क्रमांं�क मवि�सेे-१०१६/प्र.क्र. १९/आस्थाा-३.—भाारतााच्याा संंवि�धाानााच्याा अनुुच्छेेद ३०९ च्याा परंंतुुकाान्वयेे प्रदाान करण्याात आलेेल्याा अधि�काारांं�चाा वाापर करून, महाारााष्ट्र वि�काास सेेवाा (रचनाा, वर्गीीकरण आणि� भरतीी) नि�यम, १९७३ मध्येे आणखीी सुुधाारणाा करण्याासााठीी महाारााष्ट्रााचेे रााज्यपााल यााद्वाारेे खाालीीलप्रमााणेे नि�यम करीीत आहेेत :— १. या ा नि�यमांं�नाा महाारााष्ट्र वि�काास सेेवाा (रचनाा, वर्गीीकरण आणि� भरतीी) (सुुधाारणाा) नि�यम, २०२४ असेे संंबोोधण्याात येेईल.
२. महाारााष्ट्र वि�काास सेेवाा (रचनाा, वर्गीीकरण आणि� भरतीी) नि�यम, १९७३ (याात याापुुढेे “मूूळ नि�यम” असेे संंबोोधलेे जााईल.)

(क) उपनि�यम (६) च्याा कलम (६) मधीील मजकुुरााऐवजीी खाालीील मजकूूर समाावि�ष्ट करण्याात येेईल.
“(६) सहाायक गट वि�काास अधि�काारीी (गट-ब) (रााजपत्रि�त) याा पदाावरीील पदोोन्नतीी व नाामनि�र्देेशनाानेे नि�युुक्तीीचेे प्रमााण अनुुक्रमेे ५०: ५० टक्केे असेे रााहीील.” ३. मुुख् य नि�यमाातीील नि�यम क्रमांं�क ९ मधीील मजकुुरााऐवजीी खाालीील मजकूूर दााखल करण्याात येेईल :— “९. (१) नि�यम ६ (ख) मध्येे नमूूद केेलेेल्याा पदाावर पदोोन्नतीीनेे नि�युुक्त होोणााऱ्याा व्यक्तीीनेे, सदर पदाावर पदोोन्नतीी मि�ळण्याापूूर्वीी मरााठीी भााषाा व हिं�ंदीी भााषाा परीीक्षाा उत्तीीर्णण केेलेेलीी नसल्याास अथवाा उत्तीीर्णण होोण्याापाासूून सूूट मि�ळवि�लेेलीी नसल्याास शाासनाानेे वेेळोोवेेळीी केेलेेल्याा नि�यमांं�नुुसाार किं�ंवाा त्यााबााबत शाासनाानेे वेेळोोवेेळीी पाारि�त केेलेेल्याा आदेेशांं�नुुसाार, सदर पदाावरीील पदोोन्नतीीपूूर्वीी मरााठीी व हिं�ंदीी भााषाा परीीक्षाा उत्तीीर्णण होोणेे आवश्यक रााहीील.
(२) नि� यम ६ (क) मध्येे नमूूद केलेेले्याा पदाावर नाामनि�र्देशनाानेे नि�युुक्त होोणााऱ्याा व्यक्तीीने ेशाासनाानेे वेळेोोवळीी केलेेले्याा नि�यमांं�नुुसाार किं�ंवाा वेेळोोवेेळीी पाारि�त केेलेेल्याा आदेेशांं�नुुसाार, मरााठीी व हिं�ंदीी भााषाा परीीक्षाा नि�युुक्तीीपूूर्वीी उत्तीीर्णण केेलेेलीी नसेेल तर, नि�युुक्तीीनंंतर वि�हि�त मुुदतीीत हिं�ंदीी भााषाा व मरााठीी भााषाा परीीक्षाा उत्तीीर्णण होोणेे आवश्यक रााहीील अथवाा उत्तीीर्णण होोण्याापाासूून सूूट मि�ळवि�लेेलीी असणेे आवश्यक रााहीील. सदर परीीक्षाा उत्तीीर्णण होोईपर्यंंत अशाा व्यक्तीीलाा वाार्षि�िक वेेतनवााढ व वरि�ष्ठ पदाावर पदोोन्नतीी अनुुज्ञेेय रााहणाार नााहीी.”.
४. मुुख् य नि�यमाातीील नि�यम क्रमांं�क १० मधीील मजकुुरााऐवजीी खाालीील मजकूूर दााखल करण्याात येेईल :— “१०. (१) नि�यम ६ (ख) मध्येे नमूूद केेलेेल्याा पदाावर पदोोन्नतीीनेे नि�युुक्त होोणााऱ्याा व्यक्तीीकडेे शाासनाानेे वेेळोोवेेळीी केेलेेल्याा नि�यमांं�नुुसाार किं�ंवाा वेेळोोवेेळीी पाारि�त केेलेेल्याा आदेेशांं�नुुसाार, सदर पदाावरीील पदोोन्नतीीपूूर्वीी संंगणक काार्ययचलनााचेे (कॉॉम्प्युुटर ऑपरेेशन्स) प्रमााणपत्र धाारण करण्याापाासूून सूूट मि�ळवलेेलीी नसल्याास संंगणक काार्ययचलनााचेे (Computer Operations) प्रमााणपत्र धाारण करणेे आवश्यक रााहीील.
