(iii) is name is removed from the Slate Register under section 17.

(b) 1 wo Superintendents of Hospitals approved and recognised by the Council under section 24 nomi nated by the Slate Government by ro tation ;
(c) The Assistant Director of Health Services (Nursing) and in the event of the said oflice being vacant, . the Superintendent, Nursing Services—cx-ollicio;
(d) The Principal, College of Nuriug, Indore—cx-olficfo;
(c) 1 wo Matrons from Medical College Hospitals nomi nated by the State Government by rotation;
(f) Two Sister tutors of Schools of Nursing in Madhya * Pradesh nominated by the State Government by ro tation; '
(g) One nurse elected by the Madhya, Pradesh Branch of trained Nurses Association from amongsf the registered nurses residing in Madhya Pradesh;
(h) Three nurses elected by registered nurses other than those who, are members of the Madhya Pradesh Board of Trained Nurses Association from amongst themselves of whom one shall be male nu rse ;
(i) One midwife elected by registered mid wives L jm ■.

(j) One auxiliary nurse-midwife elected by registered auxiliai7 nursc-midwivcs from amongst them selves ; -
(k) One health visitor elected by registered health visi- 1 tors from amougsl themselves;

(m) One member elected by Mid-India Board of Ex'aminers from amongst its members: '
Provided that no person shall at; the same lime serve its a member in more than one capacity.
(2) The name of every person elected or nominated under sub-section .(1) shall be notified in the Gazelle.
5. (1) The Director of Health Services, Madhya Pradclh, shall be exoflicio President of the Council.
(2) The Vice-President of (lie Council shall be elected by the members of tht Council from amongst themselves.

10. (1) The Council shall meet at least once in each year at such time and place as may be appointed by the Council.
(4) Fisc members of the Council shall form a quorum and all a us of tbe Council shall be. decided by the majority of the members present and voting. In the case of mi ci|uaJjty of votes, Lhc pei.'.on presiding shall have a casting vole. ‘
11. No act of the Council shall be invalid merely by reason of— ’ 1
(a) any vacancy in, or defect in the constitution of the Council; or
(b) any defect in the clecLion or nomination of a person acting as a member thereof; or
(c) any irregularity in its procedure not aflccling the raeriLs of the case. * , - 12- There shall be paid lo Lhc President, Vice-President and members of Lhe Council, such allowances for attending meetings as the Council may, by regulations, determine- ° PA RT III—REGISTRATION - .

(2) The Council shall appoint a Treasurer who shall exer cise general control over the funds of Lhc Couuci] : .

(3) The Council may employ such oilier persons as it may deem necessary to cany out the purposes of the Act.

33. (i) The Slate Government may, make rules to carry out the purposes of this Act.
(2) All rules made under this section shall be laid uit the table of the Assembly.
' 34. Hie Council may, with the previous .sanction of the State Government and'subject to rules made under section 33, make regulations generally !u carry mil the purposes of this Act, and. without prejudice to the generality of tiiis power, such regulations may provide for— '

(4) Any person who coutravciiccs the provisions of sub-section (3 ) shall, on conviction, be punished with fine which may extend to Rs. 500. ■
(5) Where a person committing an 'offence under lliis section is a company or oilier body corporate or an association of persons {whether incorporated oi not), every person who at ihe time of the commission ol Llic_ ofTencc was a director, m anager, secretary, agent or other officer or person concerned with the management uuueo shall, unless he proves that the offence was coinnntum without his knowledge or consent, he deemed lo guilty of such oilehce.

(1) The Council may, if it considers it so to do, and after giving due noLice to the person concerned and enquiring • into Ins objections, iT nny, order Hun any entry in die Slate Register which shall be proved to die satisfaction ol die Coumil to have been fraudulently or incorrectly made or brought about, be cancelled or amended.
(2) The Council may direct the removal altogether, or for a specified period from the State Register ,,r_ the n'mnc of any registered nurse, midwife, auxiliary mnse-midwife or health visitor for the same reasons for which registration may lie pioliibitcd by die Council under sccLion 17.
(8) The Council may direrL that, any name removed under sub-section (2) shall be restored subject to such conditions, if ■any, which the Council may deem fit to impose.
19. For the purpose of any enquiry under .section 115 oi section 17, die Council or any committee authorised by rules made, under section 33 shall be deemed to be a Court; within ■ the meaning of tbc Indian Evidence Act, 1872 (f of 1872), and shall exercise all the powers of a. Commissioner appointed under the Public Servants (Inquiries) Act. bird) (37 oT 18a()), and stick enquiries shall be conducted, as far as may be, m accordance with the provisions of section 5 and set duns R te_ ,0 of the said Public Servants (Inquiries) Act, 1850 (37 or lo.m).
