322 (18) TT^ra^I w r a , f^rioF 24 3 # U 2015 Bhopal, the 24th April 2015 F 10-10/2013/17/Med-2.- In exercise o f the powers conferred by sub section (1) and clause (b) o f sub-section (2) o f section 27 read with section 5 o f the M adhya Pradesh Ayurvigyan Parishad Adhiniyam , 1987 (No. 11 o f 1990) the State Government, hereby, makes the follow ing rules relating to the m ode and procedure o f election o f members, restrictions on nom ination and their m em berships and their terms o f office, to carry out the purpose o f the said Act, nam ely:- RULES
1. Short title and commencement
(1) These rules may be called the Madhya Pradesh Ayurvigyan Parishad Election Rules, 2014;
(2) These rules shall come into force on the date of their publication in the official Gazette.
2. Definitions - In these rules unless the context otherwise requires.—
(a) “Act” means the Madhya Pradesh Ayurvigyan Parishad Adhiniyam, 1987 (No. 11 of 1990);
(b) “Election” means a election to be held by the appropriate authority under such procedure as prescribed by the rules;
(c) “Electrol rolls” means the updated list of the Regi stered Medi cal Practitioner Prepared from the State Medical Register by the Registrar under the Madhya Pradesh Ayurvigyan Parishad;
(d) “Form” means a form annexed to these rule;
(e) “Government ” means the Government of Madhya Pradesh;
(f) “Returning Officer” means a officer appointed by the State Government for the purpose of conducting the election of the Council;
(g) “Section” means the Section of the Act;
(h) “State” means the State of Madhya Pradesh;
(i) Words and expressions used but not defined in this rules shall have the same meanings as assigned to them in the Act.

CHAPTER-XX Mode of Election
3. Preparation of Electoral Roll
(1) For the purpose of Election of members under clause (a) of sub-section (I) of section 4 of the Act, the Registrar shall prepare the electoral roll from the State Medical Register kept and maintained under section 11 of the Act. The electoral roll shall be include the names of all Registered Medical Practitioners on such date prior to the date of election as may be fixed by the council for each election.
(2) The electoral roll shall be kept open for inspection in the office of the Registrar, Madhya Pradesh Medical Council, Bhopal at least thirty days before the last date fixed for receipt of nomination papers under rule 9. The Registrar shall be at the same time, issue in the Official Gazette or in such other manner as he thinks, fit, a notice in Forni A, calling upon the Registered Medical Practitioners, their objections or suggestions, if any, with regard to the entries in the electoral roll before a date specified in the notice which shall not be earlier than fifteen days of the publication of the notice. Ali objections received before the date specified in the notice shall be considered by the Registrar and corrections made, if necessary, in the electoral roll.
(3) Any Registered Medical Practitioner aggrieved by the decision of the Registrar about any corrections/addition made by the Registrar in the electoral roll, may within five days from the date of receipt of order prefer an appeal to the State Government.
4. Persons eligible for Election or for Nomination as M em ber.—All the registered medical practitioner whose names are borne on the electoral-roll (as prepared under rale-1) shall eligible for contesting, the Election or for being nomination as a member.

5. Restriction on Election or for Nomination as membership.— No person shall be eligible for Election or Nomination as a member under section 4.
(1) Unless his/her name is borne on the State Medical Register; and
(2) For more than two consecutive terms.
6. Disqualifications for Election or Nomination as a member.—A person shall be disqualified for being chosen as a member of the council by election or by nomination: -
(i) if his name dose not borne on the State Medical Register of the Council;
(ii) if he is not a Indian citizen;
(iii) if he has not been ordinarily resident in the state for not less than five years immediately before the date of Election/Nomination and also carries on his/her practice as Registered Medical Practitioner in the State of Madhya Pradesh;
(iv) if he is a whole-time/part-time paid employee of the medical council;
(v) if he is of unsound mind and stand so declared by a Competentcourt/Authority, deaf or mute;
(vi) if he has been declared an undischarged insolvent or to be adjudicated by a competent-Court/Authority;
(vii) (a) if he has been sentenced minimum for a period of six months or fine Rupees Five Thousand by a competent court for an offence involving moral turpitude;
(b) if she has been penalized with a fine of Rs. 5000A by a competent authority under the State/ Central Consumers Fouram Act;
(c) if he has been found guilty of infamous conduct, in any professional respect after due enquiry by the Medical Council through a Special Inquiry Committee and imposed a fine of minimum Rs. 5000/-.

