�मांक िविध-2019/�.�.79/मिश-2.—महाराष्� िवनाअनदुािनत खाजगी व्यावसाियक शैक्षिणक संस्था (�वेश व शलु्क यांचे िविनयमन) अिधिनयम, 2015 (2015 चा महा.28) याच्या कलम 23 �ारे �दान करण्यात आलेल्या अिधकारांचा वापर क�न, महाराष्� शासन, या�ारे, महाराष्� िवनाअनदुािनत खाजगी व्यावसाियक शैक्षिणक संस्था (पणूर्वेळ व्यावसाियक िविध पदवीपवूर् पा��मांच्या �ावयाच्या �वेशाचे िविनयमन) िनयम, 2017 यामध्ये सधुारणा करण्यासाठी पढुील िनयम करीत आहे : ------
1. या िनयमांना, महाराष्� िवनाअनदुािनत खाजगी व्यावसाियक शैक्षिणक संस्था (पणूर्वेळ व्यावसाियक िविध पदवीपवूर् पा��मांच्या �वेशाचे िविनयमन) (सधुारणा) िनयम, 2019 असे म्हणाव.े
2. महाराष्� िवनाअनदुािनत खाजगी व्यावसाियक शैक्षिणक संस्था (पणूर्वेळ व्यावसाियक िविध पदवीपवूर् पा��मांच्या �ावयाच्या �वेशाचे िविनयमन) िनयम, 2017 (यात यापढेु ज्याचा िनद�श “मखु्य िनयम ” असा करण्यात आला आहे) यांच्या िनयम 4 मधील, उप-िनयम (3) वगळण्यात येईल.
3. मखु्य िनयमांच्या िनयम 8 मध्ये,— (एक ) उप-िनयम (2) ऐवजी, पढुील उप-िनयम दाखल करण्यात येईल : --- (१) भाग चार-ब-182--- 1 2 ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, VÉÚxÉ 14, 2019/VªÉä¹`ö 24, ¶ÉEäò 1941 “(2) पडताळणीमळेु गणुांमध्ये होणारा बदल.—गणुांची पडताळणी केल्यामळेु अहर्ता परीके्षमधील गणुांमध्ये फेरबदल झाले असतील आिण संबंिधत समिुचत �ािधकरणाने िंकवा मंडळाने ते गणु यथोिचतिरत्या �मािणत केलेले असतील तर, ते गणु, कें �ीभतू �वेश �ि�येमाफर् त �वेश देण्याकिरता सक्षम �ािधकाऱ्याला िंकवा त्याच्या पदिनद�िशत �ितिनधींना अंितम गणुव�ा यादी �िस� होणाच्या िदवशी सायंकाळी 5-00 वाजेपवू� कळिवण्यात येतील. ” (दोन) उप-िनयम (3) मधील खंड (एक), उप-खंड (एक) च्या परंतुकाऐवजी, पढुील परंतुक दाखल करण्यात येईल :— “परंत,ु समसमान गणु असतील त्या �करणी, उमेदवारांमधील तौलिनक गणुव�ा ही पढुील �ाधान्य�माने व खाली िविन�दष्ट केलेल्या प�तीने ठरिवण्यात येईल,— “(क) तीन वष�चा पदवी पा��म (िविध),— (एक) सांिविधक िव�ापीठाची पदव्य�ुर पदवी असणाऱ्या उमेदवारांना �ाधान्य देण्यात येईल ;
(दोन) सांिविधक िव�ापीठाच्या पदव्य�ुर पदवी परीके्षतील गणुांची अिधकतम टक्केवारी ;
(तीन) सांिविधक िव�ापीठाच्या पदवी परीके्षतील गणुांची अिधकतम टक्केवारी ;
(चार) एच.एस.सी. िंकवा समतलु्य परीके्षतील एकूण गणुांची अिधकतम टक्केवारी ;
(पाच) एस.एस.सी. िंकवा समतलु्य परीके्षतील एकूण गणुांची अिधकतम टक्केवारी ;
(सहा) वयाने मोठा असलेला ;
(ख) पाच वष�चा संकिलत पदवी पा��म (िविध) , — (एक) अहर्ता परीके्षतील म्हणजेच एच.एस.सी. िंकवा समतुल्य परीके्षतील गणुांची अिधकतम टक्केवारी ;
(दोन) एच.एस.सी. िंकवा समतलु्य परीके्षत �थम भाषा िवषयातील गणुाची अिधकतम टक्केवारी ;
(तीन) एस.एस.सी. िंकवा समतलु्य परीके्षतील गणुांची अिधकतम टक्केवारी ;
(चार) एस.एस.सी. िंकवा समतलु्य परीके्षत इं�जी िवषयातील गणुांची अिधकतम टक्केवारी ;
(पाच) वयाने मोठा असलेला ;”
