Order MAHARASHTRA PUBLIC UNIVERSITIES ACT, 2016.
PARINI. 2018/C. R. No. 81/VISHI-2.—In exercise of the powers conferred by sub-section (11) of section 99 of the Maharashtra Public Universities Act, 2016 (Mah. Act No. VI of 2017), the Government of Maharashtra hereby, specifies the procedure for election, authority for conduct of election, mechanism for conduct of such elections, code of conduct for candidates and election administrators, and grievances redressal mechanism in respect of election to Students’ Council, namely :—
1. Short title and commencement.—(1) This Order may be called the Maharashtra Public Universities (Procedure for Election, Authority for Conduct of Election, Mechanism for Conduct of Such Elections, Code of Conduct for Candidates and Election Administrators, and Grievances Redressal Mechanism in Respect of Election to Students’ Council) Order, 2018.
(2) This order shall be come into force 29th October 2018.
2. Definitions.—(1) For the purposes of this order,—
(a) “Act” means Maharashtra Public Universities Act, 2016 (Mah. VI of 2017) ;
(b) “Class” means a group consisting of all students’ of each division of the full-time course of a particular year ;
(c) “College Students’ Council” means a College Students’ Council constituted in accordance with provisions of section 99(3) of the Act ;
(d) “continuing candidate” means any candidate not elected or not excluded from the poll at any given stage of counting of votes ;
(e) “count” means all the operations involved in the counting of the first preferences recorded for candidates; or all the operations involved in the transfer of the surplus of an elected candidate; or all the operations involved in the transfer of the votes of an excluded candidate or of two or more candidates excluded together ;
(f) “Election Officer” means, in relation to College Students’ Council the teacher nominated by the Principal of a college or Director of a recognized institution and in relation to University Department Students’ Council and University Students’ Council the teacher nominated by the Director of Students’ Development ;
(g) “Election Programme” means the date-wise schedule of election programme, including date of declaration of programme, date of filing of nomination, date of withdrawal of nomination, date displaying the list of contesting candidate, date of election, date of counting and declaration of result and such other details prepared and published by the Election Officer ;
(h) “first preference” means the digit “1” standing alone opposite the name of a candidate; “second preference” means the digit “2” standing alone opposite the name of the candidate in succession to the digit “1”; “third preference” means the digit “3” standing alone opposite the name of a candidate in succession to the digits “1” and “2” and so on, on the voting paper ;
(i) “Full-time course” means and includes an undergraduate degree or post-graduate degree course approved by the university but shall not include any other certificate/diploma course, add–on course, any academic programme in distance mode/external mode and any other autonomous course offered by college or institution or university department ;

(j) “next available preference” means a second or subsequent preference recorded in consecutive numerical order for a continuing candidate, the preferences, next in order on voting paper for candidates already elected or excluded from the poll being ignored ;
(k) “non-transferable paper” means a voting paper on which no second or subsequent preference is recorded for a continuing candidate or the names of two or more candidates (whether continuing or not) are marked with the same number and are next in order of preference; or the name of the candidate next in order of preference (whether continuing or not) is marked by a number not following consecutively after some other number on the voting paper; or by two or more numbers or for any other reason it cannot be determined for which of the continuing candidates the next available preference of the elector is recorded ;
(l) “original vote” in regard to any candidate means a vote derived from a voting paper on which a first preference is recorded for that candidate ;
(m) “quota” means the number of votes sufficient to secure the election of a candidate, determined at each election by dividing the total number of valid votes cast at an election by the number of vacancies to be filled plus one at that election and by adding one to the result so arrived at, any fractional remainder in doing so shall be disregarded ;
e.g.,— Total number of valid votes Quota = ———————————————— + 1 number of vacancies+1 Example : Number of vacancies = 5 Valid votes = 100 100 Quota = ———— +1 5+1 = 16.67 + 1 = 17.67 = 17 (17.67 shall not be rounded off to 18, because already ‘1’ is added to the 16.67) ;
(n) “surplus” means the number of votes by which the total number of original and transferred votes, credited to any candidate, exceeds the quota;
(o) “transferable paper” means a voting paper on which, following the first preference, a second or subsequent preference is recorded in consecutive numerical order in favour of a continuing candidate;
(p) “transferred vote” in regard to any candidate means a vote derived from a voting paper on which a second or subsequent preference is recorded for that candidate;
(q) “University Students’ Association” means an University Students’ Association constituted as provided in section 99(4)(a) of the Act;
(r) “University Students’ Council” means a University Students’ Council constituted as provided in section 99(4)(b) of the Act ;
(s) “University Department Students’ Council” means a University Department Students’ Council constituted as provided in section 99 (2) of the Act.