7. Payment of the Election Fees
(1) Every candidate shall alongwith the proposal of nomination security deposit with the Returning Officer through Bank Draft a sum of Rs, 10,000/- only (Ten thousand) towards security amount for contesting the election. The Bank draft should be payable at Bhopal in favour of the Registrar, Madhya Pradesh Medical Council, Bhopal. A nomination paper shall not be accepted by the Returning Officer if the Bank Draft of the Election fee is not attached;
(2) The security amount deposited once for contesting the Election shall not be refunded on the expiry of the last date fixed for withdrawal of the Candidature.
8. Procedure of Election The Returning Officer shall conduct the Election of the members of the Council.
9. Fixation of the Stages of election.—
(1) The Returning Officer shall fix the date, hour and place for the following stages of the election, namely
(a) Receipt of nomination papers;
(b) Scrutiny of nomination papers;
(c) Receipt of voting papers; and
(d) Scrutiny and counting of votes.
(2) The date of the receipt of nomination papers shall be not less than forty days before the date fixed for voting. The date fixed for scrutiny of nomination papers shall not less than thirty five days before the date fixed for of voting.
10. Notice of Election.-— At least twenty days before the date fixed for the receipt of nomination papers, the Returning officer shall publish in the Official Gazette, and in such other manner as he think fit a notice in Form-B notifying the dates fixed under rule 9 and calling upon the electors to elect new members and to send nominations for the purpose.

11. Nomination of Candidates.—
(1) Every registered practitioner whose name appears in the electoral roll prepared under rule 1, (hereinafter referred to as the elector in this part:) shall be qualified for election.
(2) Candidates qualified for election shall be proposed and seconded by practitioners qualified as electors.
(3) The nomination papers shall in Form-C and the forms shall be supplied by Registrar to every candidate on his requisition/may be downloaded from the council website.
(4) Every nomination paper duly completed and signed by the proposer and the seconder and subscribed by the candidate himself as assenting to the nomination shall be sent by Regd. A.D. post or otherwise, so as to reach the Returning Officer on or before the date and the time appointed under rule 10 for receiving of nomination papers. Nomination papers received after the time so fixed shall be rejected. The Returning Officer shall immediately on receipt of a nomination paper record thereon the date and the time of its receipt by him.
12. Scrutiny of Nomination papers.— On the date appointed for scrutiny of nomination papers, the candidates and one proposer and seconder of each candidate may be attend at the appointed time and place, and the Returning Officer shall give them all reasonable facilities to examine the nomination papers which have been delivered within the time fixed for their receipt under rule 9.
13. Disposal of Objection, Rejection or Nomination.—
(1) The Returning officer shall examine the nomination papers and shall decide all objection and may either on such objection or on his own motion after such summary enquiry, if any, as he thinks necessary, refuse any nomination for any of the following reasons, namely:-
(a) that the candidates or his proposer or his seconder is not an elector;

