�मांक संकीणर्. 2018/�.�. 248/िव. िश. 3.—ज्याअथ�, भारत सरकारच्या मानव संसाधन िवकास मं�ालयाने, समहू िव�ापीठे िनम�ण करणे शक्य व्हाव े यासाठी, िविन�दष्ट तरतदू करण्याकिरता िडसेंबर, 2013 मध्ये राष्�ीय उच्चतर िशक्षा अिभयानाबाबत मागर्दशर्कतत्वे जारी केली आहेत ;
आिण ज्याअथ�, उक्त मागर्दशर्क त�वांनसुार, राज्यभरातील उच्च शैक्षिणक संस्था अंतरिनहाय िवखरुण्यामधील मोठी तफावत दरू करण्याकिरता “समहू िव�ापीठे स्थापन करण्याची तरतदू केलेली आहे. ज्या महािव�ालयांकडे परेुशा शैक्षिणक, भौितक व तांि�क पायाभतू सोयीसिुवधा आहेत अशा 3 ते 5 िव�मान महािव�ालयांची संसाधने एकि�त क�न, ही िव�ापीठे िनम�ण करण्यात येतील. एका समहूामध्ये सहभागी असणारी सवर् महािव�ालये ही अंितमत: नव्याने िनम�ण केलेल्या िव�ापीठांची घटक महािव�ालये असतील. डॉ. होमी भाभा िव�ापीठाचे िविवध दज�त्मक मापदंड मो�ा �माणात दशर्वतील अशी, गणुव�ेचा दज� राखण्यात िंकवा अन्य कोणत्याही िनकषांमध्ये समथर् असलेली, महािव�ालये म्हणनू जी ओळखली जातील अशी, महािव�ालये स्थापन करण्यात येतील. समहूामध्ये सहभागी होणारी महािव�ालये जेव्हा एक� येतील तेव्हा त्यांच्याकडे िव�ापीठ म्हणनू काम करण्याची क्षमता असली पािहजे. यामध्ये, इतर घटकांबरोबरच �शासकीय कमर्चारीवग�ची क्षमता आिण अनभुव, स्वतं� महािव�ालये म्हणनू कायर्रत असण्याची एकूण वष�, मागील काळात त्यांनी उपभोगलेल्या स्वायत�ेचा दज� इत्यादींचा समावेश असेल” ;
आिण ज्याअथ�, उक्त मागर्दशर्क तत्वांचे परु:सरण क�न, महाराष्� राज्य राष्�ीय उच्चतर िशक्षा अिभयान (�सा) पिरषदेच्या िदनांक 25 मे 2018 रोजी घेण्यात आलेल्या 12 व्या बैठकीमध्ये, एक मखु्य महािव�ालय म्हणनू िवज्ञान संस्था, मुंबई आिण घटक महािव�ालये म्हणनू तीन इतर महािव�ालये म्हणजे, एलिफन्स्टन महािव�ालय, मुंबई, िसडनहमॅ महािव�ालय, मुंबई 2 ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, ¡äò¥ÉÖ́ ÉÉ®úÒ 13, 2019/¨ÉÉPÉ 24, ¶ÉEäò 1940 आिण माध्यिमक �िशक्षण महािव�ालय, मुंबई यांचे िमळून डॉ. होमी भाभा समहू िव�ापीठ स्थापन करण्याची राज्य शासनाला िशफारस करण्याचे ठरिवण्यात आले होते ;
आिण ज्याअथ�, राष्�ीय उच्चतर िशक्षा अिभयान (�सा) याच्या उक्त िशफारशीवर िवचार केल्यानंतर शासनास उक्त घटक महािव�ालयांचा समावेश असलेले डॉ. होमी भाभा स्टेट यिुनव्ह�सटी स्थापन करणे इष्ट वाटते.
त्याअथ�, आता, महाराष्� सावर्जिनक िव�ापीठ अिधिनयम, 2016 (सन 2017 चा महा. 6) याच्या कलम 3 च्या पोट-कलम (6) �ारे �दान करण्यात आलेल्या अिधकारांचा वापर क�न, महाराष्� शासन, या�ारे या समहुामधील �मखु महािव�ालय म्हणनू िवज्ञान संस्था, मुंबई, तसेच घटक महािव�ालय म्हणनू एलिफन्स्टन महािव�ालय मुबंई, िसडनहमॅ महािव�ालय, मुंबई आिण माध्यिमक �िशक्षण महािव�ालय, मुंबई यांचा समावेश असलेले, डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई स्थापन करीत आहे; आिण पढुील�माणे त्याची �ािधकरणे, अिधकार व कतर्व्ये िविन�दष्ट करीत आहे : —
1. व्याख्या :— (एक) या अिधसचूनेमध्ये संदभ�नसुार दसुरा अथर् अपेिक्षत नसेल तर,—
(1) “अिधिनयम” याचा अथर्, महाराष्� सावर्जिनक िव�ापीठ अिधिनयम, 2016 (सन 2017 चा महा. 6) असा आहे ;
(2) “�ािधकरणे” याचा अथर्, या अिधसचूनेअन्वये घिटत केलेल्या डॉ. होमी भाभा स्टेट यिुनव्ह�सटीचे �ािधकरणे, असा आहे ;
(3) “कुलपती” आिण “कुलग�ु” याचा अथर्, डॉ. होमी भाभा स्टेट यिुनव्ह�सटीचा अन�ुमे कुलपती व कुलग�ु, असा आहे ;
(4) “कमर्चारी” याचा अथर्, या अिधसचूनेअन्वये स्थापन केलेल्या डॉ. होमी भाभा स्टेट यिुनव्ह�सटीचे अध्यापक, अिधकारी व इतर कमर्चारी यांच्यासहीत, त्याने िनयकु्त केलेली कोणतीही व्यक्ती, असा आहे ;
(5) “कलम” याचा अथर्, अिधिनयमाचे कलम, असा आहे ;
(6) “िव�ापीठ” याचा अथर्, या अिधसचूनेअन्वये स्थापन केलेले डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई असा आहे ;
(दोन) यामध्ये वापरलेले परंतु व्याख्या न केलेले शब्द व शब्द�योग यांना अिधिनयमात अन�ुमे जे अथर् नेमनू देण्यात आले असतील तेच अथर् असतील.
2. डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई याची रचना
(1) ही अिधसचूना राजप�ात �िस� झाल्यापासनू, ज्या समहूामध्ये मखु्य महािव�ालय म्हणनू िव�मान िवज्ञान संस्था, मुंबई तसेच घटक महािव�ालय म्हणनू एलिफन्स्टन महािव�ालय, मुंबई, िसडनहमॅ महािव�ालय, मुंबई आिण माध्यिमक �िशक्षण महािव�ालय, मुंबई यांचा समावशे आहे असे, डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई हे स्थापन करण्यात येईल.
(2) कुलपती, कुलग�ु, सवर्साधारण पिरषद, व्यवस्थापन पिरषद, िव�ापिरषद आिण ज्या यानंतर असे पद िंकवा सदस्य�व जो पय�त धारण करण्याचे चाल ूठेवतील तो पय�त असे अिधकारी िंकवा सदस्य असतील अशा इतर व्यक्ती, या सव�नी िमळून बनलेले एक िव�ापीठ, या�ारे घिटत करण्यात येत आहे आिण ते डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई नावाचा एक िनगम िनकाय असल्याचे घोिषत करण्यात येत आहे.
(3) या िव�ापीठास अखंड परंपरा व सामान्य म�ुा असेल आिण उक्त नावाने त्याच्या िव�� िंकवा त्याला दावा दाखल करता येईल.
(4) हे िव�ापीठ, या अिधसचूनेअन्वये स्थापन केलेले अ-संलग्न िव�ापीठ म्हणनू कायर् करील आिण त्यामध्ये �वेश िदलेल्या िव�ाथ्य�ना पािरतोिषके, पदवी, पदिवका आिण त्याच्या पदवीची �माणप�े �दान करण्यासाठी ते अन्य कोणत्याही महािव�ालयास िंकवा पिरसंस्थेस संलग्न असणार नाही.

