(1) No court shall take cognizance of any offence punishable under this Act except on a complaint made-
(a) By the employee of an establishment either by himself or through the registered trade union or voluntary organisation within three months from the date on which the offence is alleged to have been committed; or
(b) By the Inspector within six months from the date on which the alleged office comes to his knowledge.
(2) No court inferior to that of judicial Magistrate of the first class shall try any offence punishable under this Act or any rules or ordered made there under.