(b) that there has been any failure to comply with the provisions of the Act or the rules made thereunder; and
(c) that the signature of the candidate or his seconder is not genuine or has been obtained by fraud.
(2) Where an elector has signed as proposer or seconder a larger number of nomination paper than there are vacancies to be filled. Only such of the papers so signed as have been first received up to the number of vacancies to be filled shall be deemed to be valid and the rest shall be deemed to be invalid and rejected.
14. Completion of Scrutiny.—
(1) The Returning Officer shall endorse on each nomination paper his decision whether the nomination paper has been accepted or rejected, and in case the nomination paper has been rejected the reasons therefore. .
(2) The Scrutiny shall be completed on the date appointed in this behalf and no adjournment or procedure shall be allowed.
15. W ithdraw al of Candidature.—Any candidate may withdraw his candidature within thirty days of completion of scrutiny of nomination by a notice in writing signed by him and delivered to the Returning Officer.
16. List of valid Nominations.— On completion of the scrutiny of the nominations and after the expiry of the period within which a candidate may withdraw his candidature under rule 15, the Returning Officer shall forthwith under his signature publish on the notice-board at the office of the council a list of valid nomination.
17. Procedure in uncontested election.— After the publication of the list of valid nomination, if the number of valid nominated candidatures does not exceed the number of vacancies to be filled in, the Returning Officer shall forthwith declare such candidates to be duly elected to fill, such vacancies and report the names of such candidates to the State Government.
322 (24) WHT, 24 2015 IS, Contested Election.—
(1) When there are more candidates than the vacancies, the voting shall be by postal ballot.
(2) The Returning Officer shall forthwith publish the names and addresses of the contesting candidates in the Official Gazette and affixed on the notice-board at the office of the Council.
19. Printing of voting papers.— The Returning Officer shall arrange for the printing of voting papers in Form-D with the names of the contesting candidates in alphabetical order.
20. Despatch of voting Papers to Electors.—
(1) The Returning Officer 21 days before the date fixed for the receipt o f voting papers under rules-9, shall be send to every elector by post under Certificate of Posting or by couiier-
(a) One Voting paper in Form-D bearing his initials or facsimile signature;
(b) An small Blank, envelope with the words voting Paper printed thereon;
and
(c) A larger envelope address to himself in Form-E.
(2) The Returning Officer shall make a mark in one copy of the electoral roll against the name of eveiy elector to whom a voting paper and covers have been sent. The marked copy of the electoral roll and the counterfoils of the voting papers sent shall be sealed in a packet immediately after the date fixed for receipt o f voting papers under rules 9.
21. Issue of Duplicate Voting paper.— If any elector has not received his voting paper and covers or he has inadvertently spoiled the papers or lost them, he may send to the Returning Officer at least seven days before the date fixed for receipt of papers under rule 9, a declaration to that effect signed by himself and the spoilt paper, if any, and require the Returning Officer to send him duplicate papers in place of those not received spoilt or lost. When duplicate papers are issued record thereof RaNv 24 3?tu 2015 322 (25) shall be kept by the Returning Officer and shall be marked duplicate on the larger cover and on the voting papers issued. The Returning Officer shall cancel any spoilt paper received back from the elector.
Delivery of Voting Paper to Elector in Person.—Any elector whose voting paper is returned undelivered may be apply to the Returning Officer in person for such voting paper before the date fixed for receipt o f voting paper under rale 9 and take delivery o f the voting papers after satisfying the Returning Officer of his identity and giving a receipt.
Recording of Votes by Electors.—
(1) On receipt of the voting paper, an elector shall record his votes by putting cross (x) in column (3) of the voting paper against the names of candidates of whom he wishes to give his votes. The elector may give as many votes as there are vacancies and can give only one vote to each candidate. The elector shall not reveal his identity on the voting paper by putting his signature or by any other means.
(2) After recording his vote, the elector shall put the voting paper in the smaller envelope close it and put it in the larger envelope. The elector shall than close the larger envelope and write his full name and sign at the places marked on the larger envelope. The larger envelope shall be sent by registered post or courier or otherwise so as to reach the Returning Officer on or before the date and the time fixed under rule 9 for receipt o f voting papers.
(3) Any elector, who is under any disability which incapacities him from recording his vote in the above manner, may take the assistance of a Gazetted Officer or a Magistrate in recording his votes. Such officer shall in such case, record on the back of the larger cover a certificate in the following manner, namely 322 (26) TT5TO, 24 2015 I (Name of the Officer)............................................................. ......... . hereby, Certify that (Name of the elector).........................................................