(2) Words and expressions used but not defined in this order shall have the same meanings respectively assigned to them in the Act.
3. Authority for Election of Students’ Councils.–(1) The principal of the college or Director of the recognized institution shall be the Authority for election of College Students’ Council.
(2) The Director of Students’ Development shall be the Authority for election of University Department Students’ Council and University Students’ Council.

4. Powers of the Election Officer to decide about Validity of Votes and Result of Elections.—(1) The Election Officer shall have the power to decide, in case of doubt, the validity or invalidity of a vote recorded;
(2) The Election Officer shall have the power to declare the result of each election.
5. Election Programme.—(1) The Director, Students’ Development shall,—
(i) prepare the Election Programme in consultation with the Vice-Chancellor. Election Programme shall include detailed time-table of all activities related to elections, notifications, publications and submissions and it shall be declared on or before 31st July of the respective academic year;
(ii) ensure that University Students’ Council is constituted on or before 30th September of the academic year;
(iii) in consultation with the Vice-Chancellor, undertake the process of deciding the category of reservation for each college by drawing lots as required under section 99(3)(d) of the Act and the outcome of this process shall be declared in the form of list of category of reservation for each college along with Election Programme.
(2) There shall be one common schedule for conducting elections to University Department Students’ Council and College Students’ Council to ensure that the election at all colleges or institutions or University Departments are held on the same working day.
(3) There shall be a gap of minimum ten clear day’s between the date of official publication of duly constituted University Students’ Association (i.e.Electoral College for University Students’ Council) and election of University Students’ Council.
6. Eligibility to Contest the Election.—(1) A candidate shall be a full-time regular student, who is registered and admitted in the academic year for a full-time approved course of the university which is offered by the college or institution or university department.
(2) The candidate shall have cleared all heads of passing of previous years without any backlog and/or benefit of Allow to Keep Term (ATKT).
(3) The student shall not be a re-admitted student in the same class.
(4) The upper age-limit for a candidate to contest the election shall be twenty-five completed years as on 30thSeptember of that academic year.
(5) A candidate, who wants to contest the election for the representative of reserved category, shall have Caste Certificate issued by the competent authority at the time of filing of nomination for election.
7. Disqualification to Contest the Election.—A student shall not be entitled to be a member of Students’ Council, if he,—
(1) has completed seven academic years from the first entry to higher education; or
(2) has been punished by the competent authority for indulging in unfair means in any university examination or for committing any misconduct; or
(3) has been convicted for any offence involving moral turpitude.
8. Procedure of Election.—(1) In case of a College or Institution, a teacher shall be nominated as an Election Officer by the Principal or Director of that College or Institution respectively. In case of the University, a teacher shall be nominated as an Election Officer by the Director of Students Development in consultation with the Pro-Vice-Chancellor.The Election Officer shall prepare and publish the provisional and final list of electoral college for each class to elect Class Representatives and students electoral college consisting of all students, who are engaged in full time studies in that college for electing President, Secretary, Lady Representative, Representative of Reserved Category for respective Students’ Council. A copy of such electoral-roll shall be made available on the website of the University, College or Institution as the case may be. A hard copy of such electoral-roll shall be also made available to the candidates at the reasonable price.
(2) The voting shall be by ballot. The ballot paper shall mention the names of the candidates in the alphabetical order beginning with surnames.
