NOTIFICATION Maharashtra Public Universities Act, 2016.
No. MISC 2023/CR. 98/UE-3.– In exercise of the powers conferred by sub-section (10) of section 72 read with sub-sections (2) and (3) of section 124 of the Maharashtra Public Universities Act, 2016 (Mah. Act No. VI of 2017), the Government of Maharashtra hereby prescribes the uniform Statute relating to norms and procedure for grant and continuation of status of empowered autonomous cluster institutions, constitution of authorities and bodies and powers and functions of the empowered autonomous cluster institutions, namely:– UNIFORM STATUTE No. 2 OF 2023
1. Short title, application and commencement.–
(1) This Statute may be called the Maharashtra Public Universities (Norms and Procedure for Grant and Continuation of Status of Empowered Autonomous Cluster Institutions, Constitution of Authorities and Bodies, and Powers and Functions of the Empowered Autonomous Cluster Institutions) Uniform Statute, 2023.
(2) This Statute shall apply to all affiliated autonomous colleges of the Universities in the State of Maharashtra under the Maharashtra Public Universities Act, 2016 (Mah. Act No. VI of 2017) seeking the conferment of status of empowered autonomous cluster institution.
(3) This Statute shall come into force from the date of publication of this notification in the Maharashtra Government Gazette.

2. Eligibility.– The management of a group of affiliated autonomous colleges or autonomous recognized institutions shall be eligible to apply to the University for grant of status of empowered autonomous cluster institutions, to such group of affiliated autonomous colleges or recognized autonomous institutions, if all such affiliated autonomous colleges or recognized autonomous institutions –
(1) have a valid accreditation issued by the National Assessment and Accreditation Council (NAAC) with a Cumulative Grade Point Average (CGPA) of 3.01 or above, or if at least sixty per cent. of the programs offered by the college or institution have been accredited by the National Board of Accreditation (NBA) or corresponding accreditation Grade from any accreditation agency empanelled by the University Grants Commission; and
(2) have at least five years standing as an autonomous affiliated college or autonomous recognized institution.
3. Procedure for Grant of Status of Empowered Autonomous Cluster Institutions.–
(1) A group of affiliated autonomous colleges or autonomous recognized institutions desirous of having status of empowered autonomous cluster institutions shall apply to the Pro-Vice-Chancellor of the University in the Form prescribed in the Annexure appended hereto, accompanied by the fees of Rupees Twenty Five Thousand, which shall be increased by fifty per cent. after every ten years.
(2) The procedure prescribed in the Maharashtra Public Universities (Norms and Procedure for Grant and Continuation of Status of Empowered Autonomous Colleges, Constitution of Authorities and Bodies, and Powers and Functions of the Empowered Autonomous Colleges) Uniform Statutes, 2023, shall apply, mutatis-mutandis, for the grant of status of empowered autonomous cluster institutions to the group of autonomous affiliated colleges or autonomous recognized institutions.
4. Period of Grant of Status of Empowered Autonomous Cluster Institutions.– The status of empowered autonomous cluster institutions shall be granted to the group of affiliated autonomous colleges or recognized autonomous institutions, initially for a period of ten years at a time. The same may be continued for a further period of ten years, subject to the procedure prescribed in clause 3.
5. Continuation of Status of Empowered Autonomous Cluster Institutions.– The procedure prescribed in the Maharashtra Public Universities (Norms and Procedure for Grant and Continuation of Status of Empowered Autonomous Colleges, Constitution of Authorities and Bodies, and Powers and Functions of the Empowered Autonomous Colleges) Uniform Statutes, 2023, shall apply, mutatis-mutandis, for continuation of status of empowered autonomous cluster institutions granted to the group of affiliated autonomous colleges or recognized institutions of the same management.
6. Constitution of Authorities and Bodies of the Empowered Autonomous Cluster Institutions.– The authorities or bodies of the empowered autonomous cluster institutions shall be, महाराष्टट्र शासन राजपत्र असाधारण भाग चार-ब, मे २२, २०२३/ज््ययेष््ठ १, शके १९४५ 3 as prescribed by the University Grants Commission, from time to time, for colleges having autonomous status.
7. Powers and Functions of Empowered Autonomous Cluster Institutions.–
(1) The empowered autonomous cluster institutions shall exercise the powers and perform the functions and carry out the administrative, academic, financial and other activities as prescribed by the University Grants Commission for colleges having autonomous status.
(2) The empowered autonomous cluster institutions are empowered to grant a joint degree with the affiliating University. The degree certificate shall bear names and logos of the affiliating University and empowered autonomous cluster institutions.
(3) The empowered autonomous cluster institutions shall enjoy all such privileges as prescribed by the State Government and the University Grants Commission, in addition to the privileges enjoyed by an autonomous affiliated college or an autonomous recognized institution.
8. General Provisions–
(1) The students may take up the study programme partly in some empowered autonomous cluster institutions and partly in the some other empowered autonomous cluster institutions or empowered autonomous college.
(2) The empowered autonomous cluster institutions shall continue to be affiliated to or recognized by the University concerned.
(3) All eligible students of the empowered autonomous cluster institutions shall be awarded a joint degree certificate bearing names and logos of the affiliating University and empowered autonomous cluster institutions, irrespective of dates of their admission to the course concerned.
(4) The individual autonomous affiliated college or recognized institution shall retain its original identity after grant of status of empowered autonomous cluster institutions.
(5) All facilities under individual affiliated autonomous college or recognized autonomous institution, such as housekeeping, security services, library, sports, laboratories, parking, ground and classes, shall come under the umbrella of the empowered autonomous cluster institutions.
Facilities in individual affiliated autonomous colleges or recognized autonomous institutions shall be put to optimum utilization for the overall benefit of students in the empowered autonomous cluster institutions so that the expenditure on separate resources is curtailed and a common pool can benefit all the students.
(6) All provisions applicable to the affiliated autonomous colleges prescribed as per the University Grants Commission (Conferment of Autonomous Status upon Colleges and Measures for Maintenance of Standards in Autonomous College) Regulations, 2023, as amended from time to time, shall be applicable to the empowered autonomous cluster institutions.
(7) The State Government shall continue to release the same grants or funds to the government aided autonomous affiliated colleges or recognized institutions as it had been releasing to them before the conferment of status of empowered autonomous cluster institutions.