Signature and Designation
24. Custody of voting papers.— All envelope containing voting papers shall be kept in sealed box by the Returning Officer after noting the date and time of receipt on each envelope. Any envelope received after the date and time fixed for receipt o f voting papers under rule 9 shall be kept in a separate packet and shall not be opened.
25. Scrutiny and counting of votes.—
(1) The scrutiny and counting of votes shall be undertaken by the Returning Officer at the time, day and at the place fixed under role 9.
(2) A candidate not more than one representative duly authorised by him may remain present at the time of counting of votes.
(3) • All voting papers shall be treated as invalid,—
(a) If the elector has failed to write his full name and make his signature on the larger envelope in which the smaller envelope containing the voting paper is kept;
(b) If the mark (x) is placed opposite the name of more candidates than the number of seats to be filled or if more votes are given than he is entitled to under sub-rule (1) rule 23.
(c) If the elector has put his signature on the voting paper or has made any other mark thereon which may reveal his identity.
(4) If the Returning Officer receives more than one voting paper from one smaller envelope or more than one smaller envelope in any larger envelope, then all such voting papers shall be treated as invalid.

(5) If the mark (x) cross mark is so placed as to make doubtful to which candidate the elector has given his vote the vote shall be deemed to be invalid.
(6) If any elector has given more than one vote to any candidate the voting paper shall be deemed to be invalid.
(7) The Returning Officer shall nominee such number of scrutinizers not exceeding four as he think fit. The scrutinizers shall be Gazetted Officers of the State.
26. Declaration of Result of Election
(1) When the counting of the votes is completed the Returning officer shall forthwith declare the candidates to whom the largest number of valid votes has been given to be elected. If there is an equal number of valid votes in favour of two or more candidates for one vacancy the selection for the vacancy shall be determined by the Returning Officer by drawing a lot.
(2) The Returning Officer shall also inform each successful candidate by letter of his having been elected to the council and a report to the State Government the date of declaration of the election and the result thereof.
(3) After the result of the election has been declared by him, the Returning Officer shall seal up the voting papers and all other documents relating to the election and shall retain the same in safe custody for a period of six months and thereafter destroyed.
27. Gazette Notification of the result.—The name of every person elected or nominated under sub-section(l) of section 4 of the Act, shall be published in the Gazette by the Returning Officer and the members shall enter the post and their term be deemed to have entered upon their respective offices with effect from the date o f such, publication.

28. Terms of office of members.— An elected or nominated member shall hold office for a term of five years from the date, he enters upon his office as provided in sub section (3) of section-4:
Provided that an outgoing member shall continue to hold office till his successor enters upon his office.
29. Vacancy of the Seats.—An elected or nominated members shall be deemed to have vacated his seat if in the opinion of the Council he is absent without sufficient cause from three consecutive ordinaiy meetings of the Council or if he ceases to be a registered practitioner.
If the said term of five years is to be expire in respect of any member, a successor may be elected or nominated at any time within three months before the said term expires but he shall not be deemed to assume office until the said term has expire.
30. Filling of casual vacancy .-—A casual vacancy of a member in the council shall be filled as soon as possible by election or nomination, as the case may be, minimum within three moths from the date of receipts of as letter of notice in this connection.
The person elected or nominated so to fill the vacancy shall hold office for the unexpired term of his predecessor.
31 Disposal of any dispute regarding Election /Nomination under the Rule.— If any dispute arises in connection with any election or nomination under these rules, shall be referred to the State Government within three months period from the date of declaration of the result of election/nomination and the decision thereon shall be f inal .
32. The President and Vice-President of the Council.— The Director of Medical Services shall be the President of the Council and the Dean shall be the Vice- President of the Council. The Vice-President shall perform all such duties and exercise all such powers of the president in absence of the President.

