Section 4: Casual vacancy.

Notwithstanding anything contained in the Marketing Regulation Act and the rules made thereunder, but subject to the provisions of sub-section (2) of section 14 of that Act, in the event of a vacancy occurring in any Market Committee on account of death, resignation or removal of a member or through a member becoming incapable of acting, previous to the expiry of his term of office, or otherwise, the Chairman shall forthwith communicate the occurrence to the Director, as soon as conveniently, may be, by appointment or nomination of a person thereto, who shall hold office so long only as the member in whose place, he is appointed or nominated would have held it; if the vacancy had not occurred :

Provided that, if the vacancy occurs within six months preceding the date on which the term of office of the member expires, the vacancy shall, unless the State Government directs otherwise, not be filled.
