NOTIFICATION Maharashtra Public Universities Act, 2016.
No. MISC 2023/C.R. 98/UE-3.—In exercise of the powers conferred by sub-section (10) of section 72 read with sub-sections (2) and (3) of section 123 of the Maharashtra Public Universities Act, 2016 (Mah. Act No. VI of 2017), the Government of Maharashtra hereby prescribes the Uniform Statute relating to norms and procedure for grant and continuation of status of empowered autonomous colleges, constitution of authorities and bodies and powers and functions of the empowered autonomous Colleges, namely:– UNIFORM STATUTE No. 1 OF 2023
1. Short title, application and commencement.—
(1) This Statute may be called the Maharashtra Public Universities (Norms and Procedure for Grant and Continuation of Status of Empowered Autonomous Colleges, Constitution of Authorities and Bodies, and Powers and Functions of the Empowered Autonomous Colleges) Uniform Statute, 2023.
(2) This Statute shall apply to all affiliated autonomous colleges of the Universities in the State of Maharashtra under the Maharashtra Public Universities Act, 2016 (Mah. Act No. VI of 2017) seeking the conferment of empowered autonomous status.
(3) This Statute shall come into force from the date of publication of this notification in the Maharashtra Government Gazette.

2. Eligibility.— The management of an affiliated autonomous college shall be eligible to apply to the University for grant of status of empowered autonomous college, if the affiliated autonomous college—
(1) has a valid accreditation issued by the National Assessment and Accreditation Council (NAAC) with a Cumulative Grade Point Average (CGPA) of 3.01 or above, or if at least sixty per cent. of the programs offered by the college have been accredited by the National Board of Accreditation (NBA) or corresponding accreditation Grade from any accreditation agency empanelled by the University Grants Commission; and
(2) has at least five years standing as an affiliated autonomous college.
3. Procedure for Grant of Status of Empowered Autonomous College.—
(1) The affiliated autonomous college desirous of having status of empowered autonomous college shall apply to the Pro-Vice-Chancellor of the University in the form prescribed in the Annexure appended hereto, accompanied by the fees of Rupees Twenty-Five Thousand, which shall be increased by fifty per cent after every ten years.
(2) The affiliated autonomous college shall apply before the 31st May of the year from which it desires to have empowered autonomous status.
(3) (a) The Vice-Chancellor shall constitute an Expert Committee to examine the applications received during an academic year, consisting of the following members, namely:-
(i) Pro-Vice-Chancellor of the University - Chairperson;
(ii) three experts out of the panel of experts nominated by the Academic Council of the University who shall be eminent educationist or scientist or industrialist;
(iii) one Principal or former Principal of the affiliated autonomous college or Director or former Director of the autonomous recognized institution;
(iv) Deputy Registrar of the Academic Section of the University shall act as the Secretary of the Expert Committee.
(b) Nominated members of the Expert Committee shall not be the members of the Board of Deans.
(c) The Expert Committee shall scrutinize all such applications and shall submit a report thereof to the Vice-Chancellor, with such recommendations, duly supported by relevant reasons as are deemed appropriate, within fifteen days from the date of receipt of an application.
(4) The report of the Expert Committee shall be placed by the Registrar before the Academic Council for its consideration.
(5) The Academic Council shall consider such application for grant of empowered autonomous status upon such college along with the report of the Expert Committee and make its recommendations to the Management Council.
(6) The Management Council may after considering the recommendations of the Academic Council may confer the autonomous status upon such college or may reject the application after recording the reasons therefor.
(7) The Pro-Vice-Chancellor of the University shall notify and communicate the decision of the Management Council of the University regarding grant of status of empowered autonomous college to the applicant affiliated autonomous college concerned. If the Management Council decides to reject the application, the Pro-Vice-Chancellor shall inform the applicant about the rejection of such application along with the reasons therefor.
(8) Once the application is rejected, the University shall not entertain fresh application of the said affiliated autonomous college, before the expiry of one year from the date of rejection of such application.

(9) The entire process for grant of status of empowered autonomous college shall be completed and the affiliated autonomous college concerned shall be informed accordingly, on or before 30th June of the year in which such application is made.
(10) If the University fails to communicate its decision about grant of empowered autonomous college to the affiliated autonomous college concerned, within the time line mentioned in sub-clause (9) then the affiliated autonomous college concerned shall be deemed to have been conferred the status of empowered autonomous college by the University.
4. Period of Grant of Status of Empowered Autonomous College.— The status of empowered autonomous college shall be granted to the affiliated autonomous college initially for a period of ten years at a time. The same may be continued for a further period of ten years, subject to the procedure prescribed and timelines indicated in clause 3.
5. Constitution of Authorities and Bodies of the Empowered Autonomous College.- The authorities or bodies of the empowered autonomous college shall be as prescribed by the University Grants Commission, from time to time, for colleges having autonomous status.
6. Powers and Functions of Empowered Autonomous College.—
(1) The empowered autonomous college shall exercise the powers and perform the functions and carry out the administrative, academic, financial and other activities, as prescribed by the University Grants Commission for colleges having autonomous status, from time to time.
(2) The empowered autonomous college is empowered to grant a joint degree with the affiliating University. The degree certificate shall bear names and logos of the affiliating University and the empowered autonomous college.
(3) The empowered autonomous college shall enjoy all such privileges in addition to the privileges enjoyed by autonomous college as prescribed by the State Government and the University Grants Commission.
7. General Provisions.—
(1) The students may take up the study programme partly in one empowered autonomous college and partly in the other empowered autonomous college or empowered autonomous cluster institutions.
(2) The empowered autonomous college shall continue to be affiliated to the University concerned.
(3) All eligible students of the empowered autonomous cluster institutions shall be awarded a joint degree certificate bearing names and logos of the affiliating University and empowered autonomous cluster institutions, irrespective of dates of their admission to the course concerned.
(4) All provisions applicable to the autonomous affiliated colleges prescribed as per the University Grants Commission (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards in Autonomous College) Regulations, 2023, as amended from time to time, shall be applicable to the empowered autonomous colleges.
(5) The State Government shall continue to release the same grants or funds to the Government aided empowered autonomous colleges as it had been releasing to them before the conferment of empowered autonomous status.
