The Mizoram Salaries and Allowances of Leader of the opposition Amedment) Act, 1991.
Received the assent of the Governor of Mizoram on the 24.4.1991) THE MIZORAM SALARIES AND ALLOWANCES OF LEADER OF THE OPPOSITION (AMENDMENT) ACT, 1991.
AN ACT to provide for the salary and allowances of the Leader of the Opposition in the Mizoram Lagislative Assembly and for matters connected therewith.
Be it enacted by the Legislative Assembly of Mizoram in the Forty-Second Year of the Republic of India, as follows:-
1. (1) This Act may be called the Mizoram Salary and Allowances of Leader of Opposition Act, 1991.
(2) It shall be deemed to have come into force with effect from the First of April, 1991.
2. In this Act, unless the context otherwise requires, - on umber “Leader of the Opposition” means a Member of the Assembly who is for the Vol XX Aizawl, Monday 13.5.1991 Vaisakha 23. S.E. 1913 Issue No. 96 Short title and co mme ncement Definitions time being the Leader in the Assembly of the party in Opposition to the State Goverment having the greatest numerical strength in the Assembly and recognised by the Speaker as the Leader of the Opposition Party
(a) “Leader of the Opposition” means a member of the Assembly who is for the time being the Leader in the Assembly of the Party in the Opposition to the State Government having the greatest numerical strength in the Assembly and recognised by the Speaker as Leader of the Opposition Party.
(b) Words and expressions not defined herein and defined in the Salaries and Allowances of Minister Act, 1987 meaning respective as are as assigned to therein in that Act.
3. There shall be paid to the Leader of the Opposition such salary, sumptuary allowances, family allowances, conveyance allowances, travelling and daily allowances and shall also be entitled to such other amenities as are provided for a Minister under the Salaries and Allowances of Ministers Act, 1987 (Act No. 5 of 1987) and the the rules made therunder.
For the purpose of this Section, a “Minister’ means a member of the Cabinet in the Council of Minister.
4. No person in receipt of a salary or allowances under this Act shall be entitled to receive any sum out of the funds provided by the Assembly by way of salary or allowanced in respect of his membership of the Assembly.
5. The date on which any person becam, or ceased to be a Leader of the Opposition shall be published in the Official Gazette of Mizoram and any such notification shall be conclusive evidence of the fact that he become or ceased to be, a Leader of the Opposition on that date for all the purposes of this Act.
6. For the avoidance of doubt it is hereby declared that a person shall not be disqualified for being chosen as, or for being a member of the Assembly merely by reason of the fact that he holds the office of the leader of the Opposition.
7. The Mizoram Salaries and Allowances of Leader of Opposition Act, 1991 (Act No. I of 1991) is hereby repealed.