(3) There shall be separate ballot boxes for Class Representatives and President, Secretary, Lady Representatives and Representatives of Reserved Category to be elected to University Department Students’ Council or College Students’ Council, as the case may be.

(4) A student shall have the right to vote separately for concerned Class Representative and President, Secretary, Lady Representative and Representative of Reserved Category to be elected to University Department Students’ Council or College Students’ Council, i.e. a student shall have the right to cast total maximum five votes.
(5) The election for University Department Students’ Council and College Students’ Council shall be held in accordance with the principle of simple majority votes.
(6) The election for University Students’ Council shall be held in accordance with the system of proportional representation by means of single transferable vote. Each elector shall have one transferable vote.
(I) An elector in recording his vote,—
(a) shall place on his voting paper the digit 1 opposite the name of the candidate for whom he votes in the column of ‘order of preference’;
(b) may in addition indicate the order of his choice or preference for as many other candidates as he pleases by placing against their respective names the digits 2, 3, 4 and so on, in consecutive numerical order;
(c) shall place all preferences on his voting paper either in English or in Marathi;
(d) shall not indicate the preference in words or in roman numbers.
(II) A voting paper is invalid if,—
(a) the digit 1 standing alone, indicating a first preference, is not placed; or
(b) the digit 1 standing alone, indicating a first preference, is placed opposite the names of more than one candidate; or
(c) the digit 1 standing alone, indicating a first preference and some other digits are placed opposite the name of the same candidate; or
(d) the first preference and/or subsequent preferences are indicated in words or roman numbers or in digits of any other language except English or Marathi; or
(e) it cannot be determined for which candidate the first preference of the voter is recorded;
or
(f) in an election by ballot any mark is placed by the voter by which he may afterwards be identified; or
(g) preference is indicated in any ink other than blue ink;
(h) there is any scratching, overwriting or alteration in the digits indicating the voter’s preference.
(III) A valid ballot paper with next preference given to more than one candidate shall become invalid for such immediately subsequent preference.
(7) The Director of Students’ Development shall prepare and publish the list of members of the University Students’ Association which shall be the electoral college for electing the President, Secretary, Lady Representative and Representative of Reserved Category of the University Students’ Council.
(8) A student willing to contest election shall submit the nomination in the Form ‘A’ appended with this Order along with non-refundable fees of Rs. 50 per nomination form.
(9) A candidate cannot contest election for more than one position at a time.
(10) Any member of the University Students’ Association can contest the election for the post of President, Secretary of the University Students’ Council.
(11) Any female representative of University Students’ Association can contest the election for Lady Representative of University Students’ Council.
(12) As per section 99 (4) (b) (iv) of the Act, rotation for representative belonging to Scheduled Caste or Scheduled Tribes or De-notified Tribes (VimuktaJatis) or Nomadic Tribes or Other Backward Classes or Special Backward Category for University Students’ Council shall be decided and declared well in advance by the university. Any candidate of such category, who is member of the University Students’ Association can contest the election for the University Students’ Council as the representative of the respective Reserved Category.

(13) Each affiliated college or recognized institution shall be the polling centre for election of the University Students’ Council, where the members of the University Students’ Association who are students of such affiliated college or recognized institution, as the case may be, shall vote. The Election Officer shall appoint the polling officers for each polling centre for election of the University Students’ Council. Such polling officer shall be from the district other than the district in which such polling centre is situated. The college or institution where such polling centre is established shall provide necessary facilities and support.
(14) The time span for actual voting shall be four continuous clock hours to be declared by Election Officer.
(15) The Election Officer shall declare the list of voters at each polling centre who shall have to exercise their voting right only at such polling centre.
(16) The sealed ballot boxes along with relevant record shall be immediately moved to the university after the process of voting is over.
(17) The counting of votes and declaration of results shall be completed on the same day of voting in case of University Departments Students’ Council and College Students’ Council.