(5) ही अिधसचूना राजप�ात �िस� झाल्याच्या िदनांकास व त्या िदनांकापासनू िव�मान िवज्ञान संस्था, मुबंई व एिलिफन्स्टन महािव�ालय, मुंबई, िसडनहमॅ महािव�ालय, मुंबई आिण माध्यिमक �िशक्षण महािव�ालय, मुंबई हे मुबंई िव�ापीठापासनू िवलग झाल्या�माणे असतील.
(6) हे िव�ापीठ डॉ. होमी भाभा स्टेट यिुनव्ह�सटी, मुंबई, महाराष्�, 15, मादाम कामा मागर्, मुंबई 400 032 येथे �स्थत असेल आिण तेथे त्याचे मखु्यालय असेल.
3. िव�ापीठाची उि�ष्टे :— िव�ापीठाच्या उि�ष्टांसंबंधीच्या कलम 4 च्या तरतुदी या अिधसचूनेअतंगर्त िव�ापीठाच्या उि�ष्टांच्या बाबतीत लाग ू असतील.
4. िव�ापीठाचे अिधकार व कतर्व्ये पढुील�माणे असतील :—
(1) िव�ापीठ, वेळोवेळी िन�श्चत करील, अशा शाखा िंकवा िवषय िंकवा िव�ाशाखांमध्ये आिण पसंतीवर आधािरत �ेयांक प�त आिण भिवष्यात उदयास येऊ शकेल अशी इतर कोणतीही प�त यासह अभ्यास पा��मामध्ये िशक्षण, िवस्तार, अध्यापन, अध्ययन व �िशक्षण यांची तरतदू करणे ;
(2) संशोधन आिण ज्ञानवधर्न व ज्ञान�सार यांसाठी तरतदू करणे आिण सवर्साधारणत: (लिलत कला व �ायोिगक कला यांसह) कला व शास्�े, मानविवज्ञान, सामािजक शास्�े, लेखा व वािणज्य, श�ु व उपयोिजत शास्�े, तं�ज्ञान, व्यवस्थापन, औषधवधैकशास्�ाचे िनरिनराळे �कार, अिभयांि�की, कायदा, शािररीक िशक्षण आिण अध्ययनाच्या इतर शाखा व संस्कृती व त्यांच्या बहुिव�ाशाखांची व आतंरिव�ाशाखांची के्ष�े यांचे संवधर्न करणे व त्यांना चालना देणे ;
(3) िव�ापीठ िवभाग, �शाला, पिरसंस्था, �योगशाळा, ज्ञान स्�ोत कें �े, अध्ययन स्�ोत कें �े, �ंथालये, सं�हालये आिण अध्यपन अध्ययन, �िशक्षण, संशोधन व िवकास िंकवा िवस्तार यासाठी आवश्यक असलेली साधन साम�ुी यांचे आयोजन, पिररक्षण व व्यवस्थापन करणे ;
(4) िवभाग, संशोधन, पिरसंस्था, िवशेषीकृत अभ्यास�म पिरसंस्था िंकवा िव�ािवषयक सेवा यिुनट यांची स्थापना करणे, त्या चालवणे व त्यांचे व्यवस्थापन करणे ;
(5) घटक, समहू व संचािलत महािव�ालये, पिरसंस्था, वसितगहेृ, आरोग्य कें �े, �ोतगृहेृ आिण व्यायामशाळा यांची स्थापना करणे, त्या चालिवणे व त्यांचे व्यवस्थापन करणे ;
(6) महािव�ालयांच्या गटाला सेवा उपलब्ध क�न देण्याच्या दषृ्टीने िव�ापीठ उपपिरसर स्थापन करण्यासाठी तरतदू करणे आिण तसेच अशा उपपिरसरांमध्ये पदव्य�ुर िवभाग, बहु-िव�ाशाखा िंकवा आंतर-िव�ाशाखा �शाला, ज्ञान स्�ोत कें �े, �ंथालये, �योगशाळा, संगणक कें �े यांच्या स्व�पात सामाईक स्�ोत कें �े आिण राज्य शासनाने िंकवा िव�ापीठ अनदुान आयोगाने िनध�िरत केलेल्या मागर्दशर्क तत्वानसुार त्यांसारखी अध्ययन व कौशल्य �िशक्षण कें �े स्थापन करण्याची तरतदू करणे व ती चालिवणे ;
(7) िव�ापीठासाठी आवश्यक असणारी त्याच्या िनधीतनू आिण इतर िवधी परुवणाऱ्या अिभकरणांकडून �ाप्त झालेल्या िनधीतनू, संचालक, �ाचायर्, अध्यापक, दीघर् सटुी नसलेला िव�ािवषयक कमर्चारीवगर्, अध्यापकेतर कुशल, �शासकीय, िलिपकवग�य कमर्चारी वगर् यांची आिण इतर पदे िनम�ण करणे आिण त्यांच्या अहर्ता, अनभुव व वतेन�ेणी िविहत करणे आिण त्यांच्या िनयकु्त्या करणे ;
(8) अन्य कोणत्याही िव�ापीठात िंकवा संघटनेत काम करणाऱ्या व्यक्तींना िविन�दष्ट कालावधीसाठी िव�ापीठाचे संलग्न �ाध्यापक, संलग्न सहयोगी �ाध्यापक, संलग्न सहायक �ाध्यापक, अभ्यागत �ाध्यापक म्हणनू िनयकु्त करणे िंकवा मान्यता देणे ;
(9) िविन�दष्ट पदव्या, पदिवका िंकवा �माणप�े असलेल्या वेगवगेळ्या पिरक्षांचे िशक्षण�म व अभ्यासपा��म िविहत करणे ;

(10) एकल स्व�पात िंकवा इतर राज्यीय िंकवा राष्�ीय िंकवा जागितक िव�ापीठाशी संयकु्त स्व�पात िविन�दष्ट पदव्या, पदिवका िंकवा �माणप�े यासाठी असलेल्या वगेवगेळ्या पिरक्षांचे िशक्षण�म व पसंतीवर आधािरत �ेयांक प�तीमधील अभ्यासपा��म िविहत करणे ;
(11) िव�ापीठ िवभाग, �शाळा, बहु-िव�ाशाखा व आतंर-िव�ाशाखा �शाळा, समहू महािव�ालये, यांमधील वेगवगेळ्या अभ्यासपा��मांसाठी िव�ाथ्य�ना िदल्या जाणाऱ्या �वेशाच्या संबंधात देखरेख, िनयं�ण व िविनयमन करणे ;
(12) परीक्षा िंकवा इतर कोणतीही चाचणी यांच्या आधारे िंकवा अन्य रीतीने पदव्या, पदव्य�ुर पदिवका, उच्च माध्यिमक िशक्षणो�र पदिवका, �माणप�े आिण इतर िव�ािवषयक िवशेषोपाधी स�ु करणे ;
(13) ज्या व्यक्तींनी— (क) िविहत प�तीने त्यांना परीक्षांमधनू सटू िमळालेली नसेल तर, िव�ापीठातील िंकवा महािव�ालयातील िंकवा पिरसंस्थेतील िंकवा मान्यता�ाप्त पिरसंस्थेतील िंकवा �शाळेतील मान्यता�ाप्त अभ्यासपा��म पणूर् केलेला असेल आिण ज्या व्यक्ती िव�ापीठाने िविहत केलेल्या पिरक्षा उ�ीणर् झालेल्या असतील आिण आवश्यक �ेयांक िंकवा गणु िंकवा �ेणी िमळिवलेल्या असतील ; िंकवा (ख) िव�ापीठातील िंकवा महािव�ालयातील िंकवा पिरसंस्थेतील िंकवा मान्यता�ाप्त पिरसंस्थेतील िंकवा स्वाय� महािव�ालयातील िंकवा स्वाय� मान्यता�ाप्त पिरसंस्थेतील िंकवा अिधकार�द� स्वाय� महािव�ालयातील िंकवा अिधकार�द� स्वाय� समहू पिरसंस्थेतील िंकवा �शाळेतील मान्यता�ाप्त पा��म पणूर् केलेला असेल आिण ज्या व्यक्ती िव�ापीठाने िविहत केलेल्या परीक्षा उ�ीणर् झालेल्या असतील आिण आवश्यक �ेयांक गणु िंकवा �ेणी िमळिवलेल्या असतील ; िंकवा (ग) आदेश आिण िविनयम यां�ारे तरतदू करण्यात आलेल्या शत�नसुार संशोधन केलेले असेल ;
अशा व्यक्तींच्या परीक्षा घेणे िंकवा मलू्यांकन करणे आिण त्यांना पदव्या, पदव्य�ुर पदिवका आिण उच्च माध्यिमक िशक्षणो�र पदिवका आिण �माणप�े व इतर िव�ािवषयक िवशेषोपाधी �दान करणे ;
(14) बिह:शाल िव�ाथ� आिण प�व्यवहार व दरूस्थ प�ती�ारे िशक्षण घेणारे िव�ाथ�, तसेच ऑनलाईन व िनरंतर िशक्षणिवषयक अभ्यास�माचे िव�ाथ� यांना पदव्या, पदिवका आिण �माणप�े देणे व त्यांना व्याख्याने, िशक्षण व �िशक्षण देण्याची तरतदू करणे ;
(15) पिरिनयमां�ारे िविहत करण्यात आल्या�माणे सन्मान्य पदव्या िंकवा इतर िव�ािवषयक िवशेषोपाधी �दान करणे ;
(16) वेळोवेळी आदेशां�ारे िविनयिमत करण्यात येईल असे शलु्क व इतर आकार िन�श्चत करणे, त्यांची मागणी करणे व ती �ाप्त करणे िंकवा वसलू करणे ;
(17) शलु्क िन�श्चती सिमती घिटत करणे ;
(18) िव�ापीठ, महािव�ालये, पिरसंस्था, मान्यता�ाप्त पिरसंस्था, �शाळा आिण वसितगहेृ, यांमधील िव�ाथ्य�ची वतर्णकू व िशस्त यांवर देखरेख ठेवणे, िनयं�ण ठेवणे आिण त्यांचे िविनयमन करणे ;
(19) िव�ाथ्य�ना औपचािरक िशक्षणाकडून अनौपचािरक िशक्षणाकडे जाता याव े यासाठी आिण अनौपचािरक िशक्षणाकडून औपचािरक िशक्षणाकडे आिण राज्यातील व राज्याबाहेरील इतर िव�ापीठांमध्ये देखील जाता यावे यासाठी तरतदू करणे ;
(20) अध्यापक आिण अध्यापकेतर कमर्चारी यांचे �िशक्षण व के्ष�ातील दज�दार िशक्षण, दज� वाढिवण्याकिरता व्यापक कायर्शाला िंकवा अध्यापन पाठ यासाठी आिण त्यांची गणुव�ा वाढवण्यासाठी अंतगर्त दज� सिुन�श्चत करणाऱ्या यं�णेची देखील तरतदू करणे ;
(21) िविहत करण्यात येईल त्या�माणे अध्यापनाच्या वेळेत व अध्यापनाच्या वेळेनंतर िव�ापीठ िंकवा महािव�ालये िंकवा पिरसंस्था यांच्या जागांमध्ये असणाऱ्या अध्यापकांच्या उप�स्थतीचे िनयमन करणे व तरतदू करणे आिण तसेच खाजगी िशकवणी िंकवा खाजगी िशकवणी वगर् घेण्यास िंकवा चालिवण्यास अध्यापकांना मनाई करणे.

