[(1) In the performance of its function under this Act the Council shall be under the control and Jurisdiction of the Medical Council of India. (2) If at any time it shall appear to the Medical Council of India that the Council has neglected, exceeded or abused the exercise of its power or the performance of any duty impose upon it by this Act, the Medical Council of India may communicate the particulars of such neglect, excess or abuse to the Council and if the Council fails to remedy such neglect excess or abuse, within such times as may be fixed by the Medical Council of India in this behalf, the Medical Council of India may, for the purpose of remedying such neglect, excess or abuse cause the powers and duties of the Council to be exercised and performed by such agency and for such period as it may think fit.[