4. मखु्य िनयमांच्या िनयम 9 ऐवजी, पढुील िनयम दाखल करण्यात येईल :— “9 . कें �ीभतू �वेश �ि�या (कॅप).— (1) िवनाअनदुािनत खाजगी व्यावसाियक शैक्षिणक संस्था ही, अिधिनयमाच्या कलम 3 च्या पोट-कलम (3) मध्ये िन�दष्ट केल्या�माणे, कें �ीभतू �वेश �ि�येमाफर् त (कॅप) उमेदवारांना �वेश देईल. कें �ीभतू �वेश �ि�येचे (कॅप) टप्पे खाली नमदू केल्या�माणे असतील :— (क) सक्षम �ािधकाऱ्याने संबंिधत संचालनालयाशी िवचारिविनमय क�न मािहती प�ुस्तका �द�शत िंकवा �िस� करणे ;
(ख) कें �ीभतू �वेश �ि�येमध्ये भाग घेण्यासाठी उमेदवाराने आवेदनप�ाचा नमनुा ऑनलाईन प�तीने भरणे ;
(ग) ऑनलाईन प�तीने आवेदनप�ाचा नमनुा भरतांना �वेशासाठीच्या आवश्यकतेनसुार आवश्यक त्या वधै मळू कागदप�ांच्या स्कॅन �ितमा संगणकावर टाकणे (अपलोड करणे) ;
(घ) उमेदवाराने �वेश उप�स्थती कें �ाव�न कागदप�ांची पडताळणी क�न घेणे, उमेदवाराने आवेदनप�ात केलेल्या दाव्याच्या पषृ्टीदाखल सवर् मळू कागदप�े सादर करणे बंधनकारक आहे ;
(ड.) तात्परुत्या गणुव�ा या�ा �द�शत िंकवा �िस� करणे, त�ारी असल्यास, त्या दाखल करणे आिण अंितम गणुव�ा या�ा �द�शत िंकवा �िस� करणे ;
(च) कें �ीभतू �वेश �ि�येच्या (कॅप) त्या त्या फेऱ्यांसाठी उपलब्ध असलेल्या �वगर्िनहाय जागा (जागा वाटप) �द�शत करणे ;
(छ) कें �ीभतू �वेश �ि�येच्या (कॅप) पिहल्या व ितसऱ्या फेरीपवू� संस्थांचा पसंती�म असणारा ऑनलाईन िवकल्प नमनुा भरणे व त्यास पषु्टी देणे. सक्षम �ािधकाऱ्याने िविन�दष्ट केल्या�माणे उमेदवारांना त्यांच्या पसंतीनसुार संस्थांचा पसंती�म उतरत्या �माने भरता येईल. कें �ीभतू �वेश �ि�येच्या (कॅप) पिहल्या फेरीपवू� िवकल्प नमनु्यास एकदा का पषु्टी िदली की मग, तो िवकल्प नमनुा कें �ीभतू �वशे �ि�येच्या पिहल्या व दसुऱ्या फेरीच्या जागा वाटपासाठी ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, VÉÚxÉ 14, 2019/VªÉä¹`ö 24, ¶ÉEäò 1941 3 िवचारात घेण्यात येईल. आिण कें �ीभतू �वशे �ि�येच्या (कॅप) ितसऱ्या फेरीपवू� पषु्टी िदलेला िवकल्प नमनुा, कें �ीभतू �वेश �ि�येच्या फक्त ितसऱ्या फेरीच्या जागा वाटपासाठीच िवचारात घेण्यात येईल.
(ज) वाटप केलेली संस्था दशर्िवणारे, कें �ीभतू �वेश �ि�येच्या (कॅप) संबंधीत फेरीचे तात्परुते जागा वाटप �द�शत करणे;
(झ) सक्षम �ािधकाऱ्याने घोिषत केलेल्या वेळाप�कानसुार, उमेदवार त्याच्या लॉग-इन मधनू �वेश उप�स्थती कें �ावर जागा स्वीकृती फी भ�न त्याला देऊ केलेली जागा स्वीकारील ;
(ञ) खंड (झ) नसुार जागेचा स्वीकार केल्यानंतरच, उमेदवारने कें �ीभतू �वेश �ि�येच्या फेऱ्यांमधील अंितम जागा वाटपानसुार वाटप करण्यात आलेल्या जागेवर �वशे घेण्यासाठी जागा वाटप केलेल्या संस्थेमध्ये हजर व्हायचे आहे;
(ट) सक्षम �ािधकाऱ्याने कें �ीभतू �वेश �ि�येचे िविवध टप्पे पार पाडण्यासाठी िविहत केलेल्या वेळाप�काचे पालन करणे बंधनकारक असेल.
(2) कें �ीभतू �वेश �ि�येची पिहली फेरी आयोिजत करणे.— पिहल्या फेरीकरीता उपलब्ध असलेल्या जागा संकेतस्थळावर �द�शत करण्यात येतील. कें �ीभतू �वेश �ि�येच्या अिंतम गणुव�ा यादीत ज्या उमेदवाराचे नाव आले असेल तो उमेदवार ऑनलाईन िवकल्प नमनुा भ�न या फेरीत सहभागी होण्यास पा� असेल. उमेदवार त्याच्या लॉग-इन मधनू िवकल्प नमनुा भ�न त्यास पषु्टी देईल.