(18) Each voter must carry valid identity card of the College or Institution or University Department, as the case may be, at the time of voting. The special Identity Card shall be issued by the Election Officer of College or Institution or University Department to the elected President, Secretary, Lady Representative and Representative of Reserved Category in the format prescribed by the University. No voter shall be allowed to vote without a valid identity card.
(19) Scrutiny of voting papers.–(i)All voting papers shall be scrutinized by the Election Officer or by such other person or persons as may be authorized by the Election Officer. The Election Officer may delegate his power in relation to scrutiny and counting of voting papers to any other person or persons under his control.
(ii) The candidate or his agent, who shall be a voter of a particular constituency, duly authorized by him in writing on his behalf shall be entitled to be present at such scrutiny.
(iii) When there are more polling centres than one, voting papers of all the polling centres shall be first mixed up and then scrutinized by the Election Officer or such other person or persons as may be authorized by the Election Officer.
(20) Counting of Votes.—(i) The counting of votes of election of University Students’ Council shall start on the third day of voting and after the continuous process of counting, the result shall be declared.
(ii) After the voting papers for an electoral body have been scrutinized and counted, the Election Officer or the person or persons authorized by him, shall examine the voting papers and shall sort them into parcels according to the first preference recorded for each candidate, rejecting voting papers that are invalid.
(iii) The Election Officer or the person or persons authorized by him, shall then count the number of voting papers in each parcel and shall credit each candidate with a number of votes equal to the number of valid papers on which a first preference has been recorded for such candidate. The Election Officer shall then compile the data regarding the total number of valid voting papers and determine the quota.
(iv) The candidate or his agent who shall be a voter of the particular elector college, duly authorized by him in writing on his behalf shall only be permitted to be present during counting of votes. No person other than the candidate or his authorized agent and the person involved in election process shall be allowed within a radius of reasonable distance from the place of counting.
(v) If at the end of any count, the number of votes credited to a candidate is equal to or greater than the quota, the candidate shall thereupon be declared as elected.
(vi) If at the end of any count, the number of votes credited to a candidate is greater than the quota, the surplus shall be transferred, as provided in this Order, to the continuing candidates for whom the next available preferences have been recorded on the voting papers in the parcel or sub-parcel last received by the elected candidate.

(vii) If more than one candidate has surplus, the largest surplus shall be first dealt with. If two or more candidates have equal surplus, the surplus of the candidate with the greatest number of votes at the first count at which the candidates in question have an unequal number of votes shall be first dealt with. When the number of votes credited to such candidates is equal at all counts, the Election Officer shall determine by lot which surplus he will first deal with.
(viii) The Election Officer or the person or persons authorized by him, shall not transfer a surplus when that surplus, together with any other surplus not transferred, is less than the difference,–
(a) between the votes of the candidates lowest on the poll and the votes of the next highest candidate; or
(b) between the total of the votes of the two or more candidates lowest on the poll and the votes of the next highest candidate :
Provided that, the exclusion from the poll of the aforesaid two or more candidates lowest on the poll shall not reduce the number of continuing candidates below the number of vacancies remaining to be filled.
(ix) (a) If the votes credited to an elected candidate consist of original votes only, the Election Officer or the person or persons authorized by him, shall examine all the papers contained in the parcel of the elected candidate whose surplus is to be transferred.
(b) If the votes credited to an elected candidate consist of original and transferred votes, or transferred votes only, the Election Officer or the person or persons authorized by him, shall examine the papers contained in the sub-parcel last received by the elected candidate whose surplus is to be transferred.
(c) In either case, the Election Officer or the person or persons authorized by him, shall sort the transferable papers into sub-parcels according to the next available preference recorded thereon, shall make a separate sub-parcel of the non-transferable papers and shall ascertain the number of papers in each sub-parcel of transferable papers.
(x) If the total number of papers in the sub-parcels of transferable papers is equal to or less than the surplus, the Election Officer or the person or persons authorized by him, shall transfer the whole of each sub-parcel of transferable papers to the continuing candidates as per the next available preferences indicated thereon and shall set aside as a separate parcel so many of the non-transferable papers as are not required for the quota of the elected candidate. The particular papers set aside shall be those last filed in the parcel of non-transferable papers.
