In exercise of the power conferred by the proviso to Article 23 of the SUBIS act, the General Council of Sanchi University of Buddhist-Indic Studies hereby makes the following general rules for regulating the recruitment and conditions of service of persons appointed to public services .and posts in connection with the affairs of the Sanchi University of Buddhist-Indic Studies, namely :- • RULES I. Short Title :- These rules may be called the SUB'S Educational Service (Collegiate 13rancli) 0 Recruitment Rules, 2014

2. Definitions :- In these rules, unless the context other requires,-

(a) "Appointing Authority" in respect of the Service means Sanchi University of Buddhist- Indic Studies;

(b) "University" means Sanchi University of Buddhist-Indic Studies abbreviated as 1SUBIS';

(c) "Examination" means a competitive examination for recruitment to the service held under rule 11 of these rules.

(d) 'Scheduled Caste" means any caste, race of tribe or part of or group within caste, race a or .tribe specified as Scheduled Caste .with respect to the State of Madhya Pradesh • a under Article 341 of the Constitution of India;

(e) "Scheduled Tribe" means any tribe or tribal community or part of or group within tribe or tribal community specified as Scheduled Tribes with respect to the State of Madhya ,Pradesh under Article 342 of the Constitution of India;

(1) Other Backward Class means a class or group so notified by the Govt. Notification Number F-8-5/25/4/84 Date 26.12.84 and as amended from time to time.

• .• (g) "Selection Committee" means committee specified in the article 35 SUBIS act. • • (h) "Departmental promotion committee" committee constituted by the executive council a for promotion for various posts from time to time.

(i) "Service" means the SUBIS Educational Service (Collegiate Branch) Gazetted; Service;

(I)". Physically handicapped" means:- (I). A person is blind if he suffers from one of the following conditions,-

(i) Total loss of vision;

(ii) Intensity of eyesight is not more than 6/60 or 20/200 (shellan) in the better eye • with the corrective lens; or • (iii) The frontal angle of vision is limited to an angle o120 degree or more.

(II) A person is deaf if he lacks sensation of hearing required for daily purpose, to the extent that -he cannot hear or understand even amplified sound. Such persons who suffer from loss of hearing the better ear to the extent of more than • • (,) • • • • e • • • (III) Those persons will be deemed to be suffering from the physical infirmity who • have a physical defect or deformity which does not allow the bones, muscles or joints in normal bodily functions.

3. Scope And application :- Without prejudice to the generality of the provisions contained in the SUBIS Services (General Conditions of Service) Rules, 2014, these rules shall apply to every member of the Service.

4. Constitution of the Service:- The Service shall consist of the following persons, namely:- (I) Persons who at the commencement of these rules are holding substantively or in 0 officiating capacity the posts specified in Schedule- I

(2) Persons recruited to the Ser.vice in accordance with the provisions of these rules. a • S. Classifications, Scale of Pay, etc :- The classification of the Service the number of posts included in the Service and. the Scale of Pay attached thereto shall be as specified in Schedule - I.

g Provided that the Sanchi University of Buddhist-Indic Studies may, from time to time add Ca to or reduce the number of posts included in the Service, either in a permanent or • temporary basis.

'D 6. Method of recruitment:- • a (1) Recruitment to the Service, after the commencement of these rules, shall he by the following methods, namely:- 4) (a) By direct recruitment by competitive examination/selection; •

(b) By deputation of persons who hold in a substantive capacity such posts in such service as specified in Schedule-11;

(c) By promotion of members of the service as specified in column (2) of Schedule- IV;

(d) By absorption in accordance of the procedure prescribed in Rule 13, after the taken over of any institution by the University or otherwise;

• ta (e) By lien of persons who hold in a substantive capacity such posts in such .

• service as specified in Schedule-11;

(0 By extension/re-employment of persons of exceptional credentials; •

(g) By contract of services of persons as specified in Schedule-11; and •

(h) By invitation of persons of exceptional academic reputation & • credentials;

(2) The number of persons•recruited under clause (b) and sub-rule (c) of sub:rule • (I) shall not at any time exceed the percentage shown in Schedule-11 of the number of duty posts as specified in Schedule-1. • • _ • _) S 0 0 0 .