(22) िविहत करण्यात येईल त्या�माणे कामाच्या वेळेत व कामाच्या वळेेनंतर िव�ापीठ िंकवा महािव�ालये िंकवा पिरसंस्था यांच्या जागांमध्ये असणाऱ्या अध्यापकेतर कमर्चाऱ्यांच्या उप�स्थतीचे िनयमन करणे व तरतदू करणे;
(23) अध्यापक व अध्यापकेतर कमर्चारीवग�किरता राज्य शासनाने िविहत केलेल्या वतर्णकू व िशस्त यांसंबधीच्या िनयमांची अंमलबजावणी करणे ;
(24) िव�ाथ्य�ची सनद िविहत करणे व त्याची अंमलबजावणी करणे ;
(25) िव�ाथ्य�ना :- (क) राष्�ीय सेवा योजना ;
(ख) राष्�ीय छा�सेना ;
(ग) होमगाडर् (गहृरक्षक दल) व नागरी संरक्षण दल ;
(घ) राष्�ीय �ीडा संघटना ;
(ङ) शारीिरक व लष्करी �िशक्षण ;
(च) बिह:शाल अध्यापन व संशोधन ;
(छ) आजीवन अध्ययन, िवस्तार यांच्याशी संबंिधत कायर्�म ;
(ज) िव�ापीठाची उि�ष्टे साध्य करण्यासाठी आवश्यक व शक्य असतील असे सांस्कृितक, आ�थक आिण सामािजक सधुारणेच्या दषृ्टीने आखण्यात आलेले कोणतेही इतर कायर्�म, सेवा िंकवा उप�म, यांमध्ये सहभागी करण्यासाठी तरतदू करणे ;
(26) लोकसेवा, सावर्जिनक उप�म यांमधील सेवा�वेशाकिरता व रोजगाराच्या इतर स्पध�त्मक संधी यांकिरता स्पध�त्मक परीक्षांसाठी िवशेष �िशक्षणाची िंकवा खास िशक्षणाची तरतदू करणे ;
(27) संशोधन व सल्लागार सेवा यांसाठी अन्य कोणतेही िव�ापीठ, पिरसंस्था, �ािधकरण िंकवा संघटना यांच्याशी सहकायर् करणे िंकवा त्यांच्याशी समन्वय साधणे आिण अशा �योजनांसाठी पिर�स्थतीन�ुप मागणी केली जाईल त्या�माणे िवविक्षत पा��म चालिवण्यासाठी अन्य िव�ापीठे, पिरसंस्था, �ािधकरणे िंकवा संघटना यांसह योग्य ती व्यवस्था करणे ;
(28) राज्य शासनाच्या पवूर्परवानगीने, िव�ापीठाच्या मालम�ेच्या तारणावर, िव�ापीठाच्या �योजनांकिरता पैसा कज�ऊ घेणे ;
(29) संधोधन व िवकास, सल्ला सेवा, �िशक्षण कायर्�मांचा अंदाज घेऊन िंकवा नव्याने स�ु क�न आिण उ�ोग, व्यापार िंकवा अन्य कोणत्याही अशासकीय संघटना या के्ष�ांमधील िविवध �ाहकांना सेवा देऊन, त्या�ारे िव�ापीठाच्या साधनसंप�ीत वाढ करण्याच्या शक्यतेचा शोध घेणे ;
(30) राज्य शासनाच्या पवूर्मान्यतेने िवदेशातील िव�ापीठांबरोबर व पिरसंस्थाबरोबर िव�ािवषयक सहयोगी कायर्�म, संशोधन व सल्लागार सेवा हाती घेणे ;
(31) याबाबतीतील, कें � सरकारच्या व राज्य शासनाच्या िनयमांच्या व िविनमयांच्या अधीन राहून, िवदेशी अिभकरणांकडून सहयोगी कायर्�मासाठी िनधी स्वीकारणे ;
(32) िव�ापीठ त्याच्या अध्यापनातनू, अध्ययनातनू, �िशक्षणातनू, संशोधन व िवकास, सल्ला सेवा, आिण कोणत्याही अन्य िव�ािवषयक व परूक कायर्�म यांमधनू िव�ापीठ जे उत्पन्न िमळवेल त्या व्यितिरक्त उत्पन्नातनू िवकास िनधी तयार करणे आिण व्यावसाियकरीत्या त्या िनधीची गुतंवणकू करणे आिण त्यामधनू िमळालेल्या व्याजाचा शैक्षिणक व�ृी व िवकास, संशोधन व िवकास, शैक्षिणक व भौितक पायाभतू सिुवधा यांचा िवकास आिण कोणत्याही इतर पायाभतू सिुवधा यांच्यासाठी उपयोग करणे ;

(33) अध्यापक आिण िव�ापीठ अध्यापक यांच्याकिरता िव�ापीठाच्या मते िव�ािवषयक बाबींच्या संबंधात आवश्यक असतील अशा इतर सचूना िंकवा िनदेश घालनू देणे ;
(34) साधनसंप�ी िनम�ण करण्याच्या दषृ्टीने, शलु्क आका�न बाहेरील अिभकरणांकिरता उच्च िशक्षण, संशोधन, सल्लागार सेवा यांवर आधािरत �कल्प यांसंबंधातील िवकास कायर्�म आिण �िशक्षण कायर्�म हाती घेणे ;
(35) सामािजक आिण शैक्षिणकदषृ्�ा मागास असलेल्या वग�ना व जाती - जमातींना िव�ापीठातील िशक्षणाचे लाभ उपलब्ध क�न देण्यासाठी िवशेष तरतदू करणे ;
(36) िव�ाथ�नींना आिण िदव्यांग िव�ाथ्य�ना िव�ापीठास आवश्यक वाटतील त्या�माणे िव�ापीठातील िशक्षणाचे लाभ उपलब्ध क�न देण्यासाठी िवशेष तरतदू करणे ;
(37) िव�ापीठ यं�णेमधील अध्यापक व िव�ाथ� यांच्यामाफर् त स्वचे्छा-त�वावर राष्�ीय साक्षरता आिण �ौढ िशक्षण कायर्�म कायर्�न्वत करणे आिण त्यांच्या सवर्साधारण शैक्षिणक कामिगरीिशवाय आणखी िव�ाथ्य�चे या के्ष�ातील �यत्न व कामिगरी यांना योग्य ते गणुािधक्य देण्याची उपाययोजना करणे आिण त्याच�माणे अध्यापकांच्या या के्ष�ातील कामिगरीचेही मलू्यमापन करणे ;
(38) िव�ापीठाने स्वत: िंकवा इतर िव�ापीठांच्या िंकवा संघटनांच्या सहकाय�ने, सवर्साधारणपणे िवदेशी भाषांच्या व िवशेषत: मराठीसह आिशयाई भाषांच्या अभ्यासास चालना देणे ;
(39) जे समकालीन, जागितकदषृ्�ा स्पध�त्मक आिण स्थािनक तसेच धा�मक व राष्�ीयदषृ्�ा मह�वपणूर् आहे अशा ज्ञानाची िन�मती करणे व त्याचा �सार करणे आिण �ेष्ठ दज�च्या संशोधनाची जोपासना करणे ;
(40) िव�ाथ�कें �ी दषृ्टीकोन ठेवणे आिण ज्ञानाची िन�मती करण्यासाठी भिूमका पार पाडणे ;
(41) पदवीपवूर्, पदव्य�ूर िशक्षणाचे बळकटीकरण करणे, संशोधन व संस्कृती िवकास आिण संबंिधत पदवी कायर्�म यात वाढ करणे ;
(42) ई-अध्ययन आिण ई-�शासन या दोन्ही सेवांसाठी सवर्समावेशक िडजीटल िव�ापीठाची रचना तयार करणे ;
(43) मािहती व संदेशवहन तं�ज्ञानाचा उपयोग क�न ‘सहयोग आिण सहभाग यां�ारे िशक्षणाच्या’ अिधकारांचे समपुयोजन करणे ;
(44) अनेक ज्ञान शाखांमधील बहुिवध िव�ाशाखा गटांचा अतंभ�व असणाऱ्या िव�ापीठामधील संशोधनाचे व्यावसाियक के्ष�ामध्ये व सम�न्वत �कल्पांमध्ये �पांतर करण्यासाठी संशोधन कें �, तं�ज्ञानातील नवसंशोधन व इतर कायर् ऊ�ोगी संस्था यांची िन�मती करणे ज्यायोगे राज्यासमोरील काही मह�वाच्या समस्यांचे िनराकरण होईल ;
(45) स्थािनक गरजा, उपलब्ध �िशक्षण सिुवधा, नव्याने उद् भवणाऱ्या गरजा आिण नवीन रोजगाराची संधी िवचारात घेऊन, िव�ाथ्य�ना जी कौशल्ये माहीत क�न देण्याची गरज आहे अशी कौशल्ये िन�श्चत करणे ;
(46) त�ण िपढीला देशाच्या सम�ृ सांस्कृितक वारसाची ओळख क�न देऊन त्या�ारे त्यांच्या सव�गीण िवकासाकिरता पोषक वातावरण तयार करणे आिण खेळांमध्ये कौशल्यांचा िवकास करण्याकिरता संधी िनम�ण करणे ;
(47) मखु्यत्वके�न िव�ाशाखा, तं�ज्ञान शाखा, व्यावसाियक व सामािजक शाखा आिण व्य�क्तमत्व व सांस्कृितक िवकास शाखा या चार शाखांमधनू हस्तांतरणयोग्य �ेयांक गणुांसह पसंतीवर आधािरत �ेयांक प�ती स�ु केल्याची सिुन�श्चती करणे ;
(48) वधर्नक्षम वास्तव जीवनातील काय�चे ज्ञानात �पांतर करण्यासाठी सामािजक िवकासात गुंतलेले उ�ोग, संशोधन व िवकास �योगशाळा, अशासकीय संघटना यांसारख्या संस्थांचा सहयोग घेऊन अध्यापकांच्या चलनशीलतेला चालना देणे आिण त्याच्या पिरणाम�प िव�ापीठांच्या कायर्�मांना सम�ृ करणे ;
(49) आयोगाच्या अहवालातील िशफारशीची, त्याने िदलेल्या कालमय�देत अंमलबजावणी करणे ;
(50) िव�ापीठाचे वरील अिधकार, कतर्व्ये व जबाबदाऱ्या यांच्या संदभ�त, राज्य शासना�ारे वळेोवेळी देण्यात आलेल्या िनदेशांचे अनपुालन करणे व ते पार पाडणे ;

