‘ THE MANIPUR INTERNATIONALUNIVERSITYACI‘, 2018 (MANIPUR ACT No.2 OF 2019) AN to establish, create and incorporate a fidI-fledged qualily teaching, training, researching and qfiiliatz’ng multi model University and an international Institution which is to be called as “Manipur International University” in the State of Manipur fbr pursuit of intellectual, philosophical, historical, spiritual, scientific, profissional and vocational studies at all subjects and at all levels and for matters connected therewith or incidental thereto in the State of ' Manipur. .
WHEREAS, it is desirable to establish a University to provide quality training and education for the encouragement of higher education, vocational studies, ' skill development, and research in the State of Manipur.
AND WHEREAS, it is deemed necessary to establish an International Institution in Manipur to impart quality education to the masses as Manipur International University by this Act, to provide education and training at ‘ all levels in all subjects. The University shall be established through a unique public-pxjvate pammship model without exerting any economic burden on the State or public;
3 ~ AND WHEREAS, the Government of “India clearly mentions and upholds in the cahStitution“t11e"1ight to education as one of the ftmdamental rights guaranteed to every citizen barn'in this la‘nd,theUnive1-sity béliev'es in the constitution and aims at boosting? and reviving the _ spirit of education; ' Hence, thewUniv'ersity intends to countertthe menace Ofcommetcialization of education and for the same reason, believes that merely securing certificates does not contribute to student's overall growth and employable skills; moral values, management skills, holistic approach, modem education111 a traditional manner ‘ are essential; ‘ ~ AND WHEREAS, Article 26 of the Universal Declaration ofHuman Rights Of the Unitecl Nations also mandates and upholds that everyone [has the right to education. It also V proposes that the higher education shall be eqttally accessible to all 011 the basis ofmerit;
AND WHEREAS, it is an ardent desire of the planners to steer towards a more job-oriented education whieh promotes the supply of manpower commensurate with the needs of the society, improvement of the standards, to assess the contribution of the teaching fratemity and so on The objective of enforcing a few of its specific recommendations, it will be to effeet~-icertain'st1'uctural alterations, in the direction of.‘ improvement in the functioning of Universities and the education system;
ANDWHEREAS, the 'prOposing body approached the Government of Manipur! after noticingthe progressive and positive attitude of the Manipur Government and the people and the Government of Manipuzj reciprocated positively to support this mission and this unique project ' which shall serve as a role inodel for the rest of the world and mark as a milestone to the Free Education Movement and contribute towards the de-commercialization of education;

(g) “Founder”, “Additional Founder” and “Co-Founder” “ mean, respectively, the Founder, Additional Founder - and Co-Founder of the Universityas appointed under this Act; '
(h) “Governing Board” meansthe Governing Board of the University;
(i) "Hall” meansa unit ofresidence or of corporate life for ' the students of the University, or of-a College or an institution, maintained bythe~Uniyersity; '
(i) “Institution” meansah wademic institution, not being a‘College, maintained or affiliated or recognized by the University; ‘ '
(k) “Manipur” means the Indian State of Manipur and all the areas undertheadministrative central of State Government ofManipur unless specified otherWise;

(11) “Regulations”means the Regulations made by any authority of the University under this Act for the time being1nforce;

(r) (S) (0 (U) “Rules” means the Rules made by theChancellor of the University under, this Act forthe time being in force;
"State" or “State Government” or "Govei-nment" means the State of Manipur or the Government of Manipur, unless specified otherwise;
“Statutes” and»“01dinanoes”‘mean, respectively, the Statutes and the Ordinances of the University made under this Act for the time being1n forceexcept as stated otherwise; , "Student” means Studentofthe University91 a person enrolledintheunimityfertakingaeourseofsmdy for a degree, diploma .or other academic distinction duly instituted by the eniversity, including a research degree;

- (v) "UGC Act" means the University Grants Commission (Central Act 3 Act, l9;56
(w) "UniversityGrants Cemnii3sion" or"UGC" means the University Grants Commission(UGO) established under section 4 of the University Grants Commission Act, 1956; - = of 1956) (Central Act 3 of 1956) Establishment and Incorporation ofManipur International University.

