Shree Siddhi Vinayak Ganpati Temple Trust (Prabhadevi) Services (Recruitment) Regulations, 2008 The Shree Siddhi inaya Ganpati Temple Trust {Prabhadevi) Act, 1980 In exercise of the powers conferred by sub -section (3) of section14 read with sub- section (2) of section 14 of the Shree Siddhi Vinayak Ganpati Temple Trust (Prabhadevi) Act, 1980 (Mah.VI of 1981}, the Shree Siddhi Vinayak Ganpati Temple Trust, Magnagement Committee,- after prior approval of the Government of . Maharashtra, herehy makes the following regulations, namely; -
CHAPTER -1 GENERAL
1. Short title and commmcmuen£~ (1) These Regulations may be called the Shree Siddhi Vinayal Ganpati Temple Trust (Prabhadevi) Services (Recruitment) Regulations, 2008
(2) = They shall come into force on 4% August 2008,
2. Extent o{'apphcahnn Except as otherwise provided by or under these regulations, these rngulatmns shall apply to all persons appmrfz@d. the Trust services and posts in connection with the affaits of the Trust
Provided that, any permanent Trust servants appointed prioe to the date of coming into force of these regulations shall be exempted from the operation of these regulations for a period as may be determined by the Committee with the prior sanction of the Government.
5. Power of interprétation- If any queflt'mn arises relating to the interpretation uf these regulations, it shall be referred to the Committee, whose decision thereon shall be final.
4. Power of relaxation.- Where the Commuttee is satisfied that the operation of any of these regulations causes ot is likely to cause undue hardship in the case ofany Trust servant or class of Trust Servant's it may, with prior sanction of the Government, by an order in writing, exempt any such Trust servant or class of Trust servants from any provisions of these regulations or may direct that such provisions shall spply to such Trust Servant’s or class of Trust Servant's with such medifications not affecting the substance thereof as may be specified in such order.

5. Validity of terms of contract- The terms of a specific contract, enforceable at law necessarily override the provisions of these regulations.
8. Regulation of claims to pay and allowances- A Trust servants claim to pay and allowances is regulated by the regulations in force at the time in respect of which the pay and allowances are earned.
7. Exercise and delegation of powers under these 'n:gu]ahnns ~ It shall be open to the Committee to prcst'l ibe, by general or special order, that powers under these regulations may be exercised or delegated to the Executive Officer or any other officer of the Trust.
8. Definitions- In this mgu]amnx unfess the context otherwise requires- i (1} "Aet" means Shree Siddhn Vinayak Ganpat Temple Trust (Prabhadevi) Act, 1980 (Mah.V1 of 1981), (2] "Committee” means the Management Committee constituted under section 5 of the Act.
(8] “Dregree” means the Degree of a Statutory University and includes qualifications recognised by Government as equivalent thereto,
(4) "Executive Officer" means the Executive Officer, appointed by the Government under section 12 of the Act.
(4} "Government” means the Government of Maharashtra
(8) “Government CUommercial Certificate 7 means a certificate issued by the Bureau of Government Examinations, Directorate of Technical Education and includes a certificate issued by any other Institution as may be specifically declared by the Government to be squivalent thereto, (7] “Higher Secondary School Certificate Examination” means Higher Secondary School Certificate Examination conducted by a Divisional Board constitted under the Maharashtra Secondary and Higher Secondary Education Beards Act, 1965 (Mah. XLI of 1965} and includes any examination declared by Government to he equivalent thercta.
| (8] "Permanent post” means a post carrying a definite rate of pay sanctioned without limit of time, {10) Qecnndnrj’ School Certificate Examination” means the Sc.wnd.uy School Certificate Examination conducted by a Divisional Board constituted under the Maharashtra Secondary anidl Higher Secondary Education Boards Awt, 1965 (Mah. XLI of 1965) and includes any examination declared by the Government to be equivalent thereto.
(11} “Temporary post” means a post carrying a definite rate Uf pay sanctioned for'a limited time.
(12) “Trust’ means the Trust: evmmutcd under the Shree Sidelhi \"L!Igyd]i (.Jatlpatl Temple Trust {Prabhadeyi) Act, 1980 (Mah. VI of 1981).
2. Appointment to the posts in the Trust Service shall be made either- (a) by prometion of a suitable Trust Servant on the basis of seniority subjeet to fitness from amongst the persons holding the posts, possessing the qualifications and experience prescribed i the respective Schedule 1o these regulations, or
(b) by selection on the basis of a merit list prepared by the Commuttee -on the basis of Departmental Competitive Examination held amongst the eligible Trust servants possessing requisite qubeéfi ions and experionce as preseribed in the respective Ho tle to these regulations, or
(e) by nomination from amongst the candidates who posses the requisite qualifications as preseribed in the respective Schedule to these regulations, or {d) by deputation ofa suitable person from amongst the person holding equivalent Post m the Government.
10. Ratio of appointments hy different modes— The appointnents by Promotion, by Selection, and by Nomination shall be made 1n the ratio mentioned i the respective schedules to these regulations.

Sociery; or MS-CIT Course Certificate of an Institute authorised by the Maharashtra State Higher and Technical Education Board; and {iii} have miniroum experience of five years on the post of Assistant Manager in the service of the Trust, 2, Assistant Manager Appolntment shall be made either,- () by pomination from amongst candidates who,-
(i) unless-already in the service of the Trust, are not less r}gm 18 years and not more than 80 years of age;
(ii) possess a degree of a statutory universicy;
(iii} C.C.C or 0 Level or ‘A’ Level or ‘B Level or 'C’ Level Certificate of D.O.EACC Society; or MS-CIT Course Certificaze of an Institute authorised by the Muaharashtra State I-[;gher and Technical Education Board; and ' {iv) have minimum experience of § years in Executive capacity.
Preference shall be given to a person who possesses post- Graduate Diploma of a statutory university in Business Management or equivalent thereto.

6. Personal Assistant, Appointment shall be made aither, (&) by nomiration from amongst the candidates who,-

(ii) possess a degree of a statutory university;

18, Assistant Poojari Appointment shall be made by nomination from amongst the candidates who,-
(i) unless already in the service of the Trust, are not less than 18 years and not more than 30 years of age;
(i) have passed Higher Secondary School Certificate Examination;
(uii) has completed and passed three ‘years course in ‘Ved Shastra” from reputed Institution; and
(iv) have minimum experience of five years as a Poojari.
14. Stenographer. Appointment shall be made either,-
(a) by nomination firom amongst the candidates who-
(i) unless already in the service of the Trust, are not less than 18 years and not more than 50 years of age;
{11} possess a degree of a statutory university;
