No. DAP-1018/C.R.28/D-1481.- In the exercise of the powers conferred by section 13 read with sub-section (4) of section 3 of Maharashtra District Planning Committees (Constitutions and Functions) Act, 1998 (Mah. XXIV of 1998) and all other powers enabling it in that behalf, the Government of Maharashtra hereby amends the Maharashtra District Planning Committees (Conduct of meetings) Rules, 1999 as follows, namely :—
1. These rules may be called Maharashtra District Planning Committees (Conduct of meetings) (*Amendment) Rules, 2018.
2. In rule 2 of Maharashtra District Planning Committees (Conduct of meetings) Rules, 1999 (hereinafter referred to as “the said principal rules”), in sub-rule (1),—
(i) after clause (b), the following shall be inserted, namely :— “ (b-1) “District Annual Plan” means such District Annual Plan as may be prepared by District Planning Committee under clause (a) of section 10 of the Act ;”;
(ii) for clause (c), the following shall be substituted, namely:—
(c) “District Planning Committee” means the District Planning Committee for every district constituted under sub-section (1) of section 3 of the Act.”;
(iii) after clause (c), the following shall be inserted, namely :— “ (a) “(c-1) “D P O” means the District Planning Officer as mentioned under clause (e) of Para IV of sub-section (3) of section 3 of the Act and include Assistant District Planning Officers appointed by the State Government ;
(b) (c-2) “Executive Committee” means the Executive Committee as may be constituted by State Government under section 11 of the Act;”;
(iv) clause (d) shall be deleted.
(v) after clause (e), the following shall be added, namely :—
(a) “ (e-1) “Sub-Committee” means such Sub-Committees constituted under section 11 of the Act;”;
(b) “ (e-2) “State Government” means the Government of Maharashtra.”.
3. For rule 3 of the principal rules, the following shall be substituted, namely:—
3. Notice of meeting.—The Chairperson of the District Planning Committee, shall decide the date and time of every meeting of the District Planning Committee upon submission of proposal by Member-Secretary. The Agenda for such meeting of District Planning Committee shall be approved by the Chairperson. The notice conveying the meeting shall be issued accordingly by Member- Secretary at least seven (7) clear days before the date of the meeting to all ex-officio Members, nominated Members, elected Members and special invitees of the District Planning Committee.”.
4. For rule 4 of the principal rules, the following shall be substituted, namely:— “4. Place of meeting.- (1) The meetings of the District Planning Committee shall normally be held at the headquarter of respective districts. However, for any special reasons to be recorded by Member-Secretary, it may be held at any other place within the district upon approval by Chairperson of the District Planning Committee and under prior intimation of at least seven clear days to State Government.

(2) The first meeting of newly constituted District Planning Committee shall be held within thirty days from the date of constitution of the District Planning Committee, but ninety days shall not intervene between its last meeting and the next meeting of the District Planning Committee.”.
5. In rule 5 of the principal rules,—
(i) in sub-rule (1), for the words “of the Committee”, the words “of the District Planning Committee” shall be substituted;
(ii) in sub-rule (2),—
(a) for the word “Committee”, the words “District Planning Committee” shall be substituted.
(b) for sub-clause (a), the following shall be substituted, namely :— “(a) If the business on the Agenda of the meeting of the District Planning Committee cannot be transacted on the appointed day on which the meeting is held, the Chairperson of the District Planning Committee, may convene the meeting on the following day or on any other day within seven days of the appointed day as may be declare on that day. No fresh notice under rule 3 shall be necessary for such adjourned meeting.”;
(c) After sub-rule (2), the following shall be added, namely:— “(3) The business on Agenda of the meeting of the District Planning Committee shall be transacted first and thereafter any other subject relating to the District Annual Plan may be taken up but with permission of Chairperson of the District Planning Committee. Any subject of discussion other than those on Agenda and not relating to the District Annual Plan should not be taken as record of transaction of business of the District Planning Committee.”.
6. In rule 6 of the principal rules, for the word “Committee”, the words “District Planning Committee” shall be substituted.