(२) नि� यम ६ (क) मध्ये ेनमूदू केलेेले्याा पदाावर नाामनि�र्देशेनाानेे नि�युुक्त होोणााऱ्याा व्यक्तीीकडे ेशाासनाानेे वेळेोोवेळेीी केलेेले्याा नि�यमांं�नुुसाार किं�वंाा वेळेोोवेळेीी पाारि�त केलेेले्याा आदेेशांं�नुुसाार, संंगणक काार्ययचलनााचे े(कॉॉम्प्युुटर ऑपरेेशन्स) प्रमााणपत्र धाारण करण्याापाासूनू सूटू मि�ळवलेेलीी नसल्याास संंगणक काार्ययचलनााचेे (Computer Operations) प्रमााणपत्र वि�हि�त मुुदतीीत धाारण करणेे आवश्यक रााहीील, अन्यथाा अशाा व्यक्तीीलाा सदर प्रमााणपत्र प्रााप्त करेेपर्यंंत वाार्षि�िक वेेतनवााढ व वरि�ष्ठ पदाावर पदोोन्नतीी अनुुज्ञेेय रााहणाार नााहीी.”.
५. मू ूळ नि�यमाामधीील नि�यम क्रमांं�क १२ मधीील मजकुुरााऐवजीी पुुढीील मजकूूर दााखल करण्याात येेईल :— “१२. (१) सहाायक गट वि�काास अधि�काारीी (गट-ब) (रााजपत्रि�त) याा पदाावर नाामनि�र्देेशनााद्वाारेे नि�युुक्त केेलेेलीी व्यक्तीी दोोन वर्षेे परि�वि�क्षााधीीन असेेल. सदर परि�वि�क्षाा काालाावधीी जाास्तीीतजाास्त एक वर्षाा�पर्यंंत वााढवि�ताा येेईल. शाासनााच्याा धोोरणाानुुसाार सदर व्यक्तीीस वााढवि�लेेलाा काालाावधीी धरून परि�वि�क्षेेचाा काालाावधीी समााधाानकाारकरि�त्याा पूूर्णण करणेे अनि�वाार्यय रााहीील. शाासनााच्याा परि�वि�क्षाा धोोरणाानुुसाार, संंबंंधि�त व्यक्तीीनेे परि�वि�क्षाा काालाावधीी (वााढवि�लेेल्याा काालाावधीीसह) समााधाानकाारकरि�त्याा पूूर्णण न केेल्याास सदर व्यक्तीीच्याा सेेवाा समााप्त करण्याास पाात्र रााहतीील.
महाारााष्ट्र शाासन रााजपत्र असााधाारण भााग चाार-अ, जाानेेवाारीी १२, २०२४/पौौष २२, शकेे १९४५ 3 (२) साामाान्य प्रशाासन वि�भाागाानेे वेेळोोवेेळीी एकत्रि�त परि�वि�क्षााधीीन प्रशि�क्षण काार्ययक्रमांं�तर्गगत (सीीपीीटीीपीी) सेेवााजेेष्ठताा, वि�भाागीीय परि�क्षाा व अन्य अनुुरूप (consentaneous) बााबींंकरि�ताा वि�हि�त केेलेेलेे नि�यम व नि�यमन हेे नि�यम ६ (अ) मध्येे नमूूद केेलेेल्याा पदाावर नाामनि�र्देेशनाानेे नि�युुक्त झाालेेल्याा व एकत्रि�त परि�वि�क्षााधीीन प्रशि�क्षण काार्ययक्रमांं�तर्गगत प्रशि�क्षण घेेणााऱ्याा अधि�कााऱ्यांं�नाा लाागूू रााहतीील.”.
६. मू ूळ नि�यमाामधीील नि�यम १२ नंंतर खाालीील नि�यमााचाा समाावेेश करण्याात येेईल :— “१३. (१) नि�यम ६ (अ) मध्येे नमूूद केलेेले्याा पदाावर नाामनि�र्देशनाानेे नि�युुक्तीीसााठीी शि�फाारस केलेेले्याा व्यक्तींंनीी महाारााष्ट्र नाागरीी सेेवाा (लहाान कुुटुंं�बााचीी घोोषणाा) नि�यम, २००५ किं�ंवाा शाासनाानेे वेेळोोवेेळीी नि�र्गगमि�त केेलेेलेे अन्य नि�यम, आदेेशाानुुसाार घोोषणाापत्र साादर करणेे आवश्यक रााहीील.
(२) ज्याा व्यक्तींंनाा लहाान कुुटुंं�बााचेे घोोषणाापत्र साादर करण्यााच्याा दि�वशीी दोोन पेेक्षाा जाास्त अपत्येे असतीील अशीी व्यक्तीी शाासकीीय सेेवेेमध्येे नि�युुक्तीीसााठीी अपाात्र असेेल.