S. • • (3) Subject to the provisions of these rules, the method or methods of recruitment to be adopted for the purpose of filling any particular vacancy or vacancies in the service as may be. required to be filled during any particular period or recruitment, and the number of persons to be recruited by each method, shall be determined on each occasion by the Sanchi University of Buddhist-indic Studies in consultation with the General Council.

0 (4) Notwithstanding anything contained in sub 'rule (I), if in the opinion of the University the exigencies of the' service so require, the University may; with prior concurrence of the General Council adopt such methods of recruitment to the service other than those specified in the said sub-rule, as it may, by order issued in this behalf, prescribe. '

7. Appointment to the Service :- All appointments to the service alter the'commencement ()I' 0 these Rules shall be made by the Sanchi University of Buddhist-Indic Studies and no such • appointment shall be made except after selection by one of the method of recruitment specified in rule 6. Appointment to these services is open to candidates both from India & .

outside India.

a 8. Conditions of eligibility of Direct Recruits :- In order to be eligible to compete at the examination/selection a candidate must Satisfy the following conditions, namely:- 0 •

(1) (A) Age.- 0

(a) The candidate must have attained the age as specified in column (4) of Schedule III and not attained the age as specified in column (5) of the said schedule on the first day of January next following the date of commencement of the examination/selection.

a (b) The upper age limit shall be relaxable upto a maximum of 5 years if a a candidate belongs to a Scheduled Caste or a Scheduled Tribe.

(c) The upper age limit will also be relaxable in respect of candidates who arc C.) or have been employees of the Madhya Pradesh. • ',.....) University to the extent and subject to the conditions specified below:- • a

(i) A candidate who is a permanent Government Servant should not be more than 35 years of age. The selection committee can relax the age subject to the (.3 approval of Executive Council in Exceptional cases.

(ii) A candidate holding a post temporarily and applying for another post U should not be more than 35 years of age. This concession shall also be admissible to the teachers appointed on emergency basis, contingeitcy -c ) paid employees. Work charged employees and employees working in the Project'Implementation Committees.

(iii) A candidate who is retrenched Government servant will be allowed to -....) deduct from his age the period of all temporary service previously rendered by him up to a maximum limit of 7 years even if it represents '....)

Explanation :- The term "retrenched Government servant" denotes a person who was in temporary Government service of this State or of any of the constituent units, for a continuous period of not less than six Months and who was-discharged because of reduction in establishment not more than three years prior to the date of his registration at the employment exchange or of application made otherwise for • employment in Government Service. .

(iv) A candidate who is an ex-serviceman will be allowed to deduct from .his age the period of all defense service previously rendered by him provided that the resultant, age does not exceed the upper age limit by more than three years.

Explanation :- The term "ex-serviceman" denotes a person who .

belonged to any of the following category.and who was employed under the Government of India for a continuous period of not less than six Months and who was retrenched or declared surplus as a result of the recommendation of the Economy Unit or *due to normal reduction in establishment not more than three years before - the date of his registration at any employment exchange or of application made otherwise for employment in Government Service:- Ex-serviceman released under mustering out concessions.

Ex-Servicemen enrolled for the second time and discharged on (a) completion of short-term engagement (b) fulfilling the conditions of enrolment.

Ex-personnel of Madras Civil Unit.

Officers (Military and Civil) discharged on completion of their contract (including short service Regular Commissioned Officers).

Officers discharged after working for more than six months continuously against leave vacancies.

Ex-Servicemen invalided out of service;

Ex-Servicemen discharged on the ground that they are unlikely to become efficient soldiers.

Ex-Servicemen who are medically boarded out on account of gunshot, wounds etc.

The upper age limit shall be relaxable upto 38 years of again respect of candidates who are employees of Madhya Pradesh State Corporation/Boards.

(I 0)The general upper age limit shall be 40 years for women of General Category, 45 years for women belonging to scheduled Caste/Scheduled tribe/Others Backward Class category; and 50 (I 1)The upper age limit shall be relaxable upto maximum 2 years in 0 respect of their Candidates who are holding Green Card under the Family Welfare Progranime.

• (I 2)The general upper age limit shall be relaxed upto 5years in respect of awarded superior cast partner of a cupple under the Inter Cast CO Marriage incentive programme of the Tribal, Schedule Caste and Backward Classes Welfare Department.

