(i) certain vacancies in cetain categories of posts’ to filled up within a short time; and

(ii) the tendency of avoiding posting at certain. places. be curbed and, therefore, employees be appointed on contract basis at specified places for a specifed period:

Now, THEREFORE, in exercise of powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Madhya Pradesh hereby makes the following rules, relating to recruitinent to certain categories of services on contract basis under Department of Bhopal Gas Tragedy Relief & Rehabilitation; Madhya Pradesh, namely -— RULES |. Short title, Application and commencement.—(1} These rules may be called “The Madhya Pradesh i + Bhopal, Gas Tragedy, Relief & Rehabilitation Department ‘Contract Service (Appointment and Conditions of Service) Rulés, 2003”, oe

(2) Notwithstanding anything contained in any other rule for time being in force, these rules shall apply to such categories of contract employees appointed on contract basis, as may be specified in the Schedule, from time to time, by the state Government.

(3) They shall come into force with effect from the date of publication in the “Madhya Pradesh Gazette”,

2. Detinitions.—In these -rules, unless the context otherwise requires,—

(a) “Annexure” means Annexure appended to these rules.

(b) “Appointing Authority” means the authority specified in the Schedule for the concerned category.

3. Extent & Application —These rules shall extend to the whole: of the State and shall apply to the Contract employees appointed by the Appointing Authority for specific units under the Department of Bhopal Gas Tragedy Relief & Rehabilitation.

4, Contract Amount.—{ |) The monthly contract amount for a Contract employee shall be as mentioned in column (3) of the Schedule. 5, Selection and Method of appointment.—(1) Post.—Number of vacant posts in various units under the . Department of Bhopal Gas Tragedy Relief & Rehabilitation will be decided by Appointing Authority. :

(2) Selection and Appointment,—All Appointments to the posts Specified in the schedule shall be made by the .

appointing authority on the basis of the recommendations by a selection committee, specified in the schedule:

Provided that for the constitution of selection committee provisions of Section 8 of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21, year 1994) shall apply. ‘ noe : 7

(3) Age-—The Minimum and Maximuin age limit ‘for contractual appointment shall be 21 years.and 65 years respectively on the first day of January of that year in which the appointment is.to be made.

(4) Appointment of Retired Government Servant.—Retired Government Servants may also be entitle! for | appointment as Contract employee. Oa A i (5) Minimum Educational Qualification —Minimum Education! Qualification for the appointment of candidate shall be such as specified in the Schedule. f = i

(6) Disqualification —A candidate shall not be eligible for contractual appointment if he/she has more than two children, one of ‘hom was born on, or after 26th January 2001.

(7) Reservation—The posts shall be reserved in accordance w ith the provisions of the Madhya Pradesh Lok Seva ; a (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhade Varyon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21. year 2. 1994), the Ma:thya Pradesh Civil Services (Special Provision for Appointment of Women) Rules 1997 and the instructions pee issued by" the State Government from time to, time. mare a

6. Period of Contract Appoiniment and posting.—The maximum period of contract of contract employee shall be 2 years. : = | ;

7. Discipline and Control during Contract Period. —(1) Any person appointed under these rules shall be governed by the Madhya Pradesh Civil Services (Conduct) Rules, 1965. Liens :

10. Other Conditions—(1) The selected candidate, shall execute a agreement with the appointing authority on Non-Judicial Stamp of Rs. 50/- in the Annexure just after the receipt of the appointment order. Expenses on execution of the agreement shall be borne by the selected candidate. The selected candidate shall be deemed to be in contract service from the date of joining at the placé of his/her posting.

(2) It is compulsory for the Contract employee to Join,his/her duties within 15 days of the issue of the appointment order, at the place of contract appointment. In the event-of not jeining within the said period, the contract appointment shall stand cancelled automatically. The intimation of joining by.a Contract employee shall be sent to the Director, Gas Releif and Rehabilitation through the concerned head cf the unit.

(3) The character verification of a Contract employee shall be carried out on the basis of rules or instructions applicable to the Government servants. In case of an adverse finding regarding the character, the contract appointment shall be cancelled immediately by the Appointing Authority wittiout assigning any reason,

(4) Before the contract amount for the first month, the Contract ginployee, at his own cost, shall undergo medical examination conducted by the District Medical Board. Only after being found fitia this medical examination, the contract appointment shall be valid. The retired Government servants, if appointed as Contract employee, shall also be require, to undergo such medical examination,

(5) The Contract employee shall be requiréd to undergo 7 days training in the concertled unit within,a mon’; of joining at the place of posting. Such training shall be organized by the concerned Head of the unit. The concerned head of the unit shall be responsible for sending the Contract employee for such training. The Contract employee shall be entitled for travelling allowance as per rules lor this purpose. However, a retired Contract Government Servant will not require such taining.

-(6) The appointment of a Contract employee shall be for a specific unit only. He shall not be tansferred under any circumstances, eee

(7) The Contact employee shall be entitled for a maximum of 15 days casual leave in a calendar year. He/She can avail a maximum of three days casual Jeave at a time. A Female Contract employee having less than two living children, shall be entitled for maternity leave fora maximym period of 90 days. The powers to sanction aforesaid leaves will be vested with the concerned Head: of thé Unity oe | 3

(8) EF Coritract employee is absent from his duty for more than a month without any specific reason and without any imtimation, then his contract appointment shall be deemed to be terminated automatically fiom the date of such absence, :

(9) The Contract employee shall not be entitled for any pensionéry benefits for his contractual period. No bonur etc, shall be payable to him/her for such period. '

(10) The Contract employee will not be entitled for regularization in Government service.

(11) The Contract appointment can be terminated after one month's hotice or on payment of one months contract amount by either party and at any time. | ib

(12) Other. service conditions shall be such as may be specified in the appointment order, ils Interpretation. —If any question arises relating to the interpretation of any provision of these rules, it shall be referred to the Government, whose. decision thereon shall be final.