(xi) If the total number of transferable papers is greater than the surplus, the Election Officer or the person or persons authorized by him, shall transfer from each sub-parcel of transferable papers to the continuing candidate indicated thereon as the elector’s next available preference, the number of papers which bears the same proportion to the number of papers in the sub-parcels as the surplus bears to the total number of transferable papers.
(xii) The number of papers to be transferred from each sub-parcel shall be ascertained by multiplying the number of papers in the sub-parcel by the surplus and dividing the result by the total number of valid transferable papers.

If owing to the existence of such fractional parts, the number of papers to be transferred is less than the surplus, so many of these fractional parts taken in the order of their magnitude, beginning with the largest, as are necessary to make the total number of papers to be transferred equal to the surplus shall be reckoned as of the value 21¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, +ÉìC]õÉäõ¤É®ú 26, 2018/EòÉÌiÉEò 4, ¶ÉEäò 1940 of unity and remaining fractional parts shall be ignored. If two or more fractional parts are of equal magnitude, that fractional part shall be deemed to be the largest which arises from the largest sub-parcel, and if the sub-parcels in question are equal in size, the fractional part credited to the candidate with the greatest number of votes at the first count at which the candidates in question have an equal number of votes shall be deemed to be the largest. When the number of votes credited to such candidates are equal at all counts, the Election Officer shall determine by lot which fractional part shall be deemed to be the largest.
(xiii) The particular papers transferred from each sub-parcel shall be those last filed in the sub-parcel and each paper so transferred shall be marked in such a manner as to indicate the count at which the transfer took place.
(xiv) If at the end of any count, no candidate has a surplus or if any existing surplus need not be and is not transferred and one or more vacancies remain to be filled, the Election Officer shall exclude from the poll the candidate lowest on the poll.
(xv) If the total of the votes of the two or more candidates lowest on the poll, together with any surplus not transferred, is less than the number of votes credited to the next highest candidates the Election Officer may at the same count exclude the aforesaid two or more candidates lowest on the poll :
Provided that, the exclusion of these candidates shall not reduce the number of continuing candidates, below the number of vacancies remaining to be filled.
(xvi) When two or more candidates each have the same number of votes and lowest on the poll, the candidates with the lowest number of votes at the first count at which the candidates in question have an unequal number of votes shall be excluded and when the number of votes credited to these candidates are equal at all counts, the Election Officer shall draw lots and the candidate in whose name lot is drawn would stand excluded.
(xvii) Upon the exclusion of any candidates, the Election Officer, save as hereinafter provided, shall examine all the papers credited to that candidate, shall,—
(a) sort the transferable papers into sub-parcels according to the next available preference recorded thereon for continuing candidates ;
(b) transfer each sub-parcel to the candidate for whom that preference is recorded; and
(c) set aside as a separate sub-parcel the non-transferable papers.
(21) If at the end of any count, the number of elected candidates is equal to the number of vacancies to be filled, no further transfer of votes shall be made.
(22) If on the exclusion of a candidate or candidates, the number of the then continuing candidates is equal to the number of vacancies unfilled, the continuing candidates shall thereon be elected and no further transfer of votes shall be made.
(23) The order of priority of election of elected candidates shall be the order in which they are severally elected. If, at the end of any count two or more candidates are elected, the order of priority shall be according to the number of votes credited to such candidates beginning with the greatest. When the number of votes credited to two or more candidates are equal or when the candidates are elected unopposed, the order of priority of election shall be in alphabetical order.
(24) Whenever any transfer is made, each sub-parcel of paper transferred shall be placed on the top of the parcel, if any, of papers of the candidate, to whom the transfer is made and that candidate shall be credited with a number of votes equal to the number of papers transferred to him.
(25) Non-transferable papers, except such as in the transfer of a surplus may be required for the quota of the elected candidates, shall be set aside as a separate parcel together with any parcel of non-transferable papers already set aside.