(3) कें �ीभतू �वेश �ि�येदरम्यान,— (क) उमेदवारास त्याच्या पिहल्या पसंती�मांकावरील जागेचे वाटप झाल्यास, ती जागा आपोआप राखनू ठेवली जाईल व उमेदवार अशा�कारे वाटप झालेल्या जागेचा स्वीकार करील. असा उमेदवार कें �ीभतू �वशे �ि�येच्या त्यापढुील फेऱ्यांमध्ये सहभागी होण्यास पा� असणार नाही. असे उमेदवार कागदप�ांच्या पडताळणीसाठी व उमेदवार लॉग-इन मधनू जागा स्वीकृती शलु्क भरण्यासाठी �वेश उप�स्थती कें �ावर हजर होतील. तद्नंतर, असे उमेदवार वाटप करण्यात आलेल्या संस्थेमध्ये हजर होतील आिण वाटप करण्यात आलेल्या जागेवर �वेश घेतील. जर असा उमेदवार जागा स्वीकृती कायम करण्यासाठी �वेश उप�स्थती कें �ावर हजर झाला नाही, तर त्याला वाटप केलेल्या जागेवरील त्याचे हक्क आपोआप गमावील आिण अशी जागा नवीन वाटपासाठी उपलब्ध होईल. अशा उमेदवाराकिरता अशा�कारे करण्यात आलेले हे जागा वाटप अंितम असेल;
(ख) ज्या उमेदवारास त्याच्या पिहल्या पसंती�मांकाखेरीज इतर पसंती�मांकावरील जागेचे वाटप झाल्यास आिण उमेदवार या वाटपाने संतुष्ट असेल आिण कें �ीभतू �वेश �ि�येच्या पढुील फेरींमध्ये सहभागी होण्याची त्याची इच्छा नसेल, असा उमेदवार त्याच्या लॉग-इन मधनू त्यास देऊ केलेली जागा स्वतः गोठवू शकेल. उमेदवाराने त्याला एकदा वाटप केलेली जागा गोठिवल्यावर, असा उमेदवार कागदप�ांची पडताळणी व जागा स्वीकृती शलु्क भरण्यासाठी �वेश उप�स्थती कें �ावर हजर होईल. तद्नंतर, असा उमेदवार वाटप करण्यात आलेल्या संस्थेमध्ये हजर होईल आिण त्याला वाटप करण्यात आलेल्या जागेवर �वेश घेईल. अशा उमेदवाराकिरता अशािरतीने करण्यात आलेले हे जागावाटप अंितम वाटप राहील. जर असा उमेदवार, जागा स्वीकृती कायम करण्यासाठी �वशे उप�स्थती कें �ावर हजर झाला नाही, तर त्याला वाटप केलेल्या जागेवरील त्याचा हक्क आपोआप गमावील आिण ती जागा पनु्हा वाटपासाठी उपलब्ध होईल. जो उमेदवार वाटप केलेली जागा गोठवील तो नंतर कें �ीभतू �वेश �ि�येच्या पढुील फेरींमध्ये सहभागी होण्यास पा� नसेल;
(ग) ज्याला पिहल्या पसंती�मांकाखेरीज इतर पसंती�मांकावरील जागेचे वाटप झाले असेल आिण त्याने �वेश उप�स्थती कें �ावर हजर होऊन जागा स्वीकृती कायम करण्यासाठी उमेदवार लॉग-इन मधनू जागा स्वीकृती शलु्क भरले असेल असा उमेदवार वरच्या पसंती�मांकावरील जागा िमळिवण्याकिरता पढुील फेरींमध्ये सहभागी होण्यास पा� असेल.
(घ) ज्याला पिहल्या पसंती�मांकाखेरीज इतर पसंती�मांकावरील जागेचे वाटप झाले असेल आिण जागा स्वीकृती कायम करण्यासाठी त्याने �वेश उप�स्थती कें �ावर हजर न राहता ती जागा स्वीकारली नसेल आिण उमेदवाराने लॉग-इन मधनू जागा स्वीकृती शलु्कही भरले नसेल तर असा उमेदवार पढुील फेरींमध्ये सहभागी होण्यास पा� असेल.
(4) कें �ीभतू �वेश �ि�येची (कॅप) दसुरी फेरी आयोिजत करणे, — (क) दसुऱ्या फेरीकिरता उपलब्ध असलेल्या जागा, संकेतस्थळावर �िस� करण्यात येतील.
4 ¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, VÉÚxÉ 14, 2019/VªÉä¹`ö 24, ¶ÉEäò 1941 (ख) दसुरी फेरी ही, ज्या उमेदवारांना त्यांच्या पिहल्या पसंती�मांकाखेरीज इतर पसंती�मांकावरील जागेचे वाटप झाले असेल आिण ज्या उमेदवारांना पिहल्या फेरीत कोणतीही जागा वाटप झाली नसेल त्यांच्याकिरता वरच्या पसंती�मांकावरील जागा िमळिवण्याकिरता असेल;
(ग) उमेदवारास दसुऱ्या फेरीनंतर वरच्या पसंती�मांचा िवकल्प उपलब्ध नसेल. उमेदवारांना दसुऱ्या फेरीत करण्यात आलेले वाटप आिण/िंकवा ठेवनू घेतलेले वाटप हे अंितम वाटप असेल;
(5) कें �ीभतू �वेश �ि�येची ितसरी फेरी आयोिजत करणे, — (क) ितसऱ्या फेरीकिरता उपलब्ध असलेल्या जागा संकेतस्थळावर �िस� करण्यात येतील.
(ख) ितसऱ्या फेरीकिरता पा� असलेल्या उमेदवारांना ऑनलाईन प�तीने िवकल्प नमनुा भरण्यास आिण / िंकवा पवू�च्या फेरीसाठी उमेदवाराने भरलेल्या िवकल्प नमनु्यामध्ये बदल करण्यास परवानगी देण्यात येईल. सामाियक �वेश परीक्षा अहर्तापा� उमेदवारांनी कें �ीभतू �वेश �ि�येच्या पिहल्याफेरीपवू� त्यांची नोंदणी करण्यात कसरू केली असेल तर असे उमेदवार कें �ीभतू �वेश �ि�येच्या ितसऱ्याफेरीपवू� नोंदणी करण्यास पा� असतील. परंतु, अशा नवीन नोंदणी केलेल्या उमेदवारांची गणुव�ा यादी स्वतं�पणे �िस� करण्यात येईल आिण त्यांची नाव ेपिहल्या गणुव�ा यादीमध्ये �िस� केलेल्या उमेदवाराच्याखाली ठेवण्यात येतील. या फेऱ्यांदरम्यान वाटप करावयाच्या जागा खालील �वग�त मोडणाऱ्या पा� उमेदवारांना उपलब्ध असतील,— (एक) वरील उप िनयम 3 (ग) व 3 (घ) मधील उमेदवार ;
(दोन) पवू�च्या कोणत्याही फेरीत कोणतीही जागा वाटप न झालेले उमेदवार;
(तीन) सामाईक �वेश परीक्षा अहर्तापा� नवीन उमेदवार पवू�च्या कें �ीभतू �वेश �ि�येच्या फेरीमध्ये सहभागी (कें �ीभतू �वेश �ि�येचा अजर् नमनुा व िवकल्प नमनुा भरण्यात कसरू केलेले उमेदवार) झालेले नाहीत असे उमेदवार;
(ग) ज्या उमेदवारांना पिहल्या पसंती�मांकाखेरीज इतर पसंती�मांकावरील जागेचे वाटप झाले आहे आिण त्यांनी जागा स्वीकृती कायम करण्यासाठी संस्थेला कळिवले आहे अशा उमेदवारांना नवीन िवकल्प नमनुा भरताना त्यांना पवू�च्या फेरीमध्ये वाटप झालेला पसंती�म देणे आवश्यक नाही. एकदा वरच्या पसंती�माचे वाटप करण्यात आले की अगोदर करण्यात आलेले जागा वाटप गितशील वाटपाच्या अज�मळेु आपोआप र� होईल. जर उमेदवारास ितसऱ्या �वेशफेरीमध्ये जागा वाटप न झाल्यास, यथा�स्थती पिहल्या िंकवा दसुऱ्या फेरीमध्ये वाटप झालेली जागा आपोआप अबािधत राहील परंत ु उमेदवारास �वेश कायम करण्यासाठी �वेश उप�स्थती कें � आिण संबंिधत महािव�ालय / संस्थेत हजर व्हावे लागेल.