(51) िनयिमत कालांतरांनी िव�ापीठ िवभागांची, संचािलत महािव�ालयांची, संलग्न महािव�ालयांची, पिरसंस्थांची िंकवा �शालांची शैक्षिणक लेखापरीक्षा करणे ;
(52) िव�ापीठाची सवर् िंकवा कोणतीही उि�ष्टे पार पाडण्यासाठी आवश्यक िंकवा आनषंुिगक िंकवा पोषक असतील अशा इतर सवर् कृती आिण गोष्टी करणे ;
5. कुलपती आिण त्याचे अिधकार— महाराष्�ाचा राज्यपाल हा डॉ. होमी भाभा स्टेट यिुनव्ह�सटीचा कुलपती असेल आिण कुलपती त्याच्या पदपरत्वे डॉ. होमी भाभा स्टेट यिुनवर्हिसटीचा �मखु असेल आिण कलम 9 च्या पोट-कलम (2), (3), (४), (५) आिण (६) मध्ये तरतदू केलेल्या अिधकारांचा तो वापर करील.
6. िव�ापीठाचे अिधकारी :— डॉ. होमी भाभा स्टेट यिुनव्ह�सटीचे अिधकारी पढुील�माणे असतील :—
1. कुलग�ु ;
2. कुलसिचव ;
3. िव� व लेखा अिधकारी ;
4. संचालक, परीक्षा व मलू्यमापन मंडळ ;
5. िव�ाशाखांचे अिधष्ठाते ;
6. संचालक, नवोप�म, नवसंशोधन व साहचयर् ;
7. संचालक, ज्ञान स्�ोत कें � ;
8. पिरिनयमां�ारे िविहत करण्यात येतील असे इतर अिधकारी ;
पिरच्छेद (एक) ते (चार) मध्ये नमदू केलेल्या पदांवर िनयकु्त करण्यात आलेले अिधकारी हे, िव�ापीठाचे पणूर्- कािलक वेतनी कमर्चारी असतील, तर उप-पिरच्छेद (पाच) ते (आठ) मध्ये नमदू केलेल्या पदांवर अिधकाऱ्यांची केलेली िनयकु्ती ही कुलग�ुने वेळोवळेी िनध�िरत करावयाच्या मािसक मानधनाच्या आधारे करण्यात येईल आिण हे अिधकारी अिधिनयमाची कलमे 15, 20, 21 यांमध्ये घालनू िदलेल्या आहेत अशा अिधकारांचा वापर करतील व अशी कतर्व्ये पार पाडतील ;
7. कुलग�ुची िनयकु्ती :—कुलग�ुची िनयकु्ती ही, कलम 11 मध्ये तरतदू करण्यात आली आहे अशा रीतीने व अशा सेवा अटी व शत�वर करण्यात येईल.
8. कुलग�ुचे अिधकार व कतर्व्ये :—कुलग�ु ला, कलम 12 मध्ये िविन�दष्ट करण्यात आले आहेत असे अिधकार असतील आिण अशी कतर्व्ये तो पार पाडील ;
9. कुलसिचव.—(1) कुलसिचव हा िव�ापीठाचा मखु्य �शासकीय अिधकारी असेल. तो पणूर्कािलक वतेनी अिधकारी असेल व तो थेट कुलग�ुचे अधीक्षण, संचालन व िनयं�ण याखाली काम करील ;
(2) अिधिनयमाच्या कलम 14 च्या पोट-कलम (2), (3), (4), (5) आिण (6) मध्ये तरतदू केल्या�माणे, कुलसिचवाची िनयकु्ती सेवेच्या अटी व शत� आिण कतर्व्यांबाबतच्या तरतदूी, योग्य त्या फेरफारांसह या िव�ापीठाच्या कुलसिचवाची िनयकु्ती, सेवेच्या अटी व शत� आिण कतर्व्ये यांना लाग ूअसतील ;
10. िव� व लेखा अिधकारी—(1) िव�ापीठाचा िव� व लेखा अिधकारी हा िव�ापीठाचा �मखु िव�, लेखा व लेखापरीक्षा अिधकारी असेल. तो पणूर्कािलक वतेनी अिधकारी असेल व थेट कुलग�ुच्या पयर्वेक्षणाखाली, िनदेशनाखाली व िनयं�णाखाली काम करील.
(2) अिधिनयमाच्या कलम 18 ची पोट-कलमे (2), (3), (4), (5) आिण (6) मध्ये तरतदू केल्या�माणे, िव� व लेखा अिधकाऱ्याची िनयकु्तीसाठीची अहर्ता आिण त्याच्या सेवचे्या अटी व शत� आिण त्याचे अिधकार व काय� याबाबतच्या तरतदूी, 8 ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, ¡äò¥ÉÖ́ ÉÉ®úÒ 13, 2019/¨ÉÉPÉ 24, ¶ÉEäò 1940 योग्य त्या फेरफारांसह या िव�ापीठाच्या िव� व लेखा अिधकाऱ्याची िनयकु्ती आिण त्याच्या सेवेच्या अटी व शत� आिण त्याचे अिधकार व काय� यांना लाग ूअसतील.
11. संचालक, परीक्षा व मलू्यमापन मंडळे :—(1) संचालक, परीक्षा व मलू्यमापन मंडळे, हा पणूर्कािलक वतेनी अिधकारी असेल आिण तो थेट कुलग�ुच्या िनदेशनाखाली व िनयं�णाखाली काम करील. तो, परीक्षा व मलू्यमापन मंडळाचे पयर्वेक्षण, िनदेशन व मागर्दशर्न यानसुार आिण डॉ. होमी भाभा स्टेट यिुनव्ह�सटीच्या मलू्यमापनाखाली आपली काय� पार पाडील आिण परीक्षा व मलू्यमापन मंडळाने आखलेली धोरणे व घालनू िदलेली िनदेशकत�व ेयांची अंमलबजावणी करण्यामध्ये लक्ष घालील ;
(2) संचालक, परीक्षा व मलू्यमापन मंडळ, यांची िनयकु्ती, त्याचे अिधकार व काय� याबाबतच्या, अिधिनयमाच्या कलम 17 ची पोट-कलमे (2), (3), (4), (5) यांच्या तरतदूी �ा योग्य त्या फेरफारांसह, संचालक, परीक्षा व मलू्यमापन मंडळ, यांची िनयकु्ती आिण त्याचे अिधकार व काय� यांना लाग ूअसतील.
12. िव�ापीठाच्या �ािधकरणांचे मंडळाचे अिधकारी, सदस्य आिण िव�ापीठाचे कमर्चारी हे लोकसेवक असणे :—िव�ापीठाच्या �ािधकरणांचे, सिमत्यांचे िंकवा मंडळांचे, सवर् वेतनी अिधकारी, सदस्य, िव�ापीठांचे अध्यापक आिण इतर कमर्चारी हे, भारतीय दंड संिहतेच्या 1860 च्या (अिधिनयम �. 45) कलम 21 च्या अथ�तगर्त लोकसेवक असल्याचे मानण्यात येईल.
13. िव�ापीठाची �ािधकरणे :—
(1) िव�ापीठाची �ािधकरणे पढुील�माणे असतील :— (क) सवर्साधारण पिरषद ;
(ख) व्यवस्थापन पिरषद ;
(ग) िव�ापिरषद ;
(घ) िव� सिमती ;
(ङ) िव�ा शाखा ;
(च) अभ्यास मंडळ ;
(छ) आजीवन व अध्ययन व िवस्तार मंडळ ;
(ज) परीक्षा व मलू्यमापन मंडळ ;
(झ) राष्�ीय व आंतरराष्�ीय साहचयर् मंडळ ;
(ञ) नवोप�म, नवसंशोधन व उप�म मंडळ ;
(ट) �ीडा व शारीिरक िशक्षण मंडळ ;
(1) �त्येक �ािधकरणातील एकूण सदस्य संख्येच्या दोन-ततृीयांश सदस्य इतकी बैठकींसाठीची गणपतू� असेल.
14. सवर्साधारण पिरषद —
(1) िव�ापीठाची सवर्साधारण पिरषद हे सवर् िव�ीय अंदाजप�कांकिरताचे आिण अथर्संकल्पीय िविनयोजनांकिरताचे तसेच िव�ापीठाला वतर्मान व भिवष्यातील शैक्षिणक कायर्�मांवरील सामािजक पिरणामांची मािहती देण्याकिरताचे �मखु �ािधकरण असेल.
(2) सवर्साधारण पिरषद ही पढुील सदस्यांची िमळून बनलेली असेल :— (क) कुलपती ;
(ख) कुलग�ु ;

(घ) जे घटक महािव�ालयांचे �ाचायर् िंकवा संचालक नसतील असे कुलग�ुने िव�ापीठाच्या अध्यापकांमधनू नामिनद�िशत करावयाचे दोन अध्यापक ज्यापैकी एक आळीपाळीने अनसुिुचत जाती िंकवा अनसुिूचत जमाती िंकवा िनरिधसिुचत जमाती (िवमकु्त जाती) िंकवा भटक्या जमाती िंकवा इतर मागास वगर् या �वग�तनू असेल ;
(ङ) कुलग�ुने नामिनद�िशत करावयाचा, आळीपाळीने तत्वावरील िव�ाशाखा अध्यापकांमधनू एक असेल.
(च) राज्य शासनाने नामिनद�िशत केलेला, सहसंचालक या पदाच्या दज�पेक्षा कमी दज�चा नसेल असा एक �ितिनधी;
(छ) कुलग�ुने नामिनद�िशत करावयाचा, उ�ोगके्ष�ातील एक �ितिनधी आिण संशोधन व िवकास के्ष�ातील एक �ितिनधी;
(ज) िव�ापीठाचा कुलसिचव हा, सवर्साधारण पिरषदेचा, मतािधकार नसणारा आमंि�त असेल.
(2) सवर्साधारण पिरषद ही, िव�ापीठाचे सव�च्च �ािधकरण असेल.
15. सवर्साधारण पिरषदेचे अिधकार व कतर्व्ये.—सवर्साधारण पिरषदेचे अिधकार पढुील�माणे असतील :—
(1) िव�ापीठाच्या काय�चे सवर्साधारण अधीक्षण व िनदेशन करणे व त्यावर िनयं�ण ठेवणे.
(2) िव�ापीठाच्या इतर �ािधकरणाचे िनणर्य हे अिधिनयमाच्या िंकवा त्याखाली केलेल्या पिरिनयमांच्या, आदेशांच्या, िविनयमांच्या, िंकवा िनयमांच्या तरतदुींशी ससंुगत नसतील तर, त्यांचे पनुरीक्षण करणे ;
(एक) िव�ापीठाच्या अथर्संकल्पास व वा�षक अहवालास मान्यता देणे ;
(दोन) िव�ापीठाने अनसुरावयाची धोरणे िनध�िरत करणे ;
(तीन) सवर्तोपरी �यत्न क�नही जर िव�ापीठास सरुळीत कायर् करणे शक्य होत नसल्याची पिर�स्थती उ�वली असेल तर, िव�ापीठाचे स्वेच्छा पिरसमापन करण्यािवषयी व्यवस्थापन पिरषदेकडे िशफारस करणे.
(3) सवर्साधारण पिरषद, एक कॅलेंडर वष�त िकमान तीनदा बैठक घेईल.
16. सवर्साधारण पिरषद, ितच्या बैठकीमध्ये पढुील कामकाज चालवील :— (क) िव�ा, संशोधन व िवकास, �शासन व व्यवस्था यांसारखे िव�ापीठाचे आवश्यक भाग असलेल्या सवर् के्ष�ांमध्ये व पिरके्ष�ांमध्ये करता येऊ शकतील अशा सधुारणांवर िव�ापीठ �ािधकरणांना सचूना करणे ;
(ख) िव�मान िव�ािवषयक कायर्�म व सहयोगी कायर्�म यांचे पनुरीक्षण करणे ;
(ग) उच्च िशक्षणातील सामािजक गरजांशी ससंुगत असे नवीन िव�ािवषयक अध्ययन�म सचुिवणे ;
(घ) िव�ापीठाची सधुारणा व िवकास यांसाठी उपाय सचुिवणे ;
(ङ) व्यवस्थापन पिरषदेच्या व िव�ापिरषदेच्या िशफारशीव�न सन्मान्य पदव्या िंकवा इतर िव�ािवषयक िवशेषोपाधी �दान करणे;
(च) िव�ापीठाचे स्थलु धोरणे आिण कायर्�म यांचे पनुरीक्षण करणे आिण त्यांची सधुारणा व िवकास यांसाठी उपाय सचुिवणे;
(छ) वा�षक िव�ीय अंदाज (अथर्संकल्प), वा�षक अहवाल, लेखे, लेखापिरक्षा अहवाल आिण लेखापिरक्षकाच्या त्यावरील �माणनासह त्यांचे समाधानकारक अनपुालन अहवाल आिण िव�ापीठाने या संबंधातील िशस्तभंगिवषयक िंकवा अन्यथा केलेल्या कायर्वाहीचा अहवाल �ाप्त करणे, त्यावर चच� करणे आिण ते मान्य करणे ;

