Section 86: Offences against Act to be cognizable only on complaint by Registrar, member or State Government

The Maharashtra Non-trading Corporations ActState Act of Maharashtra · Act 26 of 1959

No Court shall take cognizance of any offence against this Act, which is alleged to have been committed by any corporation or any officer thereof, except on the complaint in writing of the Registrar, or of a member of the corporation, or of a person authorised by the State Government in that behalf :

Provided that nothing in this section shall apply to a prosecution by a corporation of any of its officers.

Explanation.— A liquidator of a corporation shall not be deemed to be an officer of the corporation within the meaning of this section.
