MADHYA PRADESH ORDINANCE No. 12 OF 2021 THE MADHYA PRADESH CO-OPERATIVE SOCIETIES (AMENDMENT) ORDINANCE, 2021 First published in the "Madhya Pradesh Gazette (Extra-ordinary)", dated the 23" January, 2021. Promulgated by the Governor in the seventy first year of the Republic of India. An Ordinance further to amend the Madhya Pradesh Co-operative Societies Act, 1960. Whereas, the State Legislature is not in session and the Governor of Madhya Pradesh is satisfied that circumstances exist which render it necessary to take immediate action; Now, therefore, in exercise of the powers conferred by clause (1) of article 213 of the Constitution of India, the Govemor of Madhya Pradesh is pleased to promulgate the following Ordinance :-
1. (1) This Ordinance may be called the Madhya Pradesh Co-operative Societies Short tide and (Amendment) Ordinance, 2021. “ommmmencemens
(2) It shall come into force from the date of its publication in the Madhya Pradesh Gazette.
2. During the period of operation of this Ordinance, the Madhya Pradesh Co-operative Madhya Pradesh Societies Act, 1960 (No. 17 of 1961) (hereinafter referred to as the principal Act), shall have — Act'No. 17 of 1961 7 7 : : to be temporarily effect subject to the amendments specified in Sections 3 to 6. amended. (ii) clause (b) shall be omitted. Amendment of 4. In Section 49 of the principal Act, in sub-section (7-a), in clause (b), in the first Section 49. proviso, for full stop, colon shall be substituted and thereafter, the following proviso shall be inserted, namely :- "Provided further that, in case of any Apex or Central Society, if in the opinion of the Registrar, a committee is required to be constituted to assist the Administrator in the discharge of his duties, the Registrar may appoint a committee consisting of following members, namely :-
(a) amaximum of three members of the said society who are eligible to be elected as a member of the Board of Directors of the society;
(b) one representative of the Registrar;
(c) onerepresentative of the financing institutions.”. Smendiment (of 5. In Section 52 of the principal Act, in sub-section (5), for clause (a), the following Section 52. : clause shall be substituted, namely :- "(a) in the Co-operative Credit Structure, the maximum limit for the share capital of the State Government shall be such as may be notified by the State Government, from time to time.". Amendment of 6. In Section 53 of the principal Act, - Section 53.
(i) in sub-section (1), after the first proviso, the following proviso shall be inserted, namely:- "Provided further that, in case of any Apex or Central Society, if in the opinion of the Registrar, a committee is required to be constituted to assist the Administrator in the discharge of his duties, the Registrar may appoint a committee consisting of following members, namely :-
(a) amaximum of three members of the said society who are eligible to be elected as a member of the Board of Directors of the society;
(b) onerepresentative of the Registrar;
(c) | onerepresentative of the financing insititutions.".