(३) एखााद्याा व्यक्तीीचीी शाासकीीय सेवेेेमध्येे नेमेणूकू झााल्याानंंतर असे ेसि�द्ध झााले ेकीी, त्याा व्यक्तीीलाा नि�युुक्तीीच्याा वेळेीी किं�वंाा त्याानंंतर दोोन पेेक्षाा जाास्त अपत्येे असतीील तर तीी व्यक्तीी शाासकीीय सेेवेेमध्येे त्याा पदाावर रााहण्याास अपाात्र असेेल.
१४. शाासनााच्याा सेेवेेत नि�युुक्त झाालेेल्याा व्यक्तींंनाा त्यांं�चीी नेेमणूूक केेल्याानंंतर शाासनाानेे नि�युुक्तीीबााबत ठरवूून दि�लेेल्याा अटीी व शर्तीी यााबााबत वेेळोोवेेळीी नि�र्गगमि�त केेलेेलेे नि�यम, आदेेश व नि�र्णणय लाागूू रााहतीील.”.

NOTIFICATION Constitution of India.
No. MDS-1016/CR 19/EST-3.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules further to amend the Maharashtra Development Service (Constitution, Classification and Recruitment) Rules, 1973, namely :—
1. These rules may be called the Maharashtra Development Service (Constitution, Classification and Recruitment) (Amendment) Rules, 2024.
2. In rule 6 of the Maharashtra Development Service (Constitution, Classification and Recruitment) Rules, 1973 (hereinafter referred to as “the Principal Rules”),—
(a) in sub-rule (1), for clause (b), the following clause shall be substituted, namely :— “(b) by promotion of the persons holding the posts mentioned in the table appended hereto and having experience of at least seven years of regular service in that post on the basis of seniority in accordance with the percentage of reservation mentioned in the following table :— Sr.

(c) in sub-rule (6), for clause (6), the following clause shall be substituted, namely :— “(6) Appointment to the post of Assistant Block Development Officer, Group-B (Gazetted), shall be made by promotion and nomination, in the ratio of 50:50, respectively.”.
3. For rule 9 of the Principal Rules, the following rule shall be substituted, namely :— “9. (1) A person to be appointed to the post mentioned in rule 6 (b) by promotion shall pass the Marathi and Hindi languages examinations as per the rules made or orders issued in that behalf by the Government, from time to time, unless he has already passed or has been exempted from passing those examinations before getting promoted to the said post.
(2) A person appointed to the post mentioned in rule 6 (a) by nomination shall pass the Marathi and Hindi languages examinations as per the rules made or order issued in that behalf by the Government, from time to time, within the prescribed time limit after appointment, unless he has already passed or has been exempted from passing those examinations. He shall not be eligible for annual increment or promotion to the next promotional post until he passes those examinations.”.

4. For rule 10 of the Principal Rules, the following rule shall be substituted, namely :— “10. (1) A person to be appointed to the post mentioned in rule 6 (b) by promotion shall possess a Certificate of Computer Operations prescribed by rules made or orders issued in that behalf by the Government, from time to time, unless he has been exempted therefrom before getting promoted to the said post.
(2) A person appointed to the post mentioned in rule 6 (a) by nomination shall possess a Certificate of Computer Operations prescribed by the Government, from time to time, within the prescribed time limit after appointment, unless he has been exempted from possessing such Certificate of Computer Operations, otherwise he shall not be eligible for annual increment or promotion to the next promotional post until he possess the same.”.
5. For rule 12 of the Principal Rules, the following rule shall be substituted, namely :— “12. (1) A person appointed to the post of Assistant Block Development Officer, Group-B (Gazetted), by nomination, shall be on probation for a period of two years. The probation period may be extended maximum up to one year. Completion of the probation period (including extended period) satisfactorily as per the probation policy of the Government, is mandatory. In the event of failing to complete the probation period (including extended period) satisfactorily as per the probation policy of the Government, his services shall be liable to be terminated.
(2) The rules and regulations of Combined Probationary Training Programme (CPTP), prescribed by the General Administration Department, from time to time, for the seniority, Departmental examination and other consentaneous matters, shall be applicable to the officers appointed by nomination on post mentioned in rule 6 (a) and taking training under the combined training programme.”.
6. After rule 12 of the Principal Rules, the following rules shall be added, namely :— “13. (1) A person recommended for appointment by nomination to the post mentioned in rule 6 (a) shall submit a Declaration of Small Family as per the provisions of the Maharashtra Civil Services (Declaration of Small Family) Rules, 2005 or any other rules, orders or any instruments issued in this behalf by the Government, from time to time.
(2) A person having more than two children on the date of submission of Declaration of Small Family shall be disqualified for the appointment in the Government Service.
(3) After appointment of a person in the Government service, if it is proved that he has more than two children at the time of appointment or thereafter, then he shall be disqualified for continuing on the said post in the Government service.
14. The terms and conditions specified by the Government, subsequent to the appointment of any Government Servant in any rules, orders or resolutions issued in this behalf by the Government, from time to time, shall also be applicable to the Government servant.”.