(झ) िव�ापीठाच्या कुलसिचवाने सादर करावयाच्या, िव�ाथ� त�ार िनवारण अहवालाचे पनुिरक्षण करणे व तो स्वीकृत करणे ;
(�) संबंिधत अिधष्ठात्यांनी सादर करावयाच्या, िव�ाथ� िवकास मंडळाच्या व �ीडा मंडळाच्या अहवालांचे पनुिरक्षण करणे व ते स्वीकृत करणे ;
(ट) िव�ापीठाच्या िव�ाथ� कल्याण, �ीडा, सांस्कृितक कायर् या के्ष�ांमध्ये व पिरके्ष�ांमध्ये करता येतील अशा सधुारणांवर िव�ापीठ �ािधकरणांना सचूना देणे ;
(ठ) पिरिनयम तयार करणे, त्यात सधुारणा करणे िंकवा ते िनरिसत करणे;
17. िव�ापीठाची व्यवस्थापन पिरषद :—
(1) िव�ापीठाची व्यवस्थापन पिरषद िव�ापीठाची व्यवस्थापन पिरषद, िव�ापीठाचे मखु्य कायर्कारी व धोरण आखणारे �मखु �ािधकरण असेल आिण िव�ापीठाचे कामकाज चालिवण्याकिरता जबाबदार असेल आिण ती अन्य कोणत्याही �ािधकरणाकडे िविनद�शपवूर्क नेमनू िदली नसतील अशी कतर्व्ये पार पाडील.
(2) िव�ापीठाच्या व्यवस्थापन पिरषदेची दर दोन मिहन्यांतनू िकमान एकदा बैठक होईल.
(3) िव�ापीठाच्या व्यवस्थापन पिरषदेत, पढुील सदस्यांचा समावेश असेल :– (क) कुलग�ु-अध्यक्ष;
(ख) कुलपतीने नामिनद�िशत करावयाची, िशक्षण, उ�ोग, कृिष, वािणज्य, बकँ, व्यवसाय, िव�, सामािजक, सांस्कृितक व इतर संलग्न के्ष�े यातील एक िवख्यात व्यक्ती;
(ग) अडीच वष�च्या मदुतीसाठी कुलग�ुने नामिनद�िशत करावयाचे दोन अिधष्ठाते;
(घ) कुलग�ुने नामिनद�िशत केलेल्या, सवर्साधारण पिरषदेच्या सदस्य नाहीत अशा तीन व्यक्ती;
(ङ) घटक महािव�ालयाचा एक सदस्य;
(च) िव�ापीठ अध्यापकांमधनू िनवडून �ावयाचे, जे घटक महािव�ालयाचे �ाचायर् नाहीत असे दोन आध्यापक, ज्यांपैकी एक, खलु्या�वग�तील आध्यापकांमधनू िनवडण्यात येईल आिण एक अनसुिूचत जाती िंकवा अनसुिूचत जमाती िंकवा िनरधीसिूचत जमाती (िवमकु्त जाती ) िंकवा भटक्या जमाती िंकवा इतर मागासवगर् या �वग�तील अध्यापकांमधनू आळीपाळीने िनवडण्यात येईल;
(छ) कुलग�ुने नामिनद�िशत केलेला एक माजी िव�ाथ� ;
(ज) कुलग�ुने नामिनद�िशत केलेला एक िवश्वास ुिव�ाथ� ;
(4) व्यवस्थापन पिरषदेच्या बैठकींची गणपतू� ही, एकूण सदस्यांच्या दोन त�ृीयांश इतकी असेल ;
18. व्यवस्थापन पिरषदेचे अिधकार व कतर्व्ये :—सावर्जिनक िव�ापीठ अिधिनयमाच्या कलम 31 अन्वये तरतदू केलेल्या, व्यवस्थापन पिरषदेच्या अिधकाऱ्यांशी व कतर्व्यांशी संबंधीत तरतदूी, या िव�ापीठाच्या व्यवस्थापन पिरषदेच्या अिधकाऱ्यांच्या कतर्व्यांच्या बाबतीत योग्य त्या फेरफारासह लाग ूअसतील ;
19. िव�ापिरषद :—
(1) िव�ापीठाची िव�ापिरषद हे िव�ापीठाचे िव�ािवषयक �मखु मंडळ असेल आिण ते अिधसचूनेच्या तरतुदींच्या आिण या �योजनाथर् करण्यात आलेल्या िनयमांच्या, पिरिनयमांच्या व आदेशांच्या अधीनतेने, िव�ापीठाच्या िव�ािवषयक धोरणांचा समन्वय करील आिण त्यांवर सवर्साधारण पयर्वेक्षण करील;
(2) िव�ापिरषदेत पढुील व्यक्तीचा समावशे असेल, ज्यांपैकी सवर्जण पदिस� सदस्य असतील :— ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, ¡äò¥ÉÖ́ ÉÉ®úÒ 13, 2019/¨ÉÉPÉ 24, ¶ÉEäò 1940 11 भाग चार-ब–51—2अ (क) कुलग�ु-अध्यक्ष ;
(ख) घटक महािव�ालयांचे सवर् �ाचायर्/�मखु ;
(ग) िव�ापीठांच्या �त्येक िव�ाशाखांचे अिधष्ठांते ;
(घ) िव�ापीठ िवभागाचे तीन �मखु ;
(ङ) �ाचाय�नी �ितिनिधत्व िदलेल्यांव्यितिरक्त अन्य घटक महािव�ालयांचे / िवषयांचे दोन �ाध्यापक/सहयोगी �ाध्यापक ;
(च) िव�ापीठांच्या आध्यापकामधनू िनवडावयाचे घटक महािव�ालयाचे �ाचायर् नसलेले दोन अध्यापक यांपैकी एक खलु्या �वग�तील अध्यापकामधनू िनवडण्यात येईल आिण एक आळीपाळीने अनसुिूचत जाती िंकवा अनसुिूचत जमाती िंकवा िनरधीसिुचत जमाती (िवमकु्त जाती ) िंकवा भटक्या जमाती िंकवा इतर मागासवगर् या �वग�तील िव�ापीठांच्या अध्यापकांमधनू िनवडण्यात येईल ;
(छ) कुलग�ुने नामिनद�िशत करावयाचे, िविवध ज्ञानशाखांचे �ितिनिधत्व करणारे, आवश्यकतेनसुार बाहेरील तज्ज्ञ ;
(ज) कुलग�ुने नामिनद�िशत केलेला एक माजी िव�ाथ� ;
(झ) कुलग�ुने नामिनद�िशत केलेला एक िनयिमत िव�ाथ� ;
(3) बैठकींची गणपतू� ही, एकूण सदस्यांच्या दोन ततृीयांश इतकी असेल ;
20. िव�ापिरषदेचे अिधकार व कतर्व्ये :— िव�ापीठाच्या िव�ापिरषदेचे अिधकार व काय� पढुील�माणे असतील :— (क) िव�ापीठामधील अध्यापनाच्या व पिरक्षांच्या मानकांचे िनयं�ण करणे आिण त्यांचे िनयमन करणे ;
(ख) िव�ापीठाकडून घेण्यात येणाऱ्या सवर् परीक्षांचे अभ्यास�म व अभ्यासपा��म िविहत करणे ;
(ग) �ाध्यापक, सहयोगी �ाध्यापक, सहायक �ाध्यापक िंकवा इतर अध्यापक पदे िनम�ण करण्यासाठी आिण त्यांच्या कतर्व्यांच्याबाबतीत िविवध िवषयांमध्ये पनु्हा योग्य दज� �ाप्त करण्यासाठी िनयामक पिरषदेला व व्यवस्थापन पिरषदेला �स्ताव सादर करणे ;
(घ) िनयामक पिरषदेच्या व व्यवस्थापन पिरषदेच्या िनयं�णाच्या अधीन राहून, िव�ाशाखा िनम�ण करण्याच्या आिण िव�ाशाखांचे िवषय नेमनू देण्याच्या संबंधातील योजना तयार करणे, त्यांत सधुारणा करणे िंकवा त्यांचे पनुरीक्षण करणे ;
(ङ) िव�ाशाखांमध्ये अध्यापकांना िंकवा तज्ञांना नामिनद�िशत करणे ;
(च) िव�ापीठांतगर्त संशोधनास चालना देणे आिण त्यात काम करणाऱ्या व्यक्तींकडून अशा संशोधनाबाबतचे अहवाल संपािदत करणे ;
(छ) िव�ािवषयक बाबींवर िनयामक पिरषदेला व व्यवस्थापन पिरषदांना सल्ला देणे ;
(ज) घटक महािव�ालयांमध्ये केल्या जाणाऱ्या अध्यापनातील उणीवा दरू करण्यासाठी समहू िव�ापीठाच्या उच्च �ािधकरणाकडे �स्ताव सादर करणे ;
(झ) ज्यांपैकी दोन ततृीयांश पेक्षा कमी नसतील इतके सदस्य हे, �ाध्यापक िंकवा सहयोगी �ाध्यापक या पदांच्या दज�पेक्षा कमी दज�चे नसतील असे, घटक, स्वाय� व संलग्न महािव�ालयांचे िव�ापीठ �ाध्यापक, सहयोगी �ाध्यापक, �ाचायर् िंकवा अध्यापक असतील अशा िव�ापिरषदेच्या सदस्यांची एक स्थायी सिमती िनयकु्त करणे आिण िव�ापिरषदेस योग्य वाटतील असे ितचे अिधकार त्या सिमतीस �दान करणे ;

