No. TPV.2707/91/C.R.180/07/UD-27.— In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules, regulating recruitment to the “posts of the Director of Town Planning, Group A, the Joint Director of Town Planning Group A, the Deputy Director of Town Planning, Group A, the Assistant Director of Town Planning, Group A, the Town Planner Group A, the Assistant Town Planner Grade I, Group B, the Assistant Town Planner, Grade II, Group B” in the Maharashtra ‘Town Planning and Valuation service in the Directorate of Town Planning and Valuation, under the Urban Development Department of the Government of Maharashtra, namely

1. These rulos, may be called the Director of Town Planning, Group A, Joint Director of Town Planning, Group A, Deputy Director of Town Planning, Group A, Assistant Director of Town Planning, Group A, Town Planner Group A, Assistant Town Planner Grade I, Group B and Assistant Town Planner Grade II Group B in the Maharashtra Town Planning and Valuation Service in the Directorate of Town Planning and Valuation (Recruitment) Rules, 2011.

2. In these Rules, unless the context requires otherwiso,—

(a) “Commission” means the Maharashtra Public Service Commission;

(b) “Degree” means a degree of a Statutory University;

(c) “Directorate” means the Directorate of Town Planning and Valuation of the Government;

(@) “Government” means the Government of Maharashtra;

(e) “Master's Degree” means a Masters Degree of & Statutory University;

(&) “University” means Statutery University recognised by UGC.

3. Appointment to the post of the Director of Town Planning, Group-A shall be made by promotion of a suitable person on the basis of strict selection with due regard to seniority, from amongst the persons holding the post of Joint Director of Town Planning in the Directorate, having not less than three years regular service in that post.

4. Appointment to the post of Joint Director of Town Planning, Group-A, shall be made by promotion of a suitable person on the basis of strict selection with dué regard to seniority from amongst the persons holding the post of Deputy Director of Town Planning, in the Directorate, having not less than three years regular service in that post.

5. Appointment to the post of Deputy Director of Town Planning, Group-A shall be made either — (A) by promotion of a suitable person on the basis of strict selection with due regard to seniority from amongst the persons holding the post of Assistant Director of Town Planning, in the Directorate having not less than three yedrs regular service in that post after cbtaining the qualification prescribed below -

(a) Masters Degree in Town Planning or City Planning or Town and Country Planning or Urban Planning or Regional Planning or Environmental Planning including specialisation if any, in Traffic and Transportation Planning or Housing of Institution recognised by Government obtained after securing a Degree in Civil Engineering or Architecture or Urban or Town Planning; or

(5) Post Graduate Diploma in Urban Planning or Town Planning or Town and Country Planning or Traffic and Transportation Planning or Urban Design or Environmental Planning from the School of Planning and Architecture, New Delhi or any other Statutory University or Recognised Institution, obtained after securing a Degree in Civil Engineering or Architecture or Urban or Town Planning; or WIS, RV TR STV W W, AT 3, 000/ tR, W (R

(c) Associate Membership of Institute of Town Planners, India, New Delhi obtained by passing the Examination conducted by Institute of Town Planners, India, New Delhi., obtained after securing a Degree in Civil Engineering or Architecture; or

(d) any other Post-Graduate qualification deemed to be equivalent thereto by the Government in Town Planning after securing a Degree in Civil Engineering or Architecture or Urban or Town Planning; or (B) By nomination from amongst candidates who — () are not more than forty five years of age:

Provided that, the age limit may be relaxed by five years for the candidates who are already in the service of Government;

(if) possess the qualifications as presribed in Rule 5 (A) (@), (b), (c) or (d) and have experience not less than five years Town Planning or Town Planning and Valuation of lands and Buildings in a post not below the rank of Town Planner or equivalent post in Government or Semigovernment organisations after obtaining the above qualification:

Provided that, the age limit may be relaxed by five years in favour of candidates possessing exceptional qualifications or experience or both.

6. Appointment to the post of Assistant Director of Town Planning, Group-A shall be made either — (A) by promotion of a suitable person on the basis of strict selection with due regard to seniority; and

(1) having not less than three years regular service as Town Planner in the Directorate after obtaining the Dagree in Civil Engineering or Civil and Rural Engineering or Architecture or Construction Technology or Urban Planning or equivalent qualification of Recognised University; or

(2) having not less than eight years regular service as Town Planner in the Directorate and who possess Diploma in Civil Engineering or Equivalent thereto from a Recognised Institution;

Provided that the age limit may be relaxed by five years for the candidates who are already in the service of Government.