0 • 0 (13)The upper age limit shall also be relaxed upto 5 years in respect of O "Vikram Award" holder candidates.

(14)The upper age Ii -nit shall be relaxed in the case of voluntary Home 0 ,Guards and non-commissioned officers of Home Guards for the period of service rendered or by them subject to the limit of 8 years but in no case their age should exceed 38 years.

Note:- Candidates who are admitted to the examination/selection under the age • concessions mentioned in rule 8 (c) (i) and (ii) above will not be eligible for • appointment if after submitting the application, they resign from service either before or after taking the examination. They will, however, continue to be eligible if they are retrenched form the service or post after submitting the applications. In a no other case will these age limits be relaxed. Departmental candidates must obtain previous permission of the appointing authority to appear for the examination.

a • ra (B) Educational Qualification :- He/She must possess. the educational qualification prescribed for the service as shown in Schedule-III:

• years in respect of widows, destitute and divorced women of reserved category candidates. Whereas for widows, destitute and . divorced women candidate of general category the maximum upper age shall be limited to 45 years. This provision should be applicable to the residents of Madhya Pradesh only.

Provided that - 0

(a) In exceptional cases the Selection Committee may, on the recommendation of the 0 Academic Council, treat as qualified a candidate, who though not possessing any of the qualifications prescribed in this.clause, has passed examination conducted by ;,.) other institutions by a standard which, in the opinion of the Selection Committee, -justifies the admission of the candidate to the examination/selection;

(6) Candidates who are otherwise qualified but have taken degree from Foreign i.) Universities, being Universities not specifically recognised by University may also be considered for the examination/selection at the discretion of the Selection :.„) Committee.

i.) - (c) In exceptional cases in the fields which are new & innovative in which organized education does not exist, the Selection Committee may, on the recommendation of (.) the Academic Council, treat as qualified a candidate, who though not possessing _ • • • • • Castes, Scheduled Tribes and Other Backward Classes respectively. In addition to this, six percent (three perCent General, one percent SC, one percent 013C) of the 1 13 available vacancies shall be reserved for those Physically Handicapped whose deformity does not become hurdle in teaching work.

(4) In filling the vacancies so reserved, candidates who are Physically Handicapped, 3 members of the Scheduled Castes, Scheduled Tribes and Other Backward Classes shall be considered for appointment in the order in which their names appear in the list referred to in rule 12 irrespective of their relative rank as compared with other candidates.

Candidates belonging to the Scheduled Castes, the Scheduled Tribes and Other Backward Classes recommended by the Selection Committee to be suitable for appointment to the service with due regard to the maintenance or efficiency of administration, may be appointed to the vacancies reserved for the candidates of the Schedule Castes, the Scheduled Tribes and the Other Backward. Classes as the -case may be, under sub-rule (3)

(6) If a sufficient number of candidates belonging to the Scheduled caste, Scheduled Tribes and Other Backward Classes are not available for filling all the vacancies reserved for them; the remaining vacancies shall be readvertised.

0 9. Disqualification :- Any attempt on the part of a candidate to obtain support for his candidature by any means may be held by the Selection Committee to disqualify him for admission/selection to the examination. •

10. Commitee's Decision about the Eligibility of Candidates Final :- The decision of the Selection Committee as to the eligibility; or otherwise of a candidate for admission to the • • examination/selection shall be final and no candidate to whom a certificate of admission has not been issued by the Selection Committee, shall be admitted to the examination or • - interviewed by the Selection Committee.

• 1 1 . Direct Recruitment by Selection :- • (I) Direct • recruitment shall be made by competitive examination to the posts ol' Professor, Associate Professor, Assistant Professor, Librarian and Sports Officer a and the Merit list shall be made for the appointment on the basis of total marks obtained in basic & additional relevant qualifications, written examination, quality of experience and interview.

. (2) The selection for recruitment to the.service shall be held at such intervals as the University may in consultation with the Selection Committee from time to time tip determine. The examination shall .be conducted by the Selection Committee in accordance with such orders as the University may from time to time issued in a consultation with the Executive Council.

