No. TEM. 2019/C.R. 40/TE-4.—In exercise of the powers conferred by section 23 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 (Mah. XXVIIl of 2015), the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions to the Full Time Professional Post Graduate Technical Courses) Rules, 2017, namely :—
1. These rules may be called the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions to the Full Time Professional Post Graduate Technical Courses) (Amendment) Rules, 2019.
2. Inrule 2 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions to the Full Time Professional Post Graduate Technical Courses) Rules, 2017 (hereinafter referred to as the “ the principal rules "), in clause (g), for the words “ Management and Computer Applications” the words “Management and Computer Applications, Pharm. D. (Post Baccalaureate) and Planning " shall be substituted.
3. inrule 8 of the principal rules, in sub-rule (3),—
(i) after the words “Hotel Management and Catering Technology” the words “, Pharm D. (Post Baccalaureate), Planning” shall be inserted ;
(i) in proviso to sub-rule (i), for clause (a) the following clause shall be substituted, namely :— “(a) higher percentage of marks in HSC or Diploma ;”;
(iii) in proviso to sub-rule (ii), for clause (a) the following clause shall be substituted, namely -— “(a) higher percentage of marks in HSC or Diploma ;.
4. Inrule 10 of the principal rules,—
(1) in sub-rule (1), in Stage-I,—
(i) after sub-clause (a), the following sub-clause shall be inserted, namely :— “(a-1) Economically Weaker Section (EWS) and Orphan Candidates shall be considered for allotment of seats reserved for them as per their Inter-Se-Merit, and if seat is not available in their respective reserved category, then they shall be considered for allotment in Open Category as per their Inter-Se-Merit. ”;
(i) for sub-clauses (d) and (e) the following sub-clauses shall be substituted, namely :— “(d) Persons with Disability Category Candidates shall be considered for allotment of the seats reserved for them in their respective Category, as per their Inter-Se-Merit and if seat in their respective reserve Category is not available, then they shall be considered for allotment in Open Category as per their Inter-Se-Merit.
(e) For Engineering and Technology, Pharmacy, Pharm D (Post Baccalaureate) and Planning Courses Sponsored or Non -Sponsored Candidates shall be considered for allotment as per Inter-Se-Merit. ”;
(iii) the Stage — Ill, Stage —IV and Stage — V shall be deleted ;

(2) in sub-rule (2),—
(i) in clause (a), for the words “ conducted by All India Council for Technical Education ” the words “conducted by National Testing Agency” shall be substituted ;
(i) in clause (b), for the words “ conducted by All India Council for Technical Education ” the words and brackets “conducted by National Testing Agency” shall be substituted ;
(iii) after clause (f) the following clauses shall be added, namely :— *(9) First Year Planning Score of Common Entrance Examination for Design (CEED) conducted by the Indian Institute of Technology ;
(h) First Year Pharm D. (Post Baccalaureate)- Score of Graduate Pharmacy Aptitude Test (GPAT), conducted by the National Testing Agency. ".
5. In rule 11 of the principal rules, in sub-rule (3),- (/) in clause (a), for sub-clause (i), following sub-clause shall be substituted, namely:- “(ii) Stages | to VI of sub-rule (1) of rule 10;7;(ii) in clause (b), for sub-clause (i) the following sub-clause shall be substituted, namely:— “ (i) Stages | to VI of sub-rule (7) of rule 10 ; ".
6. Inrule 12 of the principal rules,—
(i) for clause (j) the following clause shall be substituted, namely : — “(j) The seat acceptance fee shall be Rs. 1000/-, for all admitted candidates and the same shall be treated as non- refundable .”;
(i) after clause (m), the following clauses shall be inserted, namely:— " (n) If any of the statement made in application form or any information supplied by the candidate in connection with his admission is found to be false or incorrect, the Principal shall cancel his admission and forfeit the fees. An appeal against the action of cancellation of admission, may be preferred within seven days to the Competent Authority. The Competent Authority shall decide the appeal within fifteen days and his decision thereon shall be final.
(o) Complaints regarding the use of fake certificates to be investigated in time bound manner and if found guilty, such admission shall be cancelled. Further appropriate action shall be initiated with due intimation to Competent Authority. ”.
7. Inrule 15 of the principal rules, after clause (c), the following clause shall be added, namely :— "(d) The institution shall not recover the fees for the subsequent years from the student seeking cancellation of his admission at any point of time. ".
8. In SCHEDULE-I to the principal rules, in the heading “A. Allocation of seats within sanctioned Intake”, for sub-leading “Direct Admission to Second Year of Computer Application” and entries at Sr.
No.9and 10, appended to the said sub-leading the following sub-leading and entries shall be substituted, namely -— “ For Pharm D. (Post Baccalaureate) and Planning Courses 9 | Unaided Private 80% (60% for Non- Nil 20% (15% for Non- Professional Sponsored Seats Sponsored Seats and Educational Institutions| and 20% for 5% for Sponsored (excluding minority Sponsored Seats) Seats) institutions).