(घ) वाटप करण्यात आलेली जागा कायम करण्यासाठी वाटप करण्यात आलेल्या संस्थेमध्ये उप�स्थत होण्याच्यावेळी अज�मध्ये केलेल्या दाव्याच्या पषु्�थर् सवर् मळू कागदप�े सादर करील. त्यावेळी उमेदवाराने अज�मध्ये अशािरतीने केलेल्या दाव्याच्या पषु्�थर् मळू कागदप�े सादर करण्यात कसरू केल्यास ते जागा वाटप आपोआप र� होईल आिण ती जागा पढुील फेरीमध्ये वाटपासाठी उपलब्ध होईल;
(ङ) उमेदवार �वेश उप�स्थती कें �ावर मळू कागदप�े पडताळणीच्या वेळेस �वेश अज�तील खालील चकुा द�ुस्त क�न घेण्यास हक्कदार असेल, जसे,— (एक) िंलग बदल प�ुष व स्�ी आिण त्याउलट;
(दोन) परीके्षतील, सामाईक �वेश परीके्षतील गणु भरताना झालेली चकू. तथािप, गणुांतील वाढीमळेु पिहल्या गणुव�ा यादीतील गणुव�ा�मात बदल करण्यास परवानगी नसेल;
(तीन) जात, पोटजात, मागासवग�य �वगर् भरताना झालेली चकू. मागासवग�य �वग�तील उमेदवाराने यथा�स्थती जात �माणप�, जमाती �माणप�, वैधता �माणप�, उन्नत �वग�त मोडत नसल्याचे �माणप� इत्यादीसारखी आवश्यक ती कागदप�े सादर करण्यात कसरू करील तर, त्यास राखीव �वग�तनू सामान्य �वग�त बदल करण्याची परवानगी राहील ;
(चार) आधारभतू कागदप� सादर क� न शकल्यामळेु अल्पसंख्याक दज� काढून टाकणे ;
(पाच) आधारभतू कागदप�े सादर न क� शकल्यामळेु िवकलांग दज� काढून टाकणे ;
(सहा) आधारभतू कागदप�े सादर न क� शकल्यामळेु संरक्षण (Defense) दज� काढून टाकणे ;
(सात) उमेदवारी �कारातील बदल ;
(आठ) शैक्षिणक अहर्ता बदल.
¨É½þÉ®úɹ]Åõ ¶ÉɺÉxÉ ®úÉVÉ{ÉjÉ +ºÉÉvÉÉ®úhÉ ¦ÉÉMÉ SÉÉ®ú-¤É, VÉÚxÉ 14, 2019/VªÉä¹`ö 24, ¶ÉEäò 1941 5 वरील बाबींव्यितिरक्त इतर कोणत्याही बाबीत बदल िंकवा द�ुस्ती करण्यास परवानगी नाही.
(च) अितिरक्त फेरीच्या बाबतीत (घेण्यात आल्यास), वरील खंड (ख) मध्ये नमदू केलेल्या �वग�तील उमेदवार या फेरीत सहभागी होण्यास हक्कदार असतील व ते नवीन िवकल्प नमनुा भरण्यास हक्कदार असतील. अशा �करणी, उमेदवारास त्याला पवू�च्या फेरीमध्ये वाटप झालेला िवकल्प पसंती�माच्या यादीत भरण्याची गरज असणार नाही. एकदा वरच्या पसंती�मांकानसुार नवीन जागेचे वाटप करण्यात आले की, अगोदर करण्यात आलेले वाटप आपोआप र� होईल. जर उमेदवारास अितिरक्त �वेशफेरीमध्ये (घेण्यात आल्यास) जागा वाटप न झाल्यास, यथा�स्थती पवू�च्या फेरीमध्ये वाटप झालेली जागा आपोआप अबािधत राहील, परंत ु उमेदवारास �वेश कायम करण्यासाठी �वेश उप�स्थती कें �ामध्ये आिण संबंिधत महािव�ालय िंकवा संस्थेत हजर व्हावे लागेल.
(6) िविहत केलेल्या वेळाप�कानसुार उमेदवार त्यास अिंतमत: वाटप केलेल्या संस्थेमध्ये उप�स्थत राहील व त्या संस्थेतील त्याचा �वेश कायम करील. संस्था आवश्यक त्या कागदप�ांची पडताळणी करील व उमेदवारांचा �वेश संस्थेच्या लॉग-इन मधनू तात्काळ ऑनलाईन �णालीत टाकील (अपलोड करील) आिण उमेदवारास �वेश कायम झाल्याच्या पषु्टीसाठी ऑनलाईन �णालीतनू िमळणारी पावती देईल.”
