Section 46: Provisions of Civil Procedure Code to apply to proceedings.

Save as otherwise expressly provided in this Act, the provisions of the Code of Civil Procedure, 1908 (V of 1908), shall apply to all proceedings under this Chapter:
[Provided that the Court may in a proper case and on such terms as may appear to it to be just, exercise its powers to add or strike out parties under rule 10 of Order I of the said Code in any proceeding pending before it under section 4 or 24 notwithstanding the fact that such addition, or striking out of parties is to be made after the date specified in section 4 or 24, as the case may be, has elapsed].