3. (I) There shall be established and incorporated a "UniVersity by the name and style of "Manipur Ihtemational University”, as an autonomous body ' corporate which shall enjoy full legal competence to pursue its activities and objectives, financial, academic and administrative independence and ,- autonomy; to discharge its business in the State ofManipur , I (2) Themain campus,headquarters and admmistrative ' “Campusof the University shall be,”in the Stateof Manipiir and shall not be shifted outside the State Whatsoever.
(3) The University shall establish a minimum of seven campuses Of the University offering quality education1n differem streams across the State of Manipur‘ and there shall have at least one campus which shall offer free/ nearfree/ fiee-ship/ subsidized ed11cation.>~ 4
(4) The University may establish,afliliate, recognize or maintain campus, off-campus,admhlist1ative campus, constituent college, training centre, regio11al centre, school, college, study centre, learning cenfi'e,res'ea1ch stations. extension centres, finishing schools anywherein the State of 1143de and elsewhere/anywhere111 India as it may deem fit;
ProVid‘ed that the Universi1y may, with the approval of Governing Board, establish siich ce11‘tres anywhere outside ofIndia or overseas as may be permissibleunder relevant laws ofthe land '
(5) The University shall be a body corporate and body politic by the name and style as “Manipur Idternational University” and shall have perpetual succession and a:
common seal with the power to acquire; alienate, assign, bequest, demise, deviSe, gift, grant, hold, ,bypothecate, lease,.mortgage, rent,::se‘lh or 1:0 takemnd dispose of any property, movable and imniovable, - including Rust property and endowments,’which may 'be or may have become or deemed to be vested in or acquired by the University for 'the purpose of the University and to contract, anddto do all: things and acts nmsary for the purpose of its constitution and may‘sue‘orbe sued byits corporate name as aforesaid. (9) The University shallbeafally empoWered/ authorized/ fulI-fledged aeerediting, affiliating, educating, degree g1anting, teaching, training, researching, examining, certifying and recognizing body subjeet to observance of relevant guidelines of the UGC.
(10) No institution afliliatedto or fiaintained by any other _ University'111 the State of Manipur shall be afliliated with the University for any purpose, except with the prior approval of the concerned University or the State Government01both asthe case maybe.
41(1) It1s hereby declared that the institution l010wn from now as the Manipur International University shall be an “International University ofExcellence? and “Institution of State Importance”.
(2) By the virtue of this Act, the Univers11y is hereby declared and is eligible to call itselfas “An Autonomous _ Public International University of State Importance and Exeellenoe?‘ 01 in parts as it maydeem fit. 1
5.0) The University shall be a self-finaneing Universtty and hereby dedicated tothe Nation andtothe service of the mankind. ,_ a
(2) The University shall befullyautonomousand self- - governing. The management and administration of the University shallcompletely lay01' rest with theGoverning Board. .1-
(3) The Government ofManipnr;stallfines;shat! notbe 9 , considered responsible in regardvto anyadw or financial orother commitmentsrelawd to the University or to" any of its subordinate bodies owned totally or partially by it.’
(4) The University shall notmake a demand- for any grantin—aid' or any othet financial assistanee: from the State Govemment or .anygother bodyeecorporation owned or controlledby the State Government. \ '
Provided that voluntary donation ofany kind from anybody including the State shall be accepted and acceptable by the University;
Provided fi1rther that the State, at its discretion, may providevfinancial or. any other support throughgrants~01 otherwise; for research, development and other activities for which other State Government" organizations are provided with financial assistance-‘or for any Specific research or prograins receiving » support fmm the Government; and for the benefit of other Universities in the State whether subject to a change in State policy or otherwise; for the rural development and youth empowerment '01 for any other purpose which the State Government may think‘fit:
Provided also that the State, at its discretion, may also provide / grant! gift or assign free or subsidized land or any other movable ' or immovable property to" the University anywhere in the Sfite for the University or £01 building University theilities or for doing UniVersity activities including but not limited to research. agriculture and other purposes: ' '
Provided also thatthe Universitymay receive any kind of support, donation, deposit and property either movable or immovable from any source at its discretion and at its own terms and it shall be as allowedas per law ofthe land.
(5) The proposing body shall provide all the support for the establishment ofthe University with all such assistance which it may bem need. It shall also be responsible for raising the necessary finance towards the establiShment and maintenance ofthe University.