7. After rule 6 of the principal rules, the following shall be inserted, namely:— “6A. Executive Committee.– The State Government shall under the Chairperson of the District Planning Committee constitute an Executive Committee to assist the District Planning Committee for the purposes of clause (c) of section 10 of the Act. The Executive Committee shall of the Divisional Commissioner, District Collector, Chief Executive Officer of the Zilla Parishad, Two nominated Members, nominated under Para II of sub-section (3) of section 3, and two Special Invitees, nominated each Special Invitee under clauses (a) and (f), respectively, of Para IV of sub-section (3) of section 3 of the Act, which shall include at least one Member of Parliament and one Member of Maharashtra State Legislature, as per recommendations of Chairperson. The D P O shall be convener of the Executive Committee. The Executive Committee shall meet preferably once every month and as often as may be decided by Chairperson of the District Planning Committee.”.
8. For rule 7 of the principal rules, the following shall be substituted, namely:— “7. Decisions of District Planning Committee.— All decisions regarding business on Agenda at the meeting of District Planning Committee, as far as possible shall be arrived at by general consensus, however, in case of persistent disagreement, about any business on Agenda, the Chairperson may direct that the matter may be decided by more than two-third majority of those present and voting.
For the purpose of voting, every member shall have one vote and the voting shall be conducted by raising of hands. The Member-Secretary may, with approval of the Chairperson, refer to the State Government of any decision of the District Planning Committee as decided by voting for consideration.”.
9. After rule 7 of the principal rules, the following rule shall be inserted, namely:— “7A. Sub-Committees.– (1) The State Government shall upon recommendation of Chairperson of District Planning Committee, constitute such Sub-Committees as may be desirable for effective monitoring the various Schemes and Programmes of the State Government for any of the Core or Non-Core Sector in District Annual Plan. The number of such Sub-Committees shall not exceed five.
Each such Sub-Committee shall be chaired either by a Nominated Member or Elected Member or Special Invitee, as may be recommended by Chairperson of District Planning Committee. The Sub- Committee shall consist of the following members :— 7¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, +ÉìC]õÉä¤É®ú 9, 2018/+ÉÊ·ÉxÉ 17, ¶ÉEäò 1940
(a) three subject experts to be selected by Chairperson from panel of names prepared by Member-Secretary from nominations received from academic or educational or research institutions;
(b) three District Officers to be nominated by Member-Secretary for implementing Schemes or Programmes of the State Government relating to Core or Non-Core Sector;(c) the Assistant District Planning Officers designated by the Member-Secretary, shall be the convener for such Sub- Committee.
(2) The Sub-Committees shall meet as per directions of the Executive Committee and submit their recommendations through Member-Secretary for consideration of the Executive Committee.”.
10. For rule 9 of the principal rules, the following rule shall be substituted, namely :— “9. Custody of the Records.- All records of the District Planning Committee shall be in custody of the Member-Secretary and he shall maintain the same as per the provisions of the Maharashtra Public Records Act, 2005 (Mah. IV of 2006).”.
11. In rule 10 of the principal rules, after the words “days’ meeting” at the end, the following portion shall be added, namely:— “The Chairperson, upon being satisfied that his directions to withdraw from the meeting forthwith has been in subordinated by any member, he shall direct the Member-Secretary to submit a report for consideration of State Government recommending revocation of appointment of concerned Nominated Member or debarment of concerned Special Invitees or suspension of concerned Elected Member from attending meetings of District Planning Committee for a period of up to one year, as may be decided by the State Government:
Provided that, no such direction shall be given in respect of any Member of Parliament or Member of Maharashtra State Legislature and those officers of the State Government, who are the Special Invitees.”.
12. For rule 11 of the principal rule, the following shall be substituted, namely:-— “11. Procedure for preparation of Draft Development Plan.- (1) The Member-Secretary shall place before the District Planning Committee the plans received from the constituent local bodies of the District Planning Committee for their consideration. After consideration, these plans shall be prepared by the Member-Secretary for the district as a whole and inform the District Planning Committee about recommendations made thereupon by the Executive Committee in respect of clauses
(a) and (c) of section 10 of the Act. The District Planning Committee shall, after due consideration of such plans prepared by the constituent local bodies and views and observations of the Executive Committee, approve consolidation of the plans and prepare the draft of District Annual Plan and then make recommendation for its submission by the Chairperson to the State Government as per clause
(d) of section 10 of the Act, for approval.
(2) While preparing such plans the District Planning Committee shall adhere to the guidelines issued by the State Government, from time to time, in the matters of extent and size of the financial allocation, intersectoral priorities, provisions for funds for the committed schemes, externally aided schemes and Special Programmes, for which the State Government has laid emphasis such as its Vision-2030 and commitment towards achievement of Sustainable Development Goals.(3) The final draft development plan shall be again placed before the District Planning Committee for its approval before forwarding it to the State Government.”.