(i) possess a Degree in Civil Engineering or Civil and Rural Engincering or Urban and Rural Engineering or Architecture or Construction Technology or Urban Planning of a University equivalent qualification and having experience not less than five years in Town Planning or Town Planning and Valuation of, Lands and Buildings in 2 responsible position, after obfaining the above qualification.

. Appointment to the post of Tovn Planner, Group-A shall be made either — * (&) by promotion of a suitable person on the basis of seniority subject to fitness from amongst, the persons holding the post of Assistant Town Planners Grade - I, Assistant Town Planners Grade 11, having not less than three years regular service on that post.

OR (B) by nomination from amongst candidates who —

(i) are not more than thirty three years of age

Provided that, tshe candidates belonging to reserved category, who are not more than thirty-eight years of age, may also be considered under this clause:

Provided further that, the age limit may be relaxed by five years for the candidates who are already in the service of Government;

(i6) possess a Degree in Civil Engineering or Civil and Rural Enginecring or Urban end Rural Engincering or Architecture or Construction Technology or Urban Planning of Recognised University or equivalent qualification and having experience not less than threo years in Town Planning or Town Planning and Valuation of Lands and Buildings, after obtaining the above qualification.

8. Appointment to the post of Assistant Town Planner Grade-I, Group-B shall be made by nomination from amongst the candidates who, — (&) are not more than thirty three years of age;

(ii) possesses a Degree in Civil Engineering or Civil and Rural Engineering or Urban and Rural Engineering or Architecture or Construction Technology or Urban Planning of Recognised University or equivalent qualification.

9. The person holding the post of Planning Assistant in the Directorate who has put in five years continuous service on the post of Planning Assistant on regular basis may be designated as Assistant Town Planner Grade-1l, Group-B, in consultation with the Commission.

10. Appointment to the post of Deputy Director of Town Planning, mentioned in Rule 5 by promosion from amongst the persons holding the post of Assistant Director of Town Planning as mentioned in Rule 5 (A) and by nomination as mentioned in Rule 5 (B) respectively shall be made in the ratio of 75:25.

11. Appointment to the post of Assistant Director of Town Planning mentioned in Rule 6 by promotion from amongst the persons holding the post of Town Planner as mentioned in Rule 6 (A) () and Rule 6 (A) (i) and by nomination as mentioned in Rule 6 (B) respectively, shall be made in the ratio of 50:10:40.

12. Appointment to the post of Town Planner mentioned in Rule 7, by promation, from amongst the persons holding the post of Assistant Town Planner, Grade - I, ‘Assistant Town Planner Grade - II, as mentioned in Rule 7 (A) and by nomination as mentioned in Rule 7 (B) respectively, shall be made in the ratio of 30:30:40.

13. A person appointed by nomination on the posts specified in Rules 5, 6, 7 and 8 shall be on probation for a period of two years. The probation period may be extended maximum up to one year, if, the person does not complete probation period satisfactorily or is found unsuitable for the post then he will be liable to be terminated from service without any prior notice.

14. A person appointed to the posts specified in Rules 5, 6, 7, 8 and 9 shall be required to pass examination in Hindi and Marathi according to the Rules made in that behalf, unless he has already passed or has been exzmpted from passing these examinations.

15. A person appointed to the posts specified in Rules 5, 6, 7, 8 and 9 should possess a certificate in computer operations prescribed by the Directorate of Information Technology, Government, from time to time.

16. A person appointed to the posts specified in Rules 5, 6, 7, 8 and 9 shall be liable for transfer anywhere in the State of Maharashtra.

17. A person appointed to the posts specified in Rules 5, 6, 7,8 and 9 shall, if so required, be liable to serve in any Defence service or post connected with the Defence of India anywhere in India or abroad, for a period of not less than four years, including the period spent on training, if any, on such canditions as are determined by the Government of India

Provided that, no person shall be required to serve as aforesaid after the expiry of a period of ten years from date of his appointment or after he has attained the age of fifty years, whichever is earlier.