3 (3) 16 per cent and 20 percent and 14 percent of the available vacancies for .direct recruitment shall be reserved for candidates who are members of the Scheduled .3 •

12. List of Candidates recommended by the Selection Committee :-

(1) Subject o the provisions of these rules and of the SUBIS Educational Services (General Conditions of Service) Rules, 2014, candidates will be considered for appointment to the available vacancies in the order in which their names appear in the list.

• 0 (2) The inclusion of a candidate's name in the list confers no right to appointment unless the University is satisfied, after such enquiry as may be conSidered necessary, that the candidate. is suitable in all respects for appointment to the service.

(3) The Selea List shall be valid for a period of one year from the date of its issue by the Selection Committee, provided that the University with the consultation of the O Selection Committee may extend the validity of the Select List up to a maximum period of one more year.

13. Recruitment by Absorption :- (I) The absorption of Professors, Associate Professor, AsSistant Professors Librarian and Sports Officers of any institution or university will be made through Selection Committee, after examining every case and on its recommendations to the t:0 University.

(ii) The Selection committee shall recommend the cases referred to it for absorption to appropriate posts on the following basis:- 0 (A) No person shall be absorbed if at any time in the past he or she was removed or dismissed from Government or any other service for proved a misconduct and/or criminal offence.

• a (B) No person shall be absorbed in University Service if he or she has attained the age of superannuation according to the Government rules in force at the time of absorption.

• 'a (C) No person appointed as or holding the post of a Registrar, or a Librarian or a Sports Officer, in a* non-government college taken over by the State J Government, shall be absorbed in University Service, unless at the time of appointment, such person answers such minimum requirements or holds such qualifications as may be laid down by the State Government by an order in writing. *a (D) No person shall be absorbed in University Service whose appointment is not approved as a regular appointment by Madhya Pradesh Uchcha Shiksha •• Anudan Ayog or the University as the case may be. •

(iii), (A) No person shall be absorbed in a higher post in University Service from the •• post on which he was working prior to the. take over of the college by University.

) • • • 3 • • • p3 • The Selection Committee, after taking into consideration the relevant provisions of this rule shall 'make Suitable recommendations to University. After the recommendations of the Committee are approved by University, the absorption orders of .the 'concerning persons will be issued by University according to the recommendations of the Committee.

A person absorbed to -a particular post shall get his seniority from the date the institution was taken over.

No leave shall be permitted to be carried forward by a person working in a nongovernment college on his absorption in University service. However, if such a person pays the leave salary contribution in respect of the service rendered in a non-government college, he shall be permitted to carry forward the leave so earned subject to the restrictions and maximum limits prescribed in the University Leave Rules.

(vii) No person absorbed into University service under the provision of this Rule shall . by.

virtue of the fact that he was earlier confirmed in service by the nongovernment college claim as of right to be confirmed in University service.

Confirmation of such persons shall be done in accordance with the University rules in force from time to time.

The Professor, Assistant Professor, Librarian and Sports Officer of the nongovernment college, taken over by the university whose appointments were approved as a regular appointment by Madhya - Pradesh Uchcha Shiksha Anudan Ayog, or the University, Higher Education Department as the case may be, but are rejected by the Screening Committee for their absorption in University Service due to any reason, will continue on the post, they held on temporary basis in dying cadre, but will not get any benefit of seniority, promotion, annual increments and revision of Pay-Scale in University Service as such.

14. Recruitment by Lien :- The Lien of Professors, Associate Professor, Assistant Professors Librarian and .

Sports Officers of any institution or. university will be made through Selection Committee, after examining every, case and on its recommendations to the University.

The Selection Committee shall recommend the cases referred to it for Lien to appropriate posts on the following basis:- (A) No person shall be taken on Lien if at any time removed or dismissed from Government or any misconduct and/or criminal offence.

(B) No person shall be taken on Lien in University attained the age of superannuation according to force at the time of absorption.

15. Recruitment by Deputation

(i) The deputation of Professors, Associate Professor, Assistant Professors Librarian and Sports Officers of any institution or university will be made through Selection Committee, after examining every case and on its recommendations to the o • University.

(ii) The Selection Committee shall recommend the cases referred to it for deputation to appropriate posts on the following basis:- 10 (A) No person shall be taken on deputation if at any time in the past he or she was removed or dismissed from Government or any other service for proved misconduct and/or criminal offence.

