“५३अ. सहकाारीी जि�ल्हाा संंवर्गग सेेवाा योोजन नि�धीीचीी स्थाापनाा व नि�धीीस द्याावयााच्याा वाार्षि�िक अंंशदाानााचीी काार्ययपद्धतीी :– (१) जि�ल्हाा देेखरेेख सहकाारीी संंस्थाा अधि�नि�यमााचेे कलम ६९अ खाालीील उपकलम(४)अन्वयेे गठीीत “सहकाारीी जि�ल्हाा संंवर्गग सेेवाायोोजन नि�धीी” याा नाावाानेे जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेेत बँँक खाातेे सुुरू करेेल.
(२) कलम ६९अ चेे उपकलम (५) अन्वयेे सहकाारीी जि�ल्हाा संंवर्गग सेेवाा योोजन नि�धीीस द्याावयााचेे अंंशदाान खाालीीलप्रमााणेे रााहीील.
(अ) प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा, माागीील वर्षीीच्याा वाार्षि�िक वेेतनााच्याा आधाारेे, संंस्थेेवर जि�ल्हाा देेखरेेख सहकाारीी संंस्थेेकडीील प्रति�नि�युुक्तीीवर कााम करणााऱ्याा सचि�वााच्याा १५ महि�न्यांं�च्याा वेेतनााइतपत व अन्य देेयभत्याा इतपत रक्कम सहकाारीी जि�ल्हाा संंवर्गग सेेवाा योोजन नि�धीी याा खाात्याात जमाा करीील.
परंंतुु जि�ल्हाा देेखरेेख सहकाारीी संंस्थेेनेे वि�काास सचि�वाास एकाापेेक्षाा अधि�क संंस्थेेत नेेमणूूक केेलीी असल्याास उपरोोक्त अंंशदाानााचीी रक्कम सदरच्याा संंस्थांं�मध्येे त्यांं�च्याा आर्थि�िक स्थि�ितीीनुुसाार वि�भाागण्याात येेईल.
(ब) मुंं�बई जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक मर्याा�दि�त याा बँँकेेव्यति�रीीक्त इतर जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकाा प्रतीीवर्षीी दि�.३० सप्टेंंबर रोोजीीच्याा प्रााथमि�क कृृषीी पतपुुरवठाा संंस्थाामाार्फफत वि�तरीीत अल्पमुुदत शेेतीीकर्जाा�च्याा व बि�गर शेेतीी कर्जाा�च्याा एकूूण येेणेे रकमेेवर आणि� दि�नांं�क २८ ऑक्टोोबर रोोजीीच्याा मध्यमुुदत शेेतीी माागणीी कर्जाा�वर ०.१५ टक्केे दराानेे अंंशदाान जमाा करतीील.
परंंतुु ज्याा जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकांं�चाा प्रााथमि�क कृृषीी पतपुुरवठाा संंस्थाामाार्फफत वि�तरीीत अल्प मुुदत शेेतीी कर्जाा�चाा व्यवहाार बँँकेेच्याा बि�गर शेेतीी कर्जज व्यवहााराापेेक्षाा जाास्त आहेे अशाा जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकांं�नीी याा अंंशदाानाासााठीी बि�गर शेेतीीकर्जज वि�चााराात घेेण्यााचीी आवश्यकताा असणाार नााहीी.
(३) सहकाारीी जि�ल्हाा संवंर्गग सेवेाायोोजन नि�धीीस द्याावयााचे ेअंशंदाान प्रााथमि�क कृषृीी सहकाारीी पतसंसं्थाा संसं्थाा तसेचे जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक ति�च्याा आर्थि�िक स्थीीतीीनुुसाार एक रकमीी अथवाा दरमहाा किं�ंवाा त्रैैमाासीीक हप्त्याानेे स्वनि�धीीतूून भरणाा करीील. यााप्रमााणेे अंंशदाानााचाा भरणाा करताानाा संंस्थाा तथाा बँँक माागीील आर्थीीक वर्षाा�मध्येे प्रत्यक्ष वसूूल झाालेेल्याा कर्जाा�मधीील पीीक कर्जाा�सााठीीच्याा दोोन टक्केे व्यााज गााळ्यााच्याा व मध्यम मुुदत कर्जाा�च्याा बााबतीीत जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेेच्याा कर्जज धोोरणाानुुसाार असणााराा व्यााज गााळाा वि�चााराात घेेईल.
