Madhya Pradesh Rajmarg Nidhi Adhiniyam, 2012.State Act of Madhya Pradesh · Act 18 of 2012

(1) This Act may be called the Madhya Pradesh Rajmarg Nidhi Adhiniyam, 2012.

(2) It extends to the whole of the State of Madhya Pradesh.

(3) It shall come into force on such date as the State Government may, by notification appoint. '

2. In this Act, unless the context otherwise requires,-

(a) "Authority" means the Madhya Pradesh Road Development Corporation Limited established by the Government under the Companies Act, 1956 (1 of 1956);

(b) "Executive committee" means the Executive Committee constituted under Section 5;

(c) "Concession Agreement" means agreement between the concessionaire and Authority or a statutory body specifically authorized by the State Government for the purpose whereby the concessionaire undertakes to finance, construct, maintain and operate a road or infrastructure facility;

(d) "concessionaire" means a person with which a concession agreement is entered into by the authority or a statutory body specifically authorised by Government for the purpose;

(e) "construction" includes new construction, reconstruction, rehabilitation, repair and!

or maintenance;

(f) "development cost" means initial cost incurred on the development of any road or infrastructure facility project before it is offered to a person for implementation and includes cost incurred on data collection, pre-feasibility studies or feasibility studies;

(g) "Fund" means the Madhya Pradesh Highway Fund established under section 3;

(h) "Government" means the Government of Madhya Pradesh:

(i) "Highway" means any road, way or land declared as highway under section 3 of the Madhya Pradesh Rajmarg Adhiniyam, 2004 (No. 11 of 2005), and includes-

(i) all land appurtenant to Highway, whether demarcated or not, acquire for the purpose of the Highway;

(ii) all bridges, culverts, tunnels, causeways, carriageways and other structure constructed on or across such roads; and

(iii) all trees, railings, fences, post paths, signs, signals, kilometer stone and other road furniture or accessories and Material on such roads;

U) "infrastructure projects" means projects for construction of infrastructure undertaken by authority including highways;

(k) "person" includes a body corporate, a company, a firm or an association of individuals whether incorporated or not;

(1) "prescribed" means prescribed by rules made under this Act;

(m) "premium" means amount payable by concessionaire to the Authority determined at the time of bidding of the project;

(n) "regulations" means regulations made by the Authority under this Act;

(0) "rules" means rules made by the Government under this Act;

(p) "state" means the State of Madhya Pradesh;