(B) No person shall be taken on deputation in University Service if he or she a has attained the age Of superannuation according to the Government rules in a force at the time of absorption.

(C) No person shall be. taken on deputation in University Service against a post for promotion, unless it is lying vacant for the want of appropriate person.

The deputation shall be only for the limited period, till the promotional post is filled by due process.

• • 16. Recruitment by Extension/Re-employment :-

(i) The extension/re-employment of Professors, Associate Professor, Assistant Professors Librarian and Sports Officers of any institution or university will be made through Selection Committee, after examining every case and on its recommendations to the University.

(ii) The Selection Committee shall recommend the cases referred to it for extension/reemployment to appropriate posts on the following basis:- 3 (A) No person shall be taken on extension/re-employment unless he is of exceptional caliber 8c credentials and is in absolute academic interest of the university & its reputation. This should be done in rarest of the rare cases.

(B) No person shall be taken .on extension/re-employment if at any time in the past he or she was removed or dismissed from Government or any other service for proved misconduct and/or criminal offence.

(C) No person shall be taken on extension/re-employment in University Service if he or she has attained the age of superannuation according to the Government rules in force at the time of absorption.

• _) • • (C) No person shall be taken on Lien in University Service against a post for promotion, unless it is lying vacant for the want of appropriate person. The Lien shall be only for the limited period, till the promotional post is tilled by due process.

S 17. Recruitment by Invitation :- IP (I) The University on the recommendation of Academic Council can recruit a person P of exceptional academic • caliber & reputation by invitation for the post of IP Professors, Associate Professor, Assistant Professors Librarian and Sports Officers se of any institution or university will be made through Selection Committee, after ao examining every case and on its recommendations to the University.

I (ii) The Selection Committee shall recommend the cases referred to it for recruitment to appropriate posts on the following basis:- a • • 3 • 0 41 0 •

18. Recruitment by Contract :- IP The University on the recommendation of Academic council can recruit a person a of exceptional academic caliber & reputation or when- it is eXtremely necessary to recruit to give quality teaching because of paucity of faculty on contact for not more than 2 years at a time for the post of Professors, Associate Professor, Assistant Professors Librarian and Sports Officers of any institution or university will be made through Selection Committee, after examining every case and on its recommendations to the University.

(A) No person shall be taken on contract if at any time in the past he or she was removed or dismissed from Government or any other service for proved misconduct and/or criminal offence.

• (B) No person shall be taken in University Service against a post for promotion, 411 unless it is lying vacant for the want of appropriate person. The recruitment shall be only for the limited period, till the promotional post is filled by due process.

‘) • ' 19. Appointment by Promotion :- • m There shall be constituted a committee consisting of the members mentioned in Schedule-IV for making a selection for promotion of eligible candidates.

(2) The Committee shall meet at intervals ordinarily not exceeding one year.

No person shall be taken on deputation if at any time in the past he or she was removed or dismissed from Government or any other service for proved misconduct and/or criminal offence.

No person shall be 'taken on in University Service if he or she has attained the age of superannuation according to the Government rules in force at the time of absorption.

No person shall be taken in University Service against a post for promotion.

(3) 16% and 20% of the available vacancies for promotion for Scheduled caste and Scheduled Tribe respectively ' 0

(4) Procedure for making promotions in the reserved vacancies shall be in accordance with the instructions issued by Government in the General Administration Department from , . time to time.

0 Note - The departmental promotion committee shall be formed by the executive council from time to time. - •

20. Conditions of eligibility for promotion/transfer :7 (A) Promotions on the basis of seniority — cum merit.

• (1) In such, cases where the promotion is to be made on the basis of seniority subject to fitness, there shall be no zone of consideration for all categories.

(2) The names of only such public servant shall be considered for promotion. Who have • completed the prescribed qualifying serVice in their feeder cadre/part of service/pay • scale of post according to the Recruitment. Rules. It is, however, not necessary to consider all the names of public servant who have completed the prescribed minimum length of service but only such number of cases of public servant shall be considered according to the seniority which shall be sufficient to cover the number of existing and anticipated vacancies due to retirement during the year under each category. Iii addition to this, with a view of inclusion, in the Select List, the names of two public servant or 25 percent of the number of the public servant included in Select List whichever is more, the names of the required number of the public • servant shall be considered for each category to fill up the unforeseen vacancies occurring during the course of the aforesaid period.

