MADHYA PRADESH ACT No. 34 of 1981 THE MADHYA PRADESK FISHERIES (AMENDMENT) ACT, 1981 [Received the assent of the:President on the 5th October, 1981; assent first published in the "Madhya Pradesh Gazette (Extra-ordinary)", dated the 7th October, 1'181.1 An Act further to amend the Madhya Pradesh Fisheries Act, 1918.

Be it enacted by the Madhya Pradesh Legislature in the Thirtysecond Year of the Republic of India as follokvs :-

1. This Act may be called the Madhya Pradesh Fisheries (.-\mend- short title ment) Act, 1981.

2. In section 3 of the Madhya Pradesh Fisheries Act, 1948 (No. 8 of Amendment r;'

1948) (hereinafter referred to as the Principal Act)- section 3.

(a) in sub-section (3), for clause (f), the following clause.< s i~al l be substituted, namely :- "(1) prohibited sale or purchase of fish or transport or n~ovement of tish within or outside the State in excess of the prescribed quantity except under a licence;

% ( f f ) prescribe the seasons during which- .

( i ) the hilling or catShing of fish of any prescribed species shall be prohil)ited ;

( i i ) sale, movement or transport of any prescribed specie.: si!all be prohibited except under a licence ;

(Iff) regulate the grant of l ice~ces under clnuse (f ) and sub-clause

(ii) of clause (B), anillor prescribe the fees pay:ll~le l l~c rc - for and the conditions to be attached thereto; and" :

(b) in sub-section (5), for clauses (a) and (I]), the follo\ving clauses shall be substituted, namely :- "(a) the seizure, removal and forfeiture of any fixed engine, apparatus or cquipnient erected or used for fishir?g in contravention of ihe rules ;

(b) the forfeiture of any fish procured by means of any such fixed engine,, apparatus or equipment or transported in contravention of the rules; and

(c) t h e seizure, removal and forfeiture of any animals, carts, vessels, rafts, boats or vehicles used -for transporting CZ!

Cognizance of 5-A. Every offence under this Act shall be cognizable.".

i Amendment of 4. In section 6 of the Principal Act,- rection 0,

(b) for sub-section (3), the follo\ving sub-section shall be substituted, namely :- "(3) All Fi,shery Oficers sliall havc the snme po\vers of scnr.ch, seizure and investigations in respect of a n ,offence under this Act as a police oficer of the rank of a Sub-Inspecto:.

Amendment of 5. For sub-section (1)of section 8 of the Principal Act, the follo\vsection 8. ing sub-section shall be substituted, namely :- i "(1) Any offence specified in the Schedule may be compounded by the Collector by acceptance of a sum not exceeding one thousand rupees.".

Amendment of 6. In the Schedule to the Principal Act, after entry 4, the following Schedule. entries shall be inserted, namely :- "4-A. ~ r a n s ~ b r t i n g or attempting to transport any fish of a prohibited species during a closed season except under and in accordance,with the conditions of the licence granted uncler the rules ;

Repeal. 7. The hladhya Prade\h Fisheries (Amendment) Ordin~incc, l!ifil (No. 11 of 1981) is hereby repealed.
