Section 85: Recovery of sums due.

(1) All dues recoverable under this Act or rules framed there under except those referred to the tribunal for adjudication under clause (4) of Section 65 shall be reduced to the form of a Co-operative Demand Certificate, as in Schedule appended to this Act over the signature of the Registrar or of such Gazetted officer as may have powers delegated to them by the Registrar in this behalf and shall be recovered as an arrear of land revenue and shall be paid to the certificate holder or his authorized nominee. Such certificate shall be in the name of the claimant and shall be delivered to him.

Notwithstanding anything contained in sub-section (1), all the said dues shall also be recoverable as a public demand in accordance with the procedure laid down in- the Public Demand Recovery Act on a written requisition sent to the certificate officer in the prescribed form over the signature of the Registrar or such Gazetted officer as may have powers delegated to him by the Registrar in this behalf.

Explanation- The Certificate Officer means the officer so defined in, and the prescribed form means the form so prescribed under the Public Demands Recovery Act.

(3)In case of the recoverable loans, dues referred to the tribunal, recovery of the same will be made on the basis of the order passed by the tribunal and in the manner and the procedure as laid downin section 64.