3 • Explanation :- Manner of computation for eligibility for promotion :- Period of qualifying service on 1St January of the relevant year in which Departmental a Promotion Committee is convened shall be counted from the calendar year in • which the public servant has joined the feeding cadre/part of the service/pay scale of the post and not from the date of joining of the cadre/part of the service a . /Pay Scale of post. And not from the date of joining of the cadre/part of the service /Pay Scale of post.

3 (3) The number of vacancies for promotion during the course of the year i.e. from 1st January to almost December shall be worked out after taking into account the existing and anticipated vacancies on account of retirement, and promotions to higher cadres/part of the service/higher pay scale of posts. Vacancies arising out of deputation for periods exceeding one year shall also be taken into account. The number of vacancies to be reserved for public servants belonging, to Scheduled Castes and Scheduled Tribes shall be worked out on the basis of the roster which is required to be maintained in accordance with the provisions of rule 9 of these rules.

(4) The meeting of the Departmental Promotion Committee shall be held every year. It • shall consider the Suitability of the public servants for promotion separately with reference to the vaCancies of each year starting with the earliest year onwards. _i_1) (5) The Departmental Promotion Committee shall assess the suitability of the public servants for promotion on the basis of their service record and with particular reference to the Annual Confidential Reports (ACRs) for 5 preceding years.

However, in cases where the required qualifying service is more than 5 years, the Departmental Promotion Committee shall see the record with particular reference to • the ACRs for the years equal to the required qualifying service.

(6) When one or more ACRs are not available for any reason for the. relevant period the SI Departmental Promotion Committee shall consider the ACRs of the years preceding IP the period in question.

(7) For filling up the posts by this method, the Departmental Promotion Committee shall 3 consider the case of each public servants separately on the basis of his own merit, that is to say, that there shall be no need to make a comparative assessment of the merits of public servant. The Departmental Promotion Committee shall consider the • recOrds of each public servant separately and shall categories therh as 'fit' or 'not tit'.

(8) Separate Select Lists shall be prepared for the public servants of unreserved D category, Scheduled Castes and Scheduled Tribes category in which the names of such number of public servants belonging to unreserved category. Scheduled Castes 3 and Scheduled Tribes category shall be included which is equal to the number of posts reserved for each of these categories. In addition to this, names of two public servants or twenty five Percent of the number public servants included in the Select a List whichever is more, will also be included in the Select List of each category as prescribed in sub rule (2).

a . (9) The names of university public servants included in each list shall be arranged in the same order of their seniority, as they existed in the cadre/part of the service/pay scale .3 of post from which promotion is to be made.

(I 0) The promotion of public servants shall be made from these separate Select Lists • according of their seniority in the feeder cadre/part of the service/pay scale of post J• and according to the prescribed order shown in the roster.

• ,.) (I 1) In order to determine the inter-se-seniority of the public servants belonging to the three categories in the cadre/part of the service/pay scale of post to which promotion 3 is to be made, a combined Select List of the above three categories of public servants shall be prepared in the same order in which their names appear in the seniority list .3 of the cadre/part of the service/pay scale of post from which the promotion is being • ) • made.

(12) The names of pOblic servants promoted On the basis of above combined Select List 3 shall be places enblock below the name of last public servant promoted on the basis of the immediately preceding year's combined Select List„. gc.

IP 0 • e (13) The reserved posts which remain .unfilled due to non-availability of suitable public servants of the category for which the post is reserved despite consideration of the names of all public servants eligible for consideration as per the Recruitment Rules ,0 shall be carried forward, that is to say, shall be kept vacant until the suitable public S servants belonging to that reserved category is available. In no circumstances any vacancy of reserved category shall be filled-up by promotion from the public servant belonging to any other category.

