[3A. Constitution of Council.- (1) The Council shall consist of the following members, including the President and the Vice-President,-

(a) the Director of Ayurved, ex-officio;

(b) five members nominated by the State Government, out of whom two shall be practitioners in Ashtang Ayurvedic or Siddha system of Medicine and two shall be practitioners in Unani or Unani Tibb system of medicine;

(c) nine members elected by registered practitioners as follows, that is to say,-

(i) [eight members] elected by registered practitioners whose names are entered in Part I of the register, from amongst themselves;

[(ii) one member elected by the registered practitioners whose names are entered in Part II and Part III of the register, from amongst themselves;]

[(d) (i) two members elected by the Principals or Heads of Colleges or institutions affiliated to or, as the case may be, recognised by any statutory university in the State of Maharashtra and which are imparting education in Indian Medicine for appearing at the examinations held by any such university, from amongst themselves; and

(ii) two members elected by the Teachers (other than Principals or Heads) of such colleges or institutions, from amongst themselves,

who are registered practitioners possessing any of the qualification specified in the Schedule and for a period of not less than three years engaged in teaching any of the systems of Indian Medicine in any such colleges or institutions :

Provided that, the members to be elected under sub-clauses (i) and (ii) of this clause shall be persons other than those nominated or elected under the preceding clauses.]

(2) If at any election, the electors fail to elect the requisite number of members to the Council, the State Government shall nominate such registered practitioners as it deems fit to fill the vacancies which remain unfilled after the election, and the practitioners so nominated shall be deemed to have been duly elected under sub-section (1).

(3) The President and the Vice-President of the Council shall be elected by the members, from amongst themselves.]
