क्रमांं�क संंकीीर्णण-२०२४/प्र.क्र.४७/अ-३.– ज्यााअर्थीी, भूूमि�संंपाादन, पुुनर्ववसन व पुुनर्ववसााहत करताानाा उचि�त भरपााई मि�ळण्यााचाा आणि� पाारदर्शशकतेेचाा हक्क अधि�नि�यम, २०१३ (२०१३ चाा ३०) महाारााष्ट्र रााज्याालाा लाागूू असताानाा, (याात याापुुढेे ज्यााचाा नि�र्देेश “उक्त अधि�नि�यम” असाा करण्याात आलाा आहे.े)यााच्याा कलम १० क मध्येे, अशीी तरतूदू आहे ेकीी, रााज्य शाासनाास लोोकहि�ताास्तव रााजपत्राातीील अधि�सूूचनेेद्वाारेे उक्त कलम १०क मध्येे नमूूद केेलेेल्याा कोोणत्यााहीी प्रकल्पांं�नाा, उक्त अधि�नि�यमााच्याा प्रकरण दोोन आणि� प्रकरण तीीन यांं�च्याा तरतुुदीी लाागूू करण्याापाासूून सूूट देेताा येेईल ;
आणि� ज्यााअर्थीी, रााज्य शाासनाास असेे दि�सूून आलेे आहेे कीी, याा सोोबत जोोडलेेल्याा अनुुसूूचीी एक मध्येे नमूूद केेलेेल्याा जमि�नीी उक्त कलम १० क च्याा खंंड (च) च्याा व्यााप्तीीत येेणााऱ्याा आणि� याासोोबत जोोडलेेल्याा अनुुसूूचीी दोोन मध्येे नमूूद केेलेेल्याा प्रकल्पाासााठीी (याात याापुढुे ेज्यााचाा, नि�र्देशे “उक्त प्रकल्प” असाा करण्याात आलाा आहे.े) आवश्यक आहेेत किं�वंाा त्यांं�चीी आवश्यकताा भाासण्यााचीी शक्यताा आहेे.
आणि� ज्यााअर्थीी, रााज्य शाासनााने ेउक्त प्रकल्पांं�करि�ताा केवेळ कि�माान नि�व्वळ जमि�नीीचीी आवश्यकताा भाासेले हे ेलक्षाात घेऊेन प्रस्ताावि�त संंपाादनाासााठीीच उक्त जमि�नीीचेे व्यााप्ति��क्षेेत्र नि�श्चि�ित केेलेे आहेे ;
आणि� ज्यााअर्थीी, महाारााष्ट्र शाासनाास यााद्वाारेे उक्त अधि�नि�यमााच्याा कलम १० क खाालीील उक्त प्रकल्पाालाा उक्त अधि�नि�यमााच्याा प्रकरण दोोन आणि� प्रकरण तीीन च्याा तरतुुदीी लाागूू करण्याापाासूून लोोकहि�ताास्तव सूूट देेणेे इष्ट वााटतेे.
त्यााअर्थीी, आताा, उक्त अधि�नि�यमााच्याा कलम १० क द्वाारेे प्रदाान करण्याात आलेेल्याा अधि�काारांं�चाा आणि� यााबााबतीीत, त्याास समर्थथ करणााऱ्याा इतर सर्वव अधि�काारांं�चाा वाापर करून, महाारााष्ट्र शाासन यााद्वाारेे लोोकहि�ताास्तव, उक्त अधि�नि�यमााच्याा प्रकरण दोोनच्याा आणि� प्रकरण तीीनच्याा तरतुुदीी लाागूू करण्याापाासूून उक्त प्रकल्पाालाा सूूट देेत आहेे.

NOTIFICATION RIGHT TO FAIR COMPENSATION AND TRANSPARENCY INLAND ACQUISITION, REHABILITATION AND RESETTLEMENT ACT, 2013.
No. Sankirna-2024/C.R.47/A-3.—WHEREAS, section 10A of the Right to Fair Compensation and Transparency inLand Acquisition, Rehabilitation and Resettlement Act, 2013 (30of2013), in itsapplication to the State ofMaharashtra (hereinafter referred to as “the said Act"), provides that the State Government may, inthepublic interest, by notification in the Official Gazette, exempt any oftheprojects mentioned inthe said section 10A from the application of the provisions of Chapter IIand Chapter IIIofthe said Act;
And whereas, it appears to the Government ofMaharashtra that the lands mentioned in Schedule-I appended hereto are required or likely to be required forthe project mentioned inSchedule- II appended hereto, which iscovered under clause (/) of the said section 10A (hereinafter referred to as “the said project”);
And whereas, the Government ofMaharashtra has ensured the extent ofthe said lands forthe proposed acquisition being bare minimum land required forthe said project;
And whereas, the Government ofMaharashtra considers it expedient in the public interest to exempt thesaid project under section 10A of the said Act from the application of the provisions of Chapter IIand Chapter IIIofthe said Act.
Now therefore, in exercise ofthe powers conferred by section 10A ofthe said Act and ofallother powers enabling it in that behalf, the Government ofMaharashtra hereby, exempts thesaid project, in the public interest from theapplication ofthe provisions ofChapter IIand Chapter IIIofthesaid Act.