21. अिधिनयमाच्या िवविक्षत तरतदुी योग्य त्या फेरफारांसह लाग ूअसणे :—अिधिनयमाच्या पढुील तरतुदी, योग्य त्या फेरफारांसह या िव�ापीठाच्या बाबतीत लाग ूअसतील ;
(एक) िव�ापीठाच्या िव�ाशाखांची संख्या त्यांचे िवषय व रचना यांबाबतीत, कलम 34 ची पोट-कलमे (2), (3) व (4) ;
(दोन) िव�ाशाखेचे अिधकार व कतर्व्ये याबाबतीत, कलम 35 ;
(तीन) अभ्यास मंडळाचे अिधकार व कतर्व्ये याबाबतीत, कलम 41 ;
(चार) आजीवन अध्ययन व िवस्तार मंडळ व त्याची रचना या संबंधात, कलम 45 ;
(पाच) आजीवन अध्ययन व िवस्तार मंडळाचे अिधकार व कतर्व्ये यासंबंधात, कलम 46 ;
(सहा) परीक्षा व मलु्यमापन मंडळ आिण त्यांची रचना यासंबंधात, कलम 47 ;
(सात) परीक्षा व मलु्यमापन मंडळाचे अिधकार व कतर्व्ये यासंबंधात, कलम 48 ;
(आठ) राष्�ीय व आंतरराष्�ीय साहचयर् मंडळासंबंधीत, कलम 51 ;
(नऊ) राष्�ीय व आंतरराष्�ीय साहचयर् मंडळाचे अिधकार व कतर्व्ये यासंबंधीत, कलम 52 ;
(दहा) नवोप�म, नवसंशोधन व उप�म मंडळ व त्याची रचना यासंबंधीत, कलम 53 ;
(अकरा) नवोप�म, नवसंशोधन व उप�म मंडळाचे अिधकार व कतर्व्ये याबाबतीत, कलम 54 ;
(बारा) �ीडा व शारीिरक िशक्षण मंडळाच्या व त्यांच्या घटनेच्या बाबतीत, कलम 57 ;
(तेरा) शारीिरक िशक्षण मंडळाचे अिधकार व कतर्व्ये यांच्याबाबतीत, कलम 58.
22. िव�ापीठ िवस�जत करणे :—राज्य शासनाने िव�ापीठ, िव�ापीठाचे कमर्चारी व िव�ाथ� यांना तशा आशयाची नोटीस िकमान एक वषर् आगाऊ देऊन िव�ापीठ िवस�जत करता येईल :
परंतु, िव�ापीठाचे िवसजर्न हे, िनयिमत पा��मांच्या िव�ाथ्य�च्या शेवटच्या तकुडीने आपला पा��म पणूर् केल्यानंतरच आिण त्यांना पदव्या, पदिवका िंकवा, यथा�स्थती, परुस्कार �दान करण्यात आल्यानंतरच केवळ, अंमलात येईल.
(2) िव�ापीठाच्या िवसजर्नानंतर, िव�ापीठाच्या सवर् म�ा व दाियत्व ेही, शासनाकडे िनिहत असतील.
(3) िव�ापीठाने अिधिनयमाच्या कोणत्याही तरतुदींचे िंकवा त्याखालील केलेले कोणतेही िनयम, पिरिनयम िंकवा आदेश यांचे उल्लंघन केले आहे िंकवा अिधिनयमान्वये देण्यात आलेल्या कोणत्याही िनदेशांचे उल्लंघन केले आहे िंकवा कोणतेही उप�म राबिवणे बंद केले आहे िंकवा िव�ापीठामध्ये आ�थक गैरव्यवस्थापनाची िंकवा कु�शासनाची पिर�स्थती उ�वली आहे, असे शासनास िदसनू आले तर, शासन, िव�ापीठाचे पिरसमापन करण्याचा आदेश का देण्यात येऊ नये याबाबत िव�ापीठाने पंचेचाळीस िदवसांच्या आत कारणे दाखिवण्याबाबत त्या िव�ापीठावर नोटीस बजावील.
(4) िव�ापीठाचे �मखु महािव�ालय आिण घटक महािव�ालये यांना राज्य शासनाच्या पवूर् परवानगीने, मळू िव�ापीठाशी संलग्नीकरण्याकिरता अजर् करता येईल.
23. शंका दरू करणे.—शंका दरू करण्यासाठी, उपरोक्त पिरच्छेद 23 च्या आधारे आिण यामध्ये समािवष्ट तरतुदींमध्ये अिभ�ेत असल्या�माणे ज्यांमध्ये स्पष्टपणे सधुारणा करण्यात आलेली नाही अशा अिधिनयमाच्या तरतुदी या िव�ापीठाला लाग ू असणे चाल ूराहील.

No. MIS-2018/C.R.248/U.E. 3.—Whereas, RUSA guidelines issued by Ministry of Human Resource Development, Government of India in December 2013, to make a specific provision for enabling creation of cluster universities ;
And whereas, in persuance of the said guidelines provides that “cluster universities aims essentially at addressing the critical gaps in the spatial distribution of higher educational institutions across the states. These universities will be created by pooling the resources of 3 to 5 existing colleges that have adequate academic, physical and technical infrastructural facilities. All the participating colleges in a cluster should eventually become constituent colleges of the newly created universities. Colleges identified as colleges with potential for excellence or any other criteria which amply demonstrate the various quality parameters of a Dr. Homi Bhabha University would be established. Colleges joining the cluster must have the capacity to function as a university when coalesced. This would include, among other factors, the strength and experience of the administrative staff, the number of years that the individual colleges have been functioning, degree of autonomy they have enjoyed in the past, etc.”;
And whereas, in furtherance of the said guidelines the Maharashtra State Rashtriya Ucchatar Shikshan Abhiyan (RUSA) Council 12th meeting held on the 25th May 2018, decided to recommend the State Government for setting up a Dr. Homi Bhabha Cluster University with the Institute of Science, Mumbai as a lead college and three other colleges, namely Elphinstone College, Mumbai, Sydenham College, Mumbai and Secondary Training College, Mumbai as comprising constituent college ;
And whereas, after considering the said recommendation of the Rashtriya Uchchatar Shikshan Abhiyan (RUSA), the Government considers it expedient to establish a Dr. Homi Bhabha University comprising of the said constituent colleges ;
Now, therefore, in exercise of the powers conferred by sub-section (6) of section 3 of the Maharashtra Public Universities Act, 2016 (Mah. VI of 2017) the Government of Maharashtra hereby constitutes the Dr. Homi Bhabha State University, Mumbai which shall comprise of a cluster of Institute of Science, Mumbai as a lead college and Elphinstone College, Mumbai, Sydenham College, Mumbai and Secondary Training College, Mumbai as constituent colleges; and specifies its authorities, powers and functions as follows, namely :—
1. Definitions :
(I) In this notification unless the context otherwise requires :
(1) “Act” means Maharashtra Public Universities Act, 2016 (Mah.VI of 2017) ;
(2) “Authorities” mean the authorities of Dr. Homi Bhabha University constituted under this notification ;
(3) “Chancellor” and “Vice-Chancellor” means, respectively the Chancellor and Vice- Chancellor of Dr. Homi Bhabha University ;
(4) “Employee” means any person appointed by Dr. Homi Bhabha State University constituted under this notification including its teachers, officers and other staff ;

(5) “section” means section of the Act;
(6) “University” means the Dr. Homi Bhabha State University, Mumbai, constituted under this notification.
(II) Words and expressions used but not defined herein shall have their respective meaning assigned to them in the Act :
2. Constitution of Dr. Homi Bhabha State University, Mumbai.–(1) With effect from the publication of this notification in the Official Gazette, there shall be constituted the Dr. Homi Bhabha State University, Mumbai comprising of a cluster of the existing Institute of Science, Mumbai as a lead College and Elphinstone College, Mumbai, Sydenham College, Mumbai and Secondary Training College, Mumbai as a constituent colleges.
(2) The Chancellor, the Vice-Chancellor, the General Council, Management Council, Academic Council and all other persons who may hereafter become such officers or members so long as they continue to hold such office or membership, are hereby constituted and declared to be a body corporate by the name of the “Dr. Homi Bhabha State University, Mumbai”.
(3) The University shall have perpetual succession and a common seal and shall sue and be sued by the said name.
(4) The University shall function as a non-affiliating University constituted under this notification and it shall not affiliate any other college or institution for the award, conferment of degree, diploma and certificate of its degree to the students admitted therein.
(5) On and with effect from the date of publication of this notification in the Official Gazette, existing Institute of Science, Mumbai and Elphinstone College, Mumbai, Sydenham College, Mumbai and Secondary Training College, Mumbai, shall stand de-affiliated to the University of Mumbai, Mumbai.
(6) The University shall be situated and have its head-quarter at Dr. Homi Bhabha State University, Mumbai, Maharashtra, 15, Madam Cama Road, Mumbai 400032.
3. Objects of the University.— The provisions of section 4 regarding the objects of the university, shall apply with respect to the objects of the University under this notification.
4. Powers And Duties of the University.—The University shall have the following powers and duties, namely :
(1) to provide for instructions, extension, teaching, learning and training in such branches or subjects or disciplines and courses of study including a choice based credit system and any other system that may emerge in future, as the University may, from time to time, determine;
(2) to make provision for research and for the advancement and dissemination of knowledge, and generally to cultivate and promote the arts (including fine arts and performing arts), humanities, social sciences, accounts and commerce, pure and applied sciences, technologies, managements, different forms of medicine, engineering, law, physical education and other branches of learning and culture and their multi-disciplinary and inter-disciplinary areas;
(3) to organize, maintain and manage University departments, schools, institutions, laboratories, knowledge resource centers, learning resource centers, libraries, museums and equipment for teaching, learning, training, research and development or extension;
(4) to establish, maintain and manage departments, institutions of research, institutions of specialized studies or academic services unit;
(5) to establish, maintain and manage constituent, community and conducted colleges, institutions, hostels, health centers, auditoria and gymnasiums ;

