'FT f.r. >to 1157 ({) if If'l'1fmr f'P'< '1<:; iT I MINISTRY OF PERSONNEL, PUBLIC GRIEVANCES AND PENSIONS ( Department of Personnel and Training) NOTlF1CATION New Delhi, the 30th January, 1992 G,S,R, 71(E),-In exercise of the powers conferred by clause (c) of sub-section (2) of section 35 read with section 36A of Ibe Administrative Tribunals Act, 1985 (13 of 1985), the Central Government hereby makes the following rules furtber to amend the 1\faharashtra Admini<tra;ive Tribunal Salaries and Allowances and Conditions of Service of Chairman, Vice-Chairman and Members) Rules, 1986, namely :_ L (1) Short title and commencement.-These rules may be called the Maharashtra Administrative T ribu nal (Salaries and Allowances and Conditions of Service of Chirman, Vice-Chairman and Members) Amend ment Rules, 1992,
(2) They shall be deemed to have come into force on the 8th day of July, 1991.
2. In the Maharashtra Administrative Tribunal (Salaries and Allowances and Cond'tions of Service of Chairman, Vice-Chairman and Members) Rules, 1986 (hereinafter referred to as the said rules), for rule 3, the following rule shall be SUbstituted, namely :_ "3, Pay,-The Chairman shall receive a pay of rupees eight thousand plus a special pay of rupees five hundred per mensem. A Vice Chairman shall rece've a pay of rupees eight thousand per mensem· A member shall re ceive a pay in the scale of Rs, 7300-100-7600 per mensem:
Provided that in the case of an appoint ment all Chairman, Vice-Chairman or a person who has retired as a Judge of a High Court or who has retired from service under the Central Government or a State Government and who is in receipt or or has received or has become entitled to receive any retirement benefits by way of pension and or gratuity, employer's contribution to tbe Contributiory Provident Fund or other fonns of retirement benefits, the pay shall be reduced by the gross amount of pension and pension eqnivalent of service gratuity or employer's contribution to the Contributory Provident Fund or any other form of retire ment benefits, if any, but excluding pension equivalent of retirement gratuity, drawn or to be drawn by him,"
3. In the said rules, for rule 4, the following rwe shall be subst:tuted, namely :- "4. Dearness Allowance and City Compensatory Allowance.-The Chairman, a Vice-Chair man and a Member shall receive Dearness Allowance and CIty Compensatory aliowance appropriate to their pay at the rates admIS sible to Group 'N Officers of the Central Government draw'ng a pay in the scale of Rs. 7300-100-7600 or above, as the case may be."
4. After rule 15 of the said rules, the following rule >hall be inserted, namely :- "J5A. Notwithstanding anything contained i!'
rules 4 to 15 of the said rules, the condi tions of service and other perquisites avail able to the Chairman and Vice-Cha'rman of the Mnharashtra Administrauve Tribunal shall be the same as admissible to a serving Judge of a High Court as . contained in .the High Court Judges (Cond.tlOns of Semee) 3 Act, 1954 (28 of 1954) and High Court Judges (I'ravelling Allowances) Rubs, 1956.

EXPLANATORY MEMORANDUM The Central Government has decided to implement the decisions taken on the recommendatious oj the Fourth Central Pay Commiss;on relating to revision of pay in respect of the Central Civil Serviees Group 'A'.
Since all the appointments of Chairman, Vice-Chair man and Members in the Mnharashtra Administrative Tribunal have been made with effect from 8tb July, 1991, these rules are being given effect from that date.
It's cert'fied that no Chairman, Vice-Chairman and Member of the Maharashtra Administrative Tribunal is likely to be affected adversely by this notification being given retrospective effect.