5. मखु्य िनयमांच्या िनयम 10, उप-िनयम (1) मध्ये, -
(1) टप्पा- एक मध्ये , (एक) उप-खंड (क) नंतर पढुील उप-खंड समािवष्ट करण्यात येईल :— “(क-1) आ�थकदषृ्�ा दबुर्ल घटकातील व अनाथ उमेदवारांचा त्यांच्या परस्पर गणुव�ेच्या आधारे त्यांच्यासाठी राखनू ठेवलेल्या जागा वाटपासाठी िवचार करण्यात येईल आिण त्यांच्या संबंिधत राखीव �वग�त जागा उपलब्ध नसल्यास, परस्पर गणुव�ेच्या आधारे खलु्या �वग�तील जागा वाटपासाठी त्यांचा िवचार करण्यात येईल.”;
(दोन) उप-खंड (ङ) व (च) ऐवजी पढुील उप-खंड दाखल करण्यात येईल:— “(ङ) िदव्यांग �वग�तील उमेदवारांचा त्यांच्या परस्पर गणुव�ेच्या आधारे त्यांच्या �वग�त राखनू ठेवलेल्या जागा वाटपासाठी िवचार करण्यात येईल आिण त्यांच्या संबंिधत राखीव �वग�त जागा उपलब्ध नसल्यास, परस्पर गणुव�ेच्या आधारे खलु्या �वग�तील जागा वाटपासाठी त्यांचा िवचार करण्यात येईल.
(च) संरक्षण �वग�तील उमेदवारांचा त्यांच्या परस्पर गणुव�ेच्या आधारे त्यांच्या संबिधत �वग�त राखनू ठेवलेल्या जागा वाटपासाठी िवचार करण्यात येईल आिण त्यांच्या संबंिधत राखीव �वग�त जागा उपलब्ध नसल्यास, परस्पर गणुव�ेच्या आधारे खलु्या �वग�तील जागा वाटपासाठी त्यांचा िवचार करण्यात येईल.”;
(ख) टप्पा-चार, टप्पा-पाच व टप्पा-सहा र� करण्यात येतील.
6. मखु्य िनयमांच्या िनयम 12 मध्ये,— (एक) खंड (झ) मधील, “�वेश उप�स्थती कें �ावर, सक्षम �ािधकाऱ्याच्या नावे दशर्नी धनाकषर् जमा करावा लागेल” या मजकुराऐवजी “उमेदवाराच्या लॉग-ईन मधनू जागा स्वीकृती शलु्क भरावे लागेल” हा मजकूर दाखल करण्यात येईल.
(दोन) खंड (ञ) ऐवजी, पढुील खंड दाखल करण्यात येईल: — “(ञ) �वेश िदलेल्या सवर् उमेदवारांसाठी जागा-स्वीकृती शलु्क हे �.1,000 एवढे असेल व हे शलु्क ना-परतावा असल्याचे मानण्यात येईल;”.
(तीन ) खंड (ढ) ऐवजी, पढुील खंड दाखल करण्यात येतील:- “ (ढ) उमेदवाराने �वेश अज�मध्ये त्याच्या �वेशाशी संबंिधत केलेले कोणतेही िवधान िंकवा िदलेली कोणतीही मािहती खोटी िंकवा चकुीची असल्याचे आढळून आल्यास, �ाचायर् अशा उमेदवाराचा �वेश र� क�न शलु्क जप्त करील. �वेश र� करण्याच्या कारवाई िव�� सक्षम �ािधकाऱ्यासमोर सात िदवसांच्या आत अपील दाखल करता येईल. सक्षम �ािधकारी त्या अिपलावर पंधरा िदवसांच्या आत िनणर्य देईल आिण त्याचा िनणर्य अिंतम असेल.

7. मखु्य िनयमांच्या िनयम 13 मध्ये,— (एक) खंड (ग) मधील “समक्ष �ािधकरणाने िन�श्चत केलेली देय रक्कम भ�न, सक्षम �ािधकाऱ्याच्या संकेतस्थळावर आिण” हा मजकूर वगळण्यात येईल ;
(दोन) खंड (ङ) मधील “संस्था” या मजकुराऐवजी, “संस्था सवर् आवश्यक त्या कागदप�ांची पडताळणी केल्यानंतर ” हा मजकूर दाखल करण्यात येईल ;
(तीन ) खंड (च ) च्या ऐवजी पढुील खंड दाखल करण्यात येईल :— “(च) अल्पसंख्याक िंकवा अल्पसंख्याकेतर संस्था िविन�दष्ट केलेल्या पा��मांच्या संस्थास्तरीय को�ातील जागा (अंशत: िंकवा पणूर्त:) कें �ीभतू �वेश �ि�येला �त्य�पत करण्यास इच्छुक असेल तर ती कें �ीभतू �वेश �ि�येच्या पिहल्या फेरीतील जागांचे वाटप �द�शत करण्याच्या दोन िदवस अगोदर कळिवल आिण त्या जागांचे, कें �ीभतू �वेश �ि�येच्या िनयमांनसुार वाटप करण्यात येईल. तद्नंतर, संस्थास्तरीय को�ातील जागा �त्य�पत करण्याची मभुा त्या संस्थेला असणार नाही ;”
8. मखु्य िनयमांच्या िनयम 15 ऐवजी, पढुील िनयम दाखल करण्यात येईल :— “15 �वेश र� करणे व शलु्काचा परतावा, संस्थे�ारे कागदप�े परत करणे:- (क) उमेदवार �वेश र� करण्यासाठी ऑन-लाईन िंकवा ऑफ-लाईन प�तीने अजर् करील आिण �वेश र� करण्यासाठी असलेल्या, �णाली िन�मत अज�ची िंकवा हस्तिलिखत अज�ची स्वाक्षरीत �त संस्थेला सादर करील. उमेदवाराने �वेश र� करण्यासाठी ऑनलाईन िंकवा ऑफ-लाईन प�तीने िवनंती सादर केल्यानंतर, त्या उमेदवाराचा �वशे र� झाला असे समजण्यात येईल. उमेदवाराने �णाली िन�मत अज�ची िंकवा हस्तिलिखत अज�ची यथोिचतिरत्या स्वाक्षिरत �त संस्थेला सादर केली िंकवा कसे हे िवचारात न घेता, संस्था, उमेदवाराने �वेश र� करण्यासाठी ऑनलाईन िंकवा ऑफ-लाईन प�तीने सादर केलेली िवनंती अंितम मानील. अशा �कारे जागा र� केल्यावर, उमेदवार त्या जागेवरील हक्क गमवील व ती जागा पढुील वाटपासाठी उपलब्ध होईल. तद्नंतर, उमेदवार शलु्क परताव्याचा दावा क� शकेल व �णाली िन�मत अज�ची िंकवा हस्तिलिखत अज�ची यथोिचतिरत्या स्वाक्षिरत �त संस्थेला सादर केल्याच्या दोन िदवसांच्या आत, संस्था, �ि�या शलु्क म्हणनू �पये 1,000 वजा क�न उवर्िरत संपणूर् शलु्काची रक्कम परत करील आिण संस्थेला सादर केलेली सवर् मळू �माणप�े उमेदवारास परत करील ;
