क्रमांक एसटीए-२०१८/प्र.क्र.९१/विशि-२.—महाराष्टट्र सार््वजनिक विद्यापीठ अधिनियम, २०१६ (२०१७ चा महा. ६) याच््यया कलम ७१ च््यया पोट-कलम (१६) तसेच कलम ७२ च््यया पोट-कलम (२) च््यया खंड अधिनियम, (१०) द्वारे प्रदान केलेल््यया अधिकारांचा वापर करून, महाराष्टट्र शासन, याद्वारे, महाविद्यालयाच््यया किंवा परिसंस््थथेच््यया व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी परवानगी देण््ययाच््यया कार््यपद्धतीशी संबंधित असणारे पुढील परिनियम विहित करीत आहे :— सन २०२२ चे एकरूप परिनियम क्रमांक - १ १. सकं्षिप््त नाव.—या परिनियमासं, महाराष्टट्र सार््वजनिक विद्यापीठ (महाविद्यालयाच््यया किवा परिसस््थथेच््यया व््यवस््थथापनाच ेहस््तताांतरण करण््ययासाठी परवानगी देण््ययाची कार््यपद्धती) एकरूप परिनियम, २०२२ असे म््हणावे.
२. व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी परवानगी देताना अनुसरावयाची कार््यपद्धती— (१) कोणत््ययाही सलंग््न महाविद्यालयाच ेकिवा परिससं््थथेच ेविद्यमान व््यवस््थथापन, कोणत््ययाही सलंग््न महाविद्यालयाच््यया किवा यथास््थथिति, मान््यताप्राप््त परिसंस््थथेच््यया व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी परवानगी देण््ययाकरिता ज््यया वर््षषात व््यवस््थथापनाचे हस््तताांतरण करण््ययाची मागणी केली आहे त््यया वर््षषाच््यया पूर््ववर्ती वर््षषाच््यया सप््टेेंबरच््यया शेवटच््यया दिवसापूर्वी विद्यापीठाकडे प्रस््तताव सादर करील.
(२) विद्यमान व््यवस््थथापन, यासोबत जोडलेल््यया नमुन््ययात व््यवस््थथापनाचे हस््तताांतरण करण््ययाचा प्रस््तताव विद्यापीठाकडे सादर करील आणि त््ययासोबत पुढील गोष््टटी सादर करीलः— (एक) खंड (५) च््यया उप-खंड (एक) ते (पाच) मध््यये नमूद केलेली सविस््तर माहिती व दस््तऐवज.
2 महाराष्टट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेेंबर १५, २०२२/अग्रहायण २४, शके १९४४ (दोन) रुपये २५०००/- इतके शुल््क हे परिनियम ज््यया वर््षषात शासकीय राजपत्रात प्रसिद्ध केले आहेत त््यया वर््षषानंतर दरवर्षी दहा टक््कक्ययाांनी वाढवण््ययात येईल.
(तीन) विद्यमान व््यवस््थथापनान,े पढुील बाबीसंबधंी नवीन व््यवस््थथापनाला सर््व माहिती पूरवील अशा आशयाच ेहमीपत्रः— (क) विविध पाठ्यक्रमांना प्रवेश दिलेले विद्यार्थी, निकाल घोषित करणे, शुल््क, इत््ययादी;
(ख) अध््ययापक व अध््ययापकेतर कर््मचाऱ््ययाांच््यया सेवेच््यया अटी व शर्ती आणि इतर सेवा लाभ या विषयीच््यया माहितीसह त््ययाांचा तपशील;
(ग) पायाभूत सुविधा, ग्रंथ, साधनसामग्री, जंगम व स््थथावर मालमत्ता, बँक खाते, लेखापरीक्षा अहवाल, इत््ययादीींचा तपशील;
(घ) विद्यापीठाकडून विहित करण््ययात येतील असे इतर दस््तऐवज.
(३) व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी परस््पर प्रस््तताव प्राप््त झाल््ययावर, विद्यापीठ, संबंधित हितसंबंधित व््यक््तीींकडून हरकती व सूचना मागवणारी जाहिरात दोन स््थथानिक मराठी वृत्तपत््राांमध््यये आणि एका राज््यस््तरीय मराठी वृत्तपत््राांमध््यये प्रसिद्ध करील.
(४) विद्यमान व््यवस््थथापनाकडून आणि नवीन व््यवस््थथापनाकडून अशा प्रकारे प्राप््त झालेल््यया आणि त््ययाांच््यया सर््व सदस््ययाांनी यथोचितरीत््यया स््ववाक्षरी केलेल््यया प्रस््ततावांची अधिष््ठठाता मंडळाकडून छाननी करण््ययात येईल आणि व््यवस््थथापन परिषदेस तिच््यया विचारार््थ व मान््यतेसाठी पाठवण््ययात येईल.