33. Meeting of Council .—The Council shall meet atleast twice in each year at such time and place as may be fixed by the President. Unless otherwise provided by Regulation, the quorum of the Council shall be five members, out of whom atleast one shall be non-official member and all question brought before any meeting of the Council shall be decided by the majority of the members present and voting and in the case of an equality of votes, the Presiding Authority shall have a second or casting vote.
CHAPTER-ni
34. Calling of the Council Meeting.— The council shall ordinarily meet for the transaction of business in the months of April and October in each year. The President may, whenever he thinks fit, sHaii/upon a written requisition of not less than seven members and on a date not less than 15 days after the receipt of such re quisition call an extraordinaiy meeting. The date, time and place of such meeting shall be decided by the President.
35. Notice for calling of meeting
(1) All members of the Council shall be given thirty clear days notice of an ordinary meeting and ten clear days notice of an extraordinary meeting. Every notice shall also be posted at the office of the council. Such notice shall specify the date, time and place of the meeting and state whether the meeting is for general business or for any special business. If the meeting is for a special business the nature of such business shall also be mentioned in the notice.
(2) The Registrar shall send to all members a copy of the agenda and explanatory notes thereon ten clear days before the date fixed for an ordinary meeting.

(1) Any member shall send his proposal to be included in the agenda for an ordinary meeting so as to reach the Registrar twenty clear days before the date fixed for the meeting. The Registrar shall take the orders of the President for inclusion of such motion in the agenda and if disallowed, the reasons for disallowed so shall also be communicated along with the agenda to the member who send the proposal.
(2) Proposal for the consideration of the council shall not be admissible
(a) If the matter to which it relates is not within the scope of the function of the council; or
(b) If it raises substantially the same question as a proposal o r amendment which had been moved and either decided or withdraw with the permission of the Council within six months of the date of the meeting at which it is designed to move such new proposal unless and otherwise agreed by the President; or
(c) If it is not clearly and precisely expressed and does not raise substantially only one definite issue; or
(d) If it contains arguments inferences ironical expressions or defamatory statements.
37. Attendance at the M eetings.-- In each meeting an attendance Register shall be placed in the meeting room and every member present shall sign against his name in the register.
38:. Business to be transacted at Meeting.— In an ordinary meeting no business other than that specified in the agenda and in the case of. an extraordinary meeting other than that specified in the requisition shall be transacted:
Provided that the Presiding Authority may permit any business to be discussed which is or an urgent nature and which could not reasonably be entered in the notice.

39. Conduct of business at meeting.—
(1) The President of the Council shall be preside over every meeting of the Council. In the absence of the President, the Vice President shall preside the meeting.
(2) The quorum of the meeting shall, generally one third o f the council members.
(3) Every question to be determined by the Council shall be determined on a proposal moved by a member and put to the Council by the Presiding Officer.
(4) The votes at the meeting shall be taken by show of hands.
(5) In all cases where divisions has taken place any member of the Council may require that the members of the numbers of the majority or the minority or those who decline to vote and those who are absent be entered in the minutes.
(6) The result of the votes shall be announced by the presiding authority and shall not be called in question.
40. Identical Motions.—When motions identical in purpose stand in the names of two or more members, the President shall decided whose motion shall be moved and the other motion or motions identical in purpose shall thereupon be deemed to be withdrawn.
41. Method of Moving motions
(1) All motions and amendments shall in writing and shall be signed by the proposer. Eveiy motion or amendments , shall seconded and, if any motion or amendment is not seconded, it shall be deemed to have failed.
(2) When a motion is admitted, it may be discussed as question to be resolved either in the affirmative or in negative. Any member may, subject to rules 43 and 44 move an amendment to the motion. .