(ख) वरील खंड (क) मध्ये काहीही अंतभूर्त असले तरी, सक्षम �ािधकाऱ्याने िवहीत केलेल्या �वेशाच्या अंितम िदनांकाच्या िदवशी सायंकाळी 5-00 वाजल्या नंतर जर उमेदवाराने �वेश र� करण्यासाठी ऑनलाईन प�तीने अजर् केला असेल तर, उमेदवार �ितभतूी ठेव आिण तारण धनठेव यांव्यितिरक्त कोणत्याही शलु्काचा परतावा िमळण्यास पा� असणार नाही;
(ग) कोणतीही संस्था, िजच्याकडे एखा�ा व्य�क्तने ितची पदवी, पदिवका, िंकवा अन्य कोणताही परुस्कार िंकवा इतर कागदप�े �वेशासाठी जमा केलेली असतील िंकवा ितच्या ताब्यात असतील तर, ती संस्था अशा व्य�क्तवर अशा संस्थेमध्ये ती कोणताही अभ्यास�म िंकवा अध्ययन�म पढेु चाल ू ठेवण्यासाठी िंकवा त्या संस्थेतील सिुवधा घेण्यासाठी इच्छुक नसताना कोणतेही शलु्क िंकवा शलु्क भरण्यास दबाव टाकण्याच्या िंकवा सक्ती करण्याच्या उ�ेशाने अशी पदवी, पदिवका, परुस्कार िंकवा इतर कागदप�े उमेदवारास परत करण्यास कोणत्याही �कारे िवरोध करणार नाही ;

NOTIFICATION MAHARASHTRA UNAIDED PRIVATE PROFESSIONAL EDUCATIONAL INSTITUTIONS (REGULATION OF ADMISSIONS AND FEES) ACT, 2015.
No. Vidhi-2019/C.R.79/Mashi-2.— In exercise of the powers conferred by section 23 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions and Fees) Act, 2015 (Mah.
XXVIII of 2015), the Government of Maharashtra hereby makes the following rules further to amend the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Law Courses) Rules, 2017, namely :—
1. These rules may be called the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admission to the Full Time Professional Undergraduate Law Courses) (Amendment) Rules,
2019.
2. In rule 4 of the Maharashtra Unaided Private Professional Educational Institutions (Regulation of Admissions to the Full Time Professional Under Graduate Law Courses) Rules, 2017 (hereinafter referred to as “the principal rules”), sub-rule (3) shall be deleted.
3. In rule 8 of the principal rules,—
(i) for sub-rule (2), the following sub-rule shall be substituted, namely :— “(2) Change of Marks due to verification.—If the marks in the qualifying examination are modified due to verification and the same is duly certified by the concerned Appropriate Authority or Board, the same shall be reported to the Competent Authority for admission through Centralized Admission Process (CAP) or its designated representatives prior to 5 p.m. on the day of display of final merit list.”;
(ii) in sub-rule (3), for proviso to sub-clause (I), the following proviso shall be substituted, namely:
“Provided that, in case of tie, the relative merit of Candidates shall be resolved in the following order of preference and the methodology as specified below,—
(a) Three Year Degree Course (LL.B.)—
(i) first preference shall be given to the Candidate having Post Graduate degree of statutory University;
(ii) higher percentage of marks in Post Graduate degree of statutory University;
(iii) higher percentage of marks in Qualifying undergraduate examination;
(iv) higher percentage of marks in aggregate at HSC or equivalent examination;
(v) higher percentage of marks in aggregate at SSC or equivalent examination;
(vi) older in age.
(b) Five Year Integrated Degree Course (LL.B.)—
(i) higher percentage of marks in Qualifying Examination i.e. HSC or equivalent examination;
(ii) higher percentage of marks in first language at HSC or equivalent examination;
(iii) higher percentage of marks in SSC or equivalent examination;
(iv) higher percentage of marks in English at SSC or equivalent examination;
(v) older in age.”.