(४) जि�ल्हाा देेखरेेख सहकाारीी संंस्थेेस संंलग्न असलेेलीी प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा तसेेच जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक संंवर्गग सेेवाायोोजन नि�धीीमध्येे जमाा कराावयााचीी अंंशदाानााचीी रक्कम प्रतीीवर्षीी ३१ डि�सेंंबर पुुर्वीी भरणाा करेेल.
(५) प्रत्येेक वर्षाा�च्याा अखेेरीीनंंतर येेणााऱ्याा ३१ ऑक्टोोबर पुुर्वीी प्रत्येेक प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा तसेेच जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक त्याावर्षीी द्याावयााच्याा अंंशदाानााचीी रक्कम ठरवि�ण्याासााठीी आवश्यक असणाारीी मााहि�तीी संंबंंधीीत जि�ल्हाा देखेरेखे सहकाारीी संसं्थेसे पुरुवीील. संबंंधंीीत देखेरेखे संसं्थाा याा मााहि�तीीचीी छााननीी करीील व त्याा प्रााथमि�क कृषृीी सहकाारीी पतसंस्थेनेेे तसेेच जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेेनेे द्याावयााचीी त्याा वर्षाा�च्याा अंंशदाानााचीी तसेेच अंंशदाान थकबााकीीचीी रक्कम नि�श्चीीत करेेल. जि�ल्हाा देेखरेेख सहकाारीी संंस्थाा प्रति�वर्षीी ३१ डि�सेंंबरपूूर्वीी नि�श्चि�ित केेलेेलेे अंंशदाानााचीी माागणीी करण्यााबााबतचीी नोोटीीस प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा व जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेेवर बजाावीील. प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा तसेेच जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक त्याा वर्षाा�सााठीी देेय असणाारेे अंंशदाान संंबंंधीीत जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेेतीील “सहकाारीी जि�ल्हाा संंवर्गग सेेवाायोोजन नि�धीी” याा खाात्याात जमाा करीील.
(६) प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थेेमाार्फफत सदर नि�धीीमध्येे द्याावयााचेे अंंशदाान भरणाा न केेल्याास संंबंंधीीत जि�ल्हाा देेखरेेख सहकाारीी संंस्थेेस संंबंंधीीत संंस्थेेवर प्रतीीनि�युुक्तीीद्वाारेे नि�युुक्त केेलेेल्याा सचि�वाास परत बोोलवि�ताा येेईल.
महाारााष्ट्र शाासन रााजपत्र असााधाारण भााग चाार-ब, õõõऑक्टोोबर ९, २०२४/आश्वि�िन १७, शकेे १९४६ 3 (७) कोोणतीीहीी जि�ल्हाा मध्यवर्तीी सहकाारीी बँँक लगत पूूर्वीीच्याा पोोटनि�यमाात तरतुुद केेल्यााप्रमााणेे वाार्षि�िक अंंशदाान देेण्याात कसुुर करीील त्यााबााबतीीत, जि�ल्हाा देेखरेेख सहकाारीी संंस्थाा यााबााबतचाा अहवााल नि�बंंधकाास साादर करीील.
(८) वरीील उपनि�यम (४) मध्येे नमुुद केेल्यााप्रमााणेे अंंशदाानााचीी रक्कम भरणाा करणााऱ्याा संंस्थांं�च्याा सचि�वांं�चेे वेेतन याा नि�धीीमधुुन केेलेे जााईल.
(९) सदरचेे नि�यम हेे रााज्याातीील सर्वव प्रााथमि�क कृृषीी सहकाारीी पतसंंस्थाा तसेेच मुंं�बई जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकेे व्यति�रीीक्त जि�ल्हाा मध्यवर्तीी सहकाारीी बँँकांं�नाा लाागूू रााहतीील.

NOTIFICATION Maharashtra Co-operative Societies Act, 1960.
No. Sanini-1524/C.R.110/13C.– The following draft of rules further to amend the Maharashtra Co-operative Societies Rules, 1961, which the Government of Maharashtra proposes to make in exercise of the powers conferred by sub-sections (1) and (2) of section 165 of the Maharashtra Cooperative Societies Act,1960 (Mah. XXIV of 1961), and of all other powers enabling it in that behalf, is hereby published, as required by sub-section (3) of section 165 of the said Act, for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft will be taken into consideration by the Government of Maharashtra on or after the 09th November, 2024.
