Section 34: In certain cases rent may be charged in lieu of profits.

Where any mortgaged property is in the possession of the mortgagee or his tenants other than the mortgagor, and the Court is unable to determine what profits have actually been received, it may fix a fair rent for such property and charge to the mortgagee such rent as profits for the purposes of section 33:
Provided that, if it be prove that in any year there was any suspension or remission of rent or land revenue of such land under any law relating to land revenue for the time being in force, an abatement of the whole or part of such amount may be allowed for that year.