6.(1) Unless specified otherwise in any other law for the time being in force, the University shall have absolute and exclusive academic, administrative, financial, managerial .. and Statutory autonomy and fi‘eedom, including the exercise of exclusive powers with respect to a) management and administration 01 the university; b) the fot111ulation and adoption of its academic policies and standards; c) formulation and collection of all kinds offees .etc; (1). therestablishmem of its standards for admission and ' graduation; e) the selection, appointment, suspension and .removal of its stafi', including, employing and employment of Faculty, Officers, Teachersand other employees on such terms and conditions as may be prescribed by this Act,its Statutes, Ordinances,rules, and regulations.
(2) The management, administration, and control of the peoperty, revenues, businessand afi‘airs of the University are hereby vested with the Governing Board and the Chancellor.
7.(l) The University shall be non-profit,for charity, and self-finaneing University with autonomous administration/ management with full powers, which shall seek support from its donors, volunteers, scholars, philanthropists and from other sources including but not limited to consultancy and research. .
(2) The University shall be self-Goveming, fully - autonomous,and it shall be accountable to theChancellor and to theGoveming Board ofthe University. .
(3) The University Shall be a not-for-profit legal entity and no. partofthe surplus, if any, in reyenpegftheeUniversity, ' after meeting all expenditure, in regard ,to its operations under this Act, shall be invested :h'or, any purpose other than for the growth and development of the University or achievement of its objectives or for eonducting research therein.
(4) The University shall stavetoraise funds for selfsufficiency, s_ustair'whilityA and future deyelopmentof the , Exemption.

8.(1) The donations, gifts, grantsor income received by, any income soume and properties of the University shall beexemptec!from my kind 0f tax as are petmissible! under relevant statutoryprovisions fromtime to time.
(2) The University shall be eli§151e to apny and may apply for all other tax exemptions (for example: tax exemption for the donations at the hands of the donor), . necessary registrations, and permissions under any seetion of the Income-Tax Act, 1961 0: tin Foreign Contribution (Regulation Act), 2010 or any otherCentral 01StateActor with any authon’ty as may be tequired and as it maydeem necéSsary ‘

(2) The University can receive any type‘of land as a gifi or purchase the same from anybody, any person or any organization irrespective of caste, creed and religion or type oforganisation subject to the restrictions under section 158:of the Manipur Land Revenue and Land ReformsAct, 1960 on transfer of land by a person who is a memberofthe scheduled tribes.

(3) Being a State University established under aState Act shall have the full right of conferringor grdnting degrees and it shall be competent and eligible to award degrees as specified by University Gxants Cominission under section 22 of the UGC Act. (2) The University shall also establish a unique walk in, study and get certified International Skill Training school in various parts of the State which shall be openedto all and the courses taught in thateentreshall be free of cost to the 7 students with twenty percent of the seats reserved for' students fine: the State omehpur.
20.0) The University1s empoweted toestablish, create, accredit and to recognize constituent colleges/ eentres/ schools/ institutes and bodies underthemanagement and control ofthe University. ' , . 1
(2) The constituent colleges! centres/ sehools/ institutes and bodies shall be established and managed by the University as per their respective Ordinances. Name of 1 such Institutes shall be as per the decision of the Goveming Board.
(3) The University may also cellaboifate with esteemed houses, corporate bodies, embaSsies; consulates, diplomatic missions and organizations for“ the establishment of specialized institutes/colleges and for the introduction of special courses after observing due process through the concerned Ministries, Agencies etc. as may be required.
21.0) The tWenty percehtage of the seats in all the regular courses conducted on the main campus ofthe University in the State shall compulsorily be reserved exclusively for the students domiciled in the State of Manipur or State - Subjects or legal residents of State of Manipur or these belonging to the State origin including the indigenous population of Manipur origin at all times. The policy for reservation of such seats shall be developed by the University1n association with the State.
1 (2) The UniversityShall make p‘roV‘isions for'resei'vation of non-teaehing, non-administrative pests of the University inside the State Of Manipur for persons domiciled in the State of Manipur to the extent of at least. fifly percent of thetotal number of non-teaching/non-adxnixfistrative employees ofthe Universityinside the StateofManipur. 22. The Univei'sity shall ihvestor make or bring a minimum invesanent of six"billion Indian, rupees either directly or indirectly in 01" to theState of Manipu‘r within Special Reservation in the University for persons domiciled in the State of Manipnr.