(14) Wherever the reserved vacancies for Scheduled Castes and Scheduled Tribes in all cases of promotion have remaine& unfilled in the earlier year or years, the backlog III and/or carried forward vacancies would be treated as a separate and distinct group and will not be considered together with the reserved vacancies of the year in which they are being filled up for determining the ceiling of filly percent reservation on p total number of vacancies of that year. In other words, the ceiling of fifty percent on .1111 ..2 filling up of reserved vacancies would apply only on the reserved vacancies which IP arise in the current year and the backlog/carried forward reserved vacancies ihr 3 Scheduled Castes or Scheduled Tribes of earlier year or years would be treated as a separate and distinct group would not be subject to ceiling of fifty percent:

Provided that the appointing authority shall convene a special meeting of 0 3 Departmental Promotion Committee within six months to fill up backlog vacancies and if such vacancies still remain unfilled, they shall not be dc-reserved in any a manner for filling up by the public servants not belonging to the category for whom 0 the post or posts are reserved.

D (15) When a public servant, whose name is included in the Select List wants to refuse • a promotion, he may make a written reqtiest that he may not be promoted. Such request shall be considered by the Appointing Authority taking relevant aspects into a consideration. If the reasons adduced for refuSal of promotion are acceptable to the Appointing Authority, the next public servant in the Select List may be promoted.

-.) However, since, it may not be administratively possible or desirable to offer 11111 appointment to the public servants who initially refused promotion, on every a occasion on which a vacancy arises during the period of validity of the panel, no fresh offer of appointment on promotion shall be made in such cases for a period of D one year from the date of refusal of first, promotion or till a next vacancy arises, • a whichever is letter. On the eventual promotion to the higher cadre/part of the IP service/pay scale of post, such public servant shall lose seniority vis-à-vis his juniors 3 promoted in the preceding year to the higher cadre/part of the service/pay scale of 11111•1 post.

In cases where the reasons adduced by the public servant for his refusal promotion or not acceptable to the Appointing Authority then he shall enforce the promotion on the public servant and in case the public servant still refuses to be promoted, then _) even disciplinary action may be taken against him for refusing to obey his order.

• (8) Promotion on the basis of merit-cum seniority :- ) (I) Where promotions are to be made on the basis of merit-cum seniority, the zone of consideration, that is the number of public servants to be considered for promotion out • ) © 1 of those eligible public servants in the feeder cadre/part of the service/pay scale of post shall be as under:- No. of vacancies to be fined during the year No. Of persons to be considered I 5 2, 8 3 10 4 12 5 14 6 16 The formula for the further calculation shall be that the "4" be added to the double the number of anticipated vacancies.

(2) Where ,adequate number - of public servants belonging to Scheduled Castes and Scheduled Tribes are not available within the zone of consideration as mentioned above, then the zone of consideration may be enlarged to seven times the number of vacancies and the name of only such public servant belonging to Scheduled Castes and Scheduled Tribes who are in the enlarged zone of consideration shall be considered for filling up the reserved posts.

The names of only such public servants shall be considered for promotion who have completed the requisite number of years of service in the feeder cadre/part of the service/pay scale of post according to the Recruitment Rules for promotion and who • are within the zone of consideration. In addition to this, in view of inclusion, in the Select List,- the names of two public servants or 25 percent of the number of the public servants included in Select List whichever is more, the names of the required number of the public servants who are in the zone of consideration shall he considered for each category to fill up the unforeseen vacancies occurring during the course of the aforesaid period.

Explanation :- Manner of computation for eligibility for promotion: - Period of qualifying service on 1st January of the relevant year in which Departmental Promotion Commirtee/Screening Committee is convened shall be counted from the calendar year in which the public servant has joined the feeding cadre/part of the service/pay • scale of the post and not from the date of joining of the cadre/Pay Scale of post.

1111, (4) The number of vacancies for promotion during the course of the year i.e. from 1st January to 31 December shall be worked out after taking into account the existing and anticipated vacancies on account of retirement and promotions to hiuher a cadres/part of service/higher pay scale of posts. Vacancies arising out of deputation for periods exceeding one year Shall also be taken into account. The number of vacancies to be reserved for public servants belonging to Scheduled Castes and Scheduled Tribes shall be worked out on the basis of the roster which is required to be maintained in accordance with the provisions of rule 9 of these rules.