(26) On the transfer of the surplus of an elected candidate, all papers not transferred to continuing candidates and not set aside as provided in the preceding clause, shall be placed together in one parcel as the quota of the elected candidate and the parcel shall be marked with the name of the elected candidate.

(27) Result of Election,-(i) After the scrutiny and counting is completed, the result thereof shall be reported forthwith to the Principal and Vice-Chancellor, respectively, by the Election Officer.
(ii) On the result of the election being reported as aforesaid, the result of the counting showing for each candidate, the number of first votes obtained and the successive additions, or subtractions from the number till the candidate was excluded or elected, shall be declared by the Election Officer. Immediately after the final result is prepared, the voting papers shall be sealed in a packet with the seal of one or more of the scrutinizers and then handed over to the Principal, in case of College Students’ Council and to the Registrar in case of University Students’ Council, University Department Students’ for safe custody until the destruction of the voting papers.
9. Code of Conduct.—(1) No panels of the candidates shall be formed for the purpose of election at any stage, whatsoever.
(2) The maximum permissible expenditure per candidate for the election of Class Representative shall be Rs.1000 and for the elections of President, Secretary, Lady Representative and Representative of Reserved Category shall be Rs.5000.
(3) Each candidate shall have to submit within two weeks of the declaration of the results, the selfattested statement of expenditure in Form ‘B’ appended with this order along with the serially numbered self-attested copies of vouchers to the Election Officer.
(4) No candidate shall make use of any symbol or logo or photo or image of any political party, other organization and any other person, including any religious or caste or social organizations or persons during the election campaign.
(5) No candidate shall be allowed to carry out procession or rally in the college or institution or University campus during the election campaign.
(6) Entry to the College or institution or University campus without a valid identity card of that college or institution or University shall be strictly prohibited on the day of polling.
(7) The use of public address system and vehicles and any other conveyance for the purpose of election campaign shall be prohibited on the campus of the college or institution or university.
(8) The Election Officer shall notify the designated display places in the campus which can be used by the candidates for hoarding their posters. The allocation of space at such designated display places to the candidates shall be decided by the Election Officer. The size and form of poster shall be decided by the Election Officer.
(9) No candidate shall indulge in, nor shall abate any activity, which may aggravate differences or create mutual hatred, rivalry and tension among groups of students.
(10) No candidate and his supporters shall deface or cause any destruction to the property of college or institution or university in the manner whatsoever it may be.
(11) The entry to any unauthorized person on the campus of the college or institution or university and at the polling centre shall be strictly prohibited during the entire process of election.
(12) Each candidate shall undertake to proactively support and assist the Authorities in maintaining peace and harmony on the campus of the college or institution or university during the process of election.
(13) In case of contravention of any of the provisions of code of conduct by any candidate, the Election Officer may initiate appropriate disciplinary action in addition to the revocation of his candidature. The aggrieved person shall be given due opportunity of being heard before taking the final decision in this process.
(14) The provisions of Indian Penal Code relating to “Offences relating to elections” shall be applicable to these students’ elections. Objectionable incidences may be reported to the police within twelve hours after alleged commission of offence for registering the case.
(15) It shall be the duty of all teaching and non-teaching staff of the college or institution or university to undertake any work, responsibility assigned by the Election Officer in the process of elections.

10. Grievance Redressal Mechanism.—(1) An aggrieved student or candidate may prefer an application for grievance redressal to the Grievance Redressal Authority against the decision of Election Officer during the process of election.
(2) Such application can be preferred within a period of forty-eight hours from the occurrence of the alleged grievance.
(3) The Grievance Redressal Authority shall be as under :—
(a) Principal of College or Director of Institution in case of disputes or grievances related to election of Class Representatives, President, Secretary, Lady Representative and Representative of Reserved Category in the College or Institution.
(b) The Pro-Vice-Chancellor of the university in case of disputes or grievances related to election of Class Representatives, President, Secretary, Lady Representative, Representative of Reserved Category in the University Department Students’ Council and the University Students’ Council.
(4) The decision of the Grievance Redressal Authority shall be final and binding on the parties concerned.