(५) विद्यापीठाची व््यवस््थथापन परिषद, त््ययावर विचार करील आणि राज््य शासनाकडे शिफारस करील. जे प्रस््तताव पुढील शर्तीची पूर््तता करतात अशा नवीन व््यवस््थथापनाच््यया प्रस््ततावांचीच शिफारस करण््ययात येईल:— (एक) विद्यमान व््यवस््थथापनाचे संलग््न महाविद्यालय, किंवा यथास््थथिति, मान््यताप्राप््त परिसंस््थथा ताब््ययात घेण््ययासाठी आवश््यक असलेल््यया शासनाकडून आणि विद्यापीठाकडून वेळोवेळी विहित करण््ययात येतील अशा पायाभूत सुविधा नवीन व््यवस््थथापनाकडे आहे.
(दोन) एकतर विद्यमान व््यवस््थथापनाचा किंवा नवीन व््यवस््थथापनाचा कोणताही विवाद न््ययायालयाकडे किंवा धर््ममादाय आयुक््तताच््यया न््ययायालयाकडे प्रलंबित नाही.
(तीन) उप-खंड (७) मध््यये विनिर््ददिष््ट केलेल््यया सक्षम प्राधिकरणाची पूर््व मान््यता आवश््यक आहे.
(चार) नवीन व््यवस््थथापनाची वित्तीय स््थथिती मजबूत आहे आणि विद्यमान व््यवस््थथापनाचे संलग््न महाविद्यालय, किंवा यथास््थथिति, मान््यताप्राप््त परिसंस््थथा ताब््ययात घेण््ययासाठी शासनाकडून व विद्यापीठाकडून वेळोवेळी विहित करण््ययात येतील असे वित्तीय साधनसंपत्तीचे निकष त््ययाने पूर््ण केले आहे.
(पाच) शासनाने व विद्यापीठाने वेळोवेळी विहित केल््ययाप्रमाणे विद्यमान व््यवस््थथापन ताब््ययात घेण््ययासाठी आवश््यक असलेल््यया इतर कोणत््ययाही शर्ती.
(६) विद्यापीठाच््यया व््यवस््थथापन परिषदेने शिफारस केलेले प्रस््तताव, राज््य शासनाकडे विचारार््थ सादर करण््ययात येतील आणि राज््य शासनाचा निर््णय प्राप््त झाल््ययावर, विद्यापीठ, असा निर््णय प्राप््त झाल््ययापासून आठ दिवसांच््यया आत विद्यमान व््यवस््थथापनाला व विद्यापीठास नवीन व््यवस््थथापनाला तो निर््णय कळवील.
(७) व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी परवानगी देण््ययाबाबत विद्यापीठाकडून पत्रव््यवहार प्राप््त झाल््ययावर, पूर्वीचे व््यवस््थथापन व विद्यमान व््यवस््थथापन, समुचित कायद्यान््वये व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी सक्षम प्राधिकरणांची परवानगी घेण््ययाकरिता यथोचित उपाययोजना करतील.
स््पष््टटीकरण.—या खंडाच््यया प्रयोजनार््थ “सक्षम प्राधिकरण” याचा अर््थ.— (एक) जर व््यवस््थथापन हे, नोोंदणीकृत विश््वस््त व््यवस््थथा असेल तर, महाराष्टट्र सार््वजनिक विश््वस््त मंडळ अधिनियम (सन १९५० चा २९) खालील सक्षम प्राधिकरण असा आहे; किंवा (दोन) जर व््यवस््थथापन हे, नोोंदणीकृत सोसायटी असेल तर सोसायटी नोोंदणी अधिनियम, १८६० (१८६० चा २१) खालील सक्षम प्राधिकरण, असा आहे; किंवा महाराष्टट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेेंबर १५, २०२२/अग्रहायण २४, शके १९४४ 3 (तीन) जर व््यवस््थथापन हे, नोोंदणीकृत कंपनी असेल तर, कंपनी अधिनियम, २०१३ (२०१३ चा १८) खालील सक्षम प्राधिकरण, असा आहे.
