Long title1. Short title and commencement'-(1) These rules may be called the Maritime Zones of lndia (Regulation of Fishing by Foreign Vessels) Rules, 1982. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Definitions.-In these rules, unless the context otherwise requires:- (a) “Act" means the Maritime Zones of India (Regulation of Fishing by Foreign Vessels Act, l98l (42 of1981) ; (b) "crew" includes the team of technical, semi technical and non-technical member associated with the operation of the fishing vessels ; (c) "flag state" in relation to a foreign v…

'3, Licences.{l) Evcry orvner of a foreign vessel or -,ry other peison dcscribed in section'4, who intends to use such vcssel 'for fishing within any maritime zone of India, shall makc an applicaiion in Form A to the Central Governrneut, This form sLall include the following information :-

(a) the namc and dcscription oI the vesscl, its cquipment and comPlemcnt;

(b) the flag state and home port of the vessel :

(c) the name and addrcss of the owner .rrtrd Dlaster of' the vessel and, where applicable, its charactp;r3

(d) thc sidc number of tlre vessel, the radio frequencice and iall sigs;

(e) a description of thc proposed purpose and the period for which tha licencc is requircd; (0 thc name and address of a persos resident in India having a pematrcnt offi.ce or csirblishmcnt in India reprcscnt him for the purposc of providing liaison with the Government of India ; and

(g) any information required by the Central Government oi by an officcr desigaated by it to grant-a licencc in anv case whcre. in its opinion the information iurnisLed by the ipplicant ;cquires clarification or ampliflcation.

(2) Every application referred .to in sub'-rule (1) shall te mide not icss-tian thirty days prior to the first day on which thc liccnce is required ;

(3) Every such application shall be accomparrled-by- a fee of 'rtpces -five hunf,iecl which shall' not be-reftiudable'

(4) The Ccntral Govcrnment or al oflicer desigoated b-y it - mav. on receipt of an gpplication, after making such enquiry' as may be relevant, grant a licence il Form B fof ali or any of the following puq)oses, namely :-

(i) to engage in commercial fishing;

(ii) to tranship or to take on board any lish, outfit or supplics while at sea ;

(iii) to proccs$ fish at sea;

(iv) to traosport fish froo flshing grounds; - (v) to land fsh or fish products at an Indiatr po4;- ''

(vi) to purchase or obtain bait, outfits,. provisions or sup' pfies (including fuel) at an Indian port ;

4. Yalidity of Licence : (l) Erery liceuce shall,-

(a) be issued in origisal duplicates; and authenticated copies shall be distributed to enforcement and othcr coucerned authorities ;

For this pulpose, the Internationrl Code of Signals sball be used;

(ii) display in a place that is clcarly visiblc both from thc air and from sea level tbc letters and numbers idintifying the vessel as Set out in its licence, in white markings of at least one metre in hcight in the casc of a vessel whose ovcrall lco'gth exceeds twenty metres or one-half. metrc in height in any otber case, on a black background,' and wherc the markings are painted, the paint work shall be maintained in good condition so that'the markings are clearly legible at all times ;

(w) wherc th.e vessel is. in the maritime zonc of India, the master of the vessel or a p€rson acting on behalf of the master shal.l notify the Central . Government of the estimated time of departure from . those waters not less than seventy two bours prior to that estimated time ;

(x) the licensee shall, whep required to do so, maka arrangements for training of Indian crcw and personnel on board the vessels;

(2) thc licensee shall be bound all or any of thc tcrms and conditions mentioned in strb rule (l) and such addtional conditions ot' restrictions as may be specified in the licenee.

6. Permits : (1) Every Indian citizen and person dercribed in section 5. wbo intends to use any foreign vcssel for fishing within anv maritime zcne of India shall make hn application to the Central Government for a permit.

(2) Every application refcned to iu sub-rule (1) shall bo in Form H and shall made not less than thirty days prior to the first day. on which tbe permit is required.

(3) Every such application shall be accompained bv fl fee of l'upees five hundred which shall not be refundable.

(4) The Central Government or an officer designated by it may on receipt of an application after making such enquiry as may be relevant, grant a oermit in Form I for all or any of the purposes mentioned in sub-rule (4) of rule 3 of these nrles.

7. Validity of permit-(l) Every permit shall,

8. Terms and conditions of permit : (1) Every pcrmit shall bc subject to the following terms and conditions, namely :-

(a) thc permit holder (hereioafter referrod to as the charterer iu this rule) shall pay tci the Ccntral Govcrnment an amount of Rnpees ten thousand per vessel per year at the time of takine-dclivcry of tho' pcrmit i

(b) the charterer shall have the requisitc manageriat'per-. sonnel who possess the necessary eiperience of ,fishing; .(c) the charterer shall give ao undertaking, in the form of bank guarantee, before the. commencement of tJre charter; of an amerunt to be decided by the Central Goverflment in each case to the 'Cential Government that he shall purchase required numher of vessels and put them in fishing operation in the Exclusive Economic Zone of lndia before the cnd of the stipulated period sDecified in the Schedule II.

(d) the gbarterer shall eDsure that at least twenty per cent of thc crcw are Indian citizens and . are posted as under studies to the foreign skipper, the engineer and to tle othel opcrational creu' and that they shall bc kept iir readjness to' embark on lhe chortered vessel at th€ time of inspectiol of the vessel by the authorised officer ad shrll remain on board the vcssel throughout the charter period. '(e) the charterer shall ensure that the charler party provides for the settlement of disputes beiwein 'the parties by arbitration in India. (0 the Central Government may post scientist/observer oD board each of the chartered vessel; the charterer sball ensure that the Indian scientists and observers, when so directed by the Central Govelament are permitted on bosrd the chartered vessel for collection and examinatitn of such data and material as may be lequired by that Government and shall see that such scientists and crbservers are provided proper food aod accommodation on board the vessel by the master of the vessel;

(g) the charterer shall furnish to the Central Governrfieht': valuation and sea worthiness cirtificates for the chartered vessel from an appropriate authoritv of'its flag state aDd also furnish a copy thereof to the Director Gcneral of Shippinrz, Fombay;

(b) the charterer shall cause to be furnish to the Central Government the necessary certificates to the effect that the chartered vessel meets with the requirements in respect of safetv of yessels and crerv as per the provisions of the Merchant Shipping Act, 1958 (44 of 1958);

(i) The chartetcr shall ensure that,-

(i) no fishing is done for the protected species which are covered under the Wild Life (Protection) Act. 1972 (53 of 1972\:

(ii) such protected species, if caught are immediately returned to water alive. if possible. and if not they shall be retained and preserved on board the vessel and accounted for in Form C and shall be surrendered at such place as may be directed bl the authorised officer ; 6) the charterer shall not unclertaken shrimping operations for exploitation of coastal shrimps ;