(3) The Presiding Officer may not allow an amendment to be moved which, is a substantive motion, would have been in-admissible under the rules.
42. Amendment to motion
(1) Amendment motion must be relevant and within the scope to which it relates.
(2) No amendment shall be moved which has merely the effect of a negative vote.
(3) The Presiding Officer may disallow any amendment which is in his opinion irrelevant or frivolous.
43. Form of amendment of motion.—Motion of amendment may by the omission, insertion, substitution or addition of words there from or therein.
44. Debates.—
(1) When a motion or amendment is under debate, no proposal with reference thereto shall be made other than following:-
(a) an amendment of the motion or amendment, as the case may be;
(b) to adjourn the motion of the debate on the motion or amendment or both either to a specified date and time or sine die;
(c) a motion for the closure of the debate, namely that the Council proceed to vote on the motion;
(d) a motion that the Council instead of proceeding to deal with the motion should pass to the next item on the programme of business;
(e) a motion that the Council be adjourned:
Provided that no such motion or amendment shall be moved so as to interrupt a speech:
Provided further that no motion of the nature referred to in clause
(b), (c), (d) and (e) shall be moved or second by member, who has already taken part in the debates:
Provided also that a motion referred to in clause (c), (d) and (e) shall be moved without speech.

(2) It shall be discretion of the Presiding Officer to put or refuse to put to the Council a proposal of the nature referred to in clause (b) of sub-rule (1).
(3) The proposal of the closure shall be made and seconded without debate and shall unless the Presiding Officer regulate otherwise be put forthwith, should the proposal be carried the motion or amendment under debate shall be at once voted on by the Council.
45. Withdrawal of motion.-— The motion or amendment which has been admitted shall not be withdrawn except with the consent of the Council. The consent shall not be deemed to be granted, if any member dissents from the granting thereof.
46. Mover to start debate.— After a motion has been placed before the meeting for consideration under the rule 42, the proposer may speech in support of the motion and the seconder may either follow or reserve his speech for a later stage of the debate thereon.
47. Right of reply.— If the mover waives his right, the seconder of a substantive motion may reply at the conclusion of the debate thereon but no other member shall without the express permission of the Presiding Officer speak more than once on the same motion except for the purpose of making a personal explanation, but in such case, no debatable matter shall be brought forward.
48. Time Limits of speech and point of order
(1) The Presiding Officer may fix a reasonable time limit within which the proposer the seconder and any other member shall finish his speech.
(2) The Presiding Officer shall be decide all points of order and his decision . thereon shall be final.
(3) The member may at any time raise a point of order for the decision of the Presiding Officer but in doing so he shall confine himself to setting the point.
(4) No discussion on any point of order shall be allowed except with the consent of the Presiding Officer.

53. Power to devide motion or amendment The Presiding Officer may divide a motion into two or more motions, or an amendment into two or more distinct amendments as he may deem necessary.
54. Adjournm ent of Meeting
(1) Subject to the provisions of the sub-section (2) of section 8, the Presiding officer may at any time for reasons to be recorded in writing adjourn the meeting to any next day or to any time for the same day .
(2) Whenever a meeting is adjourned to a any day, the Register shall, if possible send a notices of the adjournment to every member.
(3) When a meeting has been adjourned to a next day the President may change such day, to any other day and the Registrar shall send a written notice of the change to each member of the Council.
(4) In the adjourned meeting, the business undisposed of at the original meeting from which the adjournment took place shall, unless the President otherwise directs, take precedence over new business.
55. Minutes o f M eetings.— Minutes of the proceedings of each meeting of the Council shall be kept in a book to be provided for the purpose and shall includes the names of the members and if any member present at the meeting so desire, the name of the members voting respectively for or against any motion. The book shall be signed by the President at the next meeting after the minutes are confirmed and shall at all reasonable times, be open for inspection by any member of the Council, copies of the minutes shall be supplied to eveiy member o f the Council.