_) (5) The meeting of the Departmental Promotion/Screening Committee shall be held every. year. Ii shall consider the suitability of the public servant for promotion _) separately with reference to the vacancies of each previous year starting with the earliest year onwards. The Departmental Promotion Committee /Screening Committee shall consider, the suitability of the public servants for promotion to fill _) IS 0 - 0 ' e ¶3 .up the unfilled vacancies of the earlier year or years separately and prepare the Select List for the relevant year accordingly, Thereafter the Departmental Promotion Committee/Screening Committee shall consider the suitability of the public servants for promotion to fill up the existing and anticipated vacancies of the current year.

0 (6) The Departmental Promotion/Screening Committee shall assess the suitability of the public servants for promotion on the basis of their service record and with particular reference. to the Annual Confidential Reports (ACRs) for 5 preceding years.

(9) The Departmental Promotion/Screening Committee shall make ' a • relative/comparative assessment of the merits of public servants who are within the zone of consideration and Make and overall grading of the public servants merit on the basis'of their service records and place them in the categories as "outstanding", "Very-good", "Good", "Average' and "Poor" as the case may be. However, only a those public seryants who are graded as "Very-Good" an above will be included in the Select List, by placing the public servants graded as "Outstanding" on top a followed by those graded as "Very-Good", subject to availability of vacancies, with the public servants with the same grading maintaining their inter-se-seniority in the a feeder cadre/part of the service/pay scales of post.

• a (10) Separate Select Lists shall be prepared for the public servants of unreserved category, Scheduled Castes and Scheduled Tribes category in which.the names of such number -a of public servants belonging to unreserved category. Scheduled Castes and Scheduled Tribes category shall be included which is equal to the number of posts .

In other words, the ceiling of fifty percent on 3 -filling up of reserved vacancies would apply on the reserved vacancies which arise in the current year and the backlog/carried forward reserved vacancies for Scheduled a Castes or Scheduled Tribes of earlier year. or years would be treated as a separate and distinct group and would not be subject to ceiling of fifty percent:

(15) The reserved post which remains unfilled due to non-availability of suitable public servants of the category for which the post is reserved despite consideration of the names of all public servants eligible for consideration as per the Recruitment Rules, e shall be carried forward that is to say, shall be kept vacant until the suitable public .1 S • e • • • post: In cases where the reasons adduced by the public servant for his refusal for IP— promotion are not.acceptable to the Appointing Authority then he shall enforce the promotion on the public servant and in case the public servant still refuses to be promoted, then. even disciplinary action may be taken against him for refusing to obey his order.

IP 0 21. Lowering the standards of. evaluation :- The General Council, may by order make provisions in favour of the public servants of the Scheduled Castes and the Scheduled C Tribes for lowering the standards of evaluation in the matter of promotion to any class or classes of servides or posts in connection with the affairs of the University.

0 0 22. Roster :- 0 (i) . There shall be maintained rosters invariably by every appointing authority in the 0 prescribed forms as shown in 0 Schedide — I for backlog vacancies of Scheduled Castes category and in schedule - 0 II for the backlog vacancies of Scheduled Tribes category and in Schedule - Ill of the existing vacancies of the relevant year appended to these rules in respect of shall be maintained separately for each such cadre/part of the service/pay scale of poSt.

Before making any promotion, the appointing authority shall ascertain invariably from .the roster whether the vacancy is reserved or unreserved and if is reserved, for whom it is so reserved. Immediately after a promotion, the particulars thereof shall be entered in the roster and singed by the appointing authority.

The 'roster is a running account form year to year and shall be maintained accordingly. If promotion in a particular year stops at a particular point of cycle, say, at the 5th• point, promotion in the subsequent year shall begin at the next point, that is, at the 6th point.

Consultation -with the Committee :- The recommendations of the Departmental Promotion . 3 24..Probation :- Every person directly recruited to the service shall be appointed on probation for 3 a Period of two years.

0 25. Interpretation :- If any question arises relating to the interpretation of these rules it shall be 0 referred to Government whose decision thereon shall be final;

26. Relaxation :- Nothing in these Rules shall be construed to limit or abridge the power of the Governor.to deal with the case of any person to whom these rules apply in such manner as May appear to it to be just and equitable:

Provided that, the case shall not be dealt with in any manner less favourable to him then that provided in these rules.

27. -Saving :- Nothing in these rules shall affect reservation and other conditions required to be provided for Scheduled Castes and Scheduled Tribes in accordance with the orders issued.