2. Any objection or suggestion, which may be received by the Additional Chief Secretary (Cooperation and Marketing), Co-operation, Marketing and Textile Department, Madam Cama Marg, Hutatma Rajguru Chowk, Mantralaya, Annexe, Mumbai 400 032, from any person with respect to the said draft on or before the aforesaid date, will be considered by the Government.
DRAFT RULES
1. These rules may be called the Maharashtra Co-operative Societies (Amendment) Rules, 2024.
2. In the Maharashtra Co-operative Societies Rules, 1961 (hereinafter referred to as “the principal Rules”) after rule 53, the following rules shall be inserted, namely :– “53A Establishment of Co-operative District Cadre Employment Fund and Manner of annual contribution to be made to the fund.–
(1) The District Supervision Co-operative Society shall open an account in the name of the “Co-operative District Cadre Employment Fund” established by it under sub-section
(4) of section 69A of the Act, in the District Central Co-operative Bank.
(2) The rate of contribution payable to the Co-operative District Cadre Employment Fund under sub-section (5) of section 69A shall be as follows, namely:-
(a) The Primary Agricultural Credit Society, shall on the basis of the previous years annual salary of the secretary deputed by the District Supervision Co-operative Society, contribute to the Co-operative District Cadre Employment Fund 15 months salary and other payable allowances to the Secretary :
Provided that, if the District Supervision Co-operative Society has nominated one secretary on more than one Primary Agricultural Credit Societies then the above contribution shall be divided amongst those societies based upon their financial position.
(b) All District Central Co-operative Banks, excluding the Mumbai District Central Co-operative Bank Limited shall deposit the contribution in the Co-operative District Cadre Employment Fund at the rate of 0.15 percent of short term agricultural and non-agricultural loans disbursed through Primary Agricultural Credit Societies and which are outstanding as on 30th September each year and that of medium term loans due for recovery as on the 28th October in each year:
Provided that, the District Central Co-operative banks having short term agricultural loans disbursed through Primary Agricultural Credit Societies more than that of non-agricultural loans shall not be required to consider non-agricultural loans for the purpose of such contribution.
(3) The contribution to be paid to the Co-operative District Cadre Employment Fund shall be paid from the own funds in lumpsum or in monthly or quarterly installments महाारााष्ट्र शाासन रााजपत्र असााधाारण भााग चाार-ब, õõõऑक्टोोबर ९, २०२४/आश्वि�िन १७, शकेे १९४६ 5 depending on the financial position of the Primary Agricultural Credit Society or the District Central Co-operative Bank, as the case may be. While paying the contribution, the society or the bank will take into consideration the two percent interest margin available on crop loans actually recovered in the previous financial year and in case of medium term loans the available interest margin as per the loan policy of the District Central Co-operative Bank.
(4) The Primary Agricultural Credit Society affiliated to District Supervision Cooperative Society as well as District Central Co-operative Bank shall pay the annual contribution in the District Cadre Employment Fund before 31st December every year.
(5) The Primary Agricultural Credit Societies as well as the District Central Cooperative Bank, before 31st October following the end of each year, shall furnish to the District Supervision Co-operative Society the information necessary for determining the amount of contribution to be paid for that year. After receiving such information, the concerned supervision society will scrutinize the same and determine the amount of contribution and arrears of contribution for that year to be paid by the Primary Agricultural Credit Society and by the District Central Co-operative Bank. Before 31st December, the District Supervisory Co-operative Society shall serve a notice of demand for payment of fixed contribution on the Primary Agricultural Credit Society and the District Central Cooperative Bank. The Primary Agricultural Credit Society and District Central Co-operative Bank shall pay the amount of contribution due for that year in the “Co-operative District Cadre Employment Fund” account in the District Central Co-operative bank.
(6) In case of non-payment of contribution to the said fund by the Primary Agricultural Credit Society, the Secretary appointed on deputation may be recalled by the concerned District Supervisory Co-operative Society.
(7) In case, any District Central Co-operative Bank defaults in paying the annual contribution as provided in the preceding sub-rule (2), the District Supervision Co-operative Society shall submit a report thereof to the Registrar.
(8) The salaries of the Secretaries of the societies paying the annual contribution as mentioned in sub-rule (4) above shall be paid from this fund.
(9) These rules shall be applicable to all the Primary Agricultural Credit Societies and District Central Co-operative Banks other than Mumbai District Central Co-operative Bank.
53B. Recruitment of Secretaries.- The District Supervision Co-operative Society shall recruit secretaries by direct recruitment or by nomination from amongst the secretaries appointed by Primary Agricultural Credit Societies.
