(d) the'balance shall be paid in monthly or quarterly'instalments of such amount as may be decided by the Panchayat concerned Within 5 days of the beginning of month or quarter and the lease deed shall be executed .Within thirty days of the confirmation of the bid being.notified to him. Ifhe fails to execute the lease deed Within the period specified above the twenty fiveperc'ent. amount deposited by him shall stand forfeited in favour of the Panchayq.t concerned and ,the auction shall be treated as cancelled. . . \ '.. . '.8. Refund of earnest .-noney.-(l) The amount of earnest money of the rest of the bidders shall be refunded to the persons concerned:.
(2)Where a lower bid is proposed to be accepted under the proviso to clause (b) of rule 7, the amount deposited under claus~ (c) of the said rule shall be refunded to the person concerned as soon as may be, after sanction of the lower bid by the officer mentioned in the said proviso.
9. 10. Accounts of Auction.-The lease moriey shall be realised' by: the concerned panchayat. The Panchayat shall issue a receipt to the'leasee. The Chief Executive Officer Janpad Panchayat/ Secretary of Gram Pi:'l.llchayatshall maintain.a proper record of auction.
11. 1. Short title.-These rules may be called the Madhya Pradesh Zila Panchayat Members (Travellingand other allowances) rules, 1995.
2. Definition.-In these rules upless the context otherwise requires,-
(a) "Act"means the Madhya Pradesh Panchayat Raj Adhiniyam, 1993 (No.1 of 1994); /(b) '~Member"means a member of Zila Panchayat, ot er than the member referred to in clause (iii),(iv)and (v)of sub-section (1)of Section 29 of the Act;
(c)"Panchayat" means the Zila PE.nchayat;
(d) "Place of,meeting" means a place fIxed for the meeting of the Panchayat or a place to which jouoey is .required to be performed by President, Vice-President and any member under general or special order of Government;
(e)the expression "Place or residence" means in case of the President of Zila Panchayat, the headquarter clfZila Panchayat and in case of the Vice President and the member of Panchayat, the place intimated to the Chief Executive OffIGer,where the member usually resides if such place is within the Panchayat area and if his actual place of residence is situated outside the Panc.hayat area, then the specified nearest place within the Panchayat an~a;
(f) "President and Vice-President" means the President and VicePresident of*ZilaPanchayat. :.. _ _:3._~r~ve~l~ngil~_d_d_~y a1~owa~ceadmissible_on tour.-(l) Subject to the provisions of these rules~ the-Pres-identVice Presldenrcirid--the-meIri~-'---'_.-- -- -- bers shall be entitled to travel in AlC II Class Sleeper or First Class of railway or in higher class of bus and also entitled to draw daily allowance at the rate of forty rupees per day.
(2)Any member getting any fixed honorarium shall not be entitled to draw daily allowance.

(4)The members ofMadhya Pradesh LegislativeAssembly and member of Parliament, who 'are ex-officiomembers or.'the Panchayat shall not be entitled to draw any allowarices under these tules. .
(5)President, VicePresident and any member whose place of residence is at a distance ofmore than eight kilometers from the place of meeting, subject to the provision of these rules, shall be entitled to draw,-

(a) by railway, one return aetual fare of the Class in which he performs the journey; / (b) by road i~la Public bus (stage carriage) one return actual fare;
(ti) Daily allowance for the day ofmeeting at the rate mentioned in sub-rule (1);
(iii) the travelling allowance under clause (i)of sub-rule (5)shall be calculated by the shortest route and cheapest mode ofjourney.
(6) The travelling allowance payable in a month to the different categories of members specified in column .(2)of the following table shall be limited to the maximum number ofjourneys undertaken as specified against each in column (3)of the said table:- TABLE
4. Tour outside Jurisdiction. -If the President, VicePresident and any Member undertakes any tour outside the jurisdiction of the Panchayat concerned in. copnection \Vithany meeting, he shall be entitl~d to draw daily allowance'and travelling ali6wances at ~e rate' specified in sub-rule .
(i)of rule 3, subject to the provisions of sub-rule (2):
Provided that no such tour shall be undertaken unless authorised by general or specific order of the State Government:,
Provided further that no tour shall be undertaken outside the state unless, the State Government specificallypermits for it in advance. .
5. Tour by own vehicle~-Tour by ownvehicle shall not be permitted.
6. Tour by Panchayat vehicle.-(1) When a vehicle is provided to President, Vice President and any member of Panchayat, the monthly .._-ceiling on consumption of Petrol/ diesel and maintenance of such vehicle '- shall be governed by the instructions issued by the Panchayat and Rural Development Departrne~t from time to time. .
(2)NoPanchayat Vehicle shaUbe taken outside the jurisdiction of the concerned Panchayat without the written permission of Divisional Commissioner.
7. (2)A claim for travelling ..daily allowance and other allowances shall be deemed to have become due on the last day of the month to which it relates. (3.1If claim is preferred after one year, the reasons for the delay for submission of the same shall be ~tated by the claimant in his bill, to the satisfaction of the countersigning authority.