4. For rule 9 of the principal rules, the following rule shall be substituted, namely:— “ 9. Centralized Admission Process (CAP).— (1) The Unaided Private Professional Educational Institution shall admit Candidates through the Centralized Admission Process (CAP) as referred to in sub-section (3) of section 3 of the Act. The stages of Centralized Admission Process (CAP) shall be as stated below,-
(a) Display or publishing of Information Brochure by the Competent Authority in consultation with the concerned Directorate;

(b) Filling online application form by Candidate for participation in the Centralized Admission Process (CAP);
(c) Uploading of scanned images of valid necessary original documents as per the requirement of the admissions while filling of online application form;
(d) Document Verification at Admission Reporting Center by the Candidate. It is mandatory on the Candidate’s part to produce all original document in support of the claim made in the application form;
(e) Display or publishing of provisional merit lists, submission of grievances, if any, and display or publishing of final merit lists;
(f) Display of available Category wise Seats (Seat Matrix) available for respective CAP Rounds;
(g) Filling up and confirmation of online option form having preferences of Institutions prior to CAP Round-I and CAP Round-III. Candidates may fill in performances of Institutes in decreasing order of their preference as specified by the Competent Authority. The option form once confirmed prior to CAP Round-I shall be considered for allotment in the CAP Round-I and II and the option for confirmed prior to CAP Round III shall be considered for allotment in CAP Round III only;
(h) Display of provisional allotment of respective CAP Rounds indicating allotted institute;
(i) Candidate shall accept the offered seat by paying seat acceptance fee at Admission Reporting Centre (ARC) from Candidate’s login as per the schedule declared by the Competent Authority;
(j) Only after seat acceptance as per clause (i), the Candidate should report to the allotted institute for seeking admission on the allotted seat as per final allotment in CAP rounds;
(k) The time schedule prescribed by Competent Authority for compliances for various stages of CAP is mandatory.
(2) Conduct of CAP Round –I.- The seats available for Round-I shall be published on the website.
The Candidate whose names appeared in the final merit list of CAP shall be eligible to participate in this round by filling online option form. The Candidate shall fill and confirm the option form through Candidate’s Login.
(3) During the CAP .—
(a) If a Candidate is allotted the seat as per his first preference, such allotment shall be auto freezed and the Candidate shall accept the allotment so made. Such Candidate shall then be not eligible for participation in the subsequent CAP rounds. Such Candidates shall then report to ARC for verification of documents and payment of seat acceptance fee through Candidate’s Login. Thereafter such Candidate shall report to the allotted institute and seek admission on the allotted seat. If such Candidate does not report to ARC for confirmation of seat acceptance, their claim on the allotted seat shall stand forfeited automatically and the seat shall become available for fresh allotment. For such Candidate, the allotment so made shall be the final allotment;
(b) Candidate who have been allotted seat other than the first preference given by the Candidate and if the Candidate is satisfied with such allotment and do not wish to participate in further CAP rounds, such Candidate can freeze the offered seat through Candidate’s Login. Once the Candidate freezes the allotted seat, such Candidate shall then report to ARC for verification of documents and payment of seat acceptance fee. Thereafter such Candidate shall report to the allotted institute and seek admission on the allotted seat. For such Candidate, the allotment so made shall be the final allotment. If such Candidate does not report to ARC for confirmation of seat acceptance, their claim on the allotted seat shall stand forfeited automatically and the seat shall become available for fresh allotment. The Candidate who freezes the seat shall then be not eligible for participation in the subsequent CAP rounds;
(c) Candidate who have been allotted seat other than first preference and accepted the seat by reporting to the ARC for confirmation of seat by paying the seat acceptance fee through Candidate’s Login shall be eligible for participation in the subsequent rounds for betterment;
(d) Candidate who have been allotted seat other than first preference and not accepted the seat by not reporting to ARC for confirmation of seat acceptance and not paying the seat acceptance fee through Candidate’s Login shall be eligible for participation in the subsequent rounds.
(4) Conduct of CAP Round II.—
(a) The seats available for Round II shall be published on the website.
(b) Round II will be betterment Round for those Candidates who have been allotted seat other than first preference and who have been not allotted any seat in Round-I.

(c) There shall be no further betterment option available to the Candidate after Round II. The allotment made and/or allotment retained in Round II shall be final.
(5) Conduct of CAP round III.
(a) The seats available for Round III shall be published on the website.
(b) The Candidates eligible for Round III are allowed to fill in and/or edit online option form filled in by the Candidate for the previous round. The CET qualified Candidates who has failed to register themselves before CAP Round I for the Centralized Admission Process (CAP) shall be eligible to register for Centralized Admission Process (CAP) before Round III. But the Merit List of such newly registered Candidates will be published separately and they will be placed below the Candidates whose names have been published in the first Merit List. The seats to be allotted during these rounds shall be available to the eligible Candidates falling under the following categories :––
(i) Candidates as per the sub-rule 3 (c) and 3(d) above;
(ii) Candidate who have not been allotted any seat in any of previous rounds;
(iii) CET Qualified newly Candidates who did not participate (failure of filling CAP application form and option form) in previous round.
(c) Candidates who have been allotted seat other than first preference and reported to Institution for confirmation of seat acceptance, whilst filling fresh option form, he need not fill the preference already allotted to the Candidate in the previous round. Once upward preference is allotted to such Candidate, his earlier seat allotment shall stand automatically cancelled due to application of dynamic allocation. If the Candidate is not allotted seat in Round III, the seat allotted in Round I or II, as the case may be, shall be retained automatically but the Candidate will have to report to ARC and Concerned College or Institute for Confirmation of Admission.
(d) At the time of reporting to the allotted college on Institution for confirming the allotted seat, the Candidate shall submit all the original documents in support of the claims made in the application. In that event, if the Candidate fails to produce the documents in support of the claims, so made in the application, the allotment shall stand cancelled automatically and the seat shall become available for allotment in further rounds;
(e) The Candidate will be entitled to rectify the following errors in the application form at the time of scrutiny of documents at ARC viz.
(i) change of gender from male to female and vice-versa;
(ii) error while entering marks obtained by Candidate in examination, CET. However, the change in the merit number declared vide First Merit List due to increase in the marks will not be permitted.
