madhya Pradesh State Road ‘Transport Corporation if there is a compound wall and if there is no compound wall the nearest point of the boundary of such Bus stand, station or depot.
(d) “Bus Stand” means bus stand of MPSRTC or of Municipal Corporation or any other local body as the case may be.
(ec) “Hospital” means any hospital or nursing home run by State or Central Government or by any “Charitable institution”, where at least facilities of 10 Beds are available for admission and treatment of 10 patients.