(6) to provide for establishment of sub-campuses for serving a group of colleges, and also to provide for and maintain common resource centers in such sub-campuses in the form of postgraduate departments, multi-disciplinary or inter-disciplinary schools, knowledge resource centers, libraries, laboratories, computer centers, and the like centers of learning and skills training, as per the guidelines laid down by the State Government or the University Grants Commission ;
(7) to create posts of directors, principals, teachers, non-vacation academic staff, nonteaching skilled, administrative, ministerial staff and other posts required by the university, from its funds and from the funds received from other funding agencies, prescribe their qualifications, experience and pay-scales, and make appointments thereto ;
(8) to appoint or recognize persons working in any other university or organization as adjunct professors, adjunct associate professors, adjunct assistant professors, visiting professors of the university for specified periods ;
(9) to prescribe the courses of instruction and studies for the various examinations leading to specific degrees and diplomas or certificates ;
(10) to prescribe the courses of instruction and studies in choice based credit system for the various examinations leading to specific degrees, diplomas or certificates in a stand-alone format or joint format with other State or national or global universities ;
(11) to supervise, control and regulate admission of students for various courses of study in university departments, schools, multi-disciplinary and inter-disciplinary schools, community ;
(12) to institute degrees and post-graduate diplomas and post-higher secondary diplomas, certificates and other academic distinctions on the basis of examinations or by other tests or otherwise ;
(13) to hold examinations or evaluations and confer degrees and post-graduate diplomas and award post-higher secondary diplomas and certificates and other academic distinctions on persons who,—
(a) unless exempted therefrom in the manner prescribed, have pursued approved courses of study in the university or a school and have passed the examinations and earned the required credits or marks or grades prescribed by the university ; or
(b) have pursued approved courses of study in the university or a school and have passed the examinations and earned the required credits or marks or grades prescribed by the university ; or
(c) have engaged in research under conditions provided by Ordinances and Regulations;
(14) to confer and award such degrees, diplomas and certificates to, and provide for such lectures, instructions and training for external students online and continuing education courses ;
(15) to confer honorary degrees or other academic distinctions as prescribed by the Statutes;
(16) to fix, demand and receive or recover such fees and other charges, as may be regulated by the Ordinances, from time to time ;
(17) to constitute a fee fixation committee ;

(18) to supervise, control and regulate the conduct and discipline of the students of the University schools and hostels ;
(19) to provide for mobility of students from formal to non-formal stream and vice-versa, and also among the other universities in the State and outside the State ;
(20) to provide for the training and education in the domain of quality, intensive workshops or learning exercises on enhancing quality, and also mechanism for setting up of internal quality assurance for quality improvement of teachers and non-teaching employees ;
(21) to regulate and provide for attendance of the teachers on the premises of the university during teaching hours and beyond teaching hours, as prescribed and to prohibit teachers from taking or conducting private tuitions or private coaching classes ;
(22) to regulate and provide for attendance of the non-teaching employees on the premises of the university or during working hours and beyond working hours, as prescribed ;
(23) to enforce conduct and discipline rules for teachers and non-teaching employees prescribed by the State Government ;
(24) to prescribe and enforce students charter ;
(25) to make provision for participation of students in,—
(a) the national service scheme;
(b) the national cadet corps ;
(c) home guards and civil defense ;
(d) the national sports organization ;
(e) physical and military training ;
(f) extra-mural teaching and research ;
(g) programmes related to Lifelong Learning and Extension ;
(h) any other programmes, services or activities directed towards cultural, economic and social betterment as may be necessary and possible, to fulfill the objects of the university ;
(26) to provide for special training or coaching for competitive examinations, for recruitment to the public services, public sector undertakings and other competitive employment opportunities ;
(27) to co-operate or collaborate with any other university, institution, authority or organization for research and advisory services and for such purposes to enter into appropriate arrangement with other universities, institutions, authorities, or organizations to conduct certain courses as the situation may demand ;
(28) to borrow funds for the purposes of the university on the security of the property of the university, with the prior permission of the State Government ;
(29) to explore the possibilities of augmenting the resources of the university by exploring or innovating activities such as research and development, consultancy, training programmes and providing services for different clients from industry, trade or any other non-government organizations ;
(30) to undertake academic collaboration programmes, research and advisory services with universities and institutions abroad, with prior approval of the State Government ;
(31) to receive funds for collaboration programmes from foreign agencies, subject to rules and regulations of the Central Government and State Government in that behalf ;

(32) to create development corpus out of surplus that the university may generate through its teaching, learning, training, research and development, consultancy, and any other academic and support activities and to invest it in a professional manner and use the interest generated through it for the growth and development of academic, research and development, academic and physical infrastructure development and any other infrastructure ;
(33) to lay down for university teachers, such instructions or directions as, in the opinion of the university, may be necessary in academic matters ;
(34) to undertake development programmes in higher education, research, consultancy based projects and training programmes for outside agencies, by charging fees, so as to generate resources ;
(35) to make special provisions for the benefit of university education to be made available to classes and communities which are socially and educationally backward ;
(36) to make special provisions for such benefits of university education to be made available for women students and differently-abled students as the university may think necessary ;
(37) to implement the national literacy and adult education program through teachers and students on voluntary basis in the university system and to evolve measures to give due weightage to the efforts and performance of the students in this area in addition to their normal academic performance, and also to evaluate the performance of the teachers in this area ;
(38) to promote by itself, or in co-operation with other universities or organizations, the study of foreign languages in general and Asian languages including Marathi in particular ;
(39) to create knowledge and disseminate it and foster high quality research which is contemporary, globally competitive and locally as well as regionally and nationally relevant;
(40) to have a learner-centric approach and perform the role of being a knowledge creator ;
(41) to strengthen education at under-graduate, post-graduate level, enhance research and development culture and relevant degree programmes and cultivate desire for entrepreneurship ;
(42) to create a comprehensive digital university framework for both, e-learning and e-administrative services ;
(43) to exploit the power of 'learning by collaboration' and 'participation' with use of information and communication technology ;
(44) to cultivate research parks, technology incubators and other engagement entities to translate university research to commercial domain and co-ordinated projects involving multiple faculty groups from several disciplines that address some important issues before the State ;
(45) to identify skills to which students need to be exposed to, by taking into account the local needs, training facilities available, emerging needs and new employment opportunities ;
(46) to provide an environment for the all -round development of youth by exposing them to the rich cultural heritage of the country and creating opportunities for development of skills in sports ;
(47) to ensure introduction of choice based credit system with transferable credit points from four streams, namely, the academic stream, the technology stream, the professional and social stream and the personality and cultural development stream;

(48) to facilitate mobility of teachers to collaborating institutions such as industries, research and development laboratories, non -Government organizations, engaged in societal development, to enable translation of knowledge to viable real life applications and in turn enrich university programmes ;
(49) to implement recommendation report of the Commission within the time-frame given by it ;
(50) to comply with and carry out any directives issued by the State Government, from time to time, with reference to above powers, duties and responsibilities of the university ;
(51) to conduct academic audit of university departments, or schools, at regular intervals ;
(52) to do all such other acts and things as may be necessary for, or incidental or conducive to, the attainment of all or any of its objects.
5. Chancellor and his powers.—The Governor of Maharashtra shall be the Chancellor of Dr. Homi Bhabha University and the Chancellor, by virtue of his office, shall be the Head of Dr. Homi Bhabha University and shall exercise such powers as are provided in sub-sections (2), (3), (4), (5) and
(6) of section 9.
6. Officers of the University.—The following shall be the officers of Dr. Homi Bhabha University, namely : —
(i) The Vice Chancellor ;
(ii) The Registrar;
(iii) The Finance and Accounts Officer ;
(iv) Director Board of Examinations and Evaluation ;
(v) Deans of Faculties ;
(vi) The Director, Innovation, Incubation and Linkages ;
(vii) The Director, Knowledge Resource Centre ;
(viii) Any other officer as may be specified by statutes ;
The officers appointed on the posts mentioned in para. (i) to (iv) shall be the full-time salaried employees of the University while the appointment of officers on the posts mentioned in sub-paras (v) to (viii) shall be on the basis of monthly honorarium to be decided by the Vice-Chancellor from time to time, and shall exercise such powers and perform such duties as laid-down in sections 15, 20, 21 of the Act.
7. Appointment of the Vice-Chancellor.—The Vice-Chancellor shall be appointed in the manner on such terms and conditions of service as are provided in section 11.
8. Powers and duties of Vice-Chancellor.—The Vice-Chancellor shall have the powers and perform the duties as are specified in section 12.
9. Registrar.—(1) The Registrar shall be the Chief Administrative Officer of the University. He shall be a full-time salaried officer and shall work directly under the superintendence, direction and control of the Vice-Chancellor.
(2) The provisions regarding appointments, terms and conditions of service and duties of the Registrar as provided in sub-sections (2),(3), (4), (5) and (6) of section 14 of the Act shall, mutatis mutandis, apply to the appointments terms and conditions of service and duties of the Registrar of the University.

