Provided that in the case of an appointment as a Chairman, Vice-Chairman or a Memb~r of a person w!:o hos reth 'ed as a Judge of a High COllrt or who has retired from ser;~:e under the Central Govern m',nt or a State Government and who is in receipt of cr has received or has become entitled to receive anv retirement benefits bv way of either pension or gratuity or both or employer's contr:hution to the Contributory Provident Fund or other forms of re tir~ment benefits, the aforementioned pay shall be reollcecl by the gross amollnt of pension and pension eq,.ivalent of gratuity or employer's contribution to th~ C'mtrihutory Provident Fund or anv other form of retirement benefits, if any, drawn or to be drawn by him.