(iii) error with mentioning the caste, sub-caste, the category of backward class. A reserved category Candidate will be allowed to change his category from Reserved to General upon his failure to submit requisite documents like Caste Certificate, Tribal Certificate, Validity Certificate, Non-Creamy Layer Certificate, etc. as the case may be.
(iv) removal of minority status due to failure of submission of supporting documents;
(v) removal of Disability status due to failure of submission of supporting documents;
(vi) removal of Defense status due to failure of submission of supporting documents;
(vii) Change in type of Candidature;
(viii) change in Qualification.
Apart from the above, no other change or rectification shall be allowed.
(f) In case of additional round (if any), the category of Candidates mentioned in clause (b) above shall be entitled to participate and will be entitled to fill in fresh option Form. In such case, the Candidate need not fill in the previously allotted preference in their preference list. Once the upward allotment is made, the earlier allotment shall stand automatically cancelled. If the Candidate is not allotted seat in additional round (if any), the seat allotted in previous Round as the case may be shall be retained automatically but the Candidate will have to report to ARC and concerned College or Institute for Confirmation of Admission.

(6) The Candidate shall report to the institution finally allotted to him and confirm his admission in College or Institution as per the schedule. The College or Institute shall verify the required documents and upload the admission of the Candidates in the online system through Institute Login immediately and shall issue a system generated receipt of confirmation of admission to the Candidate.”.
5. In rule 10 of the principal rules, in sub-rule (1),-
(a) in clause (i), in Stage – I,
(i) after sub-clause (a) the following sub-clause shall be inserted, namely:–– “(a-1) Economically Weaker Section (EWS) and Orphan Candidates shall be considered for allotment of seats reserved for them as per their Inter-Se-Merit, and if seat is not available in the respective reserved category, then they shall be considered for allotment in Open Category as per the Inter-Se-Merit.”;
(ii) for sub-clauses (e) and (f) the following sub-clauses shall be substituted, namely:— “(e) Persons with Disability Category Candidates shall be considered for allotment of the seat reserved for them in their respective category, as per their Inter-Se-Merit and if seat in their respective reserve category is not available, then they shall be considered for allotment in Open Category as per their Inter-Se- Merit.
(f) Defence Category Candidates shall be considered for allotment of the seats reserved for them in the respective category as per their Inter-Se-Merit and if seat in their respective reserve category is not available then they shall be considered for allotment in Open Category as per their Inter-Se-Merit.”;
(b) the Stage – IV , Stage –V and Stage – VI shall be deleted.
6. In rule 12 of the principal rules, ––
(i) in clause (i), for the words “a demand draft in favour of Competent Authority at and Admission Reporting Centre” the words “seat acceptance fee through Candidate’s Login” shall be substituted;
(ii) for clause (j), the following clause shall be substituted, namely: –– “(j) The seat acceptance fee shall be Rs. 1000/-, for all admitted Candidates and the same shall be treated as non- refundable.”;
(iii) for clause (n), the following clauses shall be substituted, namely: –– “(n) If any of the statement made in application form or any information supplied by the Candidate in connection with his admission is found to be false or incorrect, the Principal shall cancel his admission and forfeit the fees. An appeal against the action of cancellation of admission, may be preferred within seven days to the Competent Authority. The Competent Authority shall decide the appeal within fifteen days and his decision thereon shall be final.
(o) Complaints regarding the use of fake certificates to be investigated in time bound manner and if found guilty, such admission shall be cancelled. Further, appropriate action shall be initiated with due intimation to Competent Authority.”.
7. In rule 13 of the principal rules, ––
(i) in clause (c), the words “ of Competent Authority by paying charges as decided by Competent Authority and on the website” shall be deleted;
(ii) in clause (e) for the words “The institution shall” the words “The institution after verification of all required documents shall prepare and” shall be substituted;
(iii) for sub-clause (f), the following sub-clause shall be substituted, namely: –– “(f) The Minority or Non-Minority institution intending to surrender the Institutional Quota (in part or full) of specified courses to the CAP shall communicate two days before the display of seat matrix of CAP Round I and the same shall be allotted as per the rules of CAP. The institute shall not be allowed to surrender Institutional Quota seats thereafter.”.

8. For rule 15 of the principal rules, the following rule shall be substituted, namely: –– “ 15. Cancellation of admission and refund of fees, return of documents by Institutions:––
(a) The Candidate shall apply online or off line for cancellation and submit duly signed copy of system generated application or hand written application for cancellation of admission to the Institution.
Once the Candidate submits online or off line request for cancellation, his admission shall be treated as cancelled. The Institute shall consider the online or off line request made by Candidate for cancellation as final irrespective of whether he has submitted duly signed copy of system generated application or hand written application to the institute. Upon such cancellation, the Candidate shall lose the claim on the seat and such seat shall become available for further allotment. The Candidate shall then become entitled to and the institute shall refund the entire fee to the Candidate after deduction of Rs.1000/- towards processing charge and refund all his original documents submitted to the Institute within two days form submission of duly signed copy of system generated application or hand written application to the institute.
(b) Notwithstanding clause (a) above, Candidate shall not be entitled to any refund of his fee except the Security Deposit and Caution Money Deposit if the online cancellation is effected by the Candidate after 5.00 p.m. of the cut-off date prescribed by the Competent Authority.
(c) No Institution, who has in its possession or custody, of any document in the form of certificates of degree, diploma or any, other award or other document deposited with it by a person for the purpose of seeking admission in such Institution, shall refuse to return such degree, certificate, award or other document with a view to induce or compel such person to pay any fee or fees in respect of any course or program of study which such person does not intend to pursue or avail any facility in such Institution.
(d) The Institution shall not recover the fees for the subsequent years from the student seeking cancellation of his admission at any point of time.”.