(८) समुचित कायद्यान््वये व््यवस््थथापनाचे हस््तताांतरण करण््ययासाठी सक्षम प्राधिकरणाची परवानगी प्राप््त झाल््ययावर, नवीन व््यवस््थथापन, महाराष्टट्र सार््वजनिक विद्यापीठ अधिनियम, २०१६ (२०१७ चा महा.६) याच््यया कलम १०८ अन््वये विहित केलेल््यया हमीपत्रासह अशा परवानगीची प्रत, अशी परवानगी प्राप््त झाल््ययाच््यया दिनाकंापासून आठ दिवसाचं््यया आत, विद्यापीठास सादर करील.
सक्षम प्राधिकरणाच््यया अशा परवानगीची प्रत, नवीन व््यवस््थथापनाकडून राज््य शासनाला पाठवण््ययात येईल.
(९) वरील खंडामध््यये विहित केलेली व््यवस््थथापनाच््यया हस््तताांतरणाची संपूर््ण प्रक्रिया नवीन व््यवस््थथापनाकडून विद्यमान व््यवस््थथापन ज््ययावर्षी ताब््ययात घेण््ययाचे प्रस््ततावित केले आहे त््यया वर््षषाच््यया १५ जून रोजी किंवा त््ययापूर्वी पूर््ण करण््ययात येईल. जर अशी प्रक्रिया या मदुतीत पूर््ण केली नसले तर, विद्यापीठाकडून व््यवस््थथापनाच ेहस््तताांतरण केवळ पढुील वर््षषामध््यये अंमलात आणण््ययात यईेल.
(१०) व््यवस््थथापनाच््यया हस््तताांतरणानंतर, विद्यमान व््यवस््थथापन, नवीन व््यवस््थथापनाला अशी हमी देईल की, विद्यमान व््यवस््थथापनाचा नवीन व््यवस््थथापनावर कोणताही हक््क किंवा प्राधिकार असणार नाही. अशा हमीपत्राची प्रत, विद्यापीठाला व राज््य शासनाला देखील सादर करण््ययात येईल.
(११) नवीन व््यवस््थथापन, विद्यापीठाला व राज््य शासनास त््ययाचे असे हमीपत्र सादर करील की, त््ययाने ताब््ययात घेतलेल््यया महाविद्यालयाच््यया किंवा परिसंस््थथेच््यया व््यवस््थथापनासाठी सर््वस््ववी तेच जबाबदार असेल.
(१२) विद्यमान व््यवस््थथापनाच््यया नियामक मंडळाचे किंवा मंडळाचे सदस््य, विश््वस््त, संचालक व समित््यया यांना नवीन व््यवस््थथापनाच््यया कामकाजामध््यये कोणताही हक््क असणार नाही.
(१३) नवीन व््यवस््थथापन, त््ययाच््ययाकडे हस््तताांतरित केलले ेमहाविद्यालय किवा परिसस््थथा, शासनान,े सबंधंित नियामक मडंळाने व विद्यापीठाने वेळोवेळी विहित केलेल््यया मानकांनुसार चालवील.
(१४) नवीन व््यवस््थथापनावर पुढील आबंधन असतील:- (एक) संलग््न महाविद्यालयाचे किंवा यथास््थथिती मान््यता प्राप््त परिसंस््थथेचे व््यवस््थथापन ताब््ययात घेतल््ययानंतर, संलग््न महाविद्यालयातील, किवा यथास््थथिती, मान््यताप्राप््त परिसस््थथेतील अध््ययापक व अध््ययापकेतर कर््मचाऱ््ययाांच््यया सवेाचं ेसरंक्षण करणे.
(दोन) संलग््न महाविद्यालयाचे किंवा यथास््थथिती, मान््यताप्राप््त परिसंस््थथेचे व््यवस््थथापन ताब््ययात घेतल््ययानंतर संलग््न महाविद्यालयातील किंवा यथास््थथिती मान््यताप्राप््त परिसंस््थथेतील विविध पाठ्यक्रमांना प्रवेश दिलेल््यया विद्यार््थ््याांच््यया शैक्षणिक हिताचे संरक्षण करणे.

NOTIFICATION Maharashtra Public Universities Act, 2016.
No. STA-2018/CR-91/UE-2.—In exercise of the powers conferred by clause (10) of sub-section (2) of section 72 read with sub-section (16) of section 71 of the Maharashtra Public Universities Act, 2016 (Mah. VI of 2017), the Government of Maharashtra hereby, prescribes the following uniform Statutes, relating to procedure for permission to transfer of Management of college or institution, namely:— UNIFORM STATUTES NO. 01 OF 2022
1. Short title.—This Statutes may be called the Maharashtra Public Universities (Procedure for Permission to Transfer of Management of college or institution) Uniform Statutes, 2022.