10. The Finance and Accounts Officer.—(1) The Finance and Accounts Officer of the University shall be the principal finance, accounts and audit officer of the University. He shall be a fulltime salaried officer and shall work directly under the superintendence, direction and control of the Vice-Chancellor.
(2) The provisions regarding the qualifications for the appointment of Finance and Accounts Officer and his terms and conditions of service and his powers and functions as provided in subsections (2), (3), (4), (5) and (6) of section 18 of the Act shall, mutatis mutandis, apply for the appointment of Finance and Accounts Officer of the University and his terms and conditions of service and his powers and functions.
11. Director of Board of Examination and Evaluation.—(1) The Director of Board of Examination and Evaluation of the University shall be a full-time salaried officer and shall work directly under the directions and control of the Vice-Chancellor. He shall discharge his functions under the superintendence, direction and guidance of the Board of Examinations and Evaluation of Dr. Homi Bhabha University and shall be concerned with the implementation of the policies and directives given by the Board of Examinations and Evaluation.
(2) The provisions of sub-sections (2),(3), (4), (5) of section 17 of the Act, regarding appointment of the Director Board of Examination and Evaluation and his powers and functions, shall mutatis mutandis apply for the appointment of the Director Board of Examination and Evaluation and his powers and functions.
12. Officers, members of authorities, bodies and employees of University to be public servant.—All salaried officers, members of the authorities, committees or bodies, teachers of the university and other employees of the University, shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code (Act No. 45 of 1860).
13. Authorities of University.—(1) The following shall be the authorities of University, namely :–
(a) the General Council ;
(b) Management Council ;
(c) the Academic Council ;
(d) the Finance Committee ;
(e) Faculty ;
(f) Board of Studies ;
(g) Board of Lifelong Learning and Extension ;
(h) Board of Examinations and Evaluation ;
(i) Board of National and International Linkages ;
(j) Board for Innovation, Incubation and Enterprise ;
(k) Board of Sports and Physical Education.
(2) Two-thirds of the total number of members in each authority shall be the quorum for the meetings.
14. General Council.—(1) The General Council of the University shall be the principal authority for all financial estimates and budgetary appropriations and for providing social feedback to the university on current and future academic programmes.

(2) The General Council shall consist of the following members, namely :—
(a) the Chancellor ;
(b) the Vice-Chancellor ;
(c) three persons nominated by Vice-Chancellor out of which one shall be eminent external expert and two others shall be principals of constituent colleges ;
(d) two teachers who are not principals or directors of constituent colleges to be nominated by the Vice-Chancellor from amongst the teachers of the University, out of whom one shall be from amongst the teachers who belong to Scheduled Castes or Scheduled Tribes or De-notified Tribes (Vimukta Jatis) or Nomadic Tribes or Other Backward Class categories, by rotation ;
(e) one shall be from the Deans of Faculty on rotation basis to be nominated by the Vice-Chancellor ;
(f) one representative nominated by the State Government not below the rank of Joint Director;
(g) one representative from the industries and one representative from research and development sector to be nominated by the Vice-Chancellor ;
(h) the Registrar of the University shall be a non-voting invitee to the General Council.
(2) The General Council shall be the supreme authority of the University.
15. Powers and duties of the General Council.—The General Council shall have the following powers, namely :—
(1) to provide general superintendence and directions and to control functioning of the University.
(2) to review the decisions of other authorities of the University in case they are not in conformity with the provisions of this Act or the statutes, ordinances, regulations or rules made thereunder—
(i) to approve the budget and annual report of the University ;
(ii) to lay-down the policies to be followed by the University ;
(iii) to recommend to the Management Council about the voluntary liquidation of the University if a situation arises when its smooth functioning does not remain possible, in spite of all efforts.
(3) The General Council shall meet at least thrice in a calendar year.
16. The General Council shall transact the following business at its meeting, namely :—
(a) to give suggestions to the University authorities on improvements that can be made in all areas and domains that are an integral part of the University, namely, academics, research and development, administration and governance ;
(b) to review current academic programmes and collaborative programmes ;
(c) to suggest new academic programmes consistent with the societal requirements in higher education ;
(d) to suggest measures for improvement and development of the University ;
(e) to confer, on the recommendation of the Management Council and Academic Council, honorary degrees or other academic distinctions ;

(f) to review broad policies and programmes of the University and suggest measures for its improvement and development ;
(g) to receive, discuss and approve the annual financial estimate (budget), the annual report, accounts, audit reports and their satisfactory compliances along with its certification by the auditor and the disciplinary or otherwise action taken report in this regard by the University ;
(h) to approve comprehensive perspective plan and annual plan for the location of colleges and institutions of higher learning, as recommended by the Academic Council ;
(i) to review and adopt the report of students' grievance redressal report to be presented by the Registrar ;
(j) to review and adopt the reports of the Board of Students Affairs and Board of Sports to be presented by the concerned deans ;
(k) to give suggestions to the University authorities on improvements that can be made in the area and domains of student welfare, sports, cultural activities of the University.
(l) to make, amend or repeal statutes.
17. Management Council.—(1) The Management Council of the University shall be the principal executive and policy making authority of the University and shall be responsible for administering the affairs of the university and carrying out such duties, which are not specifically assigned to any other authority.
(2) The Management Council of the University shall meet at least once in every two months.
(3) The Management Council of the University shall consist of following members, namely :—
(a) the Vice-Chancellor-Chairperson ;
(b) one eminent person either from the field of education, industry, agriculture, commerce, banking, finance, social, cultural and other allied fields to be nominated by the Chancellor ;
(c) two Deans to be nominated by the Vice-Chancellor for the tenure of two and half year ;
(d) three persons, who are not the members of the General Council, nominated by the Vice- Chancellor ;
(e) one principal of constituent college ;
(f) two teachers who are not principals of constituent colleges to be elected from amongst the teachers of the University, out of whom one shall be elected from open category amongst the teachers and one elected from amongst the teachers of the University out of Scheduled Castes or Scheduled Tribes or De-notified Tribes (Vimukta Jatis) or Nomadic Tribes or Other Backward Class categories, by rotation ;
(g) one Alumnus nominated by Vice-Chancellor ;
(h) one bonafide Student nominated by Vice-Chancellor.
(4) The quorum for meetings of the Management Council shall be two-thirds of the total members.
18. Powers and duties of Management Council.—The provisions relating to powers and duties of Management Council provided under section 31 shall, mutatis mutandis, apply in respect of the powers and duties of Management Council the University.
19. Academic Council.—(1) The Academic Council of the University shall be the principal academic body of the University and shall, subject to the provisions of this notification and the rules, 22 ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, ¡äò¥ÉÖ́ ÉÉ®úÒ 13, 2019/¨ÉÉPÉ 24, ¶ÉEäò 1940 statutes and ordinances made for the purpose, co-ordinate and exercise general supervision over the academic policies of the University.
(2) The Academic Council of the University shall consist of the following persons, all of whom shall be ex-officio members.—
(a) the Vice-Chancellor – Chairperson ;
(b) all Principal / Head of the Constituent Colleges ;
(c) the Dean of each Faculties of the University ;
(d) three Heads of Departments of the University ;
(e) two Professors / Associate Professors from Constituent Colleges / subjects other than those represented by the Principals ;
(f) two teachers who are not principals of constituent colleges to be elected from amongst the teachers of the University, out of whom one shall be elected from open category amongst the teachers and one elected from amongst the teachers of the University out of Scheduled Castes or Scheduled Tribes or De-notified Tribes (Vimukta Jatis) or Nomadic Tribes or Other Backward Class categories, by rotation ;
(g) other external experts as per requirement representing various disciplines to be nominated by Vice-Chancellor ;
(h) one Alumnus Student nominated by the Vice-Chancellor ;
(i) one Regular Student nominated by the Vice-Chancellor ;
(3) The quorum for the meetings shall be two-thirds of the total members.
20. Powers and duties of Academic Council.—The Academic Council of the University shall have the following powers and functions.—
(a) to control and regulate the standards of teaching and examinations in the University ;
(b) to prescribe the syllabi and the courses of study for all the examinations held by the University ;
(c) to make proposals to the Governing Council and the Management Council for the institution of Professorships, Associate Professorships, Assistant Professorships, or other teaching posts and re-appropriating positions in various subjects in regard to their duties.
(d) to formulate, modify or revise, subject to control the Governing Council and the Management Council, schemes for the constitution of Faculties and for the assignment of subjects to the Faculties ;
(e) to nominate teachers or specialists to the Faculties ;
(f) to promote research within the University and to acquire reports of such research from persons engaged therein ;
(g) to advise the Governing Council and the Management Councils, on academic matters ;
(h) to make proposals to the higher authorities of the Cluster University for supplementing the teaching provided in the constituent colleges ;
(i) to appoint a Standing Committee of the members of the Academic Council of which not less than two thirds shall be University Professors, Associate Professors, Principals, or teachers of constituent, autonomous and affiliated colleges not lower in rank than that of a Professor or Associate Professor and to delegate to it such of its powers as it may deem fit.

21. Certain provisions of the Act to apply mutatis mutandis.—The following provisions of the Act, shall mutatis mutandis, apply in respect of the University :—
(i) sub-sections (2), (3) and (4) of section 34, in regard to number of faculties of the University, its subjects and constitution ;
(ii) section 35, in relation to powers and duties of the faculty ;
(iii) section 41, in relation to powers and duties of the Board of studies ;
(iv) section 45, regarding Board of Lifelong Learning and Extension and its constitution ;
(v) section 46, regarding the powers and duties of the Board of Lifelong Learning and Extension ;
(vi) section 47, regarding Board of Examinations and Evaluation and its constitution ;
(vii) section 48, regarding powers and duties of the Board of Examination and Evaluation ;
(viii) section 51, regarding Board of National and International Linkages ;
(ix) section 52, regarding powers and functions of Board of National and International Linkages ;
(x) section 53, regarding Board of Innovation, Incubation and Enterprise and its constitution ;
(xi) section 54, regarding powers and duties of the Board of Innovation, Incubation and Enterprise ;
(xii) section 57, regarding Board of Sports and Physical Education and its constitution ;
(xiii) section 58, regarding powers and duties of Board of Physical Education.
22. Dissolution of the University.—(1) The State Government may dissolve the University by giving a notice to this effect to the University, the employees and the students of the University at least one year in advance :
Provided that, dissolution of the University shall have effect only after the last batches of students of the regular courses have completed their courses and they have been awarded degrees, diplomas or awards, as the case may be.
(2) On the dissolution of the University all the assets and liabilities of the University shall vest in the Government.
(3) If it appears to the Government that the University has contravened any of the provisions of the Act or the rules, statutes or ordinances made thereunder or has contravened any of the directions issued by it under the Act or has ceased to carry out any of the undertakings, situation of financial mismanagement or mal-administration has arisen in the University, it shall issue notice requiring the University to show cause within forty five days as to why an order of its liquidation should not be made.
(4) The lead college and constituent colleges of the University on prior permission of the State Government may apply for the affiliation to the parent University.

23. Removal of doubts.—For the removal of doubt, it is hereby decided that, the provisions of the Act, which are not expressly modified by virtue of paragraph 23 above and by implication of the provisions contained herein, shall continue to apply to the University.