23.(1) Upon passage of this Act, the University shallsoon establish 11 Permanent Endowment Fund for the University with a minimum amountgfitwo crore‘ (twenty million) Indian rupees, by the way of fixed deposit in a nationalizedv'bank and shall own or acquire or possess a minimum of 30 acres of "contiguous land anywhere in the State ofManipur either bought or 011 a longterm lease or -- on a permanent contract.
(2) A complianee report along with an affidavit to this effect by the Chancellor duly attested before the First Class Judicial Magistrate shall be submitted to 'the State Government as soon as this mandatory requirement as __ mandated1n the sub section (1)1s fulfilled.
(3) The mandatory requirement as imposed under this section shall deem to be fulfilled by the University upon such submission asstated1n sub section (2).
(4) UponreceiVing the compliance report and affidavit as statedin sub sectiOn (2), the State Government shall issue ‘ anotification, of such compliance, stating the facts including the fact that University has fidfilled its mandatory requirement as required by this section of this Act and by thus, allowing the. University to start its 11111.“ fledged operations and admit the students. (18) The ChaineelchII'I~ shall be responsible for the execution of policies and measures approved by the Governing Board in relation to the University and, subject to such policies, the direction, supervision, and Control of the university, including its administration;
and for the maintenance of discipline within the University and any ofIts eenters.

(i) any other matter which by this Act or the Statutes is to be,‘ or may be provided for by the Ordinances
(2) The first Ordinances shall be made by. the Governing Beard with the previous approvai of the Chancellor and .the Ordinahces so made may be amended, repealed or added to at any time by the Governing Board, in the manner prescribed by the Statutes.

(2) Whoever contravenes the provisionsofthis Act or the 65 Statutes, the Ordinances, Rules, and Regulations made there under or any· examination matters or in matters relating to award of degrees or .in giving marks· cards without such authority to do so or unless authorized I without any permission by the Chancellor shall be a cognizable offe1tce and shall on convfctionbe punishable with a minimum fine of rupees ten million which may extend to rupees hundred million or with an imprisonment for a' term of six months which may extend ' to five years or with both.
(3) Notwithstanding anything contained in this Act. or in any other law, for the time being in force, no person or> :
institution other than the University, shall confer, grant or issue or hold himself or itself out as entitled to confer, ' ' ' grant or issue any degree, .dlplomaor certificate which is identical with or is.a colorable itr.ttation of any degree, .
diploma or· certificate conferred, granted or issued by the University; '
(4) Contravention of the provisions of sub-section (3), shall be a cognizable offense and shall on conviction be punishable with a minlnruui fin€ of rupees ten milJion which may extend to rupees hundred million or with an imprisonment for a term of six months which may extend to five years or with both.
(5) Where an offence under· this section has been committed by a· company, the company as well as every person in charge of, and responsible to, the company' for the conduct of its business at the time of the commission of the offence shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished . accordingly;

83.(l) All Statutes, Ordinances and· Regulations. made under this Act shall in so far as they are not inconsistent with 'the provision of this Act, be deemed to have been made under this Act and shall ,oondnuc to·? ,in force until they are superseded or modified by the Statutes, Ordinances, Rules or ?egulationsmade under this Act.
(2) All · notices and orders, made or issued by any ·. authority under this Act shall in so far as they are not inconsistent \Viththe provisionsof this Act. be deemed to have been mad? or issued by the 'corresponding authority · under thi.?Act and shall continue to be in force until they are supersededor modified .Ypderthis Act.
(3) A person who. holds any office in the University by · virtue of his holding any other office of the University or, otherwise shall hold such office as long as he holds the other office and then:aftertill his. successor is duly nominated, appointedor elected.

Ordinances, Rules, and Regulations by vacancies, made thereafter. and under this Act, shall be invalid merely by reason of - (a) any vacancy in, or. defect in the constitution' thereof; or (b) any defect in the election nomination or appointment of a person acting as a member thereof; (c) any irregularity in its .procedure not affecting the meritsof'the case.

98.Every Statutes, Ordinances, Rules or Regulations made under this Act shall be published rn the Official Gazette of the State and the Official of the Universrty, Delegation of 99.(1) The University may delegate such as Powers. it may deem expedient to any of its authorities or tQ any of his officers, an.d may, at any rirne, withdra,v at its discretion any power so delegated.
(2) Subject to the provisions. of this Act and the Statutes, any officer or authority of the University may delegate his or its pow.ers to any other officer or or person under his or its respective control and subject to the condition that overall responsibility for exercise of the powers so delegated shall continue to vest in the officer or authority delegating such powers.
Savings 100. Anything done or any action taken under the Ordinance Manipur International University Ordinance, 2018 shall No. I of2018 be deemed to have. been done or taken under the corresponding provisions of this Act.