2. Procedure to be followed while granting permission for transfer of Management.—
(1) The existing management of any affiliated college or recognized institution shall submit a proposal to the university to grant a permission to transfer the management of any affiliated college or recognized institution, as the case may be before the last day of the September of the year, preceding the year in which transfer of management is sought.
(2) The existing management shall submit a proposal for transfer of management to the university in the form amended hereto and it shall be accompanied with the following namely :—
(i) Detail as information and documents mentioned in sub-clauses (i) to (iv) of clause (5) ;
(ii) Fees of Rs. 25,000, for the year in which these statutes are published in the Official Gazette which shall be increased by ten percent. every year there after :
(iii) An Undertaking to the effect that the existing management shall provide all information to the new management regarding the following namely :—
(a) Students admitted to various courses, declaration of results, fees, etc.;
(b) Details of teaching and non-teaching staff along with information about their terms and conditions of service and other service benefits;
(c) Details of infrastructure, books, equipment, movable and immovable properties, bank accounts, audit report, etc.;
(d) Other documents as may be prescribed by the University.
(3) On receipt of mutual proposal for transfer of Management, the University shall publish an advertisement in two local Marathi newspapers and one state level Marathi newspaper calling for objections and suggestions from concerned stakeholders.
(4) The proposals so received and duly signed by all members from the existing management and new management shall be scrutinized by the Board of Deans and shall be forwarded to the Management Council for its consideration and approval.
(5) The Management Council of the University shall consider and recommend to the State Government. Only those proposals of new management complying with the following requirements namely:—
(i) The new management has necessary infrastructure as may be prescribed by the State Government and the university from time to time, required for taking over the affiliated college or recognized institution, as the case may be, of the existing management;
(ii) there is no dispute pending in the Court of Law or Court of Charity Commissioner either of the existing management or of the new management;
(iii) Pre approval of competent authority specified in sub clause (7) is necessary;
(iv) the new management has sound financial capacity and fulfils criteria of financial महाराष्टट्र शासन राजपत्र असाधारण भाग चार-ब, डिसेेंबर १५, २०२२/अग्रहायण २४, शके १९४४ 7 resources, as may be prescribed by the State Government and the University from time to time, to take over the affiliated college or recognized institution, as the case may be, of the existing management;
(v) any other requirements necessary for taking over the existing management, as prescribed by the State Government and University, from time to time.
(6) The proposals recommended by Management council of the University shall be submitted for consideration to the State Government and on receipt of the decision of the State Government, the university shall communicate the same to the existing management and the new management within eight days of receipt of such decision by the University.
(7) On receipt of the communication from the university regarding grant of permission to transfer of management, the previous management and the new management shall take appropriate steps to obtain the permission of the competent authorities for transfer of management under the appropriate law.
Explanation.— ‘Competent Authority’ for the purposes of this clause shall mean,—
(i) the Competent Authority under the Maharashtra Public Trusts Act, (XXIX 1950), if the management is a registered trust ; or
(ii) the Competent Authority under the Societies Registration Act, 1860 (21 of 1860) if the management is a registered society ; or
(iii) the Competent Authority under the Companies Act, 2013 (18 of 2013) if the management is a registered company.
(8) On receipt of the permission of the Competent Authority for transfer of management under the appropriate law, the new management shall submit a copy of such permission along with the undertaking as prescribed under section 108 of the Maharashtra Public Universities Act, 2016 (Mah. VI of 2017) to the university, within eight days from the date of receipt of such permission. A copy of such permission of the Competent Authority shall be sent by the new management to the State Government.
(9) The entire process of transfer of management prescribed in the above clauses, shall be completed on or before the 15th June of the year in which the existing management is proposed to be taken over by the new management. If such process is not completed within this time limit, the transfer of management shall be given effect to by the university only in the subsequent academic year.
(10) After the transfer of management, the existing management shall give an undertaking to the new management that the existing management shall not have any right or authority over the new management. A copy of such undertaking shall also be submitted to the university and the State Government.
(11) The new management shall submit its undertaking to the university and the State Government that it shall be solely responsible for management of the college or institution taken over by it.
(12) Members of Governing Body or Board, trustees, directors and committees of the existing management shall not have any right in the functioning of the new management.
(13) The new management shall run the college or institution transferred to it, as per the norms prescribed by the State Government, concerned Regulatory Bodies and the University, from time to time.
(14) It shall be obligatory upon the new management :—
(i) to protect the services of teaching and non-teaching staff in the affiliated college or recognized institution, as the case may be, after taking over the management of affiliated college or recognized institution, as the case may be,
(ii) to protect the academic interest of the students admitted to various courses in the affiliated colleges or recognized institution, as the case be, after taking over the management of the affiliated college or recognized institution, as the case may be.
